has lost its appeal in a discrimination case. | :00:00. | :00:16.
The judges agreed it was wrong for the firm to refuse to make | :00:17. | :00:20.
a cake with a decoration that supported same-sex marriage | :00:21. | :00:22.
even if the statement was against their beliefs. | :00:23. | :00:23.
BBC Newsline's Tara Mills was in the court. | :00:24. | :00:28.
The argument over this image on a cake has lasted | :00:29. | :00:31.
over two years and cost hundreds of thousands of pounds. | :00:32. | :00:33.
But of course, this court battle has been about much more than a cake. | :00:34. | :00:37.
Last year, a court found the owners of the bakery had | :00:38. | :00:39.
discriminated against Gareth Lee by refusing to make it. | :00:40. | :00:42.
They arrived at court hoping for a favourable outcome | :00:43. | :00:45.
but the judges rejected their appeal. | :00:46. | :00:49.
The judges said just because they were going to put | :00:50. | :00:51.
the message on the cake, it did not mean they believed | :00:52. | :00:54.
in the same way that if they baked a Halloween cake, | :00:55. | :00:59.
it did not mean they believed in witches. | :01:00. | :01:02.
We would not decorate a cake with a pornographic picture | :01:03. | :01:04.
We would not even decorate a cake with a cruel | :01:05. | :01:09.
because to do so would be to endorse and promote it. | :01:10. | :01:15.
The court said the commission gave the impression it was not interested | :01:16. | :01:19.
in assisting the faith community in issues like this. | :01:20. | :01:23.
Well, I think a lot of people agree with that today | :01:24. | :01:26.
and that is certainly how we felt. | :01:27. | :01:29.
The customer who took the original case has remained publicly silent | :01:30. | :01:31.
throughout, but today he briefly spoke to the assembled media. | :01:32. | :01:36.
The only thing I would like to say is that I am relieved but also very | :01:37. | :01:40.
grateful to the Court of Appeals for the judgment, | :01:41. | :01:44.
Relief as well from the Equality Commission, | :01:45. | :01:49.
It said unequivocally faith is important | :01:50. | :01:55.
but it cannot set aside the equality legislation | :01:56. | :01:57.
The Appeal Court judges said the company was | :01:58. | :02:03.
In other words, they could not pick and choose which | :02:04. | :02:13.
So, what are the wider ramifications? | :02:14. | :02:18.
Like the case itself, it depends what side you ask. | :02:19. | :02:22.
For so many LGBT people across Northern Ireland these have | :02:23. | :02:25.
People have been contacting us about going to a local restaurant, | :02:26. | :02:30.
booking hotel rooms and whether or not they can | :02:31. | :02:33.
participate in society and it will be a great of relief | :02:34. | :02:35.
for the community across Northern Ireland today. | :02:36. | :02:39.
What about the Catholic baker asked to produce a cake with a message | :02:40. | :02:43.
supporting abortion, does he have to do it? | :02:44. | :02:46.
What about a Muslim printer asked to print cartoons of Muhammad? | :02:47. | :02:50.
Does he have to because of this ruling? | :02:51. | :02:54.
These are serious issues and the court has thrown | :02:55. | :02:56.
The couple walked away from court today | :02:57. | :03:00.
but it is not clear if that is the end of it. | :03:01. | :03:03.
They could decide to make a further appeal to the House of Lords. | :03:04. | :03:10.
Earlier on BBC Newsline, I spoke to the legal affairs | :03:11. | :03:13.
The cushions of. A pathetic and open du | :03:14. | :03:27.
to be? To take the -- how specific and open? I think a Islam printer | :03:28. | :03:39.
would have to print anything lawful that a customer asked them to do. It | :03:40. | :03:42.
does not follow that a bigger has to put anything on a cake, despite what | :03:43. | :03:47.
the couple were seen today. We understand they have stopped making | :03:48. | :03:50.
cakes to order, apart from birthday cakes, which are pretty safe. If you | :03:51. | :03:55.
only make birthday cakes, there is no problem. It is if you say you're | :03:56. | :03:58.
going to make custom made cakes and the customer can order whatever he | :03:59. | :04:02.
or she likes on it, that is what you have to do. | :04:03. | :04:14.
But if you say you're not going to make this book takes a toll, there | :04:15. | :04:18.
is no problem. If the couple but on the big riches to take this further, | :04:19. | :04:21.
what options are open to them? The only court they could go to now is | :04:22. | :04:24.
the United Kingdom Supreme Court in London, which has replaced the House | :04:25. | :04:26.
of Lords, and you need permission either from the court in Belfast or | :04:27. | :04:30.
the Supreme Court itself. There may be technical problems, because this | :04:31. | :04:34.
was a special type of appeal to the court in Belfast. It is what is | :04:35. | :04:38.
called an appeal by way of case stated, which means the district | :04:39. | :04:41.
judge as the number of questions to the appeal judges and was told she | :04:42. | :04:47.
had got it right. That may make it difficult on technical grounds, it | :04:48. | :04:49.
is just possible the Attorney General could challenge the | :04:50. | :04:54.
decision. He lost all so today. He argued that the Stormont did not | :04:55. | :04:59.
have the power to make this legislation, it was itself | :05:00. | :05:02.
discriminatory. That was thrown out, but he made payable to appeal. The | :05:03. | :05:06.
real question is money. If the Christian Institute, which has been | :05:07. | :05:09.
supporting the degree, going to be able to afford the risk of appeal | :05:10. | :05:14.
and the risk of paying Mr Lee's costs in the event that the court | :05:15. | :05:16.
rejects the appeal? The First and Deputy First Ministers | :05:17. | :05:19.
say there was widespread agreement that Northern Ireland is facing | :05:20. | :05:22.
"unique circumstances" The leaders of all the devolved | :05:23. | :05:25.
administrations met at Number Ten. Our Political Editor Mark Devenport | :05:26. | :05:29.
reports from Westminster. If there is a new broom at Downing | :05:30. | :05:40.
Street and quite a lot of tidying up to do in the wake of the Brexit | :05:41. | :05:44.
decision. Stormont's leaders used today's meeting to raise their | :05:45. | :05:48.
concerns about the movement of people and goods across the border | :05:49. | :05:52.
after the UK leads the EU. There will be more discussions, but as the | :05:53. | :05:57.
talking goes on, the moment when the Prime Minister will formally trigger | :05:58. | :06:00.
the UK's departure gets closer. I think she has made it clear that she | :06:01. | :06:05.
wants to go forward into negotiations with the European Union | :06:06. | :06:08.
was an understanding and with sure knowledge as to how it is going to | :06:09. | :06:11.
impact the whole of the United Kingdom. I very much welcome that, | :06:12. | :06:15.
because what we want to see after we exit the EU is a United Kingdom that | :06:16. | :06:20.
works for everybody. The test will be how this Prime Minister deals | :06:21. | :06:24.
with the issues of concern that we have raised through what will be a | :06:25. | :06:29.
very, I suppose, historic negotiation. That test has yet to be | :06:30. | :06:34.
accomplished. It is a complex balancing act. The Scottish First | :06:35. | :06:38.
Minister, Nicola Sturgeon, wants to stay in the European single market. | :06:39. | :06:42.
She will be keeping a close eye on a flexibility is offered Northern | :06:43. | :06:46.
Ireland and demanding equal treatment. The position of Northern | :06:47. | :06:49.
Ireland will be a particular position because Northern Ireland | :06:50. | :06:52.
will be the one part of the UK with a land border with a country that | :06:53. | :06:56.
will be remaining inside the European Union. And so it is in... | :06:57. | :07:01.
Given that fact, there is goodwill and a good spirit from both this | :07:02. | :07:06.
government and the Republic of Ireland government to ensure that | :07:07. | :07:08.
arrangements put in place in the future do not entail a return to | :07:09. | :07:13.
borders of the past. We want this to strengthen the United Kingdom, | :07:14. | :07:16.
strengthen those very special bonds that bind together each of the | :07:17. | :07:20.
different nations, and have that at the heart of the government. Over | :07:21. | :07:26.
the next few months, the Brexit secretary, David Davis, will chair | :07:27. | :07:29.
meetings in Edinburgh, Cardiff and Belfast, working through the | :07:30. | :07:32.
nitty-gritty of her leaving the EU will impact on each region. The | :07:33. | :07:37.
first and Deputy First Ministers say they have heard UK ministers | :07:38. | :07:42.
acknowledge Northern Ireland unique circumstances. Now, in the months | :07:43. | :07:45.
ahead, they want the UK Government's actions to match those words. Mark | :07:46. | :07:50.
Devenport, BBC Newsline, Westminster. A man is in a critical | :07:51. | :07:59.
condition after being knocked down in Consett iron earlier this | :08:00. | :08:01.
evening. -- in County Tyrone. Two men and a woman have been | :08:02. | :08:04.
arrested in Belfast during a police investigation into dissident | :08:05. | :08:07.
Republican activity. Items were recovered | :08:08. | :08:08.
following searches at Hamill Street and Foxes Glen in | :08:09. | :08:10.
the west of the city. The GAA has a revised development | :08:11. | :08:13.
plan for Casement Park in Belfast. It's ditched the 38,000-seater idea | :08:14. | :08:15.
for a smaller stadium which it hopes will get | :08:16. | :08:18.
the approval from local residents. BBC Newsline's Mark | :08:19. | :08:21.
Simpson reports. It is still a big stadium, | :08:22. | :08:24.
but rather than having room the proposed new Casement Park | :08:25. | :08:27.
will have a capacity of 34,500 fans. It is a change, and it is not | :08:28. | :08:35.
the only one the GAA has planned. We have included terracing capacity | :08:36. | :08:41.
of 8,500, so the GAA has set aside its ambition for | :08:42. | :08:44.
an all-seated facility. We have done that because we wanted | :08:45. | :08:47.
to listen to the community, to address their concerns | :08:48. | :08:51.
on the scale, height and mass and we genuinely believe | :08:52. | :08:54.
that this is the day that will be seen as the GAA | :08:55. | :08:56.
signalling its willingness to listen and we still believe | :08:57. | :09:09.
we have an iconic facility there were concerns over | :09:10. | :09:12.
the emergency exits. But the GAA says they believe safety | :09:13. | :09:16.
experts will approve the new design. We have a high level of confidence | :09:17. | :09:26.
that they will sign this off in terms of being a vehicle | :09:27. | :09:29.
that is suitable for achieving the save capacity, | :09:30. | :09:31.
and in time we will apply to Belfast City Council | :09:32. | :09:34.
for a safety certificate. They got it wrong last | :09:35. | :09:35.
time, but have they got | :09:36. | :09:37.
it right this time? The first application was too big, | :09:38. | :09:39.
I agree, the stadium was too big. This is a real no-brainer | :09:40. | :09:42.
and you can see the massive positive impact it is going | :09:43. | :09:45.
to have in the whole area. For me, the community impact | :09:46. | :09:47.
is more important than the fact you have got | :09:48. | :09:49.
a stadium for a few games a year. have been invited to give their view | :09:50. | :09:53.
on the plans and that is expected | :09:54. | :09:56.
to happen later this week. The previous plan for a new stadium | :09:57. | :09:58.
ended up in the courts The GAA are hoping that this | :09:59. | :10:01.
time will be different and that the new Casement Park | :10:02. | :10:05.
will be open by the summer of 2020. Passengers on a flight from Belfast | :10:06. | :10:14.
to the US which had to make | :10:15. | :10:17.
an emergency landing in Shannon are staying there | :10:18. | :10:19.
overnight in hotels. They'll continue their journey | :10:20. | :10:21.
tomorrow. from the International Airport | :10:22. | :10:23.
to Newark, touched down safely. The pilot declared an emergency | :10:24. | :10:27.
not long after take-off. Our reporter David Maxwell reports | :10:28. | :10:29.
from Belfast International. United operate one flight per day | :10:30. | :10:31.
from here to Newark. This morning, that flight | :10:32. | :10:33.
took off shortly before 11:20am. It had 121 passengers | :10:34. | :10:36.
and nine crew on board. it developed a mechanical | :10:37. | :10:38.
issue to do with landing gear. An emergency was declared and that | :10:39. | :10:50.
flight headed towards Shannon Before it got there, | :10:51. | :10:52.
it spent some time at high altitude before conducting a low flight | :10:53. | :11:01.
over Shannon airport That allowed people on the ground | :11:02. | :11:04.
to observe the aircraft and make sure everything was OK before | :11:05. | :11:09.
it made a final approach and landed safely | :11:10. | :11:11.
shortly before 2:30pm. Those passengers are | :11:12. | :11:13.
still have to get to Newark. United Airlines say | :11:14. | :11:19.
they are providing and have apologised for any | :11:20. | :11:21.
inconvenience caused today. David Maxwell, | :11:22. | :11:24.
Belfast International Airport. a 30 for a new swimming pool has | :11:25. | :11:45.
been put on hold while there is public consultation. Swimming clubs | :11:46. | :11:51.
are among those concerned about the design capacity. There will be more | :11:52. | :11:53.
on that in the morning. Now, with the weather forecast, | :11:54. | :11:55.
here's Angie Philips. It has been a start to the weekend | :11:56. | :12:02.
it is not looking particularly unsettled for much of the week | :12:03. | :12:07.
ahead. Brighty to begin with, but the winds will turn around and the | :12:08. | :12:11.
West. It becomes a bit more mobile may be gone. A bit more cloud and | :12:12. | :12:15.
breeze. Still not an awful lot of rain. Today, the winds have been a | :12:16. | :12:20.
life with cloud bubbling up. That melt away through the course of the | :12:21. | :12:24.
night, and as it does the temperatures and started to fall, | :12:25. | :12:26.
particularly in the countryside. Slightly below freezing in some | :12:27. | :12:29.
rural areas, giving us quite a bit of frost and some patches of mist | :12:30. | :12:33.
and fog, particularly across the size and into parts of the West. For | :12:34. | :12:38.
tomorrow, not a bad day. Dry, from sunshine coming through. But if you | :12:39. | :12:45.
do have the mist and fog, it is a cold start and it could take a | :12:46. | :12:50.
little while before it starts to left and the sun went through. If | :12:51. | :12:52.
fair amount of sunshine across the Republic and much of Scotland, | :12:53. | :12:54.
Northern England. Cloudier skies, and a few showers to begin with | :12:55. | :12:58.
across the South of England and the size of Wales. Starting today per | :12:59. | :13:01.
away. Not too chilly. Some of that cloud starts to move up into the | :13:02. | :13:04.
Republic of Ireland into the afternoon. I think we will find that | :13:05. | :13:08.
the sunshine becomes a bit easier in Northern Ireland through the | :13:09. | :13:11.
afternoon, with some high cloud edging in. | :13:12. | :13:21. |
