The West Country's most powerful policeman will be interviewed under

a criminal caution for allegedly leaking information.

It's said that Nick Gargan, who's the chief constable of Avon

and Somerset Police, breached the Data Protection Act by writing

emails to people outside the force disclosing personal information.

Mr Gargan is currently suspended after complaints against him

Our Home Affairs Correspondent Steve Brodie reports.

Since May, though, he hasn't been at work.

Suspended after allegations he'd abused his senior position

by making inappropriate advances to female members of staff.

That investigation is still continuing.

But today came the news he'll face other questions too.

The police watchdog, the IPCC, says it's uncovered evidence that the

Chief Constable may have breached the Data Protection Act, by sending

emails concerning police business, some of which may have contained

personal details, to people outside the force. The

IPCC have told the Chief Constable he will now be interviewed under

In the course of these investigations,

the new evidence, the new information has to be identified,

it has to be assessed, considered, and a decision has to be made.

Ultimately, we will find out from the IPCC

whether they think there is a case that has to go before a tribunal.

That's a matter that has to be determined by the authority,

in this case, which is the Police and Crime Commissioner.
