me almost a quarter of a century ago. Three men were wrongfully | :01:56. | :02:00. | |
convicted of her murder. One of the Cardiff Three, Yousuf Abdullahi, | :02:00. | :02:04. | |
has since died. But the surviving two still want to know why they | :02:04. | :02:08. | |
were convicted. The trial of the eight former South | :02:08. | :02:10. | |
Wales Police officers was the biggest of its kind in British | :02:10. | :02:14. | |
legal history. It collapsed last month when it was thought files of | :02:14. | :02:18. | |
evidence had been shredded. The judge at Swansea Crown Court ruled | :02:18. | :02:22. | |
that the former officers couldn't get a fair trial. They were all | :02:22. | :02:25. | |
cleared of perverting the course of justice in the original | :02:25. | :02:28. | |
investigation into the murder of Lynette White. But last night it | :02:28. | :02:31. | |
emerged that the files had been found at South Wales Police | :02:31. | :02:35. | |
Headquarters. Tony Paris is one of three men wrongfully convicted in | :02:35. | :02:40. | |
1990 of Lynette White's murder. The convictions of the so called | :02:40. | :02:48. | |
Cardiff Three were quashed in 1992. I would like to see a retrial so we | :02:48. | :02:55. | |

in this case, who gave the word that implicated me, and how they | :03:02. | :03:07. | |
got their evidence. Lynette White was 20-years-old when she was | :03:07. | :03:10. | |
murdered in 1988. She was stabbed more than 50 times in this flat in | :03:10. | :03:14. | |
Butetown, where she worked as a prostitute. The solicitor, Stuart | :03:14. | :03:16. | |
Hutton, represented the brothers, John and Ronnie Actie, who were | :03:16. | :03:21. | |
acquitted of her murder in 1990. He thinks the former police officers | :03:21. | :03:30. | |
should face a retrial. There is a lack of closure because the matter | :03:30. | :03:36. | |
has not been resolved in the quarter. It is quite incredible | :03:36. | :03:41. | |
that in these documents have now been found and, by virtue of having | :03:41. | :03:48. | |
been found, we can reasonably suppose that they existed at the | :03:48. | :03:52. | |
time that the prosecution said they had been destroyed. The cost of | :03:52. | :03:55. | |
this case from the time of Lynette White's murder in the late '80s | :03:55. | :04:04. | |
until now is thought to be around �30 million. It seems unbelievable | :04:04. | :04:08. | |
that papers were not dealt within a very detailed way and totally | :04:08. | :04:13. | |
properly, given the millions of pounds that have been spent on the | :04:13. | :04:17. | |
investigation and are that things could fall at the point when the | :04:17. | :04:22. | |
Crown Prosecution Service was bringing matters before the court. | :04:22. | :04:25. | |

in 2000. Advances in DNA led to the arrest of the security guard | :04:57. | :05:01. | |
Jeffrey Gafoor, one of her former clients. He was jailed for life in | :05:01. | :05:05. | |

today would like to see the former police officers retried, but many | :05:39. | :05:42. | |
doubt it'll be possible because of all the legal hurdles that would | :05:42. | :05:49. | |

leader of the Wales circuit. Good evening. What hurdles would have to | :06:00. | :06:06. | |
be overcome for a retrial to take place? First of all, you will have | :06:06. | :06:09. | |
to establish that this is an offense in respect of which the | :06:09. | :06:13. | |
double jeopardy rule has been abolished. It has not for this | :06:13. | :06:18. | |
offence. It was abolished for serious offences like murder, rape | :06:18. | :06:22. | |
and conspiracy to commit those offences, but not the conspiracy to | :06:22. | :06:26. | |
pervert the course of justice, and therefore the double jeopardy rule | :06:26. | :06:31. | |
still stands and you cannot retry them. If that interpretation is not | :06:31. | :06:36. | |
correct, you have got to show two things in particular. One, that | :06:36. | :06:40. | |
there is no evidence, and secondly that the new evidence is compelling | :06:40. | :06:44. | |
such as might lead a jury almost inevitably to the conclusion that | :06:44. | :06:48. | |
these defendants were guilty of this specific offence. This | :06:48. | :06:52. | |
evidence does not fall into that category because it was evidence | :06:52. | :06:56. | |
which favoured the defendants, rather than the prosecution. | :06:56. | :07:02. | |
Therefore, that hurdle could not be crossed either. We heard it here | :07:02. | :07:08. | |
that many people feel that justice will have failed without a retrial. | :07:08. | :07:14. | |
Justice has not failed. The prosecution said that there existed | :07:14. | :07:19. | |
evidence which might favour the defendants. The defence said they | :07:19. | :07:24. | |
wanted it, the prosecution said, we understand it is no longer | :07:24. | :07:28. | |
available and the judge had to decide whether that was an obstacle | :07:28. | :07:33. | |
to a fair trial for the defendants. The judge kept his eye on whether | :07:33. | :07:36. | |
the trip -- trial would be fairer not and came to the conclusion it | :07:36. | :07:42. | |
would not. That is justice. How is it that files of evidence can go | :07:42. | :07:48. | |
missing and then appear again? Was it that the evidence was not locked | :07:48. | :07:54. | |
properly? What do you suspect may have happened? This was a case in | :07:54. | :07:59. | |
which there were probably millions of pages of documents, bearing in | :07:59. | :08:04. | |
mind the age of the original case and the age of the present case. I | :08:04. | :08:11. | |
am not at all surprised that something went wrong with the | :08:11. | :08:16. | |
disclosure provisions in this particular case, having regard to | :08:16. | :08:22. | |
the volume of documents which had to be managed. I have a personal | :08:22. | :08:26. | |
professional experience of managed large cases and finding there were | :08:26. | :08:30. | |
documents which have not been disclosed to the defence, not | :08:30. | :08:38. | |
through any abuse of process by anybody but simply human error. | :08:38. | :08:42. | |
