Shepherd and her six-year-old brother, Bobby, of Horbury near | :01:13. | :01:17. | |
Wakefield, were poisoned while on holiday in Corfu. Today at the High | :01:17. | :01:21. | |
Court Thomas Cook won damages from the Greek hotel where it happened. | :01:21. | :01:25. | |

us the background. So what was today's hearing about? This was | :01:35. | :01:38. | |
essentially a hearing to try and determine which company was | :01:38. | :01:42. | |
responsible for this. We should say that there had been previous trials. | :01:42. | :01:47. | |
A couple of years ago there were seven people. Mac sorry, 11 people | :01:47. | :01:53. | |
stood trial. Three of them were found guilty. This was not about | :01:53. | :01:59. | |
apportioning blame to individuals, it was about the company 's | :01:59. | :02:04. | |
worshipping out -- giving it compensation. The judge found the | :02:04. | :02:07. | |
evidence overwhelmingly on the side of Thomas Cook that he decided that | :02:07. | :02:11. | |
there was no trial. He threw the case out and decided that the Hotel | :02:11. | :02:17. | |
group had to pay compensation, initially of �1 million, to Thomas | :02:17. | :02:22. | |
Cook. He was pretty damning, or pretty conclusive in his verdict. He | :02:22. | :02:28. | |
said, it seems to me on beyond doubt that the room was not safe. The | :02:28. | :02:32. | |
provision of a safe room is an absolute obligation and the fact | :02:32. | :02:35. | |
that it might have been a third-party whose act or omission | :02:35. | :02:39. | |
caused the carbon monoxide leak does not affect the fact that the | :02:39. | :02:44. | |
defendant was in breach of his absolute obligation. There was no | :02:44. | :02:48. | |
doubt in the mind of the High Court that it was the hotel that was | :02:48. | :02:51. | |
responsible, not Thomas Cook, and that they had to pay �1 million | :02:52. | :02:58. | |
compensation. So what happens next? This was an interim payment. Thomas | :02:58. | :03:02. | |
Cook is asking for much more. They say that the total cost of this, | :03:02. | :03:06. | |
defending the previous trials, flying people around the world, the | :03:06. | :03:13. | |
cost of the holidays, the PR, is far more than �1 million, they have | :03:13. | :03:16. | |
asked for �5 million. There is the possibility of appeal, but given the | :03:16. | :03:20. | |
strength of the judge's statement you wonder whether that was likely. | :03:20. | :03:26. | |
At the heart of this is the deaths of two children. That must not be | :03:26. | :03:31. | |
forgotten. Thomas Cook issue a statement emphasising that. They say | :03:31. | :03:35. | |
what happened in coffee was a tragedy and the thoughts and | :03:35. | :03:42. | |
sympathies of everyone at Thomas Cook will always be with the family. | :03:42. | :03:51. | |
There was a trial in 2010-2011 which identified those responsible. Thomas | :03:51. | :04:01. | |

described the rescue as "as difficult as they get". Cathy | :04:16. | :04:22. | |

practically fill. This was the result of a torrent of rain. A | :04:34. | :04:39. | |
dramatic rescue of a woman and her two young daughters, caught out as | :04:39. | :04:43. | |
the river rose. You can just see the little ones in the arms of their | :04:43. | :04:52. | |
rescuer. The survivors were just on a small island. Normally we would | :04:52. | :04:55. | |
only ever rescued two people at once, but we brought them all at the | :04:55. | :05:00. | |
same time. We made sure that they were fit and well, tried to get a | :05:00. | :05:05. | |
few smiles out of them, then we went down to rescue the mother. | :05:05. | :05:10. | |
All three were checked by medics and went home safer and wiser. To say | :05:10. | :05:14. | |
that this site is inaccessible is putting it mildly. It is a good, | :05:14. | :05:19. | |
steep half hour walk to the nearest road. Looking at the height of the | :05:19. | :05:23. | |
trees, it is amazing that the helicopter was able to get down into | :05:23. | :05:28. | |
this clearing to do the rescue. As for the river itself, usually it is | :05:28. | :05:32. | |
an easy paddle and scramble over to the island, but that pulse of rain | :05:32. | :05:35. | |
came down the river and transformed it into this torrent that you can | :05:35. | :05:41. | |
see now. The levels have dropped considerably since trapping the | :05:41. | :05:47. | |
family, but the river is still dangerous and conditions and | :05:47. | :05:50. | |
predictable. Something to heed from this is how quickly the river can | :05:50. | :06:00. | |

change from what may look like Cam and benign to a raging torrent. | :06:05. | :06:09. | |
The recent and continuing rain fall are still pouring off the hills and | :06:09. | :06:13. | |

waited too long for Hammerson's to get started. But they admit the | :07:13. | :07:17. | |
decision could mean even more delays while they look for a new investor. | :07:17. | :07:21. | |

into Sheffield. The developers, Hammerson, had grand plans. More | :07:41. | :07:45. | |
than 100 shops, restaurants and entertainment venues. But building | :07:45. | :07:50. | |
work has still not started, five years later. Sheffield City Council | :07:50. | :07:56. | |
is now looking for another developer. There is no time for | :07:56. | :08:02. | |
Sheffield. People do not want to wait any longer. We expect | :08:02. | :08:05. | |
significant interest because there is a great scheme out there to be | :08:05. | :08:08. | |
had. If all had gone to plan this would | :08:08. | :08:12. | |
now be a bustling pedestrian walkway with two floors of brand-new shops, | :08:12. | :08:18. | |
open now for more than a year. Hammerson, who are also behind this | :08:18. | :08:21. | |
development in weeds say that they have worked hard to make Sevenstone | :08:21. | :08:24. | |
work. They see that through this process they have looked at various | :08:24. | :08:34. | |

Sheffield people are disappointed, especially within this area, where | :08:37. | :08:42. | |
shopping is quite difficult. There are places like Bradford that have | :08:42. | :08:45. | |
had to wait for years and years, so the sooner that things start moving | :08:45. | :08:50. | |
the better. And the waiting goes on. The only | :08:50. | :08:55. | |
construction in the area today is here at this bar, which is expanding | :08:55. | :09:02. | |
to include a microbrewery. For the owner, today 's announcement is in | :09:02. | :09:06. | |
fact good news. It could be a blessing in disguise. If we had gone | :09:06. | :09:13. | |
ahead with the original scheme at years ago, we could be faced with a | :09:13. | :09:18. | |
new development. We probably would need to change the use of it | :09:18. | :09:22. | |
slightly, we need much more mixed use, hotels, shops, offices and | :09:22. | :09:26. | |
residential. Whoever does take over Sevenstone, | :09:26. | :09:30. | |
it will not be a quick fix. Negotiations will take at least | :09:30. | :09:34. | |
another 12 months. It will be several years before shoppers can | :09:34. | :09:37. | |
finally splash out. Well, James Vincent is in Sheffield | :09:37. | :09:44. | |
now. A bit of a mess, all of this. Have | :09:44. | :09:48. | |
the council been breathe taking this decision or will Sevenstone never | :09:48. | :09:53. | |
get built? There have been so many false starts on this one that people | :09:53. | :09:55. | |
in Sheffield will be forgiven for thinking that this project might | :09:55. | :10:02. | |
never happen at all. The work was due to start originally in 2006. | :10:02. | :10:06. | |
Investment then stopped after the recession all over the place. The | :10:06. | :10:12. | |
latest date we were told was 2015. Negotiations between Hammerson and | :10:12. | :10:15. | |
the council have broken down. The council will say that they have | :10:15. | :10:19. | |
taken a brave step here in ending their relationship with Hammerson. | :10:19. | :10:23. | |
They said that Hammerson was just not in the position to provide them | :10:23. | :10:26. | |
with what they wanted. But the opposition here, the Liberal | :10:26. | :10:29. | |
Democrats, see that too much time has been wasted and the project | :10:30. | :10:36. | |
should be over by now. Hammerson blame the tough economic climate. | :10:36. | :10:39. | |
How can the council be sure that whoever takes over will not be in | :10:39. | :10:45. | |
the same position? They are not at square one this time. They have the | :10:45. | :10:50. | |
plans and they have to -- and they have the land. They are trying to | :10:50. | :10:56. | |
sell Sheffield over other parts of the country. The Victorian quarter | :10:56. | :11:01. | |
in Leeds are going to be refurbished by Hammerson. The annual report | :11:01. | :11:05. | |
today said that they would invest in Leeds rather than investing in | :11:05. | :11:10. | |
Sheffield. The result on way to go for Sheffield to make sure that they | :11:10. | :11:13. | |
get the right people in. But there are some academics that believe that | :11:13. | :11:19. | |
it is in fact a fairly easy job. is a process that Sheffield City | :11:19. | :11:22. | |
Council have been through with schemes like this many times. There | :11:22. | :11:30. | |
will be confidence in learning what they have to do. I think there are | :11:30. | :11:37. | |
people out there with an appetite for investing in Sheffield. I do not | :11:37. | :11:41. | |
think that Hammerson 's failure to commit is not necessarily a signal | :11:41. | :11:44. | |
that Sheffield is not ready for this, I think it is a signal that | :11:45. | :11:48. | |
Hammerson were not ready for this. They have investment going on in | :11:48. | :11:53. | |
Leeds and other locations and saw her Sheffield needs to look at | :11:53. | :12:02. | |
people who want to invest in the long term. So the project now for | :12:02. | :12:07. | |
the Council and Sheffield as a whole is trying to sell themselves noisy | :12:07. | :12:17. | |

a review of the way that they provide leisure facilities across | :15:55. | :16:00. | |
this part of the district. But one coach who used to use the pool says | :16:00. | :16:07. | |
it will be the young who feel the closure most. For the reality is a | :16:07. | :16:10. | |
disaster because we have no competitive swimming pool. I think | :16:10. | :16:16. | |
the nearest pool is about five miles away. So the club will continue but | :16:16. | :16:19. | |
