have been there for each other because the girls were there for | :03:26. | :03:31. | |
each other, we owe it to them and we owe it to the memory, and the | :03:32. | :03:37. | |
futures they have been robbed of. I think that our girls two lives can | :03:38. | :03:45. | |
be worth something, they are not just swept under the carpet. It | :03:46. | :03:48. | |
be worth something, they are not up there where Laura and Mairi were | :03:49. | :03:53. | |
killed. Literally just yards from here George Square, where the bin | :03:54. | :03:56. | |
lorry crashed into the wall of the millennium hotel. In each case, the | :03:57. | :04:02. | |
driver had a medical history of black outs, in each case there was | :04:03. | :04:06. | |
no criminal prosecution. And the families who are now pursuing these | :04:07. | :04:10. | |
private prosecutions feel justice wasn't done for their loved ones. | :04:11. | :04:15. | |
Now, the families have to wait to see if their bids to have the first | :04:16. | :04:20. | |
private prosecutions this century can overcome the many legal hurdles | :04:21. | :04:22. | |

Well, joining us now is our home affairs correspondent Reevel | :04:27. | :04:28. | |
Reevel, talk us through some of these legal hurdles. | :04:29. | :04:34. | |
They are difficult. Two cases last century as Katsina mentioned. One in | :04:35. | :04:44. | |
1909 and the other in 1982. In each case the Lord Advocate gave what is | :04:45. | :04:48. | |
called a concurrence, that is to say he signified that the case could guy | :04:49. | :04:53. | |
ahead. There is strong evidence in these two cases that not going to | :04:54. | :04:57. | |
happen. If the Lord Advocate says no, it can go to High Court. They | :04:58. | :05:02. | |
can allow it to go ahead but first of all, there are two other hurdles | :05:03. | :05:06. | |
that people must overcome. The first is sufficiency of evidence. In other | :05:07. | :05:11. | |
words, the court has to be satisfied that the case had a reasonable | :05:12. | :05:15. | |
chance of success. The court must also establish whether there are | :05:16. | :05:19. | |
exceptional circumstances to allow a private prosecution, and that could | :05:20. | :05:23. | |
be a very difficult hurdle to overcome, bearing in mind that the | :05:24. | :05:26. | |
Crown has decided that in law they can't bring a prosecution. And why | :05:27. | :05:33. | |
might frank Mulholland not be willing to allow a private crossing. | :05:34. | :05:38. | |
For the same reason as the Crown couldn't bring a prosecution. Last | :05:39. | :05:42. | |
August Mr Mulholland told BBC Scotland in law the lorry driver in | :05:43. | :05:46. | |
the bin lorry case, Harry Clarke couldn't be charged for two main | :05:47. | :05:50. | |
reason, first he was unconscious at the time of the accident, therefore | :05:51. | :05:53. | |
there was no criminal intent that could be demonstrated to the court. | :05:54. | :05:59. | |
Secondly, it had been four years before since his last fainting | :06:00. | :06:04. | |
episode so he couldn't have known that day he was going to collapse | :06:05. | :06:09. | |

aimed as catching her killer, while also reassuring locals with extra | :07:05. | :07:07. | |

Passions are running high on local service, this was the scene outside | :08:56. | :09:03. | |
Edinburgh council today. It is planning 2,000 job cuts and | :09:04. | :09:08. | |
reductions to some local services. I say resign. Councils get most of | :09:09. | :09:12. | |
their cash from the Scottish Government. Most of them say the | :09:13. | :09:16. | |
deal on offer means they will need to make more savings this year than | :09:17. | :09:19. | |
they expected. There is concern here about some of the cuts Edinburgh is | :09:20. | :09:24. | |
proposing but at the same time there is sympathy for the financial | :09:25. | :09:29. | |
situation facing local Governments. The leader of the council said this | :09:30. | :09:32. | |
morning that local Government funding is broken, and it certainly | :09:33. | :09:36. | |
is broken. In Holyrood they node to take responsibility for that. | :09:37. | :09:41. | |
-- need. Edinburgh is the first council to set its budget for the | :09:42. | :09:45. | |
the year ahead. Many others still haven't accepted the Government's | :09:46. | :09:49. | |
funding offer. Tonight, one Labour council said they would turn it down | :09:50. | :09:53. | |
outright if it didn't change. I have written to the Government. We are | :09:54. | :09:58. | |
telling the Government day and daily they need to provide more money for | :09:59. | :10:02. | |
local service, if they want to continue with the rhetoric they have | :10:03. | :10:06. | |
round that tackling austerity, they need to provide the money to provide | :10:07. | :10:12. | |
those services. Many councils have concerns or query, so much so the | :10:13. | :10:16. | |
Finance Secretary sent them this letter, seen by BBC Scotland. He | :10:17. | :10:22. | |
told them he was putting back the deadline for accepting the offer, | :10:23. | :10:25. | |
originally it was tomorrow. First Minister... At Holyrood, the first | :10:26. | :10:29. | |
minute stir defended council funding. In terms of overall revenue | :10:30. | :10:34. | |
expenditure of Local Authorities, they are looking at a 2% reduction, | :10:35. | :10:39. | |

this year could help. So far, only Murray -- Moray Council plan do this | :11:03. | :11:04. | |

22 months, heavily fined. I went to a drink-driving awareness course and | :13:26. | :13:28. | |
I realised that even after a couple of pints, you are in charge of a | :13:29. | :13:31. | |
you are in charge of a lethal weapon. | :13:32. | :13:35. | |
That man suggests more driver education is needed. | :13:36. | :13:37. | |
The police admit they are disappointed with this sharp rise | :13:38. | :13:39. | |
in drunk drivers over the festive season. | :13:40. | :13:43. | |
There are still a hard-core, a minority of people in Scotland | :13:44. | :13:50. | |
prepared to take the risk to themselves and others, of drinking | :13:51. | :13:54. | |
and driving. That is unacceptable, as the vast majority of people in | :13:55. | :13:57. | |
