The families of two young women, killed when a driver blacked out | :00:08. | :00:12.
at the wheel of his car in Glasgow five years ago, | :00:13. | :00:15.
are seeking to bring a private prosecution. | :00:16. | :00:19.
Mairi Convy and Laura Stewart died, when William Payne fell unconscious | :00:20. | :00:21.
It comes as the family of three victims of the Glasgow bin lorry | :00:22. | :00:27.
crash start a private prosecution against driver Harry Clarke. | :00:28. | :00:31.
Six people lost their lives when the bin lorry careered out of control | :00:32. | :00:44.
three days before Christmas in 2014. Though the now a family are trying | :00:45. | :00:52.
to start proceedings against the driver, Harry Clarke. Yesterday they | :00:53. | :00:57.
delivered letters to the Crown Office and all that will lead to a | :00:58. | :01:01.
private prosecution. They want justice. They're not a lynch mob. | :01:02. | :01:04.
The family do not consider that they have two attend outside a cell | :01:05. | :01:10.
within use and hang him at all. They want to see justice being done. And | :01:11. | :01:15.
the natural course of justice will be a criminal prosecution. If the | :01:16. | :01:18.
driver is acquitted, the driver is acquitted, it is simple as that. The | :01:19. | :01:23.
family can thereafter on. But thereafter they conceive they have | :01:24. | :01:27.
done the best they can for the family members they lost. During the | :01:28. | :01:31.
fatal accident enquiry it emerged that the driver Harry Clarke had a | :01:32. | :01:35.
medical history of rackets spanning decades that he had failed to | :01:36. | :01:38.
disclose to his lawyers and the DVLA. But the Crown Office insisted | :01:39. | :01:43.
that was not enough evidence in law to prosecute him. Almost exactly | :01:44. | :01:50.
four years before the George Greer crashed there was another tragedy | :01:51. | :01:54.
just a quarter of a mile away. Mairi Convy and Laura Stewart were killed | :01:55. | :01:57.
in N. Hanover St in 2010 when they were knocked down by a driver Mairi | :01:58. | :02:06.
William Payne. They have lost a similar bill calling for a similar | :02:07. | :02:11.
prosecution. Families have been brought together by their fight for | :02:12. | :02:15.
justice for the girls. The girls were friends at college, they were | :02:16. | :02:19.
killed together. That binds us together as families. We have fought | :02:20. | :02:23.
this place for five years, held each other for support, we have cried and | :02:24. | :02:27.
laughed together, we have been there for each other because the girls | :02:28. | :02:30.
were there for each other. We owe it to them and we owe it to their | :02:31. | :02:35.
memories and the futures that they have been robbed of. Think that our | :02:36. | :02:44.
girls' two lives can be worth something, but they're not just | :02:45. | :02:49.
swept under the carpet. It was in N. Hanover St that Laura and Mairi | :02:50. | :02:56.
Convy were killed. Just yards from where the bin lorry crashed into the | :02:57. | :03:00.
wall of the millennium hotel. In each case the driver had a medical | :03:01. | :03:05.
history of blackouts. In each case there was no criminal prosecution. | :03:06. | :03:10.
And the families who are now pursuing these private prosecutions | :03:11. | :03:14.
feel justice was not done for their loved ones. The families have to | :03:15. | :03:18.
wait to see their bids to have the first private prosecutions this | :03:19. | :03:22.
century can overcome the many legal hurdles they face. | :03:23. | :03:27.
A 40-year-old woman has appeared in court, charged with the murder | :03:28. | :03:29.
Sandra Weir who was a neighbour made no plea or declaration | :03:30. | :03:36.
Mrs Logie, who was 82, was found dead in her home just over | :03:37. | :03:40.
Flowers outside the house that Mary Logie called home from than half her | :03:41. | :03:56.
life. A grandmother and mother of three, it is exactly two weeks since | :03:57. | :04:00.
police released this picture of the 82-year-old. Two days earlier she | :04:01. | :04:04.
had been planning a trip into town before visiting a friend in | :04:05. | :04:08.
hospital. That did not happen. Instead she was found dead in her | :04:09. | :04:12.
nightdress, the victim of what police described as a brittle and | :04:13. | :04:17.
horrendous attack. The high-profile police operation that followed was | :04:18. | :04:21.
aimed at catching her killer while also reassuring locals with extra | :04:22. | :04:25.
officers on the street. Not far away, the church were mainly was | :04:26. | :04:30.
better known to the congregation as Ray, the minister says it has been a | :04:31. | :04:34.
difficult fortnight. There were quite a few people afterwards who | :04:35. | :04:41.
were visibly upset at what happened. And you can imagine that. There are | :04:42. | :04:50.
lots of people who live in this committee on their own, older ladies | :04:51. | :04:53.
on their own. That was a worrying thing for them, that this was | :04:54. | :04:59.
happening in the area. This afternoon and neighbour appeared in | :05:00. | :05:03.
court charged with the murder of Mary Logie. 40-year-old Sandra Weir | :05:04. | :05:07.
made no plea or declaration during a short hearing held in private. The | :05:08. | :05:12.
Sheriff reminded her in custody. It is expected she will return to court | :05:13. | :05:14.
next week. A leaked draft report into sexual | :05:15. | :05:16.
abuse by Jimmy Savile linked to the BBC has found evidence | :05:17. | :05:19.
of incidents at its former TV News website Exaro has published | :05:20. | :05:22.
sections of a draft report which says incidents occurred | :05:23. | :05:29.
at "virtually every one of the BBC BBC head Lord Hall says | :05:30. | :05:32.
lessons will be learned from what he describes | :05:33. | :05:36.
as a "dark chapter". Scotland's 32 councils | :05:37. | :05:43.
are in the middle of trying to figure out how to pay | :05:44. | :05:45.
for services at a time when funds They get most of their cash | :05:46. | :05:48.
from the Scottish government, but many say they need more details | :05:49. | :05:52.
of this year's funding plan before Tonight Edinburgh Council became | :05:53. | :05:55.
the first to pass its budget - but another one rejected | :05:56. | :06:06.
the current government offer. Passions are running high on local | :06:07. | :06:15.
services. This was the scene outside and were cancelled today. It is | :06:16. | :06:22.
planning 2000 job cuts and reductions to some local services. | :06:23. | :06:28.
Councils get most of their cash from the Scottish Government. Most of | :06:29. | :06:31.
them say the deal on offer means they will need to make more savings | :06:32. | :06:35.
this year than they had expected. There is real concern here is that | :06:36. | :06:40.
some of the cuts that are been proposed but at the same time there | :06:41. | :06:43.
is some body for the financial situation facing governments. The | :06:44. | :06:48.
leader of the council has just said this morning that local government | :06:49. | :06:52.
funding is broken, and it certainly has broken. And Hollywood needs to | :06:53. | :06:56.
take responsibility for that. Edinburgh is the first council to | :06:57. | :07:00.
set its budget for the year ahead, and many others still have not | :07:01. | :07:03.
accepted the government's funding offer. Tonight one Labour council | :07:04. | :07:08.
said the would turn it down I write if it did not change. I have written | :07:09. | :07:13.
to the government. We are telling the government daily that they need | :07:14. | :07:15.
to provide more money for local services. If they want to continue | :07:16. | :07:21.
with the rhetoric they have about tackling austerity, they need to | :07:22. | :07:25.
provide the money to provide those services. Many councils have | :07:26. | :07:31.
concerns or queries, so much so that the finance secretary, John Swinney, | :07:32. | :07:35.
said then this letter seen by BBC Scotland. He said he was putting | :07:36. | :07:39.
back the deadline for accepting the offer. Originally it was tomorrow. | :07:40. | :07:44.
Meanwhile at Holyrood, First Minister defended council funding. | :07:45. | :07:48.
In terms of the overall revenue expenditure of local authorities, | :07:49. | :07:54.
they are looking at a 2% reduction, that is before we take account of | :07:55. | :07:57.
additional resources for social care, additional resources through | :07:58. | :08:01.
the attainment fund and the additional investment we planned | :08:02. | :08:03.
over the life of the next Parliament in transforming the provision of | :08:04. | :08:10.
childcare. Back at Edinburgh Council, many of these protesters | :08:11. | :08:13.
named bidding up the council tax this year could help. So far only | :08:14. | :08:19.
one council plans to do this, but a few more may follow. | :08:20. | :08:24.
459 drivers were found to be over the legal alcohol level | :08:25. | :08:27.
That's up by almost a third on the previous year, | :08:28. | :08:31.
Just 19 were found to be between the old drink-drive limit | :08:32. | :08:38.
and the new one which was introduced in December 2014. | :08:39. | :08:41.
Police have expressed disappointment that some people continue | :08:42. | :08:43.
There are still a hard-core, a minority of people in Scotland | :08:44. | :08:55.
prepared to take the risk to themselves and others of drinking | :08:56. | :09:01.
and driving. That is unacceptable as the vast majority of people in | :09:02. | :09:03.
Scotland now and accept. It started life in the 17th century, | :09:04. | :09:05.
as a home for merchants who'd fallen on hard times, but Stirling's | :09:06. | :09:09.
Cowan's Hospital is itself in need Plans to restore and reopen it | :09:10. | :09:11.
for the community have been helped by the promise of ?2 million | :09:12. | :09:16.
from the Heritage Lottery Fund. Our arts correspondent | :09:17. | :09:19.
Pauline McLean reports. Behind closed doors, an important | :09:20. | :09:33.
piece of Scottish history lies virtually untouched. You will notice | :09:34. | :09:39.
that this is not as it was originally built, there were | :09:40. | :09:42.
bedrooms upstairs initially and the bedrooms were downstairs. Back in | :09:43. | :09:48.
the 16 40s this was home, a comfortable home, for wayward | :09:49. | :09:52.
merchants. Good food, work clothes and even access to the country's | :09:53. | :09:57.
first known Bowling Green. But they had to abide by strict rules. They | :09:58. | :10:00.
were not allowed to swear or see women or drink. They had to attend | :10:01. | :10:07.
church three times on a Sunday. They literally had a very unsigned | :10:08. | :10:15.
lifestyle. Stricter not, the legacy of John Cullen lives on installing | :10:16. | :10:19.
even if his statue has seen better days. This is the hand of John | :10:20. | :10:28.
Cullen, his hand fell off tragically, so the whole statue | :10:29. | :10:30.
requires complete overhaul and maintenance. Today the campaign to | :10:31. | :10:41.
go step forward with the promise of money from Heritage Lottery Fund | :10:42. | :10:43.
stoppage will allow to refurbish the building with all the details of the | :10:44. | :10:46.
guilders and businessmen who used it over the years. These are guilt | :10:47. | :10:53.
highs, and the guilders used to take them home to their wives to prove | :10:54. | :10:56.
they were meetings here rather than at meetings in the local pub. The | :10:57. | :11:02.
plan is the will make these pies and tell them to local terrorists as | :11:03. | :11:06.
part of the attraction. And thanks to this boost, that work can now get | :11:07. | :11:09.
underway in the hospital made be open again in the near future. | :11:10. | :11:12.
Let's get the weather outlook for tonight and tomorrow | :11:13. | :11:15.
There is change afoot, the weather is turning much milder. Still snow | :11:16. | :11:28.
on the ground in Callander. But that is likely to melt tomorrow and | :11:29. | :11:33.
indeed be washed away because there is a fair amount of rain forecast | :11:34. | :11:38.
tonight and tomorrow. We have a warning in force for central and | :11:39. | :11:41.
southern parts of the country. Very heavy rain initially, a lot of | :11:42. | :11:46.
surface water on the roads and localised flooding. A strong | :11:47. | :11:48.
southerly wind around the coast and across the islands. However, a mild | :11:49. | :11:54.
start to the day. These tempered as a warmer than what many would have | :11:55. | :11:58.
seen today. And because it is southerly, more shelter through the | :11:59. | :12:01.
central belt. Even some dry interludes. Similar story to the | :12:02. | :12:08.
North. Reasonably dry at times but the rain coming your way and that is | :12:09. | :12:11.
pushing up towards Shetland. Gale-force winds for Orkney and | :12:12. | :12:16.
Shetland. On Friday most of the wet weather clears away and we see a | :12:17. | :12:21.
dramatic improvement. The rain goes and the sunshine arrives, much drier | :12:22. | :12:25.
by the afternoon, much brighter. That pattern repeats across the UK. | :12:26. | :12:29.
The rain pushes out into the North Sea. Lingering in East Anglia and | :12:30. | :12:35.
part of the south-east. Drier and brighter and mild behind it. Showers | :12:36. | :12:39.
in the north-west, some heavy, edging their way in on Friday night. | :12:40. | :12:44.
Into the weekend, high across France keeps things largely settled across | :12:45. | :12:48.
the UK. Two areas of wet weather to content with. Fairly wet on Saturday | :12:49. | :12:54.
across the far north-west. Elsewhere largely dry with some bright spells | :12:55. | :12:58.
and once again pretty mild for the time of year. Across the UK as a | :12:59. | :13:01.
whole, down towards the Home Counties will be some areas of fog | :13:02. | :13:05.
at but largely dry, some thick cloud through the Midlands. Brighter | :13:06. | :13:08.
towards Hampshire and the Isle of Wight. Through towards Sunday, a | :13:09. | :13:13.
cloudy day on Saturday with some outbreaks of rain but perhaps milder | :13:14. | :13:16.
with tempered us into the teens. Our next update is during Breakfast | :13:17. | :13:19.
at 6:25 tomorrow morning. But, from everyone on the late team | :13:20. | :13:22.
here in Glasgow and around | :13:23. | :13:26. |
