Welcome to Reporting Scotland: it guilty of killing her toddler son.

:00:20.:00:26.

Kimberley Hainey now faces a life sentence. She kept the body and her

:00:26.:00:33.

flat for months. It was a horrific and tragic set of

:00:33.:00:36.

circumstances leading to the death. One of the most horrific of tragic

:00:36.:00:42.

I have ever worked on in my police service.

:00:42.:00:49.

Also: not fit for purpose. The verdict of a committee of MSPs on

:00:49.:00:54.

the UK government plans to increase the powers of Holyrood.

:00:54.:01:00.

The vital Highland roots closed by a landslide. Now there are calls

:01:00.:01:07.

for the A83 to be up graded. And hope for all in would in the

:01:08.:01:11.

1960s but now it wins award for being the most dismal place in

:01:11.:01:19.

Scotland. -- hope for Linwood. A mother has been found guilty of

:01:19.:01:23.

killing her toddler son and then pretending for months he was still

:01:23.:01:28.

alive. Kimberley Hainey accepted gifts and money for Declan Hainey

:01:28.:01:34.

who was about 15 months old when he was last seen alive. This report

:01:34.:01:41.

from the High Court in Glasgow. Kimberley Hainey. Convicted of the

:01:42.:01:49.

murder of her son, Declan Hainey, whose body lay in the rubbish-

:01:49.:01:58.

strewn flat for months. She showed no emotion in the dock. Two women

:01:58.:02:01.

who had been her friends were in the public gallery. They gave

:02:01.:02:05.

evidence on behalf of the prosecution and heard and cried

:02:05.:02:10.

when they heard the verdict. Then she was led away to begin a life

:02:10.:02:15.

sentence. She will learn on 12th January exactly how long the

:02:15.:02:19.

minimum period will be that she must serve.

:02:19.:02:24.

It was horrific and tragic. One of the most horrific and tragic cases

:02:24.:02:30.

I have ever worked on throughout my police service.

:02:30.:02:35.

Declan Hainey's is the latest case to draw attention to the welfare of

:02:35.:02:40.

children being raised by drug or alcohol misuse and parents. At

:02:40.:02:44.

first, Kimberley Hainey did not seem to fit the picture of a

:02:44.:02:50.

chaotic life. She earned a good wage here, at a Glasgow insurance

:02:50.:02:57.

firm. She bought her own flat in Paisley. But when her uncle, a

:02:57.:03:03.

father figure, died, she began drinking. She lost her job, flat,

:03:03.:03:08.

and then a friend introduced her to heroin. She was later admitted to

:03:08.:03:14.

take a hospital with mental health and drug problems. Here she met the

:03:14.:03:19.

father of Declan Hainey. They split after she became pregnant. He

:03:19.:03:25.

wanted nothing to do with the child. She moved to a flat here. She said

:03:25.:03:30.

that the birth of the child had changed her life. She was supported

:03:30.:03:35.

on a methadone programme. At the time the initiative was based in

:03:35.:03:40.

this building. Staff said they had no concerns about the child's

:03:40.:03:45.

development but a drugs worker once smelled drink on Kimberley Hainey's

:03:45.:03:51.

breath. This a visitor attempted to visit at least seven times from

:03:51.:03:59.

summer 2009. She had a staggering 320 cases to deal with. But it was

:03:59.:04:04.

she who eventually reported Declan missing. The local authority stand

:04:04.:04:08.

by the support they offered Kimberley Hainey. But they have

:04:08.:04:11.

already reviewed and made changes to how they would deal with similar

:04:11.:04:17.

cases. We can see in retrospect what

:04:17.:04:20.

happened. Services tried to maintain contact with her to

:04:20.:04:26.

monitor what was going on for herself and her child. But she

:04:26.:04:31.

managed to defeat the best efforts and many attempts made to contact

:04:31.:04:35.

her. It may never be known exactly how

:04:35.:04:39.

Declan Hainey died but the tragic death is bound to trigger another

:04:39.:04:45.

review of how to deal with the children of addictive parents. Our

:04:45.:04:49.

social affairs Correspondent joins us now. What other way you look at

:04:49.:04:55.

this it is tragic. Given that the levels of parental drug addiction

:04:55.:04:58.

and alcoholism, given the workload that we heard about of health

:04:58.:05:03.

visitors and social workers, what more can the authorities do to

:05:03.:05:08.

prevent the sort of thing happening again?

:05:08.:05:11.

We have heard about previous tragic cases. We know from figures

:05:11.:05:17.

released by the NSPCC that there are something like 18,000 children

:05:17.:05:22.

born in Scotland whose parents are suffering from drug or alcohol

:05:22.:05:27.

addiction and/or mental health issues. But this does not fall into

:05:27.:05:33.

that category. Kimberley Hainey was adept at lying to social workers

:05:33.:05:38.

and health visitors, her neighbours, and her friends. The health visitor

:05:38.:05:44.

in that report attempted to visit 11 times. She was trying her very

:05:44.:05:48.

best. Kimberley Hainey had done well coming off heroin and then

:05:48.:05:53.

reducing her methadone does. Declan Hainey had been thriving. Without

:05:53.:05:57.

evidence of something amiss there is little that social workers can

:05:57.:06:03.

do. The father, David Gibson, made it clear he wanted nothing to do

:06:03.:06:09.

with the child. So that is the safety net. An absent father, yes,

:06:09.:06:13.

but somebody who did have contact with the child who may have alerted

:06:13.:06:17.

authorities have something was amiss. What has to be done? What

:06:17.:06:23.

have we heard? An investigation will be carried out. But there is a

:06:23.:06:27.

limited amount, social workers claim, that they can do unless they

:06:27.:06:31.

are alerted. And we all must be alert to the signs of when a child

:06:31.:06:35.

must be at risk. -- might be addressed.

:06:36.:06:43.

You might not expect SNP MSPs to turn their nose up at an extension

:06:43.:06:46.

of powers for the Scottish Parliament. But they're not sure

:06:46.:06:50.

that extra powers currently on offer from Westminster are worth

:06:50.:06:56.

having. This report from the Scottish Parliament. The SNP won a

:06:56.:06:59.

second term in power at Holyrood promising a referendum on

:06:59.:07:04.

independence. In the meantime, Alex Salmond's government must decide

:07:04.:07:09.

whether it wants the extra powers currently on offer in the UK

:07:09.:07:14.

government's Scotland Bill. One proposal is the transfer of a

:07:14.:07:20.

picture of income-tax from Westminster to Holyrood. But the

:07:20.:07:23.

SNP Committee in this Parliament has looked at the detail and is not

:07:23.:07:30.

convinced that the package is a gift worth having.

:07:30.:07:34.

The Bill as it currently stands, which we were asked to Lukacs, we

:07:34.:07:38.

would find it difficult to recommend acceptance of it as it

:07:38.:07:43.

stands. -- asked to look at. Because there are elements which

:07:43.:07:48.

damage Scotland. The committee are demanding full

:07:48.:07:56.

control taxation for Holyrood. But Liberal, Labour, and Conservative

:07:56.:08:03.

MSPs produced a minority report supporting the Westminster bill. --

:08:03.:08:08.

the Scotland Bill. It would be perverse to vote this

:08:08.:08:15.

down. I hope the reconsider their veto.

:08:15.:08:20.

I will look particularly carefully at the central proposals about the

:08:20.:08:24.

Bill as it stands. What I hope is that the Scottish Parliament as a

:08:24.:08:34.
:08:34.:08:36.

whole will endorse our position. Without approval from both

:08:36.:08:43.

parliaments the Scotland Bill will be killed off.

:08:43.:08:49.

Still to come: ready to depart. We hear from the outgoing leader of

:08:49.:08:53.

Scottish Labour. And Heart of Midlothian players get

:08:53.:08:57.

their wages for November, but will they get their of December

:08:58.:09:05.

salaries? They are due tomorrow. And join me here in Northern Italy

:09:05.:09:12.

where the Celtic supporters are enjoying a pre-match party.

:09:12.:09:15.

The annual round of European fisheries negotiations has started

:09:15.:09:19.

with a chorus of warnings about the future of the Scottish industry.

:09:19.:09:25.

Our reporter is at Peterhead in Aberdeen, one of the largest port

:09:25.:09:30.

in Europe. These annual talks all we seem to loom over the Scottish

:09:30.:09:36.

fishing industry. Why so much concern this year?

:09:36.:09:41.

This year it is different. Normally we hear concerns about a quarter

:09:41.:09:45.

for next year - that is the amount of fish that Fisher men allowed to

:09:45.:09:51.

catch in large nets like this. Well, this year, there is less concern

:09:51.:09:55.

about that. Some species are likely to increase meaning there will be

:09:56.:10:01.

more to catch. But what will likely be reduced our days at sea - the

:10:01.:10:05.

number of days per year that fishermen can take boats like this

:10:05.:10:12.

out to sea. That is said to decrease in some cases by up to 50%.

:10:12.:10:15.

Leader Stephen Scott on say that if that where the case it would be

:10:15.:10:24.

absurd. -- leaders here in Scotland. We are facing a for days per

:10:24.:10:34.
:10:34.:10:35.

fortnight, or, God help us, were so. -- for days. That makes less sense.

:10:36.:10:41.

What are the timescales for the Brussels talks?

:10:41.:10:45.

They began this morning and the continuing throughout the course of

:10:45.:10:50.

the day. There are minor talks which will resume tomorrow. That is

:10:50.:10:53.

winning new, revised set of proposals based on what was said

:10:53.:10:58.

today will be discussed. But these things tend to go on for a long

:10:58.:11:01.

time and it could be well into the night or walk -- even the weekend

:11:01.:11:06.

before we hear details of a final agreement.

:11:06.:11:11.

It has been closed three times in the past for heels by landslides.

:11:11.:11:18.

Now people Anna Gael claimed that the A83 must be upgraded. -- people

:11:18.:11:24.

and Argyll. The big problem rests with the Rest-and-Be-Thankful. When

:11:24.:11:26.

it is blocked, drivers face a huge detour north along Loch Lomond side

:11:26.:11:29.

on the A82 to Crianlarich, then over the A85, before heading back

:11:29.:11:39.
:11:39.:11:41.

south on the A819 to Inveraray.. Our correspondent made the journey.

:11:41.:11:46.

It is one of the most stunning parts of Scotland's road networks.

:11:46.:11:53.

The rest and Be thankful is the narrow artery linking much of

:11:53.:11:58.

Argyll to the central belt. Traffic was flowing freely today but this

:11:58.:12:08.
:12:08.:12:09.

artery has been blocked by a landslides, three times since 2007.

:12:09.:12:19.
:12:19.:12:20.

So 600 tons of rock and soil here. The road remains closed...

:12:20.:12:26.

The latest was yesterday. Businesses are counting the cost.

:12:26.:12:36.
:12:36.:12:37.

None more so than this oyster farm. We have had lots of wasted stock.

:12:37.:12:41.

We have had to discount lots of stock. And we depend on passing

:12:41.:12:48.

trade. The passing trade comes from people

:12:48.:12:54.

like John, who drive-through regularly, and feels frustrated.

:12:55.:13:04.

It seems to be getting worse. Further along, in in Brady, Donald

:13:04.:13:10.

questions whether shutting the road every night is necessary.

:13:10.:13:14.

If you can imagine Glasgow and Edinburgh commuters are having to

:13:14.:13:19.

go via Perth, there would be an outcry, and out of reach. Yet this

:13:19.:13:29.
:13:29.:13:32.

has happened so many times in the past. -- an outcry, and outrage.

:13:32.:13:38.

The ferry terminal and the rest is still an hour or's drive.

:13:38.:13:48.

Campbeltown as two hour's drive. So what is the solution? One

:13:48.:13:52.

suggestion is there should be better alternative transport links

:13:52.:14:02.

Some of the other stories across Scotland this Thursday evening. Two

:14:02.:14:05.

people have been killed and four others injured - two of them

:14:05.:14:09.

seriously - in a crash involving a minibus from Scotland, a car and a

:14:09.:14:12.

lorry. The accident happened on the A7, near Carlisle. Those who died

:14:12.:14:15.

were the lorry driver and a woman passenger in the minibus, which had

:14:15.:14:17.

travelled from Canonbie in Dumfries and Galloway and Newcastleton in

:14:17.:14:20.

the Borders. Two men have been arrested in

:14:21.:14:23.

connection with a spate of armed robberies on security guards

:14:23.:14:26.

outside banks in the West of Scotland. The first raid happened

:14:26.:14:31.

outside the Bank of Scotland in Carmunnock Road, Glasgow, in August.

:14:31.:14:34.

The others were at the Clydesdale Bank in Bothwell, and at the

:14:34.:14:38.

Airdrie Savings Bank in Muirhead. Around 700 jobs could be created in

:14:39.:14:41.

Dundee, with plans to create a renewables energy base at the

:14:41.:14:47.

city's port. Scottish and Southern Electricity is among a group

:14:47.:14:50.

looking into establishing a base on Tayside. An offshore wind turbine

:14:50.:15:00.
:15:00.:15:01.

Political opponents have been paying tribute to the Labour leader

:15:01.:15:05.

Iain Gray, as he prepares to step down. The East Lothian MSP

:15:05.:15:07.

announced his resignation after the party's defeat in the Scottish

:15:07.:15:09.

Parliamentary elections. His replacement will be announced this

:15:09.:15:11.

weekend. From Holyrood, our correspondent, Raymond Buchanan

:15:11.:15:20.

reports. June they say all political careers

:15:20.:15:24.

end in failure. Iain Gray can testify to that but as he made his

:15:24.:15:28.

way towards a blast First Minister's questions, he claimed

:15:28.:15:37.

this was like get -- any other. There were warm words from his

:15:37.:15:43.

opponents including his nemesis. greatly enjoyed our weekly jests in

:15:43.:15:46.

this chamber and ensure that whoever will succeed you'll have a

:15:46.:15:53.

hard act to follow. After his election, his fortunes ebbed and

:15:53.:15:59.

flowed. The former teacher brought order to Labour in Holyrood and a

:15:59.:16:05.

party one success in by-elections. It was not to last. They were

:16:05.:16:12.

humiliated in May and Ian Gray only won his seat by 151 votes. What do

:16:12.:16:17.

you blame for that result? If we were to do it again and do it

:16:17.:16:21.

differently, we would do more work to reach out to those disaffected

:16:21.:16:25.

Liberal Democrat voters, to convince them that Labour is where

:16:25.:16:30.

they should call. One episode helped to define the disastrous

:16:30.:16:36.

election campaign. Iain Gray was greeted by protesters at Glasgow's

:16:36.:16:42.

Central Station. He was pursued by the demonstrators and the wind up

:16:42.:16:49.

in a Sandwich shop. Central Station that they did not

:16:49.:16:51.

help our election campaign and that would have been good had it not

:16:51.:16:56.

happened, but it did. He says he is most proud of his work to increase

:16:56.:17:01.

the number of apprentices, the campaign to save aircraft carrier

:17:01.:17:06.

jobs and helping to pass ambitious Climate Change targets. His

:17:06.:17:10.

leadership will most likely be defined by that spectacular loss.

:17:10.:17:14.

The task for his successor is formidable. A bed tax for tourists

:17:14.:17:16.

visiting Edinburgh has been ruled out by the Scottish Government.

:17:16.:17:20.

Tourism Minister Fergus Ewing told MSPs he had no plans for such a

:17:20.:17:23.

move and Edinburgh City Council had no powers to introduce it. The

:17:23.:17:28.

council had been considering the levy to raise extra revenue.

:17:28.:17:31.

Meanwhile, after years of delays and massive increases in costs, the

:17:31.:17:35.

capital's new tram depot has been handed over to the city council.

:17:35.:17:38.

While there's still a lot of work left on the project, test runs are

:17:38.:17:41.

now underway. Council bosses say the handover demonstrates that the

:17:41.:17:43.

tram project is finally making progress. Our transport

:17:43.:17:49.

correspondent, David Miller, has been taking a look.

:17:49.:17:55.

Edinburgh's trams are finally on strike, even if they are still

:17:55.:18:03.

behind the completion of the decor is seen as a milestone.

:18:03.:18:06.

They finally have something to celebrate with today's events all

:18:06.:18:10.

the more remarkable considering that only a few months ago, this

:18:10.:18:15.

project seemed close to collapse. For relief that finally we have

:18:15.:18:22.

reached this milestone in Addis -- delivery of the trams. This is a

:18:22.:18:28.

milestone in the delivery and I have to be honest and say it is a

:18:28.:18:33.

day I feared would never come. depot will be home to the entire

:18:33.:18:37.

tram fleet - five vehicles have already arrived. The tosses

:18:37.:18:41.

Government is now playing a more hands-on role, to ensure the

:18:41.:18:46.

project is delivered. -- Scottish. We'll make sure it happens as

:18:46.:18:51.

quickly as possible so that the disruption is brought to an end and

:18:51.:18:54.

people can go about their business. We will make sure it happens for

:18:54.:18:59.

the aid budget. Council leaders still want to see the line

:19:00.:19:05.

completed as far is the waterfront. For now, other focuses on building

:19:05.:19:13.

the line as far as York Place. Signal workers in the west of

:19:13.:19:16.

Scotland are to stage a three-day strike from Christmas Eve in a row

:19:16.:19:18.

over career progression, threatening disruption to rail

:19:18.:19:23.

services. The Rail Maritime and Transport union says the walkout

:19:23.:19:28.

will last until December 27th. Network Rail said that if a strike

:19:28.:19:33.

were to take place, it would still be able to run a full service.

:19:33.:19:36.

Linwood in Renfrewshire has been given one of Scotland's most

:19:36.:19:40.

infamous awards. Voted the most dismal in the country, the town has

:19:40.:19:42.

been given what's become known as the carbuncle award. Laura Bicker

:19:43.:19:50.

spent the day there to find out what went so wrong.

:19:50.:19:56.

This town centre is like a concrete corpse, and the life remains, only

:19:56.:20:00.

an empty shell of shops whose shutters have not opened in years.

:20:00.:20:06.

Against this backdrop comes that infamous Scottish awards. Despite

:20:06.:20:11.

the seasonal cheer elsewhere in the country, gloom surrounds us here in

:20:11.:20:17.

Linwood town centre. This is that the carbuncle award for Scotland's

:20:17.:20:24.

most dismal town. This community does not deserve this award. It is

:20:24.:20:30.

a fabulous community, but having said that, I do understand why the

:20:30.:20:33.

of giving the that it to the centre because as you can see, it is

:20:33.:20:40.

dreadful. It was not always this way. It was a hub of car

:20:40.:20:45.

manufacturing and produced the Kreisler Avenger and the Sunbeam.

:20:46.:20:50.

Even with this, the first regional shopping centre was built here and

:20:50.:20:54.

there were complaints. You will find this is less than half

:20:54.:21:00.

developed and inhabited. It got worse. We had large shops and a

:21:00.:21:05.

restaurant and a cafe and it has been left to rot. People are so

:21:05.:21:09.

disgusted about the whole thing. There are plans to demolish this

:21:09.:21:13.

town centre and start again. Renfrewshire council promised the

:21:13.:21:18.

bulldozers could be in and a matter of weeks. They have plans for a

:21:18.:21:22.

town hall and a mass of Tesco. Local people say they think this is

:21:22.:21:27.

a day that may never come. The leader of the council asked to meet

:21:27.:21:31.

be beside a row of newly built houses. He says this is proof of

:21:31.:21:37.

change. The council have managed to negotiate with Tesco to build anew

:21:37.:21:41.

store. It has taken longer than they would have liked but it is on

:21:41.:21:46.

its way. An award is usually cause for celebration but at the least,

:21:46.:21:50.

people here hope that the carbuncle award will be a source of

:21:50.:21:54.

inspiration and a catalyst for change. Let's see how the sport is

:21:54.:22:03.

looking this evening. Here's David. Celtic can claim a place in the

:22:03.:22:10.

next stage of the Europa League tonight but will have to beat

:22:10.:22:20.
:22:20.:22:22.

Udinese. It was not be easy. Those who walk the cobbled streets

:22:22.:22:28.

here are used to the Italian quiet life. Here in northern Italy, a

:22:28.:22:32.

Renaissance statue stared down. The City is not completely without

:22:32.:22:42.
:22:42.:22:43.

foreign influence. Some more recent than others. Celtic and indeed here

:22:43.:22:49.

in the hope of a rare win on the road and Europa League progression.

:22:49.:22:55.

I think tonight is like a cup final for us. He put down at the back and

:22:55.:23:01.

we'll do well. We don't know how we will play so it is a dilemma for

:23:01.:23:08.

the Italians. We have to go for it. This Celtic fans here enjoying app

:23:08.:23:13.
