Convictions after a waste ddpot fire that lasted eight weeks. | :00:14. | :00:19.
Two brothers are finally sentenced, after a blaze at their recycling | :00:20. | :00:22.
We have got a pile of waste and there is black smoke | :00:23. | :00:34.
A second report into a child's death at Bristol Children's Hospital | :00:35. | :00:48.
And a much reduced chance of fog tomorrow. The queues at the end of | :00:49. | :01:01.
the programme. Two brothers responsible | :01:02. | :01:04.
for a massive fire at their waste site in Swindon will not be | :01:05. | :01:07.
going to prison. Lee and David Averies had | :01:08. | :01:09.
pleaded guilty to breaching Today, the judge gave one of them | :01:10. | :01:11.
a suspended sentence and banned the other from running a business | :01:12. | :01:15.
for three years. Here is our Wiltshire | :01:16. | :01:17.
reporter, Will Glennon. It spewed noxious smoke | :01:18. | :01:21.
across Swindon for weeks and it burnt for two months, | :01:22. | :01:38.
before it was extinguished. Today, Lee Averies, | :01:39. | :01:40.
who owned and ran the plant with his brother David, | :01:41. | :01:43.
was sentenced in court. They had already pleaded | :01:44. | :01:44.
guilty to being reckless and negligent, causing pollttion | :01:45. | :01:46.
and harm to health. The judge told Lee Averies | :01:47. | :01:56.
that his offences cause significant harm and | :01:57. | :01:58.
disruption and they were serious But he suspended a 12-month | :01:59. | :02:00.
sentence for two years. He did impose a criminal behaviour | :02:01. | :02:12.
order, which effectively bans Lee Averies from the waste hndustry | :02:13. | :02:15.
for five years. His brother David Averies w`s | :02:16. | :02:17.
disqualified as a company dhrector Living with the fire | :02:18. | :02:19.
was horrible for many. Residents had to keep windows | :02:20. | :02:22.
closed, some went to hospit`l. The smell, the smoke, | :02:23. | :02:25.
the burning plastic. It was nauseating. | :02:26. | :02:34.
The smell was horrendous. Having to work with it, | :02:35. | :02:36.
it was really not very pleasant The Environment Agency estilates | :02:37. | :02:43.
there was 10,000 tonnes The Averies had | :02:44. | :02:45.
a permit for half that. There was a fire | :02:46. | :02:48.
at Swindon Skips in 2013. The council has to deal | :02:49. | :02:58.
with the tonnes of rubbish left People are paying good monex | :02:59. | :03:01.
to have their waste taken away by reputable people, | :03:02. | :03:04.
to be dealt with properly and it has just left someone else to ddal | :03:05. | :03:07.
with and put the cost on somebody else - this | :03:08. | :03:10.
time, the public purse. The Averies also own | :03:11. | :03:12.
Calne Aggregates, which was part The Environment Agency is working | :03:13. | :03:21.
to shut it down, too. When the fire was at its hehght | :03:22. | :03:32.
Lee Averies agreed to Here is what he had to say | :03:33. | :03:34.
at the time, when I asked hhm about previous breaches | :03:35. | :03:39.
by his company. I think, to put things | :03:40. | :03:42.
in perspective, there were breaches many years ago and we did h`ve | :03:43. | :03:44.
a fine last year which was for an historic problem back in 2000, | :03:45. | :03:50.
so that was for a half years ago. Obviously we are pleased | :03:51. | :04:00.
that the site is compliant. The fire was the longest th`t Dorset | :04:01. | :04:06.
and Wiltshire Fire Rescue have ever faced and, | :04:07. | :04:09.
earlier, I asked Ian Jeary from the service how diffictlt | :04:10. | :04:11.
it was to get it under control. The fire was very | :04:12. | :04:14.
difficult to control. As the judge said, the mism`nagement | :04:15. | :04:16.
at the site made it much more difficult and dangerous | :04:17. | :04:21.
for the Fire Service We had to work very hard | :04:22. | :04:23.
to move over 3,000 tonnes of waste away from the site. | :04:24. | :04:27.
That was no thanks to the owners. The fire at Marshgate lasted for 57 | :04:28. | :04:30.
days and involved all 24 of its fire It obviously cost | :04:31. | :04:34.
you a lot of money? Yes, we estimate it cost us | :04:35. | :04:38.
in excess of ?157,000. But obviously, there | :04:39. | :04:41.
were other agencies involved, as well, so the total cost | :04:42. | :04:42.
of the operation is in excess of Are you going to try | :04:43. | :04:46.
to recover your costs? The next stage of legal | :04:47. | :04:56.
proceedings is a Proceeds of That has been placed | :04:57. | :04:58.
on the brothers. We will be making sure | :04:59. | :05:02.
that we get our costs back, if Finally, do you feel you have got | :05:03. | :05:05.
the right result today? Most importantly, people | :05:06. | :05:10.
and businesses in Swindon c`n see that when criminals carry ott these | :05:11. | :05:15.
acts without any sort of care for themselves, | :05:16. | :05:18.
others or the environment, The care in a hospital treating sick | :05:19. | :05:20.
children with heart conditions was so far below the expectdd | :05:21. | :05:31.
standard it amounted That is one of the damning | :05:32. | :05:34.
findings of a report into the treatment of four-xear old | :05:35. | :05:38.
Sean Turner from Wiltshire. He died at Bristol | :05:39. | :05:40.
Children's Hospital in 2012. His parents always said that staff | :05:41. | :05:45.
did not have the training Now, a government ombudsman | :05:46. | :05:47.
agrees with them. Sean Turner was a fun-loving | :05:48. | :05:51.
four-year-old boy. He knew about his | :05:52. | :05:57.
own heart condition before his operation at the Bristol | :05:58. | :06:00.
Children's Hospital in 2012. He told his parents he was looking | :06:01. | :06:02.
forward to being able to run around with his friends for longer. | :06:03. | :06:06.
But Sean never came home. We could see that he | :06:07. | :06:10.
was deteriorating. His parents said Sean | :06:11. | :06:12.
was badly dehydrated, taking on water by sucking on wet | :06:13. | :06:15.
wipes and a toothbrush. His parents say that there were too | :06:16. | :06:21.
few staff who did not understand how to help their son, and that | :06:22. | :06:24.
when they complained, the responses were, at best, | :06:25. | :06:26.
inaccurate and misleading. He was grabbing the wet wipds | :06:27. | :06:31.
when I was watching him. He was grabbing the paper towels | :06:32. | :06:35.
and I was trying to cool him down so he had | :06:36. | :06:42.
a temperature and he would suck out Now a new report has | :06:43. | :06:45.
confirmed their fears. The Parliamentary and Health | :06:46. | :06:48.
Service Ombudsman's report about the hospital's high | :06:49. | :06:50.
dependency capabilities, that Sean's fluid levels | :06:51. | :06:54.
weren't monitored properly It calls the failings | :06:55. | :06:55.
in nursing care "systemic". And says that the care for Sean fell | :06:56. | :07:03.
so far below the established good practice that it amounted | :07:04. | :07:06.
to a service failure. It's what we knew, | :07:07. | :07:11.
because it is what we lived. Today, University Hospitals | :07:12. | :07:14.
Bristol apologised. Their chief executive said | :07:15. | :07:20.
he was deeply sorry for failings in care and for the impact they had | :07:21. | :07:23.
on Sean and his family. I am also very sorry | :07:24. | :07:28.
that we compounded their grhef by giving inaccurate | :07:29. | :07:30.
and incomplete responses It is so important to | :07:31. | :07:32.
us to have the truth. This was our little boy | :07:33. | :07:38.
and he was very brave and we have to live | :07:39. | :07:40.
with the guilt that we put him The Turners have been | :07:41. | :07:44.
fighting for four years for recognition that Sean shmply | :07:45. | :07:49.
was not treated properly. Now, the launch of this year's | :07:50. | :08:02.
Poppy Appeal has been marked (Sailors from the Royal Navx warship | :08:03. | :08:05.
HMS Somerset created a human poppy on deck and, | :08:06. | :08:11.
at Cabot Circus in Bristol, West country band The Korgis | :08:12. | :08:14.
entertained, with all the proceeds Now to speedway and | :08:15. | :08:16.
it is congratulations to the Somerset Rebels, | :08:17. | :08:22.
who completed a league and cup double tonight, | :08:23. | :08:24.
by beating Sheffield Tigers Ali Durden has just | :08:25. | :08:26.
sent this report. The Somerset celebrations are | :08:27. | :08:31.
underway, after the Rebels regained Already two points ahead from last | :08:32. | :08:33.
night's away first leg, they beat Sheffield Tigers | :08:34. | :08:40.
comfortably tonight 54-36 And they have just been | :08:41. | :08:42.
presented with the trophy. We missed out last year to Glasgow | :08:43. | :09:13.
by two points. We have got `n inexperienced team, but we have all | :09:14. | :09:15.
worked very well together. The end of another successftl | :09:16. | :09:17.
season for the Rebels. Cup winners two weeks ago, they have | :09:18. | :09:19.
now added the league title to that. Now, we can catch up with the latest | :09:20. | :09:24.
weather outlook, with Ian. We are back with updates | :09:25. | :09:29.
in Breakfast from 6.25am Some decidedly quiet condithons for | :09:30. | :09:48.
the rest of the week and for the rest of the month on a chilly, and | :09:49. | :09:58.
into early November. The odd sunny spell tomorrow. But most | :09:59. | :10:02.
importantly, it will be dry. The last couple of mates have bden | :10:03. | :10:06.
characterised by fog, which has been quite dense in many places. | :10:07. | :10:12.
Overnight in aid, that will tend to be mitigated by the breeze `nd I am | :10:13. | :10:19.
still expecting maybe some hn East Somerset. Either way, temperatures | :10:20. | :10:28.
and dropping below double fhgures. The odd exception in the | :10:29. | :10:32.
countryside. Tomorrow, wherd we have fog, it should clear quicklx. A | :10:33. | :10:41.
filament of greatness alone. If anything, the cloud will increase | :10:42. | :10:48.
into the early afternoon. Btt still some places will get the odd bit of | :10:49. | :10:55.
greatness. Temperatures mild for this time of year, 13-15dC. | :10:56. | :11:01.
fine and dry and on the mild side. My colleague Helen Willetts has with | :11:02. | :11:04.
the national picture. Good evening. The dry October | :11:05. | :11:14.
weather is set to continue into the weekend. It's been kind if you've | :11:15. | :11:18.
been on half term. Not that I'm promising this sort of weather for | :11:19. | :11:22.
all. Isn't it lovely, taken on the Isle of Wight. Our top temperature | :11:23. | :11:27.
was 17 Celsius, not too far away. What a lovely | :11:28. | :11:28. |
