he can't be released until he's no

John Warboys is about to be freed
after less than ten years. So the | 0:03:10 | 0:03:14 | |
key question for the three members
of the Parole Board was, is John | 0:03:14 | 0:03:19 | |
Warboys still a danger to women? In
ruling that he should be released | 0:03:19 | 0:03:25 | |
they must have decided that he isn't
a danger, but they haven't made | 0:03:25 | 0:03:27 | |
public their reasons for freeing a
man suspected of being one of the | 0:03:27 | 0:03:31 | |
most prolific sex offenders of
recent years. The Parole Board is | 0:03:31 | 0:03:34 | |
not legally allowed to give reasons
for its decision, but the chair of | 0:03:34 | 0:03:39 | |
the board did give this explanation.
What's important to understand is | 0:03:39 | 0:03:44 | |
that the Parole Board's duty is not
took in a sense have another go at | 0:03:44 | 0:03:49 | |
the trial, but to assess what his
risks will be going forward and | 0:03:49 | 0:03:55 | |
that's what they did. At his trial,
John Warboys was only convicted of | 0:03:55 | 0:04:01 | |
attacking 12 women and only one of
those convictions was for rape, so | 0:04:01 | 0:04:05 | |
the judge set a minimum sentence of
eight years which means the Police | 0:04:05 | 0:04:09 | |
and Crime Panel seclusion service
are now being asked why they didn't | 0:04:09 | 0:04:12 | |
bring further cases. The Parole
Board has also had to apologise | 0:04:12 | 0:04:16 | |
because several of John Warboys'
victims had not been told of the | 0:04:16 | 0:04:20 | |
decision to release him before it
became public yesterday. This is | 0:04:20 | 0:04:24 | |
perhaps a reflection of the way in
which women who are victims of rape | 0:04:24 | 0:04:30 | |
are treated generally and until the
criminal just is agencies get this | 0:04:30 | 0:04:37 | |
right we've got a crisis in this
country around it. The Warboys case | 0:04:37 | 0:04:42 | |
has highlighted flaws in the
criminal justice system from the | 0:04:42 | 0:04:45 | |
start. Initially the police failed
to investigate it properly. Then | 0:04:45 | 0:04:49 | |
only 12 cases were brought to trial,
even though there were ultimately | 0:04:49 | 0:04:54 | |
suspicions of over 100. And now a
man who a judge said shouldn't be | 0:04:54 | 0:04:57 | |
released until he's no longer a
threat is about to walk free from | 0:04:57 | 0:05:02 | |
prison after ten years. Daniel

What are the legal options? The only
mechanism for challenging is by way | 0:05:15 | 0:05:20 | |
of judicial review. Technically any

authority can be challenged by way

argued it was unlawful. Here it will

tribunal could have come to this
decision, but the problem here is a | 0:05:30 | 0:05:34 | |
practical one. We don't know the
reasoning here, so it's a difficult | 0:05:34 | 0:05:40 | |
challenge, but there may be a way of
doing that. We are also looking at | 0:05:40 | 0:05:44 | |
the result of the story at reform of
the Parole Board itself, its | 0:05:44 | 0:05:49 | |
decisions are made in secret if you
like in private, the chair of the | 0:05:49 | 0:05:52 | |
board, Nick Hardwick, favours, in
fact is he wants a public | 0:05:52 | 0:05:55 | |
consultation on whether this should
be opened up, whether justice should | 0:05:55 | 0:05:59 | |
not only be done but seem to be
done. It's opened to the public for | 0:05:59 | 0:06:03 | |
instance in Canada. There are cost
of locations, there are implications | 0:06:03 | 0:06:06 | |
for victims perhaps having to relive
their experience -- there are cost | 0:06:06 | 0:06:11 | |
implications. And also whether the
victims knew this would be public | 0:06:11 | 0:06:14 | |
and allow the case to be assessed
for risk. The critical thing is | 0:06:14 | 0:06:21 | |
kabaddi further charges, I think
that's very difficult. It's not | 0:06:21 | 0:06:24 | |
entirely impossible. There are
issues about the passage of time, | 0:06:24 | 0:06:27 | |
about the effect of the publicity in
the original trial that might have | 0:06:27 | 0:06:32 | |
on victims, but the CPS remain under
a duty to consider any evidence that | 0:06:32 | 0:06:39 | |
the police provide to them to look
at charging, and if there's a | 0:06:39 | 0:06:42 | |
realistic prospect of conviction

the industry say confusion over

harm by encouraging drivers to hang

In the end, it was one heavy blow

then cardboard on the outside to

you do separate them, then you can

We have the capacity to recycle

reality is we are only doing a

apply to us. It's not about

having the cups themselves to

I'm not afraid to use it. Waste
