Sarah Ewart's situation brought the abortion laws into sharp focus. A | :01:11. | :01:17. | |
scan showed her baby had a fatal foetal knock abnormality and she | :01:18. | :01:21. | |
travelled to England for a termination. She could not legally | :01:22. | :01:26. | |
have one here. That prompted a public consultation on abortion. The | :01:27. | :01:29. | |
Department of Justice propose that fatal foetal abnormality be included | :01:30. | :01:34. | |
in the limited circumstances where abortions can take place. The | :01:35. | :01:37. | |
Northern Ireland Human Rights Commission took a judicial review | :01:38. | :01:40. | |
saying that the department did not go far enough. It wanted to include | :01:41. | :01:45. | |
pregnancies that result from rape or incest as well. In his ruling the | :01:46. | :01:49. | |
judge concluded that the law as it stands reaches the human rights of | :01:50. | :01:53. | |
women whose babies could not survive outside the womb and those who are | :01:54. | :02:18. | |
pregnant as a result of a sex crime. Sarah Ewart's mother was in court. | :02:19. | :02:20. | |
Probably for a lot of women like Sarah it is not polite but sheer | :02:21. | :02:23. | |
belief that they are going to get the medical help at long last and | :02:24. | :02:26. | |
they can move on with their families. Just have the right | :02:27. | :02:28. | |
medical treatment that they need. The Department of Justice has | :02:29. | :02:30. | |
recognised that in cases of foetal abnormality they want to bring | :02:31. | :02:32. | |
forward legislation. They had canvassed the issue on sexual crimes | :02:33. | :02:35. | |
but decided not to. It is not a big step for them now to decide on the | :02:36. | :02:37. | |
site -- circumstances of the judgment to legislate for the | :02:38. | :02:39. | |
victims of sexual crimes. These women are victims but we cannot make | :02:40. | :02:42. | |
a victim out of the numbered child by destroying its life. We must | :02:43. | :02:45. | |
provide care and support for those women, destroying an unborn child in | :02:46. | :02:50. | |
these circumstances is still wrong. Some say the assembly should have | :02:51. | :02:54. | |
privacy in these matters, point addressed by the High Court judge. | :02:55. | :02:58. | |
Mr justice Horner said that given the Northern Ireland Executive is | :02:59. | :03:02. | |
unlikely to address this matter in the foreseeable future and given | :03:03. | :03:17. | |
that Northern Ireland citizens are entitled to have their rights | :03:18. | :03:19. | |
protected by the courts, there was a need for a change to the law as it | :03:20. | :03:22. | |
stands. This ruling marks a considerable step towards a | :03:23. | :03:24. | |
relaxation of abortion laws relating to sexual crimes and fatal foetal | :03:25. | :03:26. | |
abnormality but it will take a further court hearing in two weeks' | :03:27. | :03:28. | |
