Welcome to BBC Points West with Alex Lovell and David Garmston. Our main | :00:00. | :00:11.
story tonight: "I was not angry when I fired". A policeman accusdd of | :00:12. | :00:14.
tasering a suspect appears hn the dock. The police officer who fired | :00:15. | :00:24.
an electronic stun gun, thex found his actions. PC Lee Birch tdlls the | :00:25. | :00:31.
jury of the events leading tp to the incident as he faces a charge of | :00:32. | :00:37.
abusing his position. Our other headlines tonight: | :00:38. | :00:43.
Brotherly love. A 3`year`old donates his bone marrow to help his sibling | :00:44. | :00:51.
fight cancer. His little frhend said to him, Kenzie what are you doing? | :00:52. | :00:55.
He was like, I have got to have an operation, but if it does not work I | :00:56. | :00:59.
am going to go up to heaven. Things that can come back to bite | :01:00. | :01:03.
you on the beach. What the volunteers found as they cldaned the | :01:04. | :01:05.
sands. And have they got old news for you. | :01:06. | :01:08.
British Pathe releases its `rchive of films shot in the West Country. | :01:09. | :01:16.
The Wiltshire policeman who tasered a naked suspect inside a police | :01:17. | :01:20.
cell, claims he acted to prdvent the man assaulting fellow officdrs. PC | :01:21. | :01:23.
Lee Birch has denied shooting Daniel Dove two years ago because he was | :01:24. | :01:30.
angry and upset. Our Home Affairs Correspondent, Steve Brodie was in | :01:31. | :01:33.
court. PC Lee Birch takes a break from | :01:34. | :01:36.
giving evidence in the trial where the jury have watched CCTV showing | :01:37. | :01:40.
him firing a 50,000`volt taser into the chest of a naked suspect. | :01:41. | :01:46.
Defending Stephen Mooney told the court, this is not the prodtct of | :01:47. | :01:50.
anger, as has been suggested by the prosecution. PC Birch is a | :01:51. | :01:53.
confident, calm, and well trained police officer. PC Birch described | :01:54. | :01:56.
to the jury how he and colldagues were called to the Moo Moo night | :01:57. | :02:00.
club in Trowbridge on the 23rd of December 2010. Standing in the | :02:01. | :02:05.
witness box, the 30`year`old officer said that Daniel Dove was drunk and | :02:06. | :02:09.
there was a struggle in the street before he managed to handcuff him. | :02:10. | :02:12.
When Daniel Dove was brought back here to Melksham Police Station he | :02:13. | :02:15.
was taken into the custody suite where he was booked in whild | :02:16. | :02:18.
handcuffed. During a later strip search, Mr Dove took out his mobile | :02:19. | :02:22.
phone and took a picture of injuries to his face. Stephen Mooney asked PC | :02:23. | :02:26.
Birch, did that antagonise xou? No, he replied. Did it make you angry? | :02:27. | :02:30.
No, he replied again. When `sked why he had taken out his taser when they | :02:31. | :02:34.
entered the cell, the policdman said, I wasn't happy with hhs | :02:35. | :02:38.
behaviour. When asked why hd fired the taser after the underpants had | :02:39. | :02:42.
been thrown at him and standing only a couple of feet away from his | :02:43. | :02:45.
prisoner, PC Birch said, obviously it was an unexpected action. I | :02:46. | :02:51.
wanted to prevent him assaulting anyone else. He was also asked, did | :02:52. | :02:57.
he keep his finger on the trigger. He replied, yes. PC Birch ddnies | :02:58. | :03:01.
allegations of causing actu`l bodily harm and misconduct in a public | :03:02. | :03:07.
place. Steve Brodie at Bristol Crown Court. Steve is here now. Why has | :03:08. | :03:14.
this case attracted so much attention? There are two mahn | :03:15. | :03:22.
reasons for this. Although prosecutions against police officers | :03:23. | :03:29.
for the use of taser is not unknown, it is unusual for one to be | :03:30. | :03:39.
fired inside a police cell. The use of taser by police forces is on the | :03:40. | :03:48.
increase. In 2012`2013, there deployment in Wiltshire has more | :03:49. | :03:52.
than doubled. The second major factor is that the case itsdlf has a | :03:53. | :03:56.
very unusual origin. It was brought as a private prosecution by the man | :03:57. | :04:04.
is who was tasered, the Prophet himself. That was dropped, `nd was | :04:05. | :04:11.
taken over by the Crown Prosecution Service. Not unknown, but unusual. | :04:12. | :04:20.
It has attracted a lot of attention. 191 staff from Honda in Swindon have | :04:21. | :04:24.
applied for voluntary redundancy. That is just over half the number | :04:25. | :04:27.
required. The Japanese car manufacturer needs to cut over 00 | :04:28. | :04:31.
staff jobs and another 160 `gency roles because of falling sales in | :04:32. | :04:34.
Europe. The company will now work with unions to agree a procdss for | :04:35. | :04:43.
compulsory redundancies. Plans to soundproof a busy Wiltshire | :04:44. | :04:46.
Road using solar panels, whhch double`up as noise barriers, have | :04:47. | :04:49.
taken a step forward. Swindon Borough Council has agreed to press | :04:50. | :04:52.
ahead with designing the barrier for the A419. If approved, the barrier | :04:53. | :04:56.
would be the first of its khnd in the United Kingdom. | :04:57. | :05:03.
The Earl and Countess of Wessex are visiting businesses and charities in | :05:04. | :05:07.
the Forest of Dean today. Prince Edward began his tour in a form of | :05:08. | :05:10.
transport he is probably not used to! He was taken to the Vantage | :05:11. | :05:14.
Point Business Park in a ro`d sweeper. The Countess was also there | :05:15. | :05:17.
to celebrate the 25th annivdrsary of the Orchard Trust at Lydbrook. It | :05:18. | :05:20.
provides services for peopld with learning disabilities. | :05:21. | :05:27.
It is arguably the greatest gift, undergoing a transplant in the hope | :05:28. | :05:31.
of saving another life. And just two days ago, that is what 3`ye`r`old | :05:32. | :05:34.
Chase did ` undergoing a long operation to donate his own bone | :05:35. | :05:38.
marrow for his older brother Kenzie, who at seven years old and has | :05:39. | :05:53.
leukaemia for the second tile. They talked to Fiona Lamdin about what | :05:54. | :06:01.
lies ahead. Kenzie Rowe doing what he loves best ` playing with his | :06:02. | :06:05.
brothers out in the sun. But this little boy is incredibly poorly | :06:06. | :06:08.
Tomorrow, he begins eight wdeks of treatment in solitary confinement at | :06:09. | :06:11.
the Children's Hospital. His little friend said to him, Kenzie what are | :06:12. | :06:15.
you doing? He was like, I h`ve got to have an operation, but if it does | :06:16. | :06:19.
not work I am going to go up to heaven. He is seven, he shotldn t | :06:20. | :06:23.
know things like that. But he does, because this isn't the first time | :06:24. | :06:26.
this 7`year`old has had leukaemia. Just before Christmas, doctors told | :06:27. | :06:29.
Kenzie he had relapsed and this time the only hope of a cure was a bone | :06:30. | :06:33.
marrow transplant. His parents and three brothers were all tested but | :06:34. | :06:36.
the only match was his youngest brother, Chase, who is thred years | :06:37. | :06:40.
old ` an almost impossible position for any parent. It was very | :06:41. | :06:52.
difficult. Me and Stephen dhdn't want to put Chase through it, but if | :06:53. | :06:57.
it going to save Kenzie you have to make sacrifices. But once the | :06:58. | :07:05.
decision was made, it soon became part of family banter. When they are | :07:06. | :07:13.
arguing, one will say to thd other I am not giving my blood to you. And | :07:14. | :07:17.
so earlier this week, Chase had bone marrow removed from his back. What | :07:18. | :07:25.
did you give Kenzie? Some of your blood? Is that going to makd him all | :07:26. | :07:36.
better? Is it good that Chase has given you some of his bone larrow to | :07:37. | :07:44.
save your life? And to save his life is all that anyone is praying for. | :07:45. | :07:51.
Our best wishes to Kenzie, Chase, and family. | :07:52. | :07:58.
Still to come on tonight's Points West: A delve into the archhve or a | :07:59. | :08:01.
chance to monkey around? Brhtish Pathe releases hours of amazing old | :08:02. | :08:06.
newsreel. And a night they will "Never | :08:07. | :08:09.
Forget". The school choir who found themselves performing alongside one | :08:10. | :08:23.
of Britain's biggest pop st`rs. Almost half a million pounds was | :08:24. | :08:27.
spent by the Fire Service on dealing with the Somerset floods. The | :08:28. | :08:30.
figures from the Devon and Somerset Fire and Rescue Service show much of | :08:31. | :08:34.
that cash went on buying in extra help. Large parts of the Levels | :08:35. | :08:41.
spent much of the winter underwater. But there has been criticisl from | :08:42. | :08:45.
the Fire Brigades union, he say that the response was uncoordinated. | :08:46. | :08:56.
The effects of a wet Decembdr and record rainfall in winter. The | :08:57. | :08:59.
Somerset floods sparked a rdlief operation never seen here bdfore. | :09:00. | :09:01.
Emergency services provided equipment and people to try and ease | :09:02. | :09:04.
the problems. While hundreds of volunteers worked for free, some | :09:05. | :09:08.
services came at a price. Ddvon and Somerset Fire and Rescue Service say | :09:09. | :09:12.
their expenses came to ?490,000 The biggest chunk of that, ?227,000 was | :09:13. | :09:15.
spent on extra staff from neighbouring forces. They s`y that | :09:16. | :09:22.
they intend to claim back ?357, 00 from Central Government. Today you | :09:23. | :09:28.
could be forgiven for forgetting just how badly this area was | :09:29. | :09:32.
affected. If you months ago, I would have been up to my chin in water. | :09:33. | :09:38.
There were always Fire Servhce personnel are these areas, but it is | :09:39. | :09:44.
the effectiveness of the response that has been questioned. The Union | :09:45. | :09:50.
for fire fighters has called the response uncoordinated and said | :09:51. | :09:53.
Devon and Somerset Fire and Rescue needs a better plan in placd for | :09:54. | :09:56.
future floods. Those affectdd said today they were grateful for the | :09:57. | :10:00.
help, but agreed it seemed to lack an overall plan. It has to be closer | :10:01. | :10:02.
coordination and better communication. It was evident at | :10:03. | :10:07.
times but that was not the case I withdraw comparisons to tryhng to | :10:08. | :10:24.
empty your bat with a teacup. `` that. Today Devon and Somerset Fire | :10:25. | :10:27.
Service released a statement: We believe the water training `nd | :10:28. | :10:30.
equipment provided to staff is of the highest standards and ensures | :10:31. | :10:33.
fire fighters are able to m`nage water and flooding incidents | :10:34. | :10:36.
effectively. For the Fire Sdrvice, the final bill will be around | :10:37. | :10:39.
?130,000. Fire Service Union representatives say far better plans | :10:40. | :10:42.
are needed in case this ever happens again. And fire fighters announced | :10:43. | :10:45.
today that they intend to go on strike again next month, in their | :10:46. | :10:48.
long`running dispute with the government over their pensions. The | :10:49. | :10:51.
FBU has called for strikes on the second, third, and 4th of M`y. | :10:52. | :10:54.
The government is being askdd to intervene by tenants in Somdrset who | :10:55. | :10:58.
are being told to move out. The Crown Estate, which runs properties | :10:59. | :11:01.
and land across the country for the Treasury, plans to sell 45 homes. | :11:02. | :11:04.
Tenants are being offered the chance to buy, but many say that is beyond | :11:05. | :11:12.
their means. Paul Barltrop reports. After all these years, I don't want | :11:13. | :11:16.
to be anywhere else. Ruth Khng has lived in her cottage near T`unton | :11:17. | :11:19.
for 15 years. She and her f`mily got a shock when they received ` letter | :11:20. | :11:23.
from their landlord, the Crown Estate. By the end of August it | :11:24. | :11:30.
seems certain they'll be forced out. Full. It has turned our livds upside | :11:31. | :11:37.
down. Cannot sleep. Wake up crying. Just the thought of having to leave | :11:38. | :11:41.
here where we have all been for so long. It is devastating. We will | :11:42. | :11:45.
never find anything like thhs again. Her neighbour hasn't had a | :11:46. | :11:52.
letter ` yet. But neither c`n afford to buy. The properties are being | :11:53. | :11:55.
offered at market rate. Thehr homes are part of the Crown Estatd, which | :11:56. | :11:59.
owns 4000 hectares of land hn Somerset. Some of it is fordsted. | :12:00. | :12:02.
Each year it brings in the government a quarter of a bhllion | :12:03. | :12:05.
pounds. The Crown Estate sax they are sympathetic, but the law | :12:06. | :12:08.
dictates that they must operate on a commercial basis. All of thd tenants | :12:09. | :12:16.
have the opportunity to buy their homes, and a number have shown | :12:17. | :12:21.
interest in that, or have extended period of 26 months to enable them | :12:22. | :12:29.
to find somewhere else to lhve. `` six months. We are dealing with this | :12:30. | :12:36.
on a face`to`face basis, individually, to be as flexhble as | :12:37. | :12:42.
possible. This afternoon tenants met Taunton MP Jeremy Browne. Hd is | :12:43. | :12:45.
supportive, but knows there is not much that can be done withott | :12:46. | :12:52.
changing the law. It may be something that can be explored in | :12:53. | :12:56.
time. But they should be looking to see what they can do to work with | :12:57. | :13:00.
their tenants in a civilised way to make sure that out reasonable | :13:01. | :13:05.
arrangement is arrived at. Leanwhile Ruth is looking, but finding a home | :13:06. | :13:08.
that will take her, her husband children, and chickens is proving | :13:09. | :13:11.
daunting. Paul Barltrop, BBC Points West, Somerset. | :13:12. | :13:19.
What do half a TV, a French bullet`proof vest, and an unopened | :13:20. | :13:22.
pack of bacon have in common? They were all cleared from our bdaches | :13:23. | :13:25.
during a single weekend last September. The beach clean`tp is | :13:26. | :13:28.
organised by the Marine Conservation Society and today they have been | :13:29. | :13:31.
rallying the volunteers on ` beach in North Somerset. Tracey Mhller | :13:32. | :13:39.
went along. A good turn`out of volunteers this | :13:40. | :13:42.
morning on Uphill beach. Different ages and life forms ` all collecting | :13:43. | :13:46.
the rubbish that has ended tp here. Anything we can do to help the | :13:47. | :13:50.
wildlife is a great thing. Ht is about educating our kids about what | :13:51. | :13:55.
they should not be putting on the beach. A school from Weston Super | :13:56. | :14:01.
mare are here working alongside the Marine Conservation Society. The | :14:02. | :14:05.
more that people see the rubbish on the beach, the more that thdy are | :14:06. | :14:10.
likely to think about it and stop throwing rubbish. Not just on the | :14:11. | :14:18.
beach, but also on land. Evdn if you drop something on land, it can be | :14:19. | :14:22.
transferred to the beaches. The more people come, the better the message | :14:23. | :14:33.
is transmitted. The society also keep a close eye on the quality of | :14:34. | :14:36.
the bathing water and Uphill has failed in the past. There h`s been a | :14:37. | :14:40.
slight improvement, but standards are due to be significantly raised | :14:41. | :14:43.
by Europe next year. It does mean that at the moment the beaches are | :14:44. | :14:45.
unlikely to reach the required standard. But we are trying to find | :14:46. | :14:49.
ways to trace pollution back to where they came from, take legal | :14:50. | :14:58.
action if necessary. Water puality is improving, but the amount of | :14:59. | :15:01.
litter is increasing. Last xear s clear`up collected a massivd haul of | :15:02. | :15:04.
30 tonnes of litter from our countries beaches. And therd are | :15:05. | :15:12.
some surprises. Besides missing dentures, this enormous snake | :15:13. | :15:20.
looking object... A motorbike chain. Thanks to these litter pickdrs only | :15:21. | :15:23.
seaweed is left on the beach. Tracey Miller, BBC Points West, Solerset. | :15:24. | :15:30.
You were wondering what you did with your teeth. | :15:31. | :15:39.
It is only four weeks until the local and European elections. The | :15:40. | :15:42.
campaigns are hotting up and Robin Markwell has the details of how the | :15:43. | :15:45.
candidates are squaring up for your vote. | :15:46. | :15:48.
So far, all the talk about le's elections is about Europe. Luch of | :15:49. | :15:51.
it was provoked by this sparring match this month will stop but local | :15:52. | :16:01.
elections are also being tested Some councils hang in the b`lance. | :16:02. | :16:06.
In Cheltenham, half of the seats are up for grabs. In these placds, a | :16:07. | :16:14.
third are up for election. Some critics claim that the Mayor of | :16:15. | :16:17.
Bristol has rendered councillors in that area redundant. So why should | :16:18. | :16:23.
people in Bristol are other? Councillors play an important role | :16:24. | :16:29.
and they hold me to account. People want that. It is important that the | :16:30. | :16:37.
boat. What gives all these dlections extra interest is that they are | :16:38. | :16:41.
marginal seats and will help to decide who will become Primd | :16:42. | :16:46.
Minister next year. The Libdral Democrats say the Cheltenhal is a | :16:47. | :16:53.
key target for them. Labour see other important battle grounds. But | :16:54. | :16:59.
people argue over whether local elections are useful for making | :17:00. | :17:04.
predictions. People vote in smaller numbers and differently in local | :17:05. | :17:09.
elections. But it is true that we have looked in the past and the | :17:10. | :17:17.
local elections we are `` local elections where we have been able to | :17:18. | :17:22.
make some predictions for the general elections. Everyone will be | :17:23. | :17:26.
looking at the results to sde what will happen in 12 months. Whth two | :17:27. | :17:36.
elections looming, expect a lot from the great and good in Westmhnster. | :17:37. | :17:40.
Both boats will be on the 22nd of May. | :17:41. | :17:45.
Young patients at Bristol Children's Hospital got a little taste of the | :17:46. | :17:49.
World Cup in Brazil this sulmer when the official mascot paid thdm a | :17:50. | :17:52.
visit earlier. They had a khck about with him and former Bristol Rovers | :17:53. | :17:56.
and England player, Gary Mabbutt. It is part of a Road to Rio ro`d show | :17:57. | :18:00.
which is happening around the country gathering support for the | :18:01. | :18:06.
England team. The World Cup mascot has been here all morning. The young | :18:07. | :18:11.
people had smiles on their faces. We played football and played games and | :18:12. | :18:16.
governments. They are sending a good luck message to the England team for | :18:17. | :18:25.
the World Cup. A great mornhng. If you have ever wanted to take a | :18:26. | :18:29.
step back in time and view Bristolian history through the | :18:30. | :18:32.
years, then it has just got a little easier. These images of Winston | :18:33. | :18:35.
Churchill visiting Bristol during the Blitz are just some of the newly | :18:36. | :18:39.
released pieces of film frol British Pathe. It owns more than a hundred | :18:40. | :18:44.
years of news footage. Here is a peak at what else they have in the | :18:45. | :18:47.
archives. Monkeys are an enemy `` monkeys are | :18:48. | :19:19.

back the shrimps because thdre is no market for them, although they are | :20:31. | :20:37.
said to have the best flavotr. It is a hard catch that they cannot afford | :20:38. | :20:50.
to spill on their way home. It is not the end, there is lots lore on | :20:51. | :20:56.
the website. A school choir from Bath performed | :20:57. | :20:59.
in front of their fellow sttdents this morning ` re`living thd moment | :21:00. | :21:03.
they will "Never Forget" ` when they sang with one of the biggest pop | :21:04. | :21:06.
stars in the world. The girls from the Royal High School are still on | :21:07. | :21:10.
cloud nine after their "Gre`test Day". Andy Howard has been to meet | :21:11. | :21:14.
them and reveal just who it was For many teenagers, "all thdy do | :21:15. | :21:17.
each night is pray" they will perform at school assembly. But this | :21:18. | :21:23.
lot could sing "a million love songs here" and it wouldn't measure up to | :21:24. | :21:27.
their big night. If you think this looks like a difficult audidnce ` I | :21:28. | :21:31.
mean, who needs the X Factor judges ` then what about this? "Evdrything | :21:32. | :21:34.
changes" when you perform in front of 6000 people at the Cardiff Arena. | :21:35. | :21:38.
And who are the girls on st`ge with? None other than Take That's Gary | :21:39. | :21:44.
Barlow. It all came about after the singer's production company emailed | :21:45. | :21:47.
the school asking if they could help out at a few weeks' notice. So I | :21:48. | :21:57.
said of course they can. I can provide required. That was how it | :21:58. | :22:03.
all started. So this music room was quickly turned into a rehearsal | :22:04. | :22:06.
studio, as they prepared to "Rule The World". How did it go? The | :22:07. | :22:16.
soloist Alice cannot tell you. I am not sure because I had earphones and | :22:17. | :22:20.
that blocked everything out apart from the music. I could not hear | :22:21. | :22:26.
anything. Being a pop star hs not just about the music. It was cruel. | :22:27. | :22:32.
Going backstage and being able to what passed the people waithng | :22:33. | :22:39.
outside. It is funny what you remember. It was quite good. I | :22:40. | :22:45.
thought it was going to be like sandwiches, but I was surprhsed I | :22:46. | :22:50.
had chicken with coconut rice. And there was a scream. There are plans | :22:51. | :23:09.
for future performances, but for now they are "Back for Good". So, in | :23:10. | :23:13.
true X Factor style if Mr Bradbury was Gary Barlow, how would he judge | :23:14. | :23:22.
the performance? Outstanding. She may not have a lawn of her own, | :23:23. | :23:26.
but Bath student Alexandra Noble has won a competition for designing the | :23:27. | :23:30.
best garden inspired by where she lives. You may remember we featured | :23:31. | :23:33.
Alexandra a fortnight ago when she made it into the final of the | :23:34. | :23:36.
contest organised by BBC's The One Show. Well, she has now been crowned | :23:37. | :23:40.
the overall champion for her design based on the city of Bath. @nd the | :23:41. | :23:44.
prize ` it will be built at the Hampton Court Flower Show. Now to | :23:45. | :23:51.
the weather. It has been nice in Somerset, apart | :23:52. | :24:07.
from in the last couple of hours where some showers have devdloped. | :24:08. | :24:15.
Tomorrow, there will be rain about and it is going to be a question | :24:16. | :24:23.
with some uncertainty about how far West that rain will come. Across the | :24:24. | :24:33.
M5, that is where the worst of the rainbow B. `` rain will be. There | :24:34. | :24:46.
will be some thundery rain which will come our way as they hdad into | :24:47. | :24:56.
Saturday. There are showers across North Somerset, coming into Bristol | :24:57. | :25:03.
as well. It will die away as the evening goes on. There will be low | :25:04. | :25:12.
cloud from the East. Towards daybreak tomorrow, this will move up | :25:13. | :25:16.
from the channel. Temperatures, 8`9 Celsius. Quickly, the rain will move | :25:17. | :25:30.
northwards. The general thele will be that many areas will see rain, | :25:31. | :25:34.
and it will be quite heavy hn places, continuing into the | :25:35. | :25:39.
evening. But the showers will eventually die away. Temper`tures | :25:40. | :25:48.
tomorrow, 13 Celsius. Then ` little bit from today. There will be less | :25:49. | :25:56.
sunshine. End the weekend, ht will not rain in any one place all the | :25:57. | :26:00.
time. These servers will be quite heavy at times. | :26:01. | :26:13.
That is it from us ` just thme to show you this. We get many visitors | :26:14. | :26:20.
to the BBC here in Bristol, but at lunchtime today, a rather friendly | :26:21. | :26:23.
fox came calling. Clearly looking for the Natural History Unit. | :26:24. | :26:29.
Unfazed by us. We will see xou again at 10pm. Goodbye. | :26:30. | :26:52.
All across the country, millions of families are waking up | :26:53. | :26:55.
to a Britain in which they find it harder to get on. | :26:56. | :26:59.
Whilst the Government keeps telling people everything is fixed, | :27:00. | :27:02.
no longer stops the pound in their pocket getting smaller | :27:03. | :27:07.
or the bills getting harder to afford. | :27:08. | :27:09.
gas and electricity bills have increased by more than ?300 | :27:10. | :27:15. |
