When I set off on this three years ago, I hoped I would win. When | :08:40. | :08:45. | |

gobsmacked but delighted. The Duchy Harrad reviewing the tribunal's | :08:50. | :08:55. | |

impacts of an oyster farm, but could be much wider than that. It | :09:55. | :09:59. | |
could go in two aspects of pollution, biological diversity etc. | :09:59. | :10:07. | |
This is quite a breakthrough? Certainly I am sure there are a lot | :10:07. | :10:10. | |
of people because of the extent of the Duchy's Land Holdings, and the | :10:10. | :10:14. | |
extent of the buildings and property, there will be quite a lot | :10:14. | :10:21. | |
of people who have concerns they want to raise, and a lot of | :10:21. | :10:24. | |
environmental factors could be involved. This is potentially quite | :10:24. | :10:28. | |
far reaching and a number of areas. What sort of questions will people | :10:28. | :10:34. | |
be asking? I think in terms of the biological diversity of activities | :10:34. | :10:41. | |
going on on Duchy property, as in this particular case it could be in | :10:41. | :10:45. | |
all the water ways, forests, the impact of buildings built on Duchy | :10:45. | :10:50. | |
land. All these are matters people may be concerned about. They may | :10:50. | :10:55. | |
simply want more information about. Until now they have not had a legal | :10:55. | :11:00. | |
right to get that information. Now they do. How has the Duchy been | :11:00. | :11:05. | |
able to get away with being so secretive Forssell long? What the | :11:05. | :11:10. | |
Duchy argued is that it is not a public authority in the Gulf terms. | :11:10. | :11:16. | |
It argued it was outside the environmental information terms. | :11:16. | :11:22. | |
Now we have had the ruling which says it does count has a public | :11:22. | :11:27. | |
body. It has a very unusual legal status going back hundreds of years. | :11:27. | :11:31. | |
That is why it was not initially clear whether it was a public | :11:31. | :11:37. | |
authority. The tribunal has now decided it is. On the other hand, I | :11:37. | :11:41. | |
expect the Duchy will probably appeal this decision, in which case | :11:41. | :11:45. | |
it will go to a higher court. It could be several months before we | :11:45. | :11:51. | |
actually have the definite resolution of this case. Residents | :11:51. | :11:54. | |
opposed to a plans for an incinerator say it'll have an even | :11:54. | :11:58. | |
greater impact than they originally feared. A 95 metre crane was placed | :11:58. | :12:01. | |
on the proposed site today to give planners and locals a chance to see | :12:01. | :12:04. | |
