BBC Scotland can reveal that survivors of abuse at the former

:00:09.:00:13.

Fort Augustus Abbey School have turned to England

:00:14.:00:15.

It comes as the Government has announced a new chair to head

:00:16.:00:20.

the independent inquiry into child sex abuse in care in Scotland.

:00:21.:00:24.

Our Home Affairs Correspondent, Reevel Alderson reports.

:00:25.:00:31.

It's just four short months until the independent inquiry

:00:32.:00:33.

into the abuse of children in care held its first session

:00:34.:00:36.

This inquiry is not just for survivors of abuse in the past,

:00:37.:00:45.

it is also for some Scottish children yet to be born.

:00:46.:00:54.

Yet earlier this month the chair resigned, leaving

:00:55.:00:56.

Now in place of Ms O'Brien, one of the most senior

:00:57.:01:00.

High Court judges in Scotland, Lady Anne Smith.

:01:01.:01:04.

Survivor groups welcomed the speed of the appointment yet have

:01:05.:01:09.

criticised the government for failing to consult

:01:10.:01:10.

them and have demanded that the Education Secretary widens

:01:11.:01:12.

We're a bit surprised, while we are pleased

:01:13.:01:22.

that he hasn't able to indicate today that he is prepared to extend

:01:23.:01:27.

remit and include a recommendation about redress in the inquiry.

:01:28.:01:29.

Now we are seeking an urgent meeting with him with a view to resolving

:01:30.:01:33.

not only this issue but a number of others as well.

:01:34.:01:41.

Allegations of systematic abuse at the former school

:01:42.:01:43.

run by the Benedictine order will be a part of the inquiry

:01:44.:01:48.

but one survivors group is so disillusioned with progress

:01:49.:01:50.

in Scotland it has been accepted as core participants in the English

:01:51.:01:53.

In a notice published in the court she said...

:01:54.:02:08.

This means the group, White Flowers Alba, is eligible

:02:09.:02:12.

for redress, something it has pressed the government to offer

:02:13.:02:18.

but so far ministers have resisted changing the remit.

:02:19.:02:20.

I want to discuss that further with survivors groups and with

:02:21.:02:24.

Lady Smith following her appointment.

:02:25.:02:26.

These issues are under active consideration to make sure

:02:27.:02:29.

we have an inquiry that can properly and fully address the issues

:02:30.:02:32.

of concern, to summarise the awful experiences of individuals

:02:33.:02:35.

and we can do that task properly on their behalf.

:02:36.:02:40.

The government insists the inquiry will continue to operate

:02:41.:02:42.

independently with no assistance from ministers.

:02:43.:02:44.

Figures the BBC has obtained show that, in the last three years,

:02:45.:02:53.

the amount of money healthboards have spent on overtime payments

:02:54.:02:55.

to consultants has increased by almost 50% -

:02:56.:02:57.

Doctors argue it's due to a lack of full time staff.

:02:58.:03:04.

The Scottish Government says it's a very small portion

:03:05.:03:09.

These figures have come from a UK wide Freedom Of Information request

:03:10.:03:21.

by the BBC. Three years ago, the bill for consultants over time was

:03:22.:03:26.

14.27 million. That had risen to nearly 21 million muster. This is

:03:27.:03:31.

over time, so money consultants are in for extra shifts, often at the

:03:32.:03:37.

weekend or evening. One consultant earns an extra ?135,000 last year.

:03:38.:03:47.

-- 135 820. They said that this was to meet targets at of pressure due

:03:48.:03:51.

to staff vacancies. They say there's something not enough staff to cope

:03:52.:03:56.

cope with growing pressures on our hospitals in Scotland. We need

:03:57.:04:00.

long-term solutions that create a sustainable NHS. Summary issues

:04:01.:04:06.

faced deal with sticking plaster solutions are temporary solutions

:04:07.:04:09.

that don't solve the problems. They may patch and meant for the short

:04:10.:04:12.

term, but we need to think about not just the next five years but the

:04:13.:04:17.

next 45 years. Three years ago, NHS Grampian said they spent nothing at

:04:18.:04:21.

all for overtime for consultants, but Laster be spent more than ?1.5

:04:22.:04:26.

billion. They say that spend is due to a lack of staff, particularly at

:04:27.:04:35.

busy periods. -- million. They have said that the overtime bill could be

:04:36.:04:41.

dramatically reduced if the right number of consultants could be

:04:42.:04:44.

recorded. The latest figures show we are 162 short. In the meantime,

:04:45.:04:52.

here's a suggestion. We have to sink a bit more sensibly and carefully

:04:53.:04:56.

about simplistic targets for rating times alone. -- think. It's

:04:57.:05:01.

important, both from the doctor and patient perspective, that we are

:05:02.:05:05.

concentrating on the quality of care, that we're actually making

:05:06.:05:08.

sure that the outcomes for patients, whether the operation is successful

:05:09.:05:12.

or not, is what we are measuring rather than sticking solely to

:05:13.:05:15.

counting the easy thing, which is how long it took to have the

:05:16.:05:18.

operation in the first place. The Scottish Government said the

:05:19.:05:22.

overtime bill in context is a tiny percentage of what it spends on

:05:23.:05:26.

consultants and the number of consultants have got up by 40% of

:05:27.:05:30.

the last ten years. Trading places are being increased, as well. The

:05:31.:05:33.

Health Secretary takes on board there may be better ways of

:05:34.:05:38.

prioritising care. Patients want to be seen as quickly as possible so

:05:39.:05:42.

that remains important, however measuring outcomes is also

:05:43.:05:47.

important, that perhaps some of their waiting time targets are a bit

:05:48.:05:51.

of a blunt instrument and we want to listen to the professions and we

:05:52.:05:54.

want to listen to patient groups about how we can perhaps focus more

:05:55.:05:58.

on the outcomes for patients, but we need to see what the group comes up

:05:59.:06:01.

with or what recommendations they need to make. The best way to

:06:02.:06:06.

achieve that balance of delivering quality care but in an acceptable

:06:07.:06:12.

time, at a reasonable price, is what it seems to be very much up for

:06:13.:06:13.

discussion now. Independence supporters have LOST

:06:14.:06:15.

a legal fight to remain camped A judge has ruled that

:06:16.:06:18.

the the group can be evicted. Here's our political

:06:19.:06:22.

correspondent, Glenn Campbell. Parliament welcomes protesters,

:06:23.:06:32.

but not this eight month long occupation by supporters

:06:33.:06:38.

of Scottish independence. It took these so-called IndyCampers

:06:39.:06:40.

to court in what became one of the weirdest of cases.

:06:41.:06:53.

There are unusual arguments heard in the case, the campers made the

:06:54.:06:55.

declaration of Arbroath and tried to call the Queen

:06:56.:06:58.

as a witness and actually claimed that Christ had returned to Earth

:06:59.:07:00.

and was backing Scottish independence.

:07:01.:07:03.

Yet at the end of the day the case was based on serious law,

:07:04.:07:05.

human rights, whether the group at the right to stay

:07:06.:07:08.

here and the right to freedom of assembly.

:07:09.:07:10.

In a written statement Lord Turnbull has turned in favour of Parliament

:07:11.:07:12.

and against the IndyCampers, whose position, he says,

:07:13.:07:16.

is selfish or arrogant in that they seemed to assert that their right to

:07:17.:07:20.

use this space is greater than the rights of others.

:07:21.:07:23.

Lord Turnbull said it would not be disproportionate for Parliament

:07:24.:07:25.

to seek the removal of this independence vigil.

:07:26.:07:30.

I think it's shocking. Basically it has walked all over

:07:31.:07:40.

human rights in Scotland. Hopefully we have the right

:07:41.:07:42.

to appeal and stay during the appeal because the vigil

:07:43.:07:44.

is a good thing. We are not a bad thing,

:07:45.:07:47.

we've never had any reported incidents to the police.

:07:48.:07:50.

There's been no drink, no drugs, we are known as middle aged teacher

:07:51.:07:54.

linkers. -- tea drinkers. Parliament officials welcomed

:07:55.:08:02.

the judgment and hoped to persuade them to leave peacefully.

:08:03.:08:04.

We have to have those conversations with them,

:08:05.:08:06.

clearly Lord Turnbull has said the onus is on them to remove

:08:07.:08:09.

themselves, if they don't we will seek to remove them.

:08:10.:08:11.

After 244 days of occupation, today's judgment should mean

:08:12.:08:16.

that the days of IndyCamp are numbered yet the campaign hope

:08:17.:08:19.

that they can still stay put until Scotland becomes

:08:20.:08:20.

an independent country. ?110 million is being invested

:08:21.:08:25.

in GSK's operations at Montrose. The pharmaceutical giant says it

:08:26.:08:31.

will provide a new, state-of-the-art The firm employs 450 people

:08:32.:08:33.

at the site in Angus, where it makes respiratory,

:08:34.:08:37.

HIV and vaccine products. It's also investing at its plants

:08:38.:08:40.

in County Durham and Hertfordshire. It's good to be investing to build a

:08:41.:08:53.

new state-of-the-art manufacturing facility that will make products

:08:54.:09:00.

which are part of GSK's spirit to rate per photo. These active

:09:01.:09:03.

ingredients go into drugs that treat problems such as asthma.

:09:04.:09:10.

Edinburgh's become the first Scottish city to impose a 20 mph

:09:11.:09:12.

The limit, which will begin being rolled out this weekend,

:09:13.:09:16.

Critics argue it's an unnecessary and damaging move.

:09:17.:09:19.

The Council insists a network of arterial roads will still have

:09:20.:09:22.

30-40 mph limits, to keep traffic flowing.

:09:23.:09:26.

Celtic earned a 1-1 draw in the first leg of their qualifier

:09:27.:09:29.

John Barnes has the story of the match.

:09:30.:09:41.

Having suffered humiliation in Gibraltar in the last round,

:09:42.:09:45.

Brendan Rodgers was hoping his side would produce a result more worthy

:09:46.:09:47.

of note in Khazakstan. It was Celtic who had

:09:48.:09:52.

the first real chance, Leigh Griffiths finding space for

:09:53.:09:54.

this shot. But Astana were quick on the break

:09:55.:09:58.

and Mikael Lustig had to be alert to deal with this cross.

:09:59.:10:02.

But from the resulting corner, Astana made the breakthrough.

:10:03.:10:08.

Craig Gordon flapping at fresh air as Kazakhstan champions

:10:09.:10:15.

were headed in front. Astana unbeaten in their last seven

:10:16.:10:18.

Champions League ties at home came close to adding a second.

:10:19.:10:20.

But this time Gordon was up to the task.

:10:21.:10:22.

There was another fright for the Scottish champions

:10:23.:10:25.

early in the second half, a striker clipping the crossbar.

:10:26.:10:29.

But 12 minutes from the end, Celtic got the equaliser,

:10:30.:10:33.

and it might prove to be priceless. Leigh Griffiths!

:10:34.:10:39.

Leigh Griffiths, last season's 40-goal hero coming up trumps

:10:40.:10:42.

for the new Celtic manager. It was Celtic's only shot on target

:10:43.:10:45.

and sets them up nicely for the second leg

:10:46.:10:46.

in Glasgow next week. A number of Hibernian fans have been

:10:47.:10:48.

banned from the club's home ground, following the pitch invasion

:10:49.:10:53.

at the Scottish Cup final in May. BBC Scotland has learned the ban

:10:54.:10:56.

will remain until the supporters involved have a meeting

:10:57.:10:59.

with Hibs' safety officer. The club identified each fan

:11:00.:11:02.

as being on the pitch The club is refusing to comment

:11:03.:11:05.

and wouldn't say how many fans have Now here's Kawser with the weather

:11:06.:11:09.

outlook for tonight and tomorrow. Thank you, good evening. It's been

:11:10.:11:22.

quite a fine end to the evening for many of us, late spells of sunshine.

:11:23.:11:27.

This lovely picture was sent in from one of our brother watchers. We will

:11:28.:11:30.

continue to seek mostly dry conditions, with clear spells

:11:31.:11:33.

developing. One or two scattered showers up over the hills and across

:11:34.:11:38.

the far northwest, the Northern Isles, cloudy with outbreaks of

:11:39.:11:41.

rain. You can see from the map, cloud thickening coming from the

:11:42.:11:45.

southwest as we end the night. Temperatures holding onto double

:11:46.:11:48.

figures for towns and cities, but under the clear spells for rural

:11:49.:11:52.

areas, down to six or 7 degrees, making it quite a cool start here.

:11:53.:11:56.

As we head through the course in the morning, the rain continuing to push

:11:57.:11:59.

in the rain continuing to push and across Dumfries Galloway. It will

:12:00.:12:02.

gradually spread eastwards as we had through the day. Holding onto drier

:12:03.:12:06.

weather across the Lothians and we will see some brighter spells across

:12:07.:12:09.

Tayside and interpret each or through the course of the morning.

:12:10.:12:13.

Still cloudy am afraid across the northwest, and for the Northern

:12:14.:12:16.

Isles and the winds of victory zero here, come in from the West. A wider

:12:17.:12:22.

look at the rest the UK, the rain progressing eastwards across most of

:12:23.:12:25.

the country, north of the central belt. Further towards the north of

:12:26.:12:29.

Scotland, we will see some brighter spells. Double figures, up to 20

:12:30.:12:40.

here, the 13 or 14 here, disappointing. Further towards the

:12:41.:12:45.

south of England holding 20-22dC. This weather system will clear away

:12:46.:12:47.

south-eastwards as we head through tomorrow night and we will start to

:12:48.:12:51.

see the winds turning more northwesterly, drying and fresher

:12:52.:12:56.

air, so for Friday it looks as if it will be quite fresh with some

:12:57.:12:59.

showers around across the Northwest, drier and brighter elsewhere but

:13:00.:13:02.

some sunshine but by the afternoon though showers will become more

:13:03.:13:06.

widespread, there will be some decent sunny spells around the

:13:07.:13:11.

sheriffs, temperatures holding on maybe 17-19dC. For the weekend, a

:13:12.:13:16.

very similar story, sunny spells, feeling fresher. After forecast for

:13:17.:13:19.

very similar story, sunny spells, now. Thank you very much.

:13:20.:13:20.

That's all from Reporting Scotland tonight.

:13:21.:13:22.

There are bulletins from 6:25 tomorrow morning, during Breakfast.

:13:23.:13:24.

From all of us here on the late team, a very good night to you.
