on its way to Yorkshire's biggest power station six years ago have had | :01:03. | :01:05. | |
their convictions quashed by the Court of Appeal. The 29 activists | :01:06. | :01:08. | |
were cleared because an undercover policeman's involvement in the | :01:09. | :01:11. | |
protest at Drax near Selby was kept secret. They're now calling for a | :01:12. | :01:16. | |
public inquiry into undercover police work. In a moment we'll get | :01:17. | :01:22. | |
the views of a barrister, but first, Cathy Killick has our top story. | :01:23. | :01:31. | |
It was in 2008 at environmental protesters ambushed a freight train | :01:32. | :01:34. | |
delivering coal to Drax Power Station near Selby. They blocked the | :01:35. | :01:40. | |
line, and 29 activists were later convicted of obstructing railway | :01:41. | :01:43. | |
engines. The group were sentenced at Leeds Crown Court and were given | :01:44. | :01:47. | |
either a conditional discharge or community service. But they didn't | :01:48. | :01:52. | |
know at the time was that their convictions depended on secret | :01:53. | :01:56. | |
evidence from Mark Kennedy. He was an undercover police officer, who | :01:57. | :02:00. | |
had infiltrated their and other campaign groups, even sleeping with | :02:01. | :02:05. | |
some of the women. We have no doubt that this conviction must be | :02:06. | :02:09. | |
quashed. The Appeal Court judge today quashed all convictions | :02:10. | :02:12. | |
because the protesters and their legal teams should have been told | :02:13. | :02:19. | |
about Mark Kennedy's involvement. We feel really pleased to have been | :02:20. | :02:22. | |
able to continue to shine a light on the underhand tactics of undercover | :02:23. | :02:29. | |
police officers. In solidarity of other individuals and groups who | :02:30. | :02:34. | |
have suffered other miscarriages of justice. Mark Kennedy drove the | :02:35. | :02:38. | |
activists to the protest and then left to tip of the transport police. | :02:39. | :02:41. | |
If the protesters had known he was a policeman when he they were tried, | :02:42. | :02:47. | |
you could of duty get them to it. They never got that chance, which is | :02:48. | :02:50. | |
why they have been cleared. The whole experience has left this | :02:51. | :02:53. | |
Greenpeace activists angry. He remains concerned about poorly | :02:54. | :03:00. | |
controlled undercover policing. Essentially, undercover policing is | :03:01. | :03:03. | |
being used to support corporations, to support the police themselves, | :03:04. | :03:10. | |
and rather than protecting citizens from violence and suchlike. What we | :03:11. | :03:15. | |
are calling for much after all these various cases and 11 police led | :03:16. | :03:19. | |
enquiries, is a public inquiry where we get all of this out in the open. | :03:20. | :03:22. | |
Lord Thomas said it was not clear who was to blame for the lack of | :03:23. | :03:29. | |
disclosure, and the failure lay either with the Crown Prosecution | :03:30. | :03:32. | |
Service or Yorkshire police, and one or other of them will have to pay | :03:33. | :03:34. | |
the costs. There are calls now for a judge`led | :03:35. | :03:37. | |
inquiry. We're joined by Simon Perkins, a barrister from Zenith | :03:38. | :03:41. | |
Chambers in Leeds. What are the implications of these protestors | :03:42. | :03:48. | |
being cleared of any charges? Plainly, this discloses that there | :03:49. | :03:52. | |
is a really serious failure of disclosure of relevant information | :03:53. | :03:56. | |
and the Lord Chief Justice spoke about that. Yes, he said there was a | :03:57. | :04:02. | |
complete failure to disclose vital information. Does this open up a | :04:03. | :04:05. | |
wider issue within the police service? In my view, yes. My own | :04:06. | :04:14. | |
opinion practising criminal law is that there are problems with | :04:15. | :04:17. | |
disclosure across the piece, not simply confined to the very serious | :04:18. | :04:21. | |
cases, but always down to what most people would think are fairly minor | :04:22. | :04:27. | |
trials. There are now calls for a public inquiry into undercover | :04:28. | :04:33. | |
policing. Should this happen? A public inquiry is a gift of the | :04:34. | :04:36. | |
government, of course. My own view is that, if there is to be a public | :04:37. | :04:40. | |
inquiry, it should not simply do with disclosure. We have the | :04:41. | :04:48. | |
protocols in place, and they need to bed down. A white inquiry into the | :04:49. | :04:52. | |
standards of the police, because they seem to have disregarded their | :04:53. | :04:58. | |
obligations in this case, this could be useful and address the wider | :04:59. | :05:02. | |
issue of public confidence in the police. So do you need to cast the | :05:03. | :05:09. | |
net wider on this inquiry? Yes, disclosure is important. There are | :05:10. | :05:12. | |
other aspects, such as do they investigate a defendant with an open | :05:13. | :05:19. | |
mind? It is not clear who is to blame on this. Who should foot the | :05:20. | :05:26. | |
bill? In the final analysis, it is just shovelling money within the | :05:27. | :05:30. | |
public purse. My own view is, does it really matter? The wider issue | :05:31. | :05:35. | |
might be, should be legal aid fund be reimbursed? Thank you for joining | :05:36. | :05:41. | |
us. Next tonight, the number of | :05:42. | :05:44. | |
vulnerable adults being abused in Sheffield has increased sharply, | :05:45. | :05:47. | |
according to latest figures. It comes as the council is looking at | :05:48. | :05:51. | |
cutting funding to adult care. So how serious is the problem? In the | :05:52. | :05:55. | |
past year, more than 2,600 incidents were reported to the city's | :05:56. | :05:59. | |
Safeguarding Adults Partnership. That compares to 2,069 the year | :06:00. | :06:05. | |
before ` a 27% increase. The City Council is planning to make cuts of | :06:06. | :06:09. | |
?23 million to adult social care services by April 2015. That's from | :06:10. | :06:17. | |
a total budget of ?127 million. So, will these cuts affect the people | :06:18. | :06:20. | |
these services are there to protect? We sent Ian White to investigate. | :06:21. | :06:32. | |
It is another day helping out at the city farm in Sheffield for Luke. He | :06:33. | :06:37. | |
has learning difficulties and feels happy and safe working here. But, in | :06:38. | :06:41. | |

they don't treat me with respect. It would be nice if people learn to be | :06:51. | :06:59. | |

difficulties. He has suffered years of name`calling and abuse while out | :07:03. | :07:08. | |
in Sheffield. It can get you very upset and angry sometimes. I have | :07:09. | :07:18. | |
had some fairly nasty experiences in my life. I had some girls putting | :07:19. | :07:30. | |
make`up on my face. I talk to people all the time, and many people who | :07:31. | :07:35. | |
have been the victim of a hate crime say they have not been, but then | :07:36. | :07:40. | |
when you talk to them they will talk about how they got spat on, or they | :07:41. | :07:44. | |
were pushed, or someone shouted rude names at them. Then it becomes their | :07:45. | :07:48. | |
everyday experience. Now, adults with dementia and mental health | :07:49. | :07:55. | |
issues can get help at 70 easy to access shops and cafes. Sheffield | :07:56. | :07:59. | |
Council is slashing ?23 million from its adult care budget, leaving many | :08:00. | :08:06. | |
services needing to go. ?23 million is a lot of money to cut from the | :08:07. | :08:13. | |
budget, but we need to, and we will do our best to make sure that people | :08:14. | :08:16. | |
will not suffer, that they will remain independent and safe, and | :08:17. | :08:20. | |
that they get the care and support they need. It looks certain that | :08:21. | :08:27. | |
David will end up relying more on help from the voluntary sector in | :08:28. | :08:32. | |
the future. One mental health charity says the cuts are | :08:33. | :08:35. | |
inappropriate and will end up costing Sheffield Council and the | :08:36. | :08:39. | |

worth of cuts to local bus services in north Yorkshire. That means some | :11:19. | :11:21. | |
routes will be axed altogether. Campaigners say it means elderly | :11:22. | :11:25. | |
people will be left isolated in their local communities. | :11:26. | :11:30. | |

group of protesters hired their own bus today to make sure councillors | :11:34. | :11:37. | |

What does lack of a bus mean to you? It would mean a lot. You go to the | :11:56. | :12:03. | |
doctors, you go shopping. Well, it would mean a big loss. Despite the | :12:04. | :12:11. | |
objections from a packed County Hall at Northallerton, the Conservative | :12:12. | :12:14. | |
controlled north Yorkshire Council said it really had no alternative | :12:15. | :12:18. | |
and it could no longer afford to spend as much on subsidies to bus | :12:19. | :12:22. | |
operators to run largely off`peak loss`making services. What we are | :12:23. | :12:29. | |
trying to do is to stop villages being totally isolated by putting in | :12:30. | :12:34. | |
not even as much as you say, sometimes only one or two days a | :12:35. | :12:39. | |
