Family of a cyclist killed in Kent demand an apology from the police | :00:07. | :00:10.
Six years of distress, worry, concern. | :00:11. | :00:23.
Confusion in Ukip, as the Kent chair of the party resigns | :00:24. | :00:26.
over the leadership - then says he may not after all. | :00:27. | :00:29.
We'll be live in Sittingbourne with the details. | :00:30. | :00:32.
After a dull start, it brightened up this afternoon, with more sunshine | :00:33. | :00:35.
The family of a cyclist killed in Kent in 2010 say they've suffered | :00:36. | :00:54.
years of distress and anguish trying to get to the bottom of the botched | :00:55. | :00:58.
An earlier Serious Case Review had found that Kent Police officers | :00:59. | :01:02.
failed to fully investigate the crash, but pages had been | :01:03. | :01:06.
redacted which revealed the force breached their duty | :01:07. | :01:09.
Having seen the full report, tonight Marc Dunk's family | :01:10. | :01:13.
Charlie Rose has our exclusive report. | :01:14. | :01:18.
Seven years after their cyclist son Marc was killed in a road crash, | :01:19. | :01:21.
Christine and Tony Elson are finally given the full picture | :01:22. | :01:25.
of the mistakes of Kent Police made during their investigation. | :01:26. | :01:32.
It's taken two years, well, six years in all to get this. | :01:33. | :01:35.
Six years of distress, worry, concern at why | :01:36. | :01:38.
All we wanted to know is how my son died. | :01:39. | :01:45.
Now we find the investigation was totally flawed. | :01:46. | :01:49.
Seen exclusively by this programme, the first half of a serious case | :01:50. | :01:52.
review, which until now had been withheld, describes how | :01:53. | :01:57.
important files were lost, and how this damages the integrity | :01:58. | :02:01.
of the investigation and breaches the duty of the police to recprd, | :02:02. | :02:04.
retain and if necessary reveal matter under the Procedure | :02:05. | :02:07.
Marc Dunk was killed when he was hit by a lorry | :02:08. | :02:23.
A coroner recorded a verdict of accidental death. | :02:24. | :02:29.
But the part of the serious case review published two years ago found | :02:30. | :02:33.
that were missed opportunities in the police investigation, | :02:34. | :02:35.
including a failure to examine the lorry driver's consumption | :02:36. | :02:39.
Tony and Christine went to a tribunal after several attempts | :02:40. | :02:46.
to get the driver's blood test results failed. | :02:47. | :02:57.
Kent Police viewed their requests as vexatious, | :02:58. | :02:58.
The force accepted that the full serious gets reviewed did not | :02:59. | :03:02.
Now it's a matter of making somebody accountable so it doesn't | :03:03. | :03:05.
Even now, they say that it's vexatious in the eyes of the IPCC. | :03:06. | :03:10.
For data protection reasons, they have been denied access | :03:11. | :03:12.
Kent Police said they now accept part of a serious case review | :03:13. | :03:18.
These parts included findings that while officers could have done | :03:19. | :03:23.
more in their enquiries, it was unlikely this | :03:24. | :03:25.
would have changed the outcome of the investigation. | :03:26. | :03:28.
Ultimately, the family want an apology and a full investigation | :03:29. | :03:34.
A man who had part of his ear bitten off and bleach squirted in his face | :03:35. | :03:42.
during an alleged attack in Gillingham has been telling | :03:43. | :03:44.
Ian Hayward claimed he was taunted by his attackers, who held | :03:45. | :03:50.
Two men and a woman are on trial in Maidstone over the incident | :03:51. | :03:55.
in Cavendish Avenue in November last year. | :03:56. | :04:01.
There's confusion in UK Independence Party tonight | :04:02. | :04:03.
after the chairman of the Kent branch of the party told | :04:04. | :04:06.
South East Today he'd had resigned his post after criticising | :04:07. | :04:08.
However it now seems that Richard Palmer is now | :04:09. | :04:15.
It comes in the wake of the county council elections | :04:16. | :04:22.
when Ukip was completely wiped out of councils in the South East. | :04:23. | :04:25.
Our reporter Piers Hopkirk is in Sittingbourne, | :04:26. | :04:26.
where Mr Palmer is set to be the party's candidate | :04:27. | :04:29.
Peirs, this all seems very extraordinary - what's going on? | :04:30. | :04:36.
It increasingly looking like one of the shortest political resignations | :04:37. | :04:43.
in history. Richard Palmer had appeared on a BBC Sunday politics | :04:44. | :04:48.
south-east yesterday, and made some very strident criticism of his party | :04:49. | :04:53.
leader, Paul Nuttall. Criticism is so strong that he felt he really | :04:54. | :04:57.
ought to stand down from his position, which he did. This exactly | :04:58. | :04:59.
what he said yesterday. Do you think Paul Nuttall, | :05:00. | :05:05.
the leader of Ukip, completely ruined this election | :05:06. | :05:07.
for hard-working local I think we should have a different | :05:08. | :05:09.
leadership team at the top. Some tough words about. What | :05:10. | :05:25.
happened next? Paul Nuttall heard of his resignation, so he rang up | :05:26. | :05:29.
Richard Palmer and tried to dissuade him. He told him Ukip is a party | :05:30. | :05:35.
that allows dissent, so you're not duty-bound to stand down and resign. | :05:36. | :05:40.
I spoke to Richard Palmer tonight. He told me he was very pleased to | :05:41. | :05:44.
talk to Paul Nuttall, that he would take some time to reflect. But he | :05:45. | :05:50.
said he would now more than likely continue as Kent's Ukip chav. -- as | :05:51. | :05:56.
Kent Ukip's chair. Well, you can find out more | :05:57. | :06:01.
about the election on our website. A full list of candidates standing | :06:02. | :06:03.
will be announced once nominations A mural by the high profile graffiti | :06:04. | :06:06.
artist Banksy that has recently appeared in Dover is drawing huge | :06:07. | :06:11.
attention in the town. It depicts the flag | :06:12. | :06:13.
of the European Union, with a workman chiselling off one | :06:14. | :06:15.
of the stars. Previous wall art works by Banksy | :06:16. | :06:17.
have been sold for hundreds Scaling new artistic heights | :06:18. | :06:20.
for Dover, from the moment the mural was attributed to the mysterious | :06:21. | :06:24.
Banksy, it became an instant People stepped up to | :06:25. | :06:27.
have their photos taken. Not only is it supremely artistic, | :06:28. | :06:32.
if anything stops people in the street these days | :06:33. | :06:37.
from looking at their telephone and not communicating with each | :06:38. | :06:40.
other, that's got to be good. For Banksy to pay us a visit and put | :06:41. | :06:45.
such a piece here, it's fantastic. God knows Dover needs | :06:46. | :06:49.
a few of those. You can look at it whether he's | :06:50. | :06:55.
thinking about whether the EU should start to break up, | :06:56. | :07:01.
because that first star that's being broken is us, | :07:02. | :07:03.
that's got to be us. Or whether he's thinking about, | :07:04. | :07:06.
well, you know, really should we be Or whether we should stay | :07:07. | :07:09.
as one complete community. His art always provokes | :07:10. | :07:14.
a reaction, and he's no One of Banksy's most famous pieces, | :07:15. | :07:22.
Two Policemen Kissing, was painted on a pub wall | :07:23. | :07:28.
in Brighton in 2004. In August 2010, he claimed | :07:29. | :07:32.
responsibility for a work that appeared on a beach in Saint | :07:33. | :07:35.
Leonards. A a few days later, a mural | :07:36. | :07:37.
of his was ripped from a shipping And this painting was returned | :07:38. | :07:40.
to Folkestone last year after a legal battle over | :07:41. | :07:47.
who owned it. So could his latest work | :07:48. | :07:50.
have a stellar value? I mean, I remember famously | :07:51. | :07:53.
that they tried to advertise a house for sale, and it just wouldn't go | :07:54. | :07:58.
off the market. And when a Banksy mural went | :07:59. | :08:01.
up on the side of it, they advertised it as a mural | :08:02. | :08:04.
by Banksy with a house And the house when for, you know, | :08:05. | :08:07.
probably almost double And that situation could well | :08:08. | :08:11.
be repeated in Dover, as the mural was painted on the side | :08:12. | :08:16.
of a derelict amusement arcade. Well our reporter Jessica Banham has | :08:17. | :08:24.
also been following this So do we now know | :08:25. | :08:26.
who owns the building? We have managed to track down a | :08:27. | :08:39.
member of the family who have confirmed to us they own the | :08:40. | :08:42.
building. They have run several businesses and own property in East | :08:43. | :08:47.
Kent for years, including at one point Dreamland. Interestingly, they | :08:48. | :08:51.
are the same family involved in the legal dispute over the Folkestone | :08:52. | :08:57.
Banksy. One member of the family has spoken to an art dealer, who | :08:58. | :09:01.
believes this work could go for up to ?1 million. He said the building | :09:02. | :09:05.
was due to be demolished, but he will talk to the local council about | :09:06. | :09:09.
what could be done to save it in the future. | :09:10. | :09:12.
Now lets take a look at the weather for the south east | :09:13. | :09:14.
Rachel - any sign of some sunshine soon? | :09:15. | :09:18.
Some sunshine tomorrow and eventually towards the end of the | :09:19. | :09:22.
week temperatures pick up. That goes hand-in-hand with some rain. A | :09:23. | :09:27.
cloudy start. It brightened by the afternoon, still quite cool. The | :09:28. | :09:32.
breeze this afternoon. There has been some brightness around. Through | :09:33. | :09:36.
the week, by Thursday and Friday there will be some rain around, | :09:37. | :09:40.
temperatures creeping up. Tonight by contrast we will be staying dry and | :09:41. | :09:46.
clear. Really, temperatures potentially dropping as low as two | :09:47. | :09:50.
or three degrees, holding up to around five or six in towns and | :09:51. | :09:54.
cities, always milder along the coast. Brightness from the start | :09:55. | :10:00.
tomorrow, by the afternoon more fair weather cloud. Still the call | :10:01. | :10:06.
north-easterly breeze, but the winds easing. Temperatures slightly cooler | :10:07. | :10:10.
along the coast, 11 or 12. Further west picking up to around 13, | :10:11. | :10:15.
possibly 14 degrees. Into Wednesday, clearer skies, temperatures really | :10:16. | :10:22.
quite similar to tonight, two three degrees, holding up in towns and | :10:23. | :10:25.
cities to around five or six. Lots of sunshine starting Wednesday, and | :10:26. | :10:30.
by the afternoon a similar story. The area of high pressure stays with | :10:31. | :10:34.
us, then reluctantly south for our weather as we had through the day on | :10:35. | :10:38.
Thursday. And indeed for Friday as well. We will see outbreaks of | :10:39. | :10:42.
rainfall poster, but more persistent rain through the day on Friday. | :10:43. | :10:47.
Towards the weekend as well, further outbreaks of rain but temperatures | :10:48. | :10:51.
eventually are going to be creeping up. Highs by Saturday and Sunday | :10:52. | :10:57.
around 15 degrees. Over the next couple of days, lots of dry weather, | :10:58. | :11:02.
it feels cool, but rain by Thursday. Here is the outlook | :11:03. | :11:03.
will become drier and feel warm. Now the National forecast. | :11:04. | :11:09.
Good evening. A quiet day on the weather front but we still managed | :11:10. | :11:18.
to have some huge contrasts in the weather. This was a beautiful | :11:19. | :11:22.
picture from Cumbria, blue skies and crystal clear blue skies in Argyll | :11:23. | :11:30.
and Bute but closer to the north coast, it sends shivers down your | :11:31. | :11:36.
spine! Chilly and cloudy all along that cost this bank of cloud that | :11:37. | :11:38. |
