this court building throughout the day. Mikaeel Kular's mother advised

around midday. Four hours later, her hearing took place, it lasted only a

few moments. She faces two charges. One charge of murder. Leading the

back door of the court building, a van believed to be carrying Mikhail

cooler's mother. She was arrested on Saturday night after her son's body

was discovered in woodland. The 33-year-old appeared in court under

her married name Rosdeep Adekoya. She was told she faces two charges,

one of attempting to defeat the ends of justice and the other of murder.

She made no plea or declaration and was remanded in custody ahead of

gathered for a vigil to remember the toddler. This morning, his

classmates were offered support as they returned to nursery for the

first time since hearing the news. Their parents were sent letters by

police asking for information on Mikaeel's movements last week. It is

tragic, especially as we have to share this with our children.

first seen last Thursday when he was reported missing from his home. Over

the next 48 hours, hundreds of locals were involved in the search.

Then came the announcement everybody was dreading.

We have recovered the body of a young boy in Fife, shortly before

:03:36.:03:43.

midnight. His body was discovered close to their former home in

:03:44.:03:48.

Kirkcaldy. The investigation is continuing. Forensic officers are

carrying out a search of the house. Meanwhile, people arrived to lay

:03:57.:04:11.

flowers. BBC Scotland has further evidence

that vulnerable are being wrongly charged care home costs. The BBC has

:04:15.:04:18.

learned of three people who are minimally conscious or in a

:04:19.:04:21.

vegetative state who have been told they're not ill enough for NHS

:04:22.:04:23.

funding. Our health correspondent Eleanor Bradford is here with more.

Who gets their care costs paid? Everyone gets free personal care,

:04:32.:04:34.

help with washing and toileting. If you have assets under ?25,000, you

:04:35.:04:38.

get some or all of your care costs paid by the council. If you have

:04:39.:04:44.

complex ongoing health needs, you should get your care costs paid by

:04:45.:04:48.

the NHS under an arrangement called continuing health care. Last year we

:04:49.:04:53.

revealed how, in England, the number of people getting this benefit is

:04:54.:04:58.

rising. In Scotland, it's falling. As I've been finding out, some of

:04:59.:05:02.

the Scots being told they don't qualify are in a vegetative state,

:05:03.:05:05.

which prompts the question, just how sick do you have to be to get this

:05:06.:05:10.

benefit? On a crisp winter's morning, I

:05:11.:05:13.

visited Robert Fyans's house. Robert's mother has been in a care

:05:14.:05:17.

home for the last three years. A severe stroke left her in a

:05:18.:05:21.

vegetative state. But despite that, Robert has been told the NHS will

:05:22.:05:26.

not pay for her care home costs. The actual NHS health care guidelines

:05:27.:05:30.

are so rigid and so hard to qualify for that nobody apparently in

:05:31.:05:38.

Scotland can qualify for it. Or very few people in Scotland could

:05:39.:05:51.

qualify. We commissioned an independent expert to look into Mrs

:05:52.:05:55.

Fyans' case. She concluded that if Mrs Fyans lived in England, she

:05:56.:05:59.

would have all her care bills paid for by the NHS, a sum which so far

:06:00.:06:05.

exceeds ?40,000. Last year, the Health Secretary urged anyone who

:06:06.:06:08.

felt they had been unfairly charged for care to contact him. Robert did

:06:09.:06:17.

that, but the decision stood. The purpose of contacting me is not for

:06:18.:06:21.

me to make the decision. These are clinical decisions made by senior

:06:22.:06:27.

doctors. The last thing anybody would want is for these decisions to

charities have told the BBC they believe people aren't getting the

NHS funding they're entitled to. A review into this whole system of

Claims about the standard of care at a private school in Aberdeen are

Hamilton School. The claims have been made by former staff and

:07:50.:07:53.

school, in Aberdeen, it was set up in 1975. Akira inspected it told us

this afternoon that it had been made aware of allegations in connection

with the school. It had passed on those allegations to Aberdeen City

Council. It is up to the Council officials to determine whether or

not there is an issue that needs to be investigated. The council told us

this afternoon that staff had had a meeting here at the Hamilton School

:08:32.:08:36.

Inspectorate upheld complaints against this school. They were over

We are able to write into the material optical circuits, analogous
