We were advised that he would sentence that the court was bound | :02:32. | :02:36. | |
to feel that was the only sentence that could be imposed. That said, I | :02:36. | :02:40. | |
wouldn't have anticipated it would be as much as four years. He was | :02:40. | :02:49. | |

People haven't got big sentences that have done the riots. He gets | :02:54. | :02:59. | |

unconnected crimes in the last few weeks. A man in Lancashire was | :03:03. | :03:06. | |
given four months for stealing a van. A man in Liverpool five-and-a- | :03:06. | :03:09. | |
half years for setting fire to his own business and two charges of | :03:09. | :03:14. | |
fraud and a man in Cheshire got seven years for manslaughter. | :03:14. | :03:18. | |
Yesterday, a Crown Court Judge said the mayhem meant he was unable to | :03:18. | :03:22. | |
consider crimes in isolation. Many others have similar views. | :03:22. | :03:27. | |
these men have been successful in their enterprise to get together a | :03:27. | :03:32. | |
gang in Warrington and or in Northwich, then many other people | :03:32. | :03:36. | |
would have acted in a criminal way, many other people would have | :03:36. | :03:42. | |
resorted to violence, to looting, to theft. Back in the legal world, | :03:42. | :03:45. | |
as the Prime Minister congratulated the judges on their sentencing, | :03:45. | :03:49. | |
other solicitors warn of many problems still to come. | :03:49. | :03:55. | |
Criminal Justice System process isn't governed by a reality TV show | :03:55. | :04:01. | |
where the majority of the vote gets the sentence. It is calibrated by | :04:01. | :04:05. | |
careful, independent judges and magistrates taking into account the | :04:05. | :04:09. | |
particular circumstances of offences. A group has been set up | :04:09. | :04:12. | |
in support of the two men jailed on the very same site that got them | :04:12. | :04:16. | |
into so much trouble in the first place. | :04:16. | :04:21. | |

quickly without the adjournment for reports. That can happen. In some | :04:45. | :04:48. | |
cases, especially where the sentence might be regarded as | :04:48. | :04:52. | |
inevitable, a prison sentence, some judges take the view there is no | :04:52. | :04:55. | |
need therefore to adjourn for reports. Is that fair to the | :04:55. | :05:00. | |
defendants because of course the judicial process still has to take | :05:00. | :05:03. | |
its rightful course? The defence advocate can always apply if there | :05:03. | :05:08. | |
is a psychiatric or a medical or some other special reason, that is | :05:08. | :05:13. | |
an application that will be made and very often heard favourably. | :05:13. | :05:16. | |
What about a barrister looking at other cases, two weeks before the | :05:16. | :05:19. | |
riots somebody was given four months for something similar and | :05:19. | :05:22. | |
now they are getting years. Wouldn't that be part of a | :05:22. | :05:25. | |
barrister's job to put that to the judge? You can't equate like with | :05:25. | :05:30. | |
like. The judge will look at the individual case, individual | :05:30. | :05:35. | |
mitigation and take account of any aggravating features or mitigation. | :05:35. | :05:38. | |
It can't be like-for-like because of the unprecedented situation | :05:38. | :05:41. | |
which surrounded each of these individual acts? These cases are so | :05:41. | :05:46. | |
unusual that it would be wrong to compare and take as an example | :05:46. | :05:52. | |
what's happened in other cases. terms of appeals, we have already | :05:52. | :05:56. | |
heard one of the Facebook people mentioned in Cheshire is going to | :05:56. | :06:00. | |
appeal. We will hear many more. There is a man who could face jail | :06:00. | :06:05. | |
for stealing two scoops of ice- cream. It will cost us a lot as | :06:05. | :06:10. | |
taxpayers? Judges have a difficult job. You have the hang them and | :06:10. | :06:14. | |
flog them brigade. On the other, you have the bleeding heart | :06:14. | :06:22. | |
liberals that want to install a reha billtive type of regime and -- | :06:22. | :06:29. | |

are recognising that these riots are unique and are serious and | :06:46. | :06:49. | |
aggravating feature to the circumstances of any particular | :06:49. | :06:53. | |
individual who is facing a serious criminal charge as a result of | :06:53. | :06:56. | |
their involvement, whatever that may be. In a word, you feel | :06:56. | :07:03. | |
completely at ease, do you, that justice is being done fairly, | :07:03. | :07:07. | |
swiftly and appropriately? system works, yes. Thank you very | :07:07. | :07:09. | |

tonight following the death of a man who was Tasered by police in | :07:12. | :07:18. | |
Cumbria. Officers had been called to a flat near Barrow town centre | :07:18. | :07:20. | |
to investigate reports of a disturbance. At some point they | :07:20. | :07:25. | |
used pepper spray and fired a Taser several times at Dale Burns. The | :07:25. | :07:29. | |
27-year-old collapsed and later died. Friends say they're | :07:29. | :07:32. | |
devastated. The Independent Police Complaints Commission says its | :07:32. | :07:36. | |
investigators are looking into what happened. Here's our Chief Reporter, | :07:36. | :07:46. | |

Dave Guest. The Taser is supposed to disable violent suspects without | :07:46. | :07:50. | |
causing permanent harm. But when Cumbria Police discharged one last | :07:50. | :07:53. | |
night things didn't work out that way. It happened when officers | :07:53. | :07:57. | |
arrived at a flat in the centre of Barrow to investigate reports of a | :07:57. | :08:03. | |
disturbance. A Taser was fired at 27-year-old Dale Burns. He died | :08:03. | :08:07. | |
soon afterwards. I don't know what's happened. I know he's been | :08:07. | :08:10. | |
Tasered for a domestic disturbance, which is a bit over the top. Dale's | :08:10. | :08:15. | |
mum left this tribute at the scene. And at a local gym, where he | :08:15. | :08:19. | |
regularly worked out, friends were in a state of disbelief. I have | :08:19. | :08:24. | |
known him since he was 15. He is one of the nicest lads you will | :08:24. | :08:33. | |
ever meet. Even though I'm 20 years older than him, he was like one of | :08:33. | :08:37. | |
my best friends, he was like my son. There are strict rules governing | :08:37. | :08:42. | |
the use of Tasers. They are capable of delivering a 50,000 volt shock | :08:42. | :08:47. | |
and were introduced in 2004. By last year, in Cumbria Tasers had | :08:47. | :08:52. | |
been drawn more than 100 times. Only discharged on 26 occasions. | :08:52. | :08:57. | |
is important to ensure that Tasers are potentially-lethal and they | :08:57. | :09:01. | |
should only be given to officers who are trained to such high | :09:01. | :09:04. | |
standards. Otherwise there is a potential risk that they could be | :09:04. | :09:09. | |
open to misuse. In a statement, Cumbria Police said that following | :09:09. | :09:12. | |
an incident at this address, a Taser was deployed and a man became | :09:12. | :09:17. | |
ill soon afterwards. He was taken to hospital where he died. They | :09:17. | :09:21. | |
said the matter has now been referred to the Independent Police | :09:21. | :09:24. | |
Complaints Commission and so they can make no further statement at | :09:24. | :09:31. | |
this time. The family of a woman from Wigan | :09:31. | :09:34. | |
are flying out to the Seychelles after her husband was killed by a | :09:34. | :09:39. | |
shark, while on honeymoon there. Ian Redmond from Nelson in | :09:39. | :09:41. | |
Lancashire died after the attack yesterday, while his wife Gemma was | :09:41. | :09:45. | |
sunbathing on the beach. Gemma said her husband was "a remarkable | :09:45. | :09:51. | |

Daresbury is the third for the North West although there won't be | :11:55. | :11:58. | |
any in Lancashire or Cumbria. But will it really provide the jobs | :11:58. | :12:05. | |
today's unemployment figures prove the region desperately needs? This | :12:05. | :12:09. | |
patch of land will David Cameron hopes become a fertile one for job | :12:09. | :12:14. | |
creation. In 20 years' time, it will be home to 10,000 hi-tech | :12:14. | :12:17. | |
science and technology jobs. It is great to come here and see how | :12:17. | :12:21. | |

less regulation, fewer planning restrictions, invest, grow and | :12:47. | :12:50. | |
expand. That will be good for everyone in the North West. Will it | :12:50. | :12:56. | |
be good for people a few miles away in Runcorn? I'm 20 years old, I | :12:56. | :13:02. | |
have been unemployed since I was 17. They are having problems getting | :13:02. | :13:04. | |
enough science and technology students into colleges, we know | :13:04. | :13:11. | |
that. Perhaps this will encourage them. If there were more jobs going, | :13:11. | :13:16. | |
I would go for science. Go and do a college course and get | :13:16. | :13:20. | |
qualifications. Four, five, six jobs created for every job on site | :13:20. | :13:24. | |
will be created off-site. There is a direct benefit to the local | :13:24. | :13:29. | |
economy as a result of that supply chain activity, servicing this site. | :13:29. | :13:37. | |
Today's good news for those at Daresbury meant bad news for Barrow | :13:37. | :13:42. | |
waterfront and BAE Systems sites at Warton and Samlesbury. They were | :13:42. | :13:46. | |

been granted planning permission to create the gas caverns 500 feet | :14:12. | :14:17. | |
below ground next to the Winsford Salt Mine in Cheshire. But miners | :14:17. | :14:21. | |
says they want to be reassured they won't be at risk once the store is | :14:21. | :14:25. | |

We have come from the oldest part of the mine... It takes 15 minutes | :14:32. | :14:38. | |

concern about a fault line in the rock. My main concern is the | :15:14. | :15:17. | |
general safety of the workforce around this area, especially being | :15:17. | :15:22. | |
so close to the gas. The ability to store gas leaves countries less at | :15:22. | :15:27. | |
the mercy of a volatile market. Storage here makes up 4% of | :15:27. | :15:33. | |
national consumption, compared to 23% in France and 19% in Germany. | :15:33. | :15:38. | |
The storage in Cheshire will allow the UK to store 12% of consumption. | :15:38. | :15:41. | |
The mine owners aren't against the store but claim they haven't been | :15:41. | :15:45. | |
consulted about safety. Having a gas facility this close to an | :15:45. | :15:50. | |
active mine is a big concern for us. We have asked repeatedly from the | :15:50. | :15:53. | |
storage energy people to provide us the information they have evaluated | :15:54. | :15:58. | |
to allow us to assess whether or not this gas storage presents a | :15:58. | :16:04. | |
risk to our employees. Safety is the key thing. Store Energy didn't | :16:04. | :16:07. | |
want to be interviewed. They say they have full planning permission | :16:07. | :16:11. | |
for the project and they are happy they have complied with all the | :16:11. | :16:16. | |
relevant authorities. The first of the gas caverns is due to open by | :16:16. | :16:26. | |
