An an and tonight on Reporting Scotland: 35 years after the | :00:18. | :00:22.
World's End murders, an obligation is made to prosecute a man for a | :00:22. | :00:26.
second time, under new double jeopardy laws. | :00:26. | :00:33.
The Suzanne Pilley murder. The man who murdered her loses his appeal | :00:34. | :00:38.
against conviction. High wind and heavy rain batter | :00:38. | :00:42.
Scotland. I am in Stonehaven, where the town | :00:42. | :00:50.
is possibly expecting a repeat of the weekend's heavy weather. | :00:50. | :00:55.
Later, we reveal Scotland's most popular baby names. | :00:55. | :01:00.
And 11 years after they last played Juventus in the Champions League, | :01:00. | :01:04.
Celtic draw them again. The Crown Office has asked the High | :01:04. | :01:07.
Court for approval to prosecute a man cleared of murdering two | :01:07. | :01:13.
teenagers in Edinburgh 35 years ago. Angus Sinclair was acquitted five | :01:13. | :01:18.
years ago of killing Christine Eadie and Helen Scott, in what | :01:18. | :01:22.
became known as the world's end murders. If a retrial is granted, | :01:22. | :01:26.
it will be the first held after double jeopardy legislation was | :01:26. | :01:30.
changed last year. 17 year-olds Helen Scott and | :01:30. | :01:35.
Christine Eadie have been on a night out in Edinburgh on 15th | :01:35. | :01:40.
October 1977. They were last seen alive leaving this club, the | :01:40. | :01:45.
world's end, on the Royal Mile. The case became known as the World's | :01:45. | :01:50.
End murders. The next day, Christine's body was found in | :01:50. | :01:57.
Castlebay in East Lothian. Helen's was found six miles away in a field, | :01:57. | :02:01.
both brutally murdered. Police conducted an investigation. Despite | :02:01. | :02:07.
their efforts, no one stood trial for the deaths until 30 years later. | :02:07. | :02:12.
That is when this man, Angus Sinclair, went on trial. But he was | :02:12. | :02:16.
acquitted after a judge ruled there was insufficient evidence against | :02:16. | :02:21.
him, leaving Helen Scott's Father devastated. Words cannot explain | :02:21. | :02:30.
how I feel. 30 years of trying to get a conclusion. I promised I | :02:30. | :02:36.
would stick by this and get somebody brought and get justice, | :02:36. | :02:40.
which honestly I do not think I have had today. It was the collapse | :02:40. | :02:45.
of this case which prompted the review of the ban on people being | :02:45. | :02:53.
charge price for the same effect -- defence. It is understood that | :02:53. | :02:58.
fresh DNA evidence has since been uncovered by police in this case. | :02:58. | :03:03.
For 35 years, Helen Scott's Father has waited for someone to be | :03:03. | :03:08.
convicted of the murder of his daughter. Today, Morain Scott told | :03:08. | :03:12.
the BBC this is completely new territory and another step on the | :03:12. | :03:16.
ladder for getting justice for his daughter and her friend. | :03:16. | :03:20.
A child has been flown to hospital in Aberdeen after a serious road | :03:20. | :03:25.
crash. The accident between a car and a lorry happened on the A90 two | :03:25. | :03:31.
miles south of Fraserburgh. Two other people were taken to hospital. | :03:31. | :03:36.
The child's condition is not known. The man found guilty of murdering | :03:36. | :03:39.
Edinburgh office worker Suzanne Pilley has had an appeal against | :03:39. | :03:43.
his conviction refused. David Gilroy was jailed earlier this year | :03:43. | :03:48.
for killing his ex-lover, whose body has never been found. | :03:48. | :03:52.
David Gilroy's family arrived in court today hoping for a positive | :03:52. | :03:56.
outcome. It was less than two hours later before his appeal was | :03:56. | :04:01.
rejected. It was in March she was found guilty of murdering Suzanne | :04:01. | :04:06.
Pilley, who have been trying to end their affair. This was made 2010. | :04:06. | :04:11.
The pair were captured on CCTV shopping. Two days later, she | :04:11. | :04:18.
disappeared. A jury convicted him of killing her in the basement of | :04:18. | :04:22.
their office before driving to Argyll with her body in the boot of | :04:22. | :04:27.
the car. He was questioned in a police station in Edinburgh and | :04:27. | :04:32.
treated as a witness. Today Gilroy's lawyer argued police | :04:33. | :04:37.
should have treated him as a suspect right from the start. He | :04:37. | :04:40.
put to the Appeal Court judges that he should have been cautioned and | :04:40. | :04:45.
give access to a lawyer, and that meant the same as he gave should | :04:45. | :04:49.
never have been used in evidence against him. They also said that | :04:49. | :04:56.
the whole trial should have been halted as the jury work given a | :04:56. | :05:05.
pathologist's report a erroneously. Kilroy has always been vocal, as he | :05:05. | :05:10.
claimed to be innocent. But in judge today he remained quiet. His | :05:10. | :05:17.
legal team say they will now go to the Supreme Court in London. | :05:17. | :05:22.
Still to come: Sophie and Jack remain the most popular baby names | :05:22. | :05:26.
in Scotland. Amelia and Riley are new on the list. | :05:27. | :05:33.
And in sport, reaction from Celtic and the next Champions League | :05:33. | :05:37.
opponents -- for their next Champions League opponents, | :05:37. | :05:43.
Juventus. And we are here from the only Scottish Formula One driver. | :05:44. | :05:47.
Flood warnings have been issued to many parts of the country until the | :05:47. | :05:52.
weekend, with heavy rain and strong wind already causing problems. I am | :05:52. | :05:56.
joined from Stonehaven by our reporter Craig Anderson and first, | :05:56. | :06:02.
from the A9 in Dunkeld, by Andrew Anderson. | :06:02. | :06:07.
A day of totally miserable weather here in Tayside, with non-stop | :06:07. | :06:13.
heavy rain and high wind. This is the A9, the main route to and from | :06:13. | :06:17.
the Highlands. It has to be closed for two hours this afternoon, such | :06:17. | :06:22.
was the volume of rainwater on the carriageway. It was covering a | :06:22. | :06:26.
stretch about 100 yards or more and the firefighters had to pump it | :06:26. | :06:30.
away. The road has re-opened but that caused some serious hold-ups | :06:30. | :06:35.
for drivers only on today. A van driver was stuck in floodwater for | :06:35. | :06:39.
a time. His band have to be towed to safety by a farmer using his | :06:39. | :06:45.
tractor. In Dundee they are keeping a close eye on the level of the | :06:45. | :06:53.
River Tay tonight. High tide is due just after eight Ben Clark and the | :06:53. | :07:00.
coast levels could get as high as five metres. -- eight o'clock. The | :07:00. | :07:04.
water cascades down into the rivers and the Burns, causing those levels | :07:04. | :07:11.
to rise and causing concern to local communities. | :07:11. | :07:15.
Earlier on today, heavy equipment was brought in to shore up the | :07:15. | :07:21.
coastal defences here which had caused problems and damage to | :07:21. | :07:24.
houses when they reached over the weekend. But today the real focus | :07:24. | :07:31.
of concern is the River Carron here in Stonehaven. Sandbags have been | :07:31. | :07:36.
issued to householders and all set up in Peterhead. There is also some | :07:36. | :07:40.
concern about the river Devon further north in Huntly and alerts | :07:40. | :07:46.
have been issued there to a care home and has told us as well. If it | :07:46. | :07:50.
is not necessarily the heaviness of the rain but its persistence with | :07:50. | :07:56.
the deluge expected to last. The company which operates the Aberdeen | :07:56. | :08:01.
to the Northern Isles ferry service has called off all ferry sailings | :08:01. | :08:05.
today. They say they may well be ferry sailings tomorrow but if not, | :08:05. | :08:09.
there will not be any more now until Boxing Day. Extra flights | :08:09. | :08:18.
have been put on as a result. Thank you very much. | :08:18. | :08:22.
Some staff at Tayside health board felt bullied into fiddling waiting | :08:22. | :08:26.
times figures and many other health boards do not have accurate ways of | :08:26. | :08:30.
making sure they are offering patients timely appointments, | :08:30. | :08:34.
according to auditors. Today the Scottish Government announced the | :08:34. | :08:38.
results of audits into the ways all health boards have met waiting | :08:38. | :08:44.
targets. Our health correspondent joins me. Why were these audits | :08:44. | :08:48.
offered in the first place? There was suspicion that health boards | :08:48. | :08:51.
were not actually meeting Government waiting time targets and | :08:51. | :08:55.
that followed a scandal in NHS Lothian where it was discovered | :08:55. | :08:57.
patients were being offered appointments they could not | :08:57. | :09:01.
possibly keep because they were at short notice in faraway hospitals. | :09:01. | :09:05.
These audits that were carried out found no evidence of general | :09:06. | :09:11.
cheating. They did find, though, that the system was very complex, | :09:11. | :09:15.
certainly not transparent for patients. There was a particular | :09:15. | :09:19.
problem in Tayside though, where it was found 17 % of patients in a | :09:19. | :09:22.
particular sample were wrongly marked down as unavailable. | :09:22. | :09:25.
Knocking someone down as unavailable means there waiting | :09:25. | :09:31.
time clock stops and it meant they were removed from the waiting time | :09:31. | :09:33.
targets and therefore NHS Tayside did not attract attention by | :09:33. | :09:38.
breaching those targets. Staff involved said they felt bullied | :09:38. | :09:42.
into doing that. NHS Tayside has apologised and said it will not | :09:42. | :09:48.
happen again. So how long should we will be waiting? The clocks start | :09:48. | :09:52.
from when you are referred for treatment by your GP. If that | :09:52. | :09:57.
referral was before October of this year, don't you should not wait | :09:57. | :10:02.
longer than 18 weeks. Is the referral was after October this | :10:02. | :10:06.
year, he should not wait longer than 12 weeks, and that is because | :10:06. | :10:10.
a new Act has come in, giving you a legal right to wait no longer than | :10:10. | :10:15.
12 weeks, and you should be offered two appointments, which have to be | :10:15. | :10:19.
reasonable. The any exception to all this is if you have a very | :10:19. | :10:23.
particular health problems which include fertility treatments, if | :10:23. | :10:28.
you have a back problem, or if you are awaiting a transplant. In all | :10:28. | :10:33.
those cases, the weights are much longer. If you cannot make an | :10:33. | :10:37.
appointment, you should now be told, and this is a new directive issued | :10:37. | :10:40.
today, you should now be told exactly how that is going to affect | :10:40. | :10:44.
your overall waiting time. My advice is to always keep an eye on | :10:44. | :10:48.
how long you have been waiting and if it starts to get too long, ring | :10:48. | :10:54.
up the clinic and asked them why. Thank you. | :10:54. | :10:57.
Scottish fishing boats will not face a cut in the number of days | :10:57. | :11:01.

seeing it so much fish. The last couple of years, we have been | :12:00. | :12:08.

says. Celtic have done well on deep two occasions they have met. First | :20:38. | :20:48.

payments due to players have still not been paid. The club say they | :21:25. | :21:29.
are consulting their legal advisors. However, Hearts now cannot sign any | :21:29. | :21:33.

The Glasgow Warriors captain Al Kellock has signed a new contract | :21:36. | :21:39.

a two year deal, with the option of a year's extension taking him up to | :21:43. | :21:46.
2015. The Scotland international says it was too attractive to turn | :21:47. | :21:56.

down. The way the contract is set up, when I am finished playing I | :21:58. | :22:02.
will have the opportunity to do some coaching and some commercial | :22:02. | :22:08.
stuff. I grabbed the contract with both hands because of that. | :22:08. | :22:11.
only Scot currently competing in Formula One says he's made progress | :22:11. | :22:13.
this year but wants further improvements next year. Paul Di | :22:13. | :22:16.
Resta, who drives for the Force India team, is targeting at least | :22:16. | :22:19.
one podium finish next season after narrowly missing out this time | :22:19. | :22:29.
:22:29. | :22:29. | ||
round. Scotland has produced some great drivers like Jim Clark and | :22:29. | :22:34.
Jackie Stewart. This man carries the corpse of the current | :22:34. | :22:41.
generation. The poor Cindy et team driver has yet to finish in the top | :22:41. | :22:51.
:22:51. | :22:52. | ||
three. As a midfield team we could certainly celebrate and look | :22:52. | :23:00.
forward into next year. In 20 living he was a Ricky of the year | :23:00. | :23:10.
:23:10. | :23:12. | ||
coming 13th overall. -- 2011. He was down one place in his second | :23:12. | :23:19.
season but his best performance was a 4th place finish. I want to step | :23:19. | :23:24.
up the ladder, get closer to the podiums and become more successful | :23:24. | :23:33.
in Formula One. A podium finish or two in D year ahead could earn him | :23:33. | :23:38.
a drive with one of the bigger teams. Christmas is a family time | :23:38. | :23:41.
but that's not always possible for people in the armed services. Last | :23:41. | :23:44.
night we brought you the story of returning troops from Afghanistan. | :23:44. | :23:48.
Tonight it's the turn of the Royal Navy. Wille Johnston reports on an | :23:48. | :23:58.
:23:58. | :23:58. | ||
emotional reunion today on the Clyde. Accrue in high spirits and | :23:58. | :24:03.
no wonder. This is one of the smallest ships in the Navy. Not | :24:03. | :24:10.
much space in which to live and work for six months. It is a | :24:10. | :24:15.
challenge. I am very proud of the efforts of the team. They have done | :24:15. | :24:22.
a very professional job over the last six months. They have been on | :24:22. | :24:28.
operation since June. They will return in just in time for | :24:28. | :24:36.
Christmas, that is reason enough for the top brass to come aboard. A | :24:36. | :24:40.
medal for one Petty Officer. For him it is more than just the end of | :24:40. | :24:47.
that tour of duty. It is the end of my 17 year at Terriers so I can | :24:47. | :24:56.
move on and start a family life in Australia with my partner. On the | :24:56. | :25:02.
quayside everything is now in place to make sure we have up warm | :25:02. | :25:11.
welcome home. The Royal Marine Band, a Royal Navy helicopter and friends | :25:11. | :25:21.
and family. I am cold but I am happy to turn up. We have a seven- | :25:21. | :25:31.
:25:31. | :25:31. | ||
year-old and three year-old while there that has been away. They had | :25:31. | :25:37.
their birthdays during his tour this time. Time to look forward to | :25:37. | :25:45.
happy family Christmases. And the start of a new life down under is | :25:45. | :25:51.
an attractive proposition on a day like this. It looks quite wet out | :25:51. | :25:57.
there. It is unfortunately. Forget a white Christmas, it is a wet and | :25:57. | :26:07.
:26:07. | :26:12. | ||
windy one. There is a weather warnings in Tayside and other areas. | :26:12. | :26:18.
A strong South East to easterly wind which will reach a deal forced | :26:18. | :26:24.
in certain parts of the east coast. This low pressure will see the | :26:25. | :26:29.
winds continue overnight particularly down the east coast. | :26:29. | :26:38.
Some coastal flooding could also be an issue. There could be flooding | :26:38. | :26:46.
on inland rivers by tomorrow morning. Things will improve during | :26:46. | :26:53.
the day tomorrow. It will still be cloudy but it will dry up. There | :26:53. | :27:00.
will be snow over high ground but that is well above road levels. | :27:00. | :27:07.
Orkney & Shetland will have coastal gales at times. Into tomorrow | :27:07. | :27:11.
afternoon, evening and overnight the game will pull away with many | :27:11. | :27:17.
area is becoming calm of a night and into Saturday morning. That | :27:17. | :27:25.
will not last. Another area of low pressure will work its way in on | :27:25. | :27:31.
Saturday. Not pleasant conditions if you have last-minute Christmas | :27:31. | :27:37.
shopping to do. The aim will sweep end on Saturday. The ground will be | :27:38. | :27:45.
saturated. On Sunday it will still be wet and windy and severe gales | :27:45. | :27:51.
are possible towards Shetland by the end of the weekend. If you are | :27:51. | :27:57.
concerned about those flood warnings you should call flat line. | :27:57. | :28:03.
A reminder of tonight's main news in brief. The Crown Office has | :28:03. | :28:10.
asked for approval to prosecute a man accused of two murders of | :28:10. | :28:15.
teenage girls in Edinburgh 35 years ago. They were known as the World's | :28:15. | :28:20.
End murders. More than 300 flood warnings and alerts for parts of | :28:20. | :28:27.
England, Scotland and Wales tonight. With the ground already saturated | :28:27. | :28:31. |
