men were stabbed in a bar just up the coast in Cabo Roig. Later that | :01:20. | :01:23. | |
same day, they were arrested as they were due to fly home from | :01:23. | :01:28. | |
Alicante airport. On July 8th, the pair were committed to jail and | :01:28. | :01:33. | |
they remained in prison until they were freed two weeks ago. Our | :01:33. | :01:41. | |
reporter Gareth George has been to meet them. | :01:41. | :01:48. | |
Spain, but loved by British tourist, but James Harris and Kyle Thain are | :01:48. | :01:52. | |
desperate to leave it. This is not paradise for ours. We are looking | :01:52. | :01:57. | |
forward to going back to Southend and the rest of our lives. We can't | :01:57. | :02:04. | |
go home, we are stuck in Spain. They came here in July for a long | :02:04. | :02:10. | |
weekend and had a night out on the strip here. The same night, there | :02:10. | :02:16. | |
was a stabbing here at a bar on the same strip. Witnesses said it was | :02:16. | :02:21. | |
two men from London, one tall, one short. The next day, the two | :02:21. | :02:27. | |
friends were arrested. Kyle Thain and James Harris say it is a case | :02:27. | :02:31. | |
of mistaken identity. They were arrested because they happened to | :02:31. | :02:35. | |
be two Englishmen who were also out on the strip that night. One was | :02:35. | :02:40. | |
tall and one was a short. They say they were in a completely different | :02:40. | :02:45. | |
Bale and photos they took that night prove it. We have been put on | :02:45. | :02:48. | |

evidence and witness statements were considered by it a judge | :03:16. | :03:20. | |
sufficient to halt the accused in prison. One of the meant he was | :03:20. | :03:26. | |

charge. Walking into prison was the most brightening expense of my life. | :03:31. | :03:36. | |
People were shouting at you, trying to intimidate you. Keeping your | :03:36. | :03:40. | |
spirits up was harder. The post really did help. They got thousands | :03:40. | :03:45. | |
of letters from supporters back home. I hope you keep your chins up, | :03:45. | :03:50. | |
you may soon be home. You are both innocent, I'm sure of that. They | :03:50. | :03:54. | |
are relieved they have been released from prison, but life on | :03:54. | :03:59. | |
bail is a monotonous one. Every day is the same, wake up in the morning | :03:59. | :04:03. | |
and trying keep active, keep up the bit of Spanish we have learnt and | :04:03. | :04:07. | |
keep our heads down until they say we can go. They are given the | :04:07. | :04:12. | |
seriousness of the allegations they face, that could be some time yet. | :04:12. | :04:15. | |
Sharon Harris is the mother of Kyle Thain. She is at her house in | :04:15. | :04:23. | |
Southend now. I know this is costing a lot of money, and you | :04:23. | :04:29. | |
have gone as far as selling your home to fund their legal costs. | :04:29. | :04:33. | |
we have sold the house now. We have to move in January, but we were | :04:34. | :04:41. | |
putting a lot of money on cards for flights over there. Obviously, we | :04:41. | :04:47. | |
need to get rid of those debts. We don't know what future cost there | :04:47. | :04:51. | |
will be with the lawyer, but we need to be ready for it. Clearly it | :04:51. | :04:56. | |
is a different justice system in Spain, but the judge obviously felt | :04:56. | :05:02. | |
there was enough evidence to hold them. Are you confident that when | :05:02. | :05:07. | |
the trial does eventually happen, they will be clear that? They will | :05:07. | :05:11. | |
be cleared. There are things that we know that we cannot talk about | :05:11. | :05:15. | |
here am afraid because it is evidence. We would love to be able | :05:15. | :05:21. | |

years? We thought they would be in prison for that time, but | :05:58. | :06:04. | |
thankfully they are not. Kyle has a job, for example. What happens | :06:04. | :06:12. | |
next? The loyal will put in for them to be bailed to England. Bail | :06:12. | :06:16. | |
is a funny word because they have not been charged, but nevertheless | :06:16. | :06:21. | |
they may be able to sign on at the Spanish embassy and at least this | :06:21. | :06:24. | |
way they could get on with their work. Kyle has a mortgage and a | :06:25. | :06:29. | |
flat and he has been taken away from that. The cost of crewing. We | :06:29. | :06:33. | |
don't want him to lose his property because it is hard enough to get on | :06:33. | :06:39. | |
