Midlands, I'm Anne Davies. The family of a man who died after

serious mistakes were made while he was in hospital say he'd sthll be

alive if lessons had been ldarnt from other deaths on the sale ward.

An inquest into the death of Stewart Maltby heard evidence that the lives

of two other patients on ward D 7 at the Queen's Medical Centre were lost

in a similar way. Are are In a moment I'll be speaking to the

Maltby family's solicitor btt first, as Jo Healey reports, they're now

considering legal action ag`inst the hospital. Are are Stewart w`s a

character who made us laugh with his mischievous sense of humour. He

spent a lot of time caring for others, often to his own detriment.

After 18 months he is still very much missed by us all. It h`s been

hard for Katie hearing how badly her dad was let down in the two days

before his death. A mix`up hn the ambulance control room meant it took

six hours to get him into hospital and he did not get the fluids he

needed until 14 hours after the call. He died two days later from

kidney failure and other problems. The coroner outlined a serids of

mistakes, errors and missed opportunities. Are She said there

were serious, repeated and systemic failures as he deteriorated and

those caring for him were oblivious to that. The inquest heard lany

measures and improvements are in place on the ward to stop it

happening again and from thd Ambulance Service there camd an

apology to the family and reassurances that they have made

crucial changes. All the falily of Stewart Maltby hope for now is that

no`one else will have to suffer as they have. Are to trust his

statement tonight. "We extend our condolences and reiterate otr

unreserved apologies to Mr Laltby's family for the failings in our care

and for letting them and thdir father down so badly. We have learnt

from this sad and tragic case and made changes to improve safdty and

outcomes for our future pathents." With me now is Mr Maltby's family

solicitor, Paul Halen. The hospital is quite specific about the change

made and they've apologised ` is that now enough It was a catalogue

of errors ` what is the famhly's feeling tonight? Some of those were

very basic, failure to keep records and then over whelming feelhng that

there monotonous staff on dtty. Family hope that all those `re

rectified at the same time. What has been the reaction of the falily

after today? They were very pleased that the extent of the enquhry by

the coroner and her findings. They are relieved that that parthcular

aspect of their ordeal was over As you mentioned during the case is not

the first incident of its khnd. There is a record of similar

feelings on that particular ward and it is hoped that improvements will

go through not just that ward by the hospital and other hospitals that

have those problems. What are the family going to do now? Thex will

take time to consider their position but but they are coming back to see

me and they will consider a legal claim against the hospital who have

virtually admitted responsibility and that is encouraging. In other

news tonight, a teenager who's accused of murdering the football

coach Antoin Akpom has told a court that he ran for his life after being

confronted by him on a Leicdster street. 19`year`old Abdul H`kim

described how Mr Akpom swung a dumbbell at his head. The tdenager

said he feared he'd be seriously injured. Here's our chief ndws

reporter Quentin Rayner. Thd jury was told that Abdul Hakim and

Hussein Hussein shared a cell at a young offenders institution. Abdul

Hakim has three convictions for carrying knives and sharp

implements. He said that he had never had any trouble with @ntoin

Akpom before. He described `n incident on the 12th of September

last year. He said that the football coach pulled up in a car and very

aggressively challenged thel by shouting at him a question `s to why

he was in his area. Moments later he ran back with men from a local gym.

Abdul Hakim said some of thd men had covered their faces and Antoin Akpom

had swung a dumbbell at his head. He was scared for his life. He later

noticed that Hussein Hussein had blood on his jacket and he told him

that he had stabbed Antoin @kpom because he feared he was behng

attacked. Abdul Hakim denied that the knife was his and that he got

rid of it. When he heard th`t four members of one family had bden

killed in a fire attack two doors from his mother's house he said that

he thought at first it was his house and they had picked the wrong

placefor a revenge attack. That is when he decided to go to thd police.

He denied that he was part of a team who were involved in murderhng

Antoin Akpom. Football, and it was quite a party at the King Power

Stadium as newly promoted Ldicester lost 4`1 to Brighton. Elsewhere

Derby County beat Blackpool 3`1 and Nottingham Forest drew 3`3 with

storm in the US. There have been reports of flash flooding and

tornadoes. You can see a narrowband which is weakening and heading out

to the Atlantic. It is the Atlantic tonight that will pick up whether

funds to the north of the UK, bringing with them or cloud and

outbreaks of rain. Meanwhile, pressure remains relatively high to

the south. There is a small chance of patchy mist and fog and low cloud

by the end of the night. But temperatures will fall away again. A

chilly start to Wednesday morning. There will be a bit of a breeze

blowing in the north. But it will be a fairly cloudy and wet affair first
