promised reforms to the way 17`year`olds are treated in custody. | :01:03. | :01:06. | |
Currently they're treated as adults, even though the High Court last | :01:07. | :01:09. | |
year ruled that was illegal saying they should be classed as children. | :01:10. | :01:13. | |
Some changes were made, but not enough according to Kesia's | :01:14. | :01:15. | |

This is Kesia Leatherbarrow as her mum likes to remember her ` | :01:25. | :01:26. | |
But behind the smile the tednager was also extremely vulnerable. | :01:27. | :01:32. | |
She suffered from depression and had self harmed. | :01:33. | :01:35. | |
When she was arrested for possessing a small amount of cannabis last | :01:36. | :01:38. | |
November she was put into a police cell in Ashton unddr Lyne. | :01:39. | :01:43. | |
Had she been 16 she would h`ve been interviewed at the station, then | :01:44. | :01:46. | |
But as a 17`year`old she was held in the cells for three days | :01:47. | :01:52. | |
and two nights as she awaited a court appe`rance. | :01:53. | :01:59. | |
I don't think she would havd coped and that is why we have comd to the | :02:00. | :02:01. | |
She should have got help whhle she was in the police station. | :02:02. | :02:09. | |
Tameside Magistrates granted her bail but her parents say thdy | :02:10. | :02:15. | |
The following day Kesia was found hanged in a friend's garden. | :02:16. | :02:22. | |
But Kesia's story isn't unipue in Greater Manchester. | :02:23. | :02:26. | |
In 2011 17`year`old Eddie Thornber was found hanged after being caught | :02:27. | :02:30. | |
And the following year Joe Lawton shot himself | :02:31. | :02:36. | |
on the family farm after behng held overnight for drink driving. | :02:37. | :02:40. | |
Last October the High Court ruled it was illegal to treat under 08s | :02:41. | :02:43. | |
as adults on arrest ` a full two months before Kesia's death. | :02:44. | :02:47. | |
Some changes have been made ` parents are now informed | :02:48. | :02:51. | |
But wider reforms have yet to happen. | :02:52. | :02:58. | |
They did absolutely the bare minimum, | :02:59. | :03:00. | |
It is this sort of element of, well, when we are ready. | :03:01. | :03:07. | |
It is already going to be too late for three children. | :03:08. | :03:15. | |
The parents of those three children havd now | :03:16. | :03:17. | |
written to the Home Secretary urging her to speed up the reforms | :03:18. | :03:20. | |
Well the organisation Justice for Kids Law is supporting those | :03:21. | :03:30. | |
Their Director Shauneen Lambe joins us from London. | :03:31. | :03:39. | |
Thank you for joining us. The parents of Katarzyna Gacek `nd the | :03:40. | :03:46. | |
two other boys feel let down. What more do you think the government | :03:47. | :03:54. | |
should be doing? `` parents of Kesia. The government promised they | :03:55. | :04:00. | |
would review all the laws that treated these children as adults. | :04:01. | :04:08. | |
There seems to be a gap in the law between being arrested as a | :04:09. | :04:12. | |
16`year`old and being arrested as an 18`year`old where you are treated as | :04:13. | :04:17. | |
an adult. The problem is we signed ups to the UN Convention on the | :04:18. | :04:23. | |
rights of the child in 1990 and the law relating to children at police | :04:24. | :04:27. | |
stations dates back to 1984. The government needs to go back and | :04:28. | :04:33. | |
review all those legislations. It is one simple word that they nded to | :04:34. | :04:40. | |
change that says 17 to 18. What difference would it have made in | :04:41. | :04:45. | |
these three cases, had they been treated differently and not been | :04:46. | :04:50. | |
kept in police cells? All of the parents feel | :04:51. | :04:52. | |
been different if their children had been tooted as children. `` treated. | :04:53. | :05:07. | |
In Kesia's case, had she bedn moved to a protected environment with | :05:08. | :05:11. | |
social workers and care workers it could have ended up with a different | :05:12. | :05:17. | |
outcome. What can you do now to make sure these reforms that werd | :05:18. | :05:21. | |
promised initially to go through? We are supporting the family in their | :05:22. | :05:25. | |
letter to the Home Secretarx and will begin legal proceedings if we | :05:26. | :05:32. | |
can't get the law changed bdcause a court agrees that 17`year`olds | :05:33. | :05:35. | |
