The M5 crash which claimed seven lives. Smoke from a fireworks | :00:18. | :00:24.
display will fly to paint on the windscreen. | :00:25. | :00:30.
The trial of Geoffrey Counsell was told there were serious weaknesses | :00:31. | :00:34.
in his planning. Also, an inquest hears how a family | :00:35. | :00:39.
was left devastated after a crash in Torquay last summer. A Polish taxi | :00:40. | :00:45.
driver and a 16`month`old baby boy died in the accident. One of the | :00:46. | :00:52.
drivers have less `` had left a suicide note. | :00:53. | :00:58.
A man has gone on trial today accused of causing one of the worst | :00:59. | :01:00.
motorway crashes in Britain. Seven people died in the accident on the | :01:01. | :01:07.
M5 in Taunton. Geoffrey Counsell, who organised a nearby fireworks | :01:08. | :01:13.
display is charged with failing to protect the safety of others. The | :01:14. | :01:18.
prosecution argued that smoke from the fireworks caused an impenetrable | :01:19. | :01:24.
fog which closed sections of the motorway. | :01:25. | :01:30.
Arriving for day one of his trial, the man accused of causing one of | :01:31. | :01:37.
the worst motorway crashes. It was two years ago this month that 34 | :01:38. | :01:40.
vehicles, lorries, vans and cars, careered into each other on the M5 | :01:41. | :01:48.
outside Taunton. The resulting fireball left seven dead and 51 | :01:49. | :01:54.
others at. Some with life changing injuries. The question is whether a | :01:55. | :02:01.
fireworks display staged at Taunton Rugby Club next to the motorway, | :02:02. | :02:06.
organised by Geoffrey Counsell, caused the crash. Peter Blair QC | :02:07. | :02:13.
said that the prosecution would prove that smoke from the fireworks | :02:14. | :02:26.
mixed with fog to make it impossible for drivers to see. One driver said | :02:27. | :02:32.
it was like having paint on your windscreen. Drivers, he said, had no | :02:33. | :02:41.
chance. Collisions were inevitable. The jury was shown various pieces of | :02:42. | :02:47.
amateur video of the display. Pictures, said the prosecution, | :02:48. | :02:51.
which show how much smoke was created. Many of the families of | :02:52. | :02:57.
those who died were in court to hear the case start. Some were in tears. | :02:58. | :03:02.
Tomorrow, the prosecution will continue their opening of this case | :03:03. | :03:07.
and then the first witnesses will be called. On Wednesday, the jury will | :03:08. | :03:12.
be taken to the scene of the crash and Taunton Rugby Club, where the | :03:13. | :03:22.
fireworks display was held. A mother, whose young son, husband | :03:23. | :03:29.
and unborn child hold tight in a crash was in court today to hear | :03:30. | :03:35.
evidence. The driver of the vehicle which caused the crash was being | :03:36. | :03:39.
followed by police because he was suicidal and when asked to pull over | :03:40. | :03:45.
and he veered into the family's cover. | :03:46. | :03:52.
The inquest heard that this accident was not an accident. On the 6th of | :03:53. | :04:00.
July last year, the family were on the last day of their holiday. Their | :04:01. | :04:06.
16`month`old son died. Her husband died later from severe injuries. She | :04:07. | :04:13.
was pregnant but lost her baby daughter. The 26`year`old Polish | :04:14. | :04:20.
taxi driver was driving a black Vauxhall. He was not wearing a seat | :04:21. | :04:25.
belt. He was having marital problems and had left a suicide note. Police | :04:26. | :04:32.
considered high risk. When the police spotted his car, they turned | :04:33. | :04:40.
on their sirens to catch up. They gestured for the car to move over | :04:41. | :04:45.
and initially he slowed down but then suddenly he accelerated and | :04:46. | :04:52.
crashed into the oncoming car. Eyewitnesses said he was not driving | :04:53. | :04:57.
erratically but when the police car was behind him they said something | :04:58. | :05:03.
went wrong. The car took off across the road. They said it would | :05:04. | :05:10.
deliberate. The Independent Police Complaints Commission said a police | :05:11. | :05:12.
vehicle is only interested in a driver has no intention of stopping. | :05:13. | :05:16.
There was no pursuit here, they said. | :05:17. | :05:24.
Dorset County Council is defending a bill which could reach ?40,000 this | :05:25. | :05:28.
year to bus pupils just 800 yards to school. Parents at Salway Ash | :05:29. | :05:33.
Primary near Bridport have been calling for a footpath for 20 years. | :05:34. | :05:37.
But the council hasn't found a way to get land to build one. But, as | :05:38. | :05:40.
Hamish Marshall reports, it's introduced the costly bus, after | :05:41. | :05:43.
admitting the road is unsafe for youngsters to walk to school. | :05:44. | :05:46.
Despite appearances, this isn't your normal school bus. It is not taking | :05:47. | :05:52.
youngsters many miles home. Its journey is just 800 metres. It has | :05:53. | :05:59.
operated since September, at a cost of ?250 per day. The majority of the | :06:00. | :06:07.
houses in the village are here and the school is half a mile down this | :06:08. | :06:11.
busy road. The council says it is too dangerous for youngsters to | :06:12. | :06:17.
walk. Parents have been campaigning for a footpath for more than 20 | :06:18. | :06:21.
years. They said the road is too narrow, twisting and cars go too | :06:22. | :06:30.
fast. The council has said the cars go at an average of 40 miles an | :06:31. | :06:36.
hour. The children want to walk. The council has said it has money set | :06:37. | :06:39.
aside for a footpath but it hasn't built one. The bus is not a | :06:40. | :06:49.
solution. We would like a footpath, not a bus. 25 children use the bus | :06:50. | :06:56.
but now parents have found out the cost and see the council should get | :06:57. | :07:00.
on with making the route safe for walking. It is ridiculous and an | :07:01. | :07:06.
embarrassment to all those services, vital services they are | :07:07. | :07:12.
having to get rid of, but adding on the cost of an unnecessary bus. The | :07:13. | :07:18.
council said it is working on a new footpath. Any statement, it said... | :07:19. | :07:31.
If the boss stays for the school year it will cost around ?40,000. | :07:32. | :07:39.
Parents hope that will focus minds to get a safe walking route to | :07:40. | :07:46.
school. A huge missed opportunity. That is | :07:47. | :07:53.
how we must council has described how the authority has lost out | :07:54. | :08:00.
post`Olympics. They said TV pictures of last year's spectacle should have | :08:01. | :08:06.
been used to promote tourism. The Olympics was said to be a gift | :08:07. | :08:09.
to Weymouth and Portland, a part of Dorset which is used to a seaside | :08:10. | :08:15.
present. But are the Olympics to gift that keeps on giving? We get a | :08:16. | :08:23.
lot more cruise ships now. Because of the Olympics? Possibly. And the | :08:24. | :08:31.
organisation of the port. Advertising is working? Yes. This | :08:32. | :08:42.
was perhaps the ultimate TV advert. Last summer, in different languages | :08:43. | :08:46.
to different countries, the story of the Olympics was told to a global | :08:47. | :09:00.
audience. This was the backdrop. As they came here, their friends back | :09:01. | :09:03.
home were taking in all the Dorset coast has to offer. The council says | :09:04. | :09:09.
National tourism advertising is not making use of the images captured. | :09:10. | :09:14.
As they try to drive visitors out of season, it is no help. It is a | :09:15. | :09:20.
missed opportunity. These images will not have a long sell by date. | :09:21. | :09:27.
They should be being used now in order to promote Britain and the | :09:28. | :09:30.
south`west and Weymouth and Portland in particular. Press trips were | :09:31. | :09:39.
organised in the run`up to the Olympics and the number of visits | :09:40. | :09:43.
this year is up, as is the amount being spent. There was criticism, | :09:44. | :09:50.
though. The home to the athletes last summer says while there is no | :09:51. | :10:00.
interest in further events, funding cannot be found. We had to take in | :10:01. | :10:09.
the changing events formats in the Olympics. It says the results so far | :10:10. | :10:15.
as being hailed as a blueprint for the future. How much of a gift well, | :10:16. | :10:22.
like any legacy, take time to emerge. One community hit by | :10:23. | :10:29.
flooding has been describing how a protection scheme is helping to | :10:30. | :10:32.
minimise the risk. The Environment Minister and North Cornwall MP Dan | :10:33. | :10:35.
Rogerson has been hearing about the scheme today amid ongoing concerns | :10:36. | :10:38.
about flood insurance. John Danks reports. | :10:39. | :10:44.
This stream runs off Dartmoor and through this village. It may be | :10:45. | :10:50.
relatively tame but the large catchment area means the water level | :10:51. | :10:53.
can rise quickly. Now, the community is ready. If levels reach a certain | :10:54. | :10:58.
point, the floodwater and receives an alert automatically. We have a | :10:59. | :11:05.
level when we know we might be flooding and within 30 minutes we | :11:06. | :11:11.
can defend the area. The environment minister visited the community to | :11:12. | :11:12.
see how small`scale projects can work successfully. For those unlucky | :11:13. | :11:18.
enough to be flooded, there is hope that getting insurance after which | :11:19. | :11:23.
could be made easier. There will be a few details to sort out but the | :11:24. | :11:26.
fundamental principle is there will be insurance for people who at the | :11:27. | :11:33.
moment can't get access to it. While the new legislation is unlikely to | :11:34. | :11:36.
be in place before 2015, the flood protection schemes here has made an | :11:37. | :11:42.
immediate impact. Coming up, a cruel twist to a | :11:43. | :11:54.
wartime tragedy. We'll easier from the family affected by the loss of | :11:55. | :12:04.
courageous and Plymouth. I'll have all the details of the | :12:05. | :12:20.
weather later. Well, it was a weekend to forget for | :12:21. | :12:24.
most of our teams. Plymouth Argyle were the only one of our League Two | :12:25. | :12:28.
sides to avoid defeat and our rugby clubs didn't fare any better either, | :12:29. | :12:31.
with the Exeter Chiefs again losing out to their bogey side in the LV | :12:32. | :12:35.
Cup. Andy Birkett rounds up the weekend's action. | :12:36. | :12:37.
We should start with football this evening. Torquay are in the | :12:38. | :12:40.
relegation zone. I was at the game and it wasn't pretty. Defensively, | :12:41. | :12:47.
they were all over the place. A good finish but leading up to that the | :12:48. | :12:52.
play was sloppy. They take full advantage, no doubt. But the | :12:53. | :12:57.
recovery isn't good enough. Defending wasn't enough. Not a nice | :12:58. | :13:05.
position. And the fans weren't happy. No, they were not. A lot of | :13:06. | :13:15.
fans today have been calling for Alan Mill to go. It is a tough job. | :13:16. | :13:22.
He doesn't want to be in that position and neither do the players | :13:23. | :13:31.
or fans. But they need some wins. Do you think they're looking for anyone | :13:32. | :13:37.
else? Not as far as I know. But something has to change on the | :13:38. | :13:41.
training ground or field. Saturday wasn't good enough. Exeter. Again, | :13:42. | :13:48.
not good enough. Their third straight defeat. Yes, it was | :13:49. | :13:54.
frustrating because they were looking really good at times. There | :13:55. | :14:05.
were only 20 million watching against Manchester United. Our only | :14:06. | :14:16.
goal from any of our teams. I made my debut at York. They went for a | :14:17. | :14:28.
good set piece here with a good delivery. A bit scrappy but he | :14:29. | :14:34.
scores the goal and it is a huge point. Looking good for them. Rugby, | :14:35. | :14:41.
now. Nothing brilliant they're either. I'm the only one not wearing | :14:42. | :14:57.
pink, too. Exeter went to Bath and they have never beaten them. It was | :14:58. | :15:06.
sloppy. This isn't typical of Exeter. Their defence is something | :15:07. | :15:12.
they pride themselves on. On a brighter note, one of their players | :15:13. | :15:19.
was back playing again. 37`15 this game ended. They have got Bath again | :15:20. | :15:28.
in a fortnight and have still never beaten them. They will want to put | :15:29. | :15:33.
that right. Briefly, the championship as well. No good news | :15:34. | :15:42.
there either. Pirates will be disappointed to lose. Plymouth | :15:43. | :15:59.
Albion also seventh at the moment. Plymouth College will be providing a | :16:00. | :16:02.
third of the England team in the World Schools Swimming Championships | :16:03. | :16:06.
in Brazil at the end of the month. John Rudd will be taking eight | :16:07. | :16:09.
swimmers from the school to Brasilia, including Olympic champion | :16:10. | :16:12.
Ruta Meilutyte. She'll be looking to add to the nine gold medals she's | :16:13. | :16:16.
already won this year and will be representing England for the first | :16:17. | :16:27.
time. Now, you may remember back in March | :16:28. | :16:31.
we told the story of the first bomb that fell on Plymouth in the Second | :16:32. | :16:34.
World War. The housewife who was killed was called Blanch Ellnor. Her | :16:35. | :16:44.
family contacted us to tell her that her sister is still alive. Phyllis, | :16:45. | :16:49.
who is now 96, tells her story for the first time. | :16:50. | :16:59.
She put the children in the air raid shelter and then went back to make | :17:00. | :17:05.
sure that the dinner was cooking. It was a straight plane which had got | :17:06. | :17:10.
lost so it dropped it bombs and about was dreadful, really. But you | :17:11. | :17:19.
had to get on with it. Phyllis lost her sister on July 30 six 1940. She | :17:20. | :17:31.
also lost her husband in the first British warship to be a lost in the | :17:32. | :17:37.
war. Phyllis waved goodbye to her husband on HMS courageous. | :17:38. | :17:48.
Courageous. Left to patrol the Irish Sea. Then she was torpedoed. | :17:49. | :17:59.
The heaviest loss is in men. Our sympathy goes to all those who are | :18:00. | :18:06.
bereaved. The men were lost in a worthy task and although they did | :18:07. | :18:09.
not return, they served their country well. | :18:10. | :18:15.
518 servicemen were lost. I kept saying he was a good swimmer so | :18:16. | :18:23.
he'll be back. There were more than 700 survivors but Phyllis's husband | :18:24. | :18:32.
was not amongst them. I still thought he would come back. I kept | :18:33. | :18:38.
saying it but it was no good. We had a telegram on the Wednesday and it | :18:39. | :18:51.
was dreadful. She wanted to put her head in the gas oven and it took | :18:52. | :19:02.
three of them to hold her. Being one of the first to lose a husband | :19:03. | :19:06.
through the war like that, you're full of sympathy for everyone else. | :19:07. | :19:12.
You know what they're going through. Despite losing her husband on the | :19:13. | :19:18.
first warship sunk and her sister in the first Plymouth bombing raid, she | :19:19. | :19:23.
soldiered on. She survived the war and kept the generations going. I'm | :19:24. | :19:38.
Phyllis. I'm Hazel the daughter. I'm her great`granddaughter. And, since | :19:39. | :19:48.
Johnny filmed his report, Phyllis's great`great`granddaughter Alissia | :19:49. | :19:55.
has been been born. It has been an eventful few days for | :19:56. | :19:59.
you, hasn't it? But it has a happy ending. You have two dogs. One of | :20:00. | :20:09.
them went missing but resurfaced in Newton Abbot on Saturday night. A | :20:10. | :20:14.
massive thanks for everyone who helped to look for. The power of | :20:15. | :20:21.
social media helped as his picture was spotted on Facebook. | :20:22. | :20:30.
Yes, and a huge thank you to everyone who went out to look for | :20:31. | :20:41.
him. Thank you so much. Now, the weather. | :20:42. | :20:50.
The weather is getting colder. It is Frosty later tonight and that is the | :20:51. | :20:58.
theme for the rest of this week. Cold air is coming in from the North | :20:59. | :21:02.
West. We will see lower temperatures and a risk of trust. `` frost. Also | :21:03. | :21:14.
the risk of some wintry showers. Combined with the lower | :21:15. | :21:17.
temperatures, there is a risk of ice. There could be a coating of ice | :21:18. | :21:33.
early on so be careful. The clearer skies across Ireland and the Irish | :21:34. | :21:36.
Sea are heading towards us. There are some showers amongst that so it | :21:37. | :21:48.
won't be completely drive tonight. The high pressure will dominate the | :21:49. | :21:51.
weather for the rest of the week. Over the next two days, it won't | :21:52. | :21:58.
dominate as much. On Wednesday, we have two weather systems. So, | :21:59. | :22:03.
perhaps some slightly less cold air before the weather front comes in | :22:04. | :22:11.
late on Wednesday. This rain is not really the change to the colder | :22:12. | :22:15.
conditions. It is the show was just coming through parts of Wales at the | :22:16. | :22:18.
moment that will introduce that colder area. This was earlier today | :22:19. | :22:26.
in the team Valley where it was called. `` cooled. After the | :22:27. | :22:39.
Sunset, very much colder air setting in. For most of us, it will be | :22:40. | :22:45.
called tonight with a risk of frost and ice. Some showers dotted around | :22:46. | :22:50.
and in the early hours of the morning some will turn wintry. | :22:51. | :22:58.
Mostly for high ground, though. Temperatures are getting fairly low. | :22:59. | :23:06.
Some places will be down to zero, hence the risk of frost and ice. | :23:07. | :23:10.
Tomorrow, a few wintry showers around. But they will start to turn | :23:11. | :23:18.
back to rain. Winds are strong from the north and north`west. We will | :23:19. | :23:25.
need to wrap up warm. It will be a cold day. He was the forecast for | :23:26. | :23:36.
the Isles of Scilly. Probably one of the warmest places in the UK, | :23:37. | :23:38.
tomorrow. Heroes of the coastal waters | :23:39. | :23:58.
forecast. Wednesday is cloudy with less cold | :23:59. | :24:18.
air. Windy, though. A cold night again on Wednesday night with the | :24:19. | :24:23.
risk of wintry showers. Thursday and Friday both days with | :24:24. | :24:29.
high`pressure. Fine but on the cold side. | :24:30. | :24:39.
Now, we have to say a huge thank you to the thousands of you who helped | :24:40. | :24:42.
