huge tree branch fell on them. The ruling today clears the | :01:04. | :01:07. | |
National Trust of blame and means not a penny in compensation will be | :01:07. | :01:11. | |
paid to the families. They had claimed the tree had not been | :01:11. | :01:14. | |
properly maintained. Daniel Mullinger was killed instantly and | :01:14. | :01:19. | |
Harry Bowen was seriously injured and now uses a wheelchair. It all | :01:19. | :01:22. | |
happened during a school trip from West Bergholt, in Essex, to | :01:22. | :01:28. | |
Felbrigg Hall, in Norfolk, in 2007. Ten children from Heathlands | :01:28. | :01:31. | |
Primary School were on the Monster trail in the Great Wood on the | :01:32. | :01:35. | |
Felbrigg estate. It began to rain and they sheltered beneath a tree. | :01:35. | :01:39. | |
A massive branch from the ancient beech tree crashed to the ground. | :01:39. | :01:43. | |
11-year-old Daniel Mullinger, trapped beneath it, died instantly. | :01:43. | :01:48. | |
Three of his companions were seriously injured and traumatised. | :01:48. | :01:50. | |
The following year, 12-year-old Harry Bowen, who suffered serious | :01:50. | :01:54. | |
pelvic and internal injuries, attended Daniel's inquest. The | :01:54. | :01:57. | |
class teacher said she had heard a noise like the creaking of a door | :01:57. | :02:01. | |
in a scary movie before the branch fell. The coroner heard claims from | :02:01. | :02:05. | |
an independent expert that the tree had been in a poor condition. Last | :02:05. | :02:09. | |
month, Harry, now 15, was at the High Court, as the four families | :02:09. | :02:13. | |
jointly sued the National Trust. They claimed it had failed to take | :02:13. | :02:16. | |
reasonable care for the safety of visitors. Their compensation claim | :02:16. | :02:19. | |
was aimed at providing Harry with the care and support he needs for | :02:19. | :02:29. | |
:02:29. | :02:32. | ||
the rest of his life. In his judgment and, the judge said there | :02:32. | :02:35. | |
were a quarter of a million trees here and the beech tree had been | :02:35. | :02:39. | |
inspected five months earlier and was not a cause for concern. This | :02:39. | :02:44. | |
was a mistake, but there was no such thing as a completely safe | :02:44. | :02:48. | |
tree. This was an art, not a science and the trust was 9th and | :02:48. | :02:53. | |
negligent or in breach of its duty, in he his opinion -- was neither | :02:53. | :02:56. | |
negligent. After the ruling, the families issued a statement through | :02:56. | :03:04. | |
their solicitors. This remains a very personal tragedy for the four | :03:04. | :03:08. | |
families involved. The judge said the claimants had suffered grievous | :03:08. | :03:11. | |
loss and injuries. And that the branch fell as the children stood | :03:11. | :03:13. | |
beneath it was the cruellest coincidence. | :03:13. | :03:16. | |

Felbrigg Hall. But first, with thousands of people visiting parks | :03:18. | :03:22. | |
and gardens, is there anything that can be done to protect against the | :03:22. | :03:27. | |
risk of falling trees? Alex Dunlop has this report. | :03:27. | :03:32. | |
Our region is home to the country's largest low lying pine forest. But | :03:32. | :03:34. | |
the Forestry Commission, which manages Thetford Forest, knows that | :03:34. | :03:37. | |
the safety of those who play among its branches, or relax below, lies | :03:37. | :03:45. | |
largely on its shoulders. This but he has become detached from the | :03:45. | :03:49. | |
tree. Cue Martin Webb. His job is to make sure trees here are not a | :03:49. | :03:56. | |
danger to the public. We have a duty of care for the trees on our | :03:56. | :04:02. | |
estate. And so we inspect them. And we have a system so that if a tree | :04:02. | :04:06. | |
is beside a public road or a right of way or Ripley area, we inspect | :04:06. | :04:09. | |
that annually. Those visiting Thetford Forest this afternoon | :04:09. | :04:12. | |
seemed unaware of the potential dangers of the overhead canopy. | :04:12. | :04:16. | |
come here all the time and it never crosses my mind, I always feel safe. | :04:16. | :04:21. | |
In never worries me, I always feel very safe in trees. The death of | :04:21. | :04:23. | |
Daniel Mullinger at Felbrigg Hall was described as a cruel | :04:24. | :04:26. | |
coincidence. But just four weeks ago, 13-year-old Sophie Howard was | :04:26. | :04:29. | |
also killed by a falling branch at a playground in Yaxley, near | :04:29. | :04:31. | |
Peterborough. Landowners like the Forestry Commission and the | :04:31. | :04:33. | |
National Trust are legally required to ensure that visitors are | :04:34. | :04:43. | |
reasonably safe and that risks are reduced as far as is practicable. | :04:43. | :04:47. | |
Even small-scale events like this court should trial in Norfolk have | :04:47. | :04:52. | |
to ensure the safety of visitors -- sculpture trail. Organisers spend | :04:52. | :04:57. | |
money on public liability insurance. We tried to make sure that if there | :04:57. | :05:03. | |
are risks for people, we try to eradicate them as much as possible. | :05:03. | :05:08. | |
It will be it of course impossible to get rid of them all those. | :05:08. | :05:13. | |
Independent risk assessors can be called in, because insurance | :05:13. | :05:18. | |
companies demand it. Be it enables organisations to identify the | :05:18. | :05:22. | |
hazards associated with their premises and also to ensure that | :05:22. | :05:26. | |
the correct controls are in place to implement the risk assessments | :05:26. | :05:33. | |
correctly. Some would argue that health and safety can go too far, | :05:33. | :05:36. | |
such as the proposal in this town to ban hanging baskets for fear | :05:36. | :05:39. | |
they could topple over. But tragic events such as the death of Daniel | :05:39. | :05:43. | |
Mullinger demonstrate the public can be at risk. But organisers can | :05:43. | :05:49. | |
only do so much to protect them. Nick champion, from the National | :05:49. | :05:54. | |
Trust, it is at Felbrigg Hall now. You see the injuries to Harry, is | :05:55. | :06:01. | |
there a moral obligation? Nobody would be human if they did | :06:01. | :06:06. | |
not see that at the heart of this case is a real human tragedy. | :06:06. | :06:16. | |

Daniel lost his life and others were injured. This has been very | :06:16. | :06:20. | |
much a compensation case and it is not about a moral or legal | :06:21. | :06:24. | |
obligation, it is much more complicated. I would wish that | :06:25. | :06:28. | |
everybody could care for Harry in the way he will need in the future, | :06:29. | :06:32. | |
but in terms of legal obligations, the judge found we were not at | :06:32. | :06:36. | |
fault. We heard the expert witness who said the tree was in poor | :06:36. | :06:42. | |
condition, would you go along with that? | :06:42. | :06:47. | |
It is a matter of measuring of the risk. If that had been in a high | :06:47. | :06:50. | |
usage so and that many more thousands were walking underneath | :06:50. | :06:55. | |
it each year, it would have been tagged -- usage zone. And work | :06:55. | :07:00. | |
would have been carried out. The judge made doubt have the risk can | :07:00. | :07:05. | |
be measured, quite rightly. Factory was in a lower usage area and when | :07:05. | :07:10. | |
the trail was started, it was moved to engage in usage area. So there | :07:10. | :07:15. | |
was a requirement to inspect it twice a year, and here, it was | :07:15. | :07:20. | |
inspected annually and five months before. Are we are reaching a stage | :07:20. | :07:23. | |
where the only way to keep people save is to stop them going into | :07:23. | :07:30. | |
woodland? When you say truly safe, that is | :07:30. | :07:35. | |
interesting. We welcome 23 million people to our countryside | :07:35. | :07:38. | |
properties each year and the recent interest from the public about | :07:38. | :07:42. | |
government plans to sell off the forest means access to the | :07:42. | :07:46. | |
countryside and to nature and trees in particular are very important to | :07:46. | :07:50. | |
many people. We would hate to not be able to welcome people to our | :07:50. | :07:54. | |
properties and countryside. We have to measure that risk and mitigate | :07:55. | :07:59. | |
as far as we possibly can to ensure the safety of people in terms of | :07:59. | :08:04. | |
our duty of care. But we can never guarantee safety. And have you made | :08:04. | :08:10. | |
changes since the accident? I would treat inspection policy at the time | :08:10. | :08:16. | |
this accident happened was in the process of review -- I would read | :08:16. | :08:22. | |
inspection policy. We are always looking at procedures to see if we | :08:22. | :08:27. | |
can learn from other people and from the wider industry. But many | :08:27. | :08:31. | |
people come to the National Trust for advice about safety so we feel | :08:31. | :08:34. | |
our procedures are robust and comprehensive and the best they can | :08:34. | :08:38. | |

boys, are between four and 14. Today, the judge told him, no doubt | :11:07. | :11:11. | |

on Facebook and through this collective confidence, they were | :11:44. | :11:48. | |

throughout. He has, when he was arrested, he branded the | :11:54. | :11:57. | |
allegations against him as ridiculous. And police have said | :11:57. | :12:01. | |
today that by not pleading guilty, he made his victims relive their | :12:01. | :12:05. | |
ordeal in court and that greatly affected not only them but their | :12:05. | :12:10. | |

The system of being able to keep excess payments has been abolished. | :18:41. | :18:46. | |
It will save �2.4 billion a year. The coalition is hoping for a | :18:47. | :18:50. | |
fairer system that will see less people put off work before up -- | :18:50. | :18:56. | |
put off work because they fear losing benefit. But critics fear it | :18:56. | :18:59. | |
will lead to families like this, their benefit has already been | :18:59. | :19:04. | |
reduced not true aim used system but through the review. Their | :19:04. | :19:08. | |
landlord has served them notice and they will be evicted in three weeks. | :19:08. | :19:14. | |
