judge was swayed by his demeanour on the stand. The judge was swayed by | :05:39. | :05:45. | |
the evidence procured by the defence, including amongst others, | :05:46. | :05:49. | |
the psychological impact that his childhood may have had on him, as | :05:50. | :05:54. | |
well as the experts that were brought in by the defence. When it | :05:55. | :05:59. | |
comes to murder, Oscar Pistorius has been given the benefit of the doubt, | :06:00. | :06:03. | |
many here consider he has had a lucky escape. As for the friends and | :06:04. | :06:08. | |
family of Reeva Steenkamp, they still need to know whether her | :06:09. | :06:10. | |
killer will spend any time in prison. Some of her friends have | :06:11. | :06:18. | |
already criticised the verdict. It is unfair but it does not surprise | :06:19. | :06:21. | |
me, it is pretty much what I expected from the outset. Because he | :06:22. | :06:26. | |
can afford the best possible defence. He can invest in private | :06:27. | :06:34. | |
investigator to support his case... Today, Oscar Pistorius left court a | :06:35. | :06:39. | |
freeman, for now. The judge agreed to extend his bail, and rejected the | :06:40. | :06:43. | |
state 's claim that he might flee the country. The athlete will be | :06:44. | :06:48. | |
back next month for sentencing. He could still get a prison term. He | :06:49. | :06:54. | |
could, this is a very serious case of culpable homicide, because of the | :06:55. | :06:59. | |
use of a firearm. Four shots were fired, in particular. The judge has | :07:00. | :07:03. | |
complete discretion, she can impose any kind of sentence, it could even | :07:04. | :07:07. | |
be a non`jail sentence. She needs to send out a strong message to the | :07:08. | :07:12. | |
public. Tonight, he is back at his uncle 's home. Some in South Africa | :07:13. | :07:17. | |
have forgiven him. Some have not. The possibility of a prison sentence | :07:18. | :07:19. | |
still hangs in the air. With me here outside of the court, a | :07:20. | :07:36. | |

the barrister in the 1980s, how have you viewed what she has been saying | :07:44. | :07:48. | |
in court? I think that she has given her judgement very well, she was the | :07:49. | :07:51. | |
second black female ever to be appointed in South Africa as a | :07:52. | :07:55. | |
permanent judge, she has been on the bench ever since, she has acquitted | :07:56. | :08:00. | |
herself very well. In regard to the way that she conducted the trial. | :08:01. | :08:04. | |
She conducted in the way that a judge should be, she was polite and | :08:05. | :08:09. | |
was not obtrusive. Dealing with the judgement, weighing up the evidence, | :08:10. | :08:13. | |
the way that she came to her findings, to a large extent, I think | :08:14. | :08:17. | |
she did a good job in that regard, especially with regard to | :08:18. | :08:20. | |
premeditated murder. She put aside a lot of the evidence and said, "I | :08:21. | :08:26. | |
need more reliable evidence," and premeditated murder has no | :08:27. | :08:32. | |
definition in South African law. It means a degree of planning. Even if | :08:33. | :08:37. | |
it is a sudden rage or an argument, it is not need to be an hour before, | :08:38. | :08:42. | |
a year before, if you pick up a gun and kill summary, it can be | :08:43. | :08:46. | |
premeditated. But the witnesses that the state called were not enough in | :08:47. | :08:50. | |
regard to liability, because of the distance. She then dealt with | :08:51. | :08:54. | |
summing up of the evidence and applied legal principles and then in | :08:55. | :08:58. | |
her own opinion, her legal findings, together with the two assessors, who | :08:59. | :09:02. | |

witness, a nearby neighbour who came to render assistance, a radiologist. | :09:39. | :09:43. | |
He tried to revive the late Reeva Steenkamp. She seemed to be in very | :09:44. | :09:50. | |
bad medical condition. He said, "I made a mistake, I thought it was an | :09:51. | :09:54. | |
intruder". He kept that in the bail application and the trial and the | :09:55. | :09:59. | |
judge believed him. He did not fabricate the evidence, it is | :10:00. | :10:02. | |
evidence that he gave, and the judge found it reasonably possibly true, | :10:03. | :10:05. | |
even though in many respects he was not a good witness. Summing up the | :10:06. | :10:10. | |
legal position, there is a lot of criticism that has been levelled. In | :10:11. | :10:15. | |
this case, you have the smoking gun and the shooter and the unfortunate | :10:16. | :10:19. | |
victim, Reeva Steenkamp. Everyone has said it is so obvious, fired | :10:20. | :10:23. | |
through a closed door, it has got to be murder. You have got to look at | :10:24. | :10:28. | |
the principals. Burden of proof, the onus. Once there is no intention, | :10:29. | :10:38. | |
then you cannot have in any way murder. You have got to look at the | :10:39. | :10:42. | |
competent medic, the objective test, which is different, subject to what | :10:43. | :10:47. | |
he believed and whether it was justified. That is how she came to | :10:48. | :10:51. | |
her conclusion. Before I ask you about sentencing, I would like to | :10:52. | :10:55. | |
speak with you. The overall impression of what you have seen in | :10:56. | :10:59. | |
court, over the last few months but particularly, the reasoning that we | :11:00. | :11:04. | |
have heard from the judge. I would like to focus specifically on the | :11:05. | :11:07. | |
nature of the crime, which was what we would see as gun violence. One of | :11:08. | :11:11. | |
the things throughout the trial, and over the last two days, an increased | :11:12. | :11:18. | |
awareness in the public around the danger of guns in the home. I think | :11:19. | :11:23. | |
the fact that Oscar Pistorius has got one conviction on one of the | :11:24. | :11:27. | |
firearms charges. The lesser firearms charges that we were | :11:28. | :11:31. | |
hearing about, which were also being heard. One of them is about | :11:32. | :11:34. | |
negligent discharge. One of the three. That will automatically | :11:35. | :11:39. | |
hopefully disqualifying him and have him declared unfit to be an owner of | :11:40. | :11:46. | |
a firearm. But we have been surprised at her acquitting him on | :11:47. | :11:50. | |
the illegal possession of ammunition. The act is very clear, | :11:51. | :11:54. | |
you do not have to have intent to possess. It goes further, there is a | :11:55. | :11:59. | |
presumption of possession. Take an example with his father, perhaps his | :12:00. | :12:04. | |
father had left the ammunition at his home and had not told him. That | :12:05. | :12:10. | |
is sufficient to see the owner of the property, where there is | :12:11. | :12:13. | |
ammunition for which you do not have a licence or do not have a licence | :12:14. | :12:18. | |
to deal, that is seen as a legal possession. That finding is really | :12:19. | :12:24. | |
very surprising and confusing in terms of our understanding of the | :12:25. | :12:28. | |
law. Very briefly, in terms of the wider case, do you feel this has | :12:29. | :12:34. | |
changed perception about gun crime in South Africa or heightened | :12:35. | :12:38. | |
awareness? Absolutely, over the last six months we have had a significant | :12:39. | :12:42. | |
increase, particularly from women, saying, "I live with my partner, I | :12:43. | :12:48. | |
know a neighbour, a woman living with a man who abuses alcohol... He | :12:49. | :12:52. | |
has a short temper... What must we do? This is important, because the | :12:53. | :12:58. | |
law is not just for the gun owner, the law is there to help prevent gun | :12:59. | :13:04. | |
violence. If we look at the case of Oscar Pistorius. Several incidents | :13:05. | :13:08. | |
where he demonstrated negligence. It would have taken one person one | :13:09. | :13:12. | |
individual to have gone to the police station and reported, not | :13:13. | :13:17. | |
levelled a charge, but deported. The police would have been required to | :13:18. | :13:23. | |
hold a section hearing, considering whether he was fit and proper to | :13:24. | :13:28. | |
continue possession of a gun. If that had been completed, then there | :13:29. | :13:31. | |
is a strong chance it would have been completed and found that he | :13:32. | :13:38. | |
should not own a gun and Reeva Steenkamp could well be alive. Found | :13:39. | :13:42. | |
guilty on only one of those three gun charges. But an important | :13:43. | :13:46. | |
charge, very significant charge, and it carries a five`year sentence. | :13:47. | :13:51. | |
Speaking of sentencing, we have a verdict but we do not know Oscar | :13:52. | :13:55. | |
Pistorius's fate beyond the 13th of October, we now know he is back at | :13:56. | :14:00. | |
his uncle's, on bail, a freeman effectively until the date. There is | :14:01. | :14:04. | |
a variety of sentence options available to the judge. The | :14:05. | :14:09. | |
sentences will not play any further role in South African law. It is up | :14:10. | :14:12. | |
to the discretion of the judge, she is the only one who will be imposing | :14:13. | :14:15. | |
a sentence. She will hear evidence from the defence, they will lead | :14:16. | :14:24. | |
evidence. The state will lead evidence in aggravation of sentence. | :14:25. | :14:26. | |
Then there will be legal arguments on both sides as to what kind of | :14:27. | :14:31. | |
sentence should be in post. I have no doubt that the state will be | :14:32. | :14:35. | |
asking for direct imprisonment. `` should be imposed. Very fortunate, | :14:36. | :14:40. | |
if this was a murder charge, if it was common law murder, the direct | :14:41. | :14:45. | |
intervention, premeditated would carry 25 years, life, in South | :14:46. | :14:49. | |

extended for another year, so that it is still in force. He is very | :15:31. | :15:34. | |
fortunate that he does not fall under minimum sentence. The judge | :15:35. | :15:38. | |
has a wide variety of options open. Direct imprisonment, had direct | :15:39. | :15:42. | |
imprisonment where a portion would be suspended. I anticipate that | :15:43. | :15:46. | |
could happen. Also, a fine, a suspended sentence, perhaps what | :15:47. | :15:52. | |
could be called community service. If you well`known sportsman, | :15:53. | :15:55. | |
unfortunately, have not had charges against them but they have gone into | :15:56. | :15:59. | |

insomniac. He used to go to the shooting range in the middle of the | :19:47. | :19:53. | |
night. He was volatile and aggressive. There was controversy on | :19:54. | :20:01. | |

suggested that his rival had cheated. He said there was something | :20:06. | :20:12. | |
wrong. After all that it was difficult to stand beside him. He | :20:13. | :20:17. | |
refused to talk to me. But the man who has become the new poster boy of | :20:18. | :20:22. | |
Paralympic sport told me that Pistorius was also capable of | :20:23. | :20:32. | |
generosity. He asked if she could pray for me. He made the first | :20:33. | :20:48. | |
breakthrough. At Pretoria University a new generation of Paralympic | :20:49. | :20:52. | |

case. He has got to go back to the people that need ten 80. He has got | :24:13. | :24:19. | |
to see that he is sorry and that he made a genuine mistake. He has got | :24:20. | :24:34. | |
to offer coaching lessons. He has got to try and get civil society to | :24:35. | :24:43. | |
back him again. At present we do not know if Oscar Pistorius is going to | :24:44. | :24:54. | |
jail. We are stealing there is a lot of anger from the family of Reeva | :24:55. | :25:08. | |
Steenkamp. Whatever happens, his family has said they will not take a | :25:09. | :25:11. | |
custodial sentence, they will appeal. It will be many years before | :25:12. | :25:23. | |
