Police on their way to a petrol station in Lancashire. | 0:00:02 | 0:00:05
SIREN WAILS | 0:00:05 | 0:00:07
Once there, they discover a 23-year-old woman in a car. | 0:00:07 | 0:00:11
She's been drugged and kidnapped. | 0:00:11 | 0:00:12
She was very drowsy, couldn't lift her head up, couldn't get herself out of the vehicle. | 0:00:13 | 0:00:17
When he's assaulted you, what has he been saying to you? | 0:00:20 | 0:00:22
He said to me basically, he'd kill me. | 0:00:22 | 0:00:24
Did you think you were going to die? | 0:00:24 | 0:00:26
I thought my life was in danger, yeah. | 0:00:26 | 0:00:29
She's broken a code that goes back hundreds of years, | 0:00:29 | 0:00:31
built around what's seen as a sacred trust - the family honour. | 0:00:31 | 0:00:36
Honour, or izzat, is respect, status. | 0:00:39 | 0:00:43
The reality is power and control. | 0:00:43 | 0:00:48
Women's behaviour has to fit in with whatever men have to say. | 0:00:48 | 0:00:51
There are thousands of other young people like her in Britain today, | 0:00:52 | 0:00:56
who live in fear of their own families. | 0:00:56 | 0:00:58
But very few are prepared to talk about it. | 0:01:00 | 0:01:03
This film, two years in the making, tells one shocking story. | 0:01:06 | 0:01:10
Do you understand that you are under arrest? | 0:01:10 | 0:01:13
BEEPING | 0:01:13 | 0:01:14
OK. | 0:01:14 | 0:01:16 | |
Family honour - that's the main thing that keeps coming up | 0:01:16 | 0:01:21
instead of happiness. | 0:01:21 | 0:01:22
PHONE RINGS | 0:01:39 | 0:01:41
This afternoon we need to speak to a 16-year-old girl | 0:01:41 | 0:01:45
who has been told that her family | 0:01:45 | 0:01:47
are going to pack her off to Pakistan to marry | 0:01:47 | 0:01:50
a 26-year-old relative. | 0:01:50 | 0:01:52
Lancashire Police have two units | 0:01:52 | 0:01:53
dedicated to tackling so-called honour crime, | 0:01:53 | 0:01:56
including forced marriages, false imprisonment and assault. | 0:01:56 | 0:02:00
If we do bring charges, we'll bring the family back in early... | 0:02:00 | 0:02:02
This programme tells the inside story of the investigation | 0:02:02 | 0:02:06
of a crime that split a family apart. | 0:02:06 | 0:02:10
It's now just going through what we need for CPS. | 0:02:10 | 0:02:12
This team, based in Blackburn, have dealt with more than 60 cases | 0:02:13 | 0:02:17
in the last 12 months. | 0:02:17 | 0:02:19
Almost all of them have involved girls under 21 being forced into marriages | 0:02:19 | 0:02:24
they don't want - otherwise face emotional blackmail or much worse. | 0:02:24 | 0:02:30
Parents are prepared to harm their own children | 0:02:32 | 0:02:35
in order to protect this, um, this THING that they call honour. | 0:02:35 | 0:02:42
Shabana is 23 and a victim of that code of honour. | 0:02:44 | 0:02:48
She's one of the latest cases for the Blackburn team. | 0:02:48 | 0:02:52
Shabana isn't her real name, and we've blurred her face | 0:02:52 | 0:02:54
and altered her voice at her request. | 0:02:54 | 0:02:57
It took me a lot of courage to run away from my family. | 0:02:57 | 0:03:02
So many times I decided to go and then I was like, | 0:03:02 | 0:03:04
"No, I love my family. | 0:03:04 | 0:03:06
"My family's here." You just... | 0:03:06 | 0:03:09
There's always that family barrier thing stopping you from going away. | 0:03:09 | 0:03:13
And then, I don't know, I just came to a point where I thought, | 0:03:14 | 0:03:19
"I've got no more choices or options," and I just had to do it. | 0:03:19 | 0:03:22
I just had to make the decision for myself. So I just went. | 0:03:22 | 0:03:26
Shabana ran away from her mother's home where she lived, | 0:03:27 | 0:03:31
rather than going through with a forced marriage to a cousin. | 0:03:31 | 0:03:35
She went to another city | 0:03:35 | 0:03:36
and met and fell in love with a young Muslim man there. | 0:03:36 | 0:03:40
I didn't want my life to end up in a question mark | 0:03:40 | 0:03:42
so I thought, "Yeah, let's get married. | 0:03:42 | 0:03:44
"What can be more beautiful than that - to have a marriage?" | 0:03:44 | 0:03:48
It's the Islamic way as well and it's legal. | 0:03:48 | 0:03:51
So we got married and I was so happy. | 0:03:51 | 0:03:56
That was the happiest day of my life. Seriously. | 0:03:56 | 0:03:59
And like, I don't know, it was just 24/7 him, him, him, him. | 0:03:59 | 0:04:02
Same for him - he treats me like a princess. | 0:04:02 | 0:04:05
But her happiness was to be short-lived. | 0:04:08 | 0:04:11
When Shabana's family found out about her secret marriage, | 0:04:11 | 0:04:14
some of them were very unhappy. | 0:04:14 | 0:04:17
They never liked him, that's the thing. They'd fake it on the face. | 0:04:17 | 0:04:20
They've never ever liked him. | 0:04:20 | 0:04:22
Shabana tried to reconcile matters with them | 0:04:24 | 0:04:26
but while she was staying without her husband | 0:04:26 | 0:04:29
at her sister's house in January 2010, matters came to a head. | 0:04:29 | 0:04:34
It didn't feel right. I said, "No, I want to go. | 0:04:36 | 0:04:38
"I just have to go." But they wouldn't let me. | 0:04:38 | 0:04:41
While Shabana was at her sister's, her mother, | 0:04:43 | 0:04:46
brother and brother-in-law went to her new home. | 0:04:46 | 0:04:50
Her brother climbed through the kitchen window of the house, | 0:04:50 | 0:04:53
and Shabana's husband says he was threatened, | 0:04:53 | 0:04:56
and her belongings, passport and marriage certificate taken away. | 0:04:56 | 0:05:00
They blackmailed him and said, | 0:05:02 | 0:05:04
"You've got two weeks to prove yourself, otherwise you're not getting her back." | 0:05:04 | 0:05:08
SIREN WAILS | 0:05:08 | 0:05:12
Her husband, concerned about Shabana's welfare, alerts police. | 0:05:12 | 0:05:15
Later that same night, they track down her whereabouts | 0:05:15 | 0:05:19
and order the car she's in to rendezvous with them at a petrol station. | 0:05:19 | 0:05:23
Shabana is a car being driven by her brother-in-law, | 0:05:28 | 0:05:32
supposedly to take her back to her husband. | 0:05:32 | 0:05:35
She was under the influence of something - we didn't know what. | 0:05:35 | 0:05:39
She couldn't talk properly. | 0:05:39 | 0:05:40
She was slurring her words. We could hardly get a name off her. | 0:05:40 | 0:05:44
Pretty much had to carry her back to our police vehicle. | 0:05:44 | 0:05:47
She was slurry and her eyes were all over the place really. | 0:05:47 | 0:05:51
She didn't look well at all. | 0:05:51 | 0:05:53
Because of Shabana's condition, she is sent to a nearby hospital. | 0:05:56 | 0:06:00
She's treated and samples of her blood and urine are taken. | 0:06:00 | 0:06:04
What she tells police that night, | 0:06:05 | 0:06:07
starts a process that will end with five members of her family being arrested. | 0:06:07 | 0:06:12
The next day, the Community Cohesion Unit of Lancashire Police | 0:06:23 | 0:06:26
based in Blackburn, begins further investigations into what Shabana has said. | 0:06:26 | 0:06:33
Cos she made a disclosure to the officer | 0:06:33 | 0:06:35
about being unwell after having this drink. | 0:06:35 | 0:06:39
Shabana is discharged from hospital and brought to the police station. | 0:06:39 | 0:06:45
Well, she's been discharged. Er, she's feeling a bit groggy. | 0:06:45 | 0:06:48
Detectives questioning her suspect she may have been drugged | 0:06:48 | 0:06:52
or poisoned through a drink she'd been given - | 0:06:52 | 0:06:55
hot, sweet milk. | 0:06:55 | 0:06:57
-See you later. Bye. -Have you had that before? This sweet milk before? | 0:06:57 | 0:07:02
No. | 0:07:02 | 0:07:03 | |
How long was it before you felt really ill after you had a mouthful of this drink? | 0:07:03 | 0:07:06
I was fine and then as soon as I went in the living room to sit down, | 0:07:06 | 0:07:11
I don't know what... | 0:07:11 | 0:07:13
I wasn't even prepared for it, I just puked. | 0:07:13 | 0:07:16
-And it was like my eyes were half shut. -So you've thrown up in the house? | 0:07:16 | 0:07:20
Yeah, and there was everybody talking to each other. | 0:07:20 | 0:07:23
And I don't know who's wiping my face. I don't know what's going on. | 0:07:23 | 0:07:26
When you said that everyone was talking and you could hear | 0:07:26 | 0:07:30
different people talking, could you hear what the conversation was like? | 0:07:30 | 0:07:34
-I don't know. I was just like knocking out, like blacking out. -Crap. | 0:07:34 | 0:07:38
Next minute, someone's holding me to take me outside the house. | 0:07:38 | 0:07:44
My brother-in-law got in the van - he was the driver. | 0:07:44 | 0:07:47
They went to a petrol station and then after that, all I can remember | 0:07:47 | 0:07:51
is a police guy knocking on the window and asking me if I'm all right. | 0:07:51 | 0:07:55
And it was confusing cos I didn't know where he'd come from | 0:07:55 | 0:07:59
because who had reported to the police what's going on? | 0:07:59 | 0:08:02
-It was your husband. -He opened the door and he got my stuff for me and he grabbed me out. | 0:08:02 | 0:08:06
And he helped me in the van. After that, I don't remember nothing. | 0:08:06 | 0:08:10
Right, I've got enough just to speak to Bobby | 0:08:10 | 0:08:12
-and then we can go back right from the beginning. Sorry about that. -It's OK. | 0:08:12 | 0:08:15
It's just something I've to get done by two o'clock. | 0:08:15 | 0:08:18
Now he's got the extra information, | 0:08:20 | 0:08:22
DC Dave Souch is anxious to brief his boss straight away. | 0:08:22 | 0:08:26
We got her to get straight to the point about what... | 0:08:26 | 0:08:28
about what's gone on before we start doing any in-depth work and bits and pieces. | 0:08:28 | 0:08:32
I'll get a statement from her, if she's happy to provide one. | 0:08:32 | 0:08:35
-So when did you make the decision to go? -I decided quite a few times. | 0:08:35 | 0:08:40
PC Angela Harwood is getting some background about why Shabana left home. | 0:08:40 | 0:08:45
I just couldn't take any more at all. | 0:08:45 | 0:08:48
Do you know, forget it, I don't want to be here. | 0:08:48 | 0:08:51
Then I just felt so helpless and hopeless. | 0:08:51 | 0:08:53
Following Shabana's account of what's happened, | 0:08:54 | 0:08:57
police believe they now have enough grounds to start making arrests. | 0:08:57 | 0:09:02
They plan to search the sister's house for any evidence, | 0:09:02 | 0:09:05
particularly relating to that hot, sweet milk. | 0:09:05 | 0:09:08
-We're looking for a mug, that's all she knows. -What colour? | 0:09:08 | 0:09:12
What colour was the mug you drank out of? A white mug? | 0:09:12 | 0:09:17
-Is it a standard mug or is it? -It's more a curved, round mug. | 0:09:17 | 0:09:21
-A curved round mug, Richard. White. Curved, round mug - white. -Round. | 0:09:21 | 0:09:27
And white. | 0:09:27 | 0:09:28
-What was the drink? -Milk. -Hot. -Hot milk. | 0:09:28 | 0:09:32
-And whereabouts did you put the mug down? -What room? | 0:09:32 | 0:09:35
-Put it back on the sink. -Put it back on the sink in the kitchen. | 0:09:35 | 0:09:38
-Colin's coming. -Yeah? | 0:09:38 | 0:09:41
Right. Um. | 0:09:44 | 0:09:46
They were saying to me, "Get a divorce. | 0:09:55 | 0:09:58
"Any guy would do but not him." | 0:09:58 | 0:10:00
-Was he angry? -Shabana recalls how her brother first came to her house. | 0:10:00 | 0:10:03
It was a terrifying experience. | 0:10:03 | 0:10:07
He said, "If you don't open the door I'm going to bash it in." | 0:10:09 | 0:10:13
He sounded angry and aggressive. | 0:10:14 | 0:10:18
-Were you frightened when he was banging on the door? -Yeah. Very frightened. | 0:10:18 | 0:10:24
-Shall we crack on? -Yes. -Right, thanks for coming. | 0:10:26 | 0:10:30
Basically we're going to execute a warrant to a corner terrace house. | 0:10:30 | 0:10:33
I'll just give you some background in relation to the job. | 0:10:33 | 0:10:38
PC Richard Jarram is briefing the arrest team. | 0:10:38 | 0:10:41
She was going to ne forced into a marriage against her will. | 0:10:41 | 0:10:46
There's plenty of backup but he's planning a low-key approach. | 0:10:48 | 0:10:52
We've had a quick look at the address as a fly-by fiscal visit. | 0:10:52 | 0:10:57
As I say, it's an end terrace house with a UPVC door. | 0:10:57 | 0:11:00
I'm assuming that we're going to be knocking on entry rather than using force. | 0:11:00 | 0:11:04
The warrant's here for you. | 0:11:04 | 0:11:07
So what we're looking for is a curved, round mug, white, | 0:11:07 | 0:11:12
maybe part of a set. | 0:11:12 | 0:11:14
Any medicine or signs of medicine having been crushed up, | 0:11:14 | 0:11:19
or any of what you'd consider to be a noxious substance that's at hand. | 0:11:19 | 0:11:24
The car in which she was in, is a Toyota Estima | 0:11:24 | 0:11:30
and it's outside the address. | 0:11:30 | 0:11:32
Oh, yeah, that's good. | 0:11:35 | 0:11:36
I've literally just finished taking a statement with her. | 0:11:36 | 0:11:40
All she wants to do is go back to be reunited with husband. | 0:11:40 | 0:11:44
They are now moving him to a safe house. | 0:11:44 | 0:11:48
The Lancashire Police team are on the way | 0:11:48 | 0:11:51
to make their arrests at Shabana's sister's house. | 0:11:51 | 0:11:53
Shabana is signing a statement that will be | 0:11:55 | 0:11:58
the basis of the evidence against her family. | 0:11:58 | 0:12:02
Whether we find anything it's going to be difficult. | 0:12:02 | 0:12:05
We may end up seizing a lot of items | 0:12:05 | 0:12:08
because to the naked eye | 0:12:08 | 0:12:10
we might not see what we're looking for, but after forensic examination | 0:12:10 | 0:12:14
we might actually find the vital bit of evidence. | 0:12:14 | 0:12:19
-Hiya, sorry to bother you. Richard Jarram from the police. -Yes. -May we come in? -Yes. | 0:12:21 | 0:12:26
We have a search warrant to search this address. | 0:12:31 | 0:12:33
Your sister's made certain allegations that we're following up, OK? | 0:12:33 | 0:12:39
Hello, sir. Are you husband? | 0:12:39 | 0:12:41
OK, I'm going to inform you that you're under arrest on suspicion of administering poison. | 0:12:41 | 0:12:47
The first arrest is Shabana's brother-in-law. | 0:12:48 | 0:12:51
He was driving the car she was found in. | 0:12:53 | 0:12:56
Anything you do say may be given in evidence. | 0:12:58 | 0:13:00
Do you understand that you're under arrest? | 0:13:00 | 0:13:02
Just over here. | 0:13:06 | 0:13:07
Next to be arrested are Shabana's father and her sister. | 0:13:07 | 0:13:11
-Sit behind this seat. -This seat? -Yes. | 0:13:14 | 0:13:18
-PHONE RINGS -Richard Jarram. | 0:13:23 | 0:13:26
Hi, Angie. | 0:13:26 | 0:13:29
Yeah, three arrested. On our way to Greenbank. | 0:13:31 | 0:13:33
Back at the police station, | 0:13:36 | 0:13:38
detectives decide that Shabana needs to stay overnight in a hotel, to allow her to rest | 0:13:38 | 0:13:43
and come in for further questioning in the morning. | 0:13:43 | 0:13:46
I need accommodation for a single female for tonight quite urgently, please. | 0:13:46 | 0:13:52
Thank you. Come on, chuck. I'm waiting for a car to turn up | 0:13:52 | 0:13:55
so I can take you to somewhere to get your head down. | 0:13:55 | 0:13:59
As Shabana leaves, her father and two other members of her family | 0:13:59 | 0:14:02
are brought in for questioning. | 0:14:02 | 0:14:05
She's taken a big step. | 0:14:05 | 0:14:08
-If you come in here... -No, come in. | 0:14:08 | 0:14:11
Shabana's brother-in-law arrives at the police station. | 0:14:14 | 0:14:18
He's destined to play a major part in this family drama. | 0:14:18 | 0:14:21
BUZZER | 0:14:21 | 0:14:24
Richard Jarram reports back to his bosses on what the search of the sister's home has uncovered. | 0:14:36 | 0:14:42
The cups at the house, there's a number that match the description | 0:14:42 | 0:14:46
-but they've all been washed. -Yes. -And they've all been put away. | 0:14:46 | 0:14:49
-There's nothing that stands out as the obvious instrument. -Right. | 0:14:49 | 0:14:53
Obviously we need to know how fast the forensics | 0:14:53 | 0:14:56
will turn round on the blood to tell us whether there's anything... | 0:14:56 | 0:15:01
-Is that urine as well? -Yeah. I think urine sample as well. | 0:15:01 | 0:15:05
So that's just being checked now. | 0:15:05 | 0:15:08
We've got them till about three o'clock tomorrow if necessary, haven't we? | 0:15:08 | 0:15:11
-Was it about three o'clock? -Half three. -All right. So we've plenty of time. | 0:15:11 | 0:15:15
The detectives discuss the plan of action for the next day. | 0:15:15 | 0:15:19
Shabana is required to give vital information | 0:15:19 | 0:15:21
before she rejoins her husband. | 0:15:21 | 0:15:25
There may be stuff to clarify after the interviews. | 0:15:25 | 0:15:27
-Yeah. -We may need another interview with her. | 0:15:27 | 0:15:29
-We'll then take her back home. -Yeah. | 0:15:29 | 0:15:32
And the agreement is that if we take her back, | 0:15:32 | 0:15:36
-we get a statement off husband. -Right. | 0:15:36 | 0:15:38
The first of Shabana's family to be questioned is her brother-in-law. | 0:15:46 | 0:15:50
He's requested a lawyer to be present. | 0:15:50 | 0:15:53
INDISTINCT CONVERSATION | 0:15:53 | 0:15:55
We've met her and she's been practically passed out in the vehicle. | 0:15:55 | 0:15:59
She didn't want to go back. | 0:15:59 | 0:16:01
A kidnap. | 0:16:02 | 0:16:04
The whole family are... So we'd normally base this on the forced marriage thing. Yeah? | 0:16:04 | 0:16:09
Whilst her brother-in-law is questioned, Shabana heads for her hotel. | 0:16:23 | 0:16:28
Her revelations have left the police with many unanswered questions. | 0:16:28 | 0:16:32
We've got a girl who, for whatever reason, | 0:16:35 | 0:16:38
has become stupefied by a chemical of some description. | 0:16:38 | 0:16:41
Um, we don't know what the reason for that was. | 0:16:41 | 0:16:46
Is it just to be able to control someone? | 0:16:46 | 0:16:50
Right up to, is it to do someone some serious harm? | 0:16:50 | 0:16:53
In which case, you go from one low spectrum of seriousness right up to, potentially, murder. | 0:16:53 | 0:16:59
She's had a drink of warm, sweet milk. | 0:17:05 | 0:17:07
And then, within five minutes, she's throwing up. | 0:17:08 | 0:17:11
Um, it's difficult to say what on earth was in that | 0:17:13 | 0:17:18
to make her be sick. | 0:17:18 | 0:17:21
It's all going to come down to toxicology reports as to what is actually in her system. | 0:17:21 | 0:17:27
It's been a long day and night | 0:17:40 | 0:17:42
but the detectives need to meet to compare notes. | 0:17:42 | 0:17:46
'There's an awful lot that we don't know.' | 0:17:47 | 0:17:50
Where she went in the car, which way the car was heading. | 0:17:50 | 0:17:53
Was she going where she wanted to go? | 0:17:53 | 0:17:55
Was she going against her own will? | 0:17:55 | 0:17:58
And obviously they're lines of enquiry. | 0:17:58 | 0:18:01
Do you want to give taped disclosure? | 0:18:01 | 0:18:03
I think we ought to in this case | 0:18:03 | 0:18:05
just in case that toxicology comes back as being iffy. | 0:18:05 | 0:18:08
The stories of the family members need to be crosschecked. | 0:18:08 | 0:18:12
Dave and Richard begin with Shabana's sister, | 0:18:12 | 0:18:15
someone she was very close to. | 0:18:15 | 0:18:18
She reveals that she saw her brother hitting Shabana during an argument. | 0:18:18 | 0:18:23
Brother's turned round and basically turned round | 0:18:24 | 0:18:26
and said, "You, wind your neck in. | 0:18:26 | 0:18:30
-"Do as you're told. I am going got tell her how it is." -Right. | 0:18:30 | 0:18:34
She said he was angry - mad, in effect. | 0:18:34 | 0:18:37
So they've gone into the living room and he starts talking | 0:18:37 | 0:18:42
about disrespecting people and actually pushes her onto the sofa. | 0:18:42 | 0:18:47
-Right. -At some point, brother has belted her across the face. | 0:18:47 | 0:18:53
-Yeah. -Did she not mention that? | 0:18:53 | 0:18:57
No, that's not mentioned in her statement. | 0:18:57 | 0:19:00
-So she's got a belt out of this. -Right. -She said, "I want to go." | 0:19:00 | 0:19:04
Brother's saying, "You ain't. | 0:19:04 | 0:19:05
"You're stopping here for a couple of days. You're doing this. | 0:19:05 | 0:19:09
-"You ain't leaving." -Right. | 0:19:09 | 0:19:10
So we've got a nice little false imprisonment from a witness there. | 0:19:10 | 0:19:13
The person doing all the talking and the bawling was her brother. | 0:19:13 | 0:19:17
He was the one making all the demands on people. | 0:19:17 | 0:19:21
And he was the one who was livid. | 0:19:23 | 0:19:26
Right. | 0:19:26 | 0:19:28
People are going to have to start to answer some very awkward questions | 0:19:29 | 0:19:33
and then it will come down to why has that happened to her? | 0:19:33 | 0:19:39
Explain. | 0:19:41 | 0:19:43
And then, no doubt, we can then go down the roads of | 0:19:43 | 0:19:47
dishonouring the family, disrespecting the family, big insults, | 0:19:47 | 0:19:53
how it affects their community standing. | 0:19:53 | 0:19:55
And see what they have to say. | 0:20:01 | 0:20:02
Shabana's father is asked about that honour issue. | 0:20:04 | 0:20:09
I said, "Well, you keep mentioning this honour, | 0:20:10 | 0:20:13
"about bringing shame to the family, dishonouring... | 0:20:13 | 0:20:16
"You know, bringing disgrace to the family, and that." | 0:20:16 | 0:20:20
So he explained that, no, no, no, | 0:20:20 | 0:20:22
although people do believe in that, other people, but he doesn't. | 0:20:22 | 0:20:25
The police case is building, and the detectives decide to arrest Shabana's brother. | 0:20:29 | 0:20:35
But because they've heard he was violent toward his sister, | 0:20:35 | 0:20:38
Dave Souch calls in some support. | 0:20:38 | 0:20:42
Unfortunately, we don't know a great deal about this lad, | 0:20:42 | 0:20:45
if he's handy or anything. | 0:20:45 | 0:20:47
That's why we like a section van there to transport him back to Greenbank. | 0:20:47 | 0:20:51
OK? | 0:20:54 | 0:20:55 | |
Thank you very much. Cheers, mate. | 0:20:55 | 0:20:58
What we're going to do is, lock him up first, | 0:21:00 | 0:21:04
keep him away from other family members, and then part four bail... | 0:21:04 | 0:21:10
..those who are already in custody, and then we deal with him in the morning. | 0:21:12 | 0:21:18
CAR ALARM | 0:21:20 | 0:21:23
You're going to be arrested on suspicion of administering | 0:21:33 | 0:21:37
a noxious fluid, and taken to Blackburn police station. | 0:21:37 | 0:21:41
Shabana's brother is the fourth member of the family to be arrested. | 0:21:41 | 0:21:45
Can I just text my partner to let them know that's what's happening? | 0:21:49 | 0:21:53
No, not at this stage. We'd speak to the custody sergeant, and he'd do it for you. | 0:21:53 | 0:21:57
Shabana's brother has a powerful role within the family. | 0:22:14 | 0:22:18
I'm authorising your detention here at the moment to secure and preserve evidence, | 0:22:18 | 0:22:22
and obtain evidence by questioning. | 0:22:22 | 0:22:24
Dad's never been around much in the family. | 0:22:24 | 0:22:27
And my big brother's always been there. | 0:22:27 | 0:22:29
He's the one who thinks... He is the one that's responsible, type of thing. | 0:22:29 | 0:22:33
Like, he's well known. | 0:22:33 | 0:22:35
When he walks around people are going to say to him, "Oh, where's your sister gone?" | 0:22:35 | 0:22:39
Like, he's going to get the blame for it, type of thing. | 0:22:39 | 0:22:44
It's like, shame for him. | 0:22:45 | 0:22:47
Like, he won't be able to bear it, that's what he said to me. | 0:22:47 | 0:22:50
What we're finding is several families think that what | 0:22:53 | 0:22:58
makes them what they are is this issue of honour. | 0:22:58 | 0:23:01
That their children, their grandchildren have to maintain it. | 0:23:01 | 0:23:06
And if they don't maintain it, there are consequences. | 0:23:06 | 0:23:09
In this case, Shabana's brother is most concerned about that. | 0:23:10 | 0:23:15
As he's being taken into a holding cell, | 0:23:17 | 0:23:19
Shabana's brother-in-law is being questioned. | 0:23:19 | 0:23:21
Right, the type is 00, 00 on... | 0:23:24 | 0:23:28
He's requested a solicitor, | 0:23:28 | 0:23:30
and she reads a statement that he's prepared. | 0:23:30 | 0:23:33
It contains a revelation that gives the police a major lead. | 0:23:33 | 0:23:38
-FROM RECORDING: -'There is a prepared statement, | 0:23:38 | 0:23:40
'it's pretty limited due to the language, | 0:23:40 | 0:23:42
'but it will just give a bit of background, and I think it might just help. | 0:23:42 | 0:23:46
'"I went to pick the children up, and when I came back | 0:23:46 | 0:23:49
'"I found out from my brother-in-law that they had given her something. | 0:23:49 | 0:23:54
'"Mother-in-law and brother-in-law were having this conversation. | 0:23:54 | 0:23:58
'"I suspected it to be Shamrez, and he said, I have given her something."' | 0:23:58 | 0:24:03
When Dave Souch returns after arresting Shabana's brother, Shamrez, | 0:24:03 | 0:24:07
he's told about the brother-in-law's statement. | 0:24:07 | 0:24:11
He's given a sort of prepared statement, | 0:24:11 | 0:24:14
but he's basically said, yeah, everything up to Tuesday, | 0:24:14 | 0:24:18
mother-in-law, brother has turned up, all very angry, quite apparent. | 0:24:18 | 0:24:24
Brother-in-law intimates, "Yeah, I've give her summat." | 0:24:24 | 0:24:28
Sorry? | 0:24:28 | 0:24:30
He says, "I can tell by looking at her she's been given something." That's on his prepared statement. | 0:24:30 | 0:24:34
So, spoke to the solicitor, she's prepared to let him answer them questions, | 0:24:36 | 0:24:40
and what he thinks the brother has meant | 0:24:40 | 0:24:41
when he said he's given her something, what does he mean. | 0:24:41 | 0:24:44
-Or somebody did. -Yeah, so just bear that in mind for the interview. | 0:24:47 | 0:24:50
Yeah. | 0:24:50 | 0:24:52 | |
Detective sergeant Colin Dassow also reports up the line about | 0:24:52 | 0:24:56
what the brother-in-law has been saying about Shabana's brother, Shamrez. | 0:24:56 | 0:24:59
Shamrez has said to him, "I've given her something." Right? | 0:24:59 | 0:25:02
Now, Shamrez is the one that Richard went to arrest, | 0:25:02 | 0:25:05
he's currently in the cells... | 0:25:05 | 0:25:07
Yeah, who we think's done it. | 0:25:07 | 0:25:10
And he's there present at all the bad stuff. | 0:25:10 | 0:25:13
So, it's all coming about, really. | 0:25:13 | 0:25:16
DC Sal Yusuf, who interviewed the brother-in-law, is delighted with how it went. | 0:25:16 | 0:25:20
It took me all of four minutes, no, 15 minutes to do the caution, | 0:25:20 | 0:25:23
and then within two minutes I'd had the confession. | 0:25:23 | 0:25:26
The news about the brother-in-law's interview is spreading. | 0:25:29 | 0:25:34
-I think there's a little bit of a cough coming on here. -I hope so. | 0:25:35 | 0:25:39
-No, from Sal's interview with the brother-in-law. -Brother-in-law, yeah. | 0:25:39 | 0:25:46
When the brother, Shamrez, is interviewed, he admits to hitting his sister, Shabana. | 0:25:46 | 0:25:50
Dave Souch also questions him about his visit to Shabana's house when she was away. | 0:26:07 | 0:26:12
Shabana's sister and father are going home on bail to return at a later date. | 0:26:30 | 0:26:35
Both have said they know nothing of any plot against Shabana. | 0:26:36 | 0:26:41
Her sister rejects the allegations against her, | 0:26:41 | 0:26:44
and says she is very close to Shabana. | 0:26:44 | 0:26:47
Shabana's father is separated from her mother, | 0:26:47 | 0:26:49
and is stunned by the charges against him. | 0:26:49 | 0:26:52
You've no suicide or self-harm issues? | 0:26:52 | 0:26:55
-I won't. -"I won't," he said. | 0:26:57 | 0:26:59
That's good enough for me. | 0:27:00 | 0:27:02
People do, unfortunately, so we have to ask the questions. | 0:27:05 | 0:27:09
Don't tempt fate like that. | 0:27:14 | 0:27:16
The next morning, the detective team meet | 0:27:28 | 0:27:31
to update everyone on what's been happening, and chew the case over. | 0:27:31 | 0:27:35
OK, let's run through yesterday's job. | 0:27:35 | 0:27:38
Our concerns are, that if she's been drugged, | 0:27:40 | 0:27:43
what was the purpose of the journey in the car? | 0:27:43 | 0:27:49
Was it to take her back to be with family? | 0:27:49 | 0:27:51
Or was there some more sinister motive? | 0:27:51 | 0:27:53
Whenever I went round the address, | 0:27:53 | 0:27:57
it was always they were expecting cops to arrest them. | 0:27:57 | 0:28:01
It was all so matter-of-fact, "You're under arrest." | 0:28:01 | 0:28:04
Yeah, brother clearly knows what he should and shouldn't be saying | 0:28:04 | 0:28:09
at this stage, like, "I don't need a solicitor, what can a solicitor | 0:28:09 | 0:28:13
"actually tell me to say to you what I don't already know?" | 0:28:13 | 0:28:18
Richard and Angela are going to examine the car Shabana was found in. | 0:28:19 | 0:28:25
They doubt the brother-in-law's claim he was driving her back to her husband. | 0:28:25 | 0:28:29
Why they acted the way they have when she's quite clearly ill, | 0:28:29 | 0:28:33
when they should be thinking about taking her to a hospital, | 0:28:33 | 0:28:36
which any reasonable person would be in those circumstances... | 0:28:36 | 0:28:40
The course of action they've taken is bizarre. | 0:28:41 | 0:28:44
It wouldn't be bizarre if their intention was to stupefy her | 0:28:44 | 0:28:48
so she doesn't put up any resistance. | 0:28:48 | 0:28:50
Or to stupefy her to harm her in some way. | 0:28:50 | 0:28:53
At the pound where the car is being held, | 0:28:53 | 0:28:56
a police photographer has already arrived to start capturing pictures | 0:28:56 | 0:29:01
that may be useful for the investigation. | 0:29:01 | 0:29:04
Richard discovers something that may be of interest. | 0:29:06 | 0:29:10
It's a bowl, like a washing-up bowl. | 0:29:10 | 0:29:12
It's got a couple of tissues in, by the looks of it, | 0:29:12 | 0:29:16
and what appears to be bile. | 0:29:16 | 0:29:18
Which would confirm that our lady was sick. | 0:29:19 | 0:29:25
And perhaps she was sick, | 0:29:25 | 0:29:27
or they'd got this ready for if she was sick in the car. | 0:29:27 | 0:29:30
Now, I'm going to take that satnav that's at the front. | 0:29:32 | 0:29:35
Can you just mind over, please? | 0:29:37 | 0:29:39
The vehicle's satellite navigation device is also taken away for analysis. | 0:29:39 | 0:29:44
It can be crucial evidence, really, because they may have | 0:29:44 | 0:29:48
programmed in certain addresses in different towns. | 0:29:48 | 0:29:52
In the end, however, the satnav doesn't reveal anything useful. | 0:29:52 | 0:29:56
Dave and Angela arrive at the hotel to pick up Shabana after she's had some sleep. | 0:30:08 | 0:30:12
Four of her family have now been arrested. | 0:30:14 | 0:30:17
You look a lot healthier, today. | 0:30:17 | 0:30:19
Most of us didn't finish till about three o'clock this morning, so we've had a busy day. | 0:30:22 | 0:30:27
Today, police will complete Shabana's formal statement. | 0:30:32 | 0:30:37
They've waited till now to help her recover from her ordeal. | 0:30:37 | 0:30:40
Right, yesterday, where do we go? | 0:30:40 | 0:30:44
During interview, a couple of things have come out. | 0:30:44 | 0:30:49
The main one is your brother was, in fact, absolutely raging. He was mad. | 0:30:49 | 0:30:53
And you've been taken into the living room where he's assaulted you. | 0:30:53 | 0:31:02
He's given you a good belt across the face, | 0:31:02 | 0:31:05
and he's pushed you onto the sofa. | 0:31:05 | 0:31:07
-Do you recall that? -Yeah. -Right. | 0:31:08 | 0:31:11
OK, we just need to take a quick statement to clarify | 0:31:11 | 0:31:14
what actually happened in the morning. | 0:31:14 | 0:31:17
She's remembered loads of stuff. | 0:31:27 | 0:31:30
One line that she can remember hearing was her mum going, | 0:31:30 | 0:31:33
"Oh, my God, you lot are stupid, she's vomiting, she's being sick. | 0:31:33 | 0:31:36
"You've made her sick." | 0:31:36 | 0:31:39
-There weren't going to let her out of the house. -That's all right. No problem. | 0:31:39 | 0:31:45
The police unit at Blackburn specialises in honour crime, | 0:31:45 | 0:31:48
so they're experienced in dealing with cases like this, | 0:31:48 | 0:31:52
and threats like those Shabana says her brother used. | 0:31:52 | 0:31:56
When he's assaulted you, what's he been saying to you? | 0:31:56 | 0:31:58
He said to me, basically, he'll kill me. | 0:31:58 | 0:32:00
Did he say, "I'll kill you if you don't do this, that and the other"? | 0:32:00 | 0:32:04
No, it was just like, "I'm going to kill you." | 0:32:04 | 0:32:07
I kept saying, "I want to go to my husband." I was scared, obviously. | 0:32:07 | 0:32:10
You know, I was on my own. | 0:32:10 | 0:32:12
-Did you believe that your brother would kill you at that time? -Yeah. -OK. | 0:32:12 | 0:32:16
Then he said, "You're not getting your phone back. | 0:32:20 | 0:32:23
"You're not going back." | 0:32:23 | 0:32:26
-Basically they came to take me back with them. -How do you know that? | 0:32:26 | 0:32:31
Because they burned my stuff. | 0:32:31 | 0:32:33
They said, "You're not going back there and you're coming back with us." | 0:32:33 | 0:32:36
That's when my mum said, "Sit down and we'll talk about this. | 0:32:37 | 0:32:42
I said to my sister, | 0:32:42 | 0:32:44
"Please pass me your house phone," and I'd ring the police." | 0:32:44 | 0:32:47
That's when my brother said to me, | 0:32:48 | 0:32:50
-"I'll kill you before they even arrive here." -OK. | 0:32:50 | 0:32:54
-Who was blocking your way? -My brother was in front of me, my mum | 0:32:57 | 0:33:03
was on the left, my brother-in-law was next to my brother. | 0:33:03 | 0:33:07
They were all around me. | 0:33:07 | 0:33:08
-Was he angry at the time he told you he'd kill you? -Very angry. | 0:33:08 | 0:33:13
I kept saying that I wanted to go to my husband, | 0:33:14 | 0:33:17
and, "You can't touch me." | 0:33:17 | 0:33:19
Cos he was touching me. | 0:33:19 | 0:33:21
That's when he physically pushed me down again and slapped me twice. | 0:33:21 | 0:33:27
Hang on. How did he hit you? Fist? Hand? | 0:33:27 | 0:33:30
He slapped me twice. I think that's because of that as well. | 0:33:30 | 0:33:34
When he hit me, it was like... everything echoed. Very like numb. | 0:33:34 | 0:33:42
My cheeks were stinging. I think that's because of that. | 0:33:42 | 0:33:46
The only person that was shocked like me was my sister. | 0:33:46 | 0:33:50
We were proper shocked. | 0:33:51 | 0:33:53
-Did you start crying? -I was crying already. | 0:33:53 | 0:33:57
I panicked because I knew I was alone. They can do anything. | 0:33:58 | 0:34:03
-Did you think you were going to die? -I thought my life was in danger, yeah. | 0:34:04 | 0:34:08
Prompted by Shabana's revelations, | 0:34:17 | 0:34:20
the police set off to make another arrest. | 0:34:20 | 0:34:23
She says that she recalls her mum saying | 0:34:23 | 0:34:27
when she was in this disorientated state, | 0:34:27 | 0:34:30
I think her exact words were, "Oh, God, look what you have done. | 0:34:30 | 0:34:37
"You lot, look what you lot have done." | 0:34:37 | 0:34:40
She has been sick which intimates that the family have done something to her to make her ill. | 0:34:41 | 0:34:50
Hello. Are you all right? | 0:34:56 | 0:34:57
She's not going to be very long, your wife. | 0:34:57 | 0:35:00
We are ready to interview her now. | 0:35:00 | 0:35:03
Shabana's mother becomes the fifth | 0:35:03 | 0:35:06
and final member of the family to be taken in for questioning. | 0:35:06 | 0:35:10
-How did you get on with the young lady? -Eight pages. | 0:35:20 | 0:35:25
-You still doing it? -Just finished it. | 0:35:25 | 0:35:29
She has had a sleep. She has got whatever was inside her out of her system. | 0:35:29 | 0:35:33
Very matter of fact. This is how it was. | 0:35:35 | 0:35:39
Which is nice because it ties in with what lots of other people | 0:35:41 | 0:35:47
have said in interviews. | 0:35:47 | 0:35:49
Yes, she was belted by her brother. | 0:35:49 | 0:35:52
He has threatened to kill her and she believed he was going to do it. | 0:35:52 | 0:35:56
Poor girl. | 0:35:57 | 0:35:59
Munover Shah a Muslim link worker at the police station checks on how | 0:35:59 | 0:36:04
Shabana is bearing up under the strain. | 0:36:04 | 0:36:06
Eat something at least. | 0:36:08 | 0:36:10
You need to flush out whatever it was. | 0:36:10 | 0:36:13
Don't say, "I don't want to eat." You need to eat to keep you going. | 0:36:15 | 0:36:21
To fight against what is coming. | 0:36:21 | 0:36:23
You need to keep yourself intact. | 0:36:25 | 0:36:28
Whatever you want to say, whatever's in your heart and mind, just tell them and they will sort you out. | 0:36:31 | 0:36:38
Where are you going now? | 0:36:38 | 0:36:39
I dressed up because I thought I was going to go to my husband today. | 0:36:39 | 0:36:44
I hope I do because I really miss him now. I really do. | 0:36:44 | 0:36:49
-Aw! -When he sees me, I don't want him to get worried. | 0:36:49 | 0:36:53
That is why I dressed up. I am going to put on a brave face. | 0:36:53 | 0:36:56
Be strong for him as well. | 0:36:56 | 0:36:58
The way things are happening, | 0:36:59 | 0:37:01
I think the community needs to learn | 0:37:01 | 0:37:03
that they need to talk to the children. | 0:37:03 | 0:37:05
What you can do with honour | 0:37:05 | 0:37:09
in the first place, then dishonour won't come upon you. | 0:37:09 | 0:37:16
If you sort yourself out in the first place. You need to speak | 0:37:16 | 0:37:23
to your children and meet them halfway. | 0:37:23 | 0:37:26
With her statement complete, officers are taking Shabana | 0:37:32 | 0:37:35
to be reunited with her husband at a secret location. | 0:37:35 | 0:37:40
The journey gives her time to reflect on the attitudes of some | 0:37:40 | 0:37:44
in the community around her. | 0:37:44 | 0:37:45
I think it is a real shame for the family | 0:37:45 | 0:37:51
if the girl goes away to get married with her own choice. | 0:37:51 | 0:37:56
Even sometimes if it's with your own cousin, they don't accept it. | 0:37:56 | 0:38:02
I don't know. Sometimes it is not even about marriage, it is about a girl working. | 0:38:02 | 0:38:10
Some families in Pakistan, they don't let you work either. | 0:38:10 | 0:38:17
Some girls, they are really close to their parents | 0:38:20 | 0:38:24
and they don't want to hurt their parents. | 0:38:24 | 0:38:29
Their parents could come round to it and accept the marriage | 0:38:29 | 0:38:34
and the children. | 0:38:34 | 0:38:35
Some parents don't. | 0:38:35 | 0:38:37
Obviously, they want you dead on the spot. | 0:38:37 | 0:38:40
Or they don't want to know you at all. | 0:38:40 | 0:38:43
It all comes down to family honour and shame. | 0:38:43 | 0:38:48
That's what it really is about. | 0:38:50 | 0:38:52
A week after arresting five members of Shabana's family on suspicion of poisoning, | 0:39:05 | 0:39:10
the police take their evidence | 0:39:10 | 0:39:12
to a lawyer from the Crown Prosecution Service. | 0:39:12 | 0:39:14
Lisa Worsley will decide what charges could be brought against members of the family. | 0:39:15 | 0:39:21
I'm just wondering, kidnap is the obvious charge for carting her off. | 0:39:21 | 0:39:29
I have looked briefly at administration of the noxious substance. | 0:39:29 | 0:39:35
We need to establish by forensics what that was. | 0:39:35 | 0:39:40
We have got the initial hurdle of proving, | 0:39:40 | 0:39:44
A - that they are in her system, B - that they have been put there | 0:39:44 | 0:39:48
illegally and they are not something she has voluntarily ingested. | 0:39:48 | 0:39:52
That the concentration of them is such that they must have been hidden. | 0:39:52 | 0:39:59
And that they are solely responsible for the reaction that was observed. | 0:39:59 | 0:40:05
Harassment? | 0:40:06 | 0:40:09
False imprisonment is a starter, isn't it? | 0:40:09 | 0:40:15
That was before the point at which she was administered whatever she was administered. | 0:40:15 | 0:40:20
You would expect her to have a recollection of that. | 0:40:20 | 0:40:23
I am reluctant to go back to her. We have already got two statements. | 0:40:24 | 0:40:28
I am reluctant to go back to her too many times | 0:40:28 | 0:40:31
because it looks like we are coaching her and prompting her. | 0:40:31 | 0:40:35
From reading the investigation, | 0:40:35 | 0:40:37
it is all about family honour from the family side. | 0:40:37 | 0:40:42
Even if they have not caused her to be in that state, | 0:40:42 | 0:40:46
they know what her symptoms are. | 0:40:46 | 0:40:49
We were not there, | 0:40:49 | 0:40:51
but it is only when this drink is given to her | 0:40:51 | 0:40:54
that she becomes ill. | 0:40:54 | 0:40:56
It is almost like it is a last-ditch attempt to stop her from going back. | 0:40:56 | 0:41:00
I will have a look at the content of conversations again. | 0:41:00 | 0:41:02
The harassment is probably a non-starter, but worth consideration. | 0:41:02 | 0:41:07
No problem. Thanks for your time. | 0:41:07 | 0:41:09
So, you will be in touch? | 0:41:09 | 0:41:11
The police have recovered Shabana's belongings which were taken from her home. | 0:41:17 | 0:41:21
Nearly two weeks after the arrests, they are taking them | 0:41:22 | 0:41:25
back to her new safe house. | 0:41:25 | 0:41:28
The detectives have heard Shabana is not happy with the location | 0:41:28 | 0:41:32
that has been chosen for her hideaway. | 0:41:32 | 0:41:35
She is fully aware that she stands out among this community | 0:41:35 | 0:41:39
because she is the only Asian lady in that area. | 0:41:39 | 0:41:44
Which is predominantly a white community so she does stand out. | 0:41:44 | 0:41:49
For all the best in the world, people will find out. | 0:41:52 | 0:41:58
The police team is concerned about Shabana's welfare. | 0:42:02 | 0:42:06
She is also the key witness and without her co-operation, | 0:42:06 | 0:42:09
the case could collapse. | 0:42:09 | 0:42:11
The less people know anything about her, | 0:42:12 | 0:42:15
the better it is for her safety. | 0:42:15 | 0:42:19
As soon as we fail to look after her properly, and she becomes | 0:42:19 | 0:42:23
at risk, potentially, she may refuse to co-operate. | 0:42:23 | 0:42:29
That would pose problems we do not need at this stage. | 0:42:29 | 0:42:33
All the time she is safe, well, happy, | 0:42:33 | 0:42:40
the better it is for others as investigators. | 0:42:40 | 0:42:43
The first thing on the agenda when Dave and Richard | 0:42:47 | 0:42:51
arrive at Shabana's temporary home is to check on how she is feeling. | 0:42:51 | 0:42:56
-Just to clarify you're happy here. -Yes. | 0:42:56 | 0:43:00
We do not want you to live like prisoners, | 0:43:00 | 0:43:03
but you must be mindful that your family is still trying to look for you. | 0:43:03 | 0:43:09
Hopefully, those efforts will come to nothing. | 0:43:09 | 0:43:12
-How are you getting on in this area? -It is all right now. | 0:43:12 | 0:43:15
At first, I said to you there were no Asian people. | 0:43:15 | 0:43:18
We found a few Indians. About the halal meat, Suzanne has asked a few people | 0:43:18 | 0:43:26
and she has find somebody for us. | 0:43:26 | 0:43:28
The people are nice, kind. | 0:43:30 | 0:43:33
-You're fitting in OK? -Yes. | 0:43:35 | 0:43:36
Reassured, Richard alerts Shabana to the real possibility that | 0:43:37 | 0:43:41
members of her family may now face serious charges. | 0:43:41 | 0:43:45
We have sent the blood and urine off that was taken off you at hospital to be forensically examined for any | 0:43:45 | 0:43:55
potential toxins or substances that made you ill. | 0:43:55 | 0:43:59
If we find something, we have been to the Crown Prosecution Service | 0:44:00 | 0:44:06
already and asked them what are the possibilities of prosecution. | 0:44:06 | 0:44:12
If we do find something, | 0:44:12 | 0:44:15
they will entertain a prosecution against one or more family members. | 0:44:15 | 0:44:20
You are still on board with that, I take it? | 0:44:20 | 0:44:23
-Yeah? -Yeah. I am getting nightmares though. -Sorry? | 0:44:23 | 0:44:28
I'm getting nightmares. Seriously. | 0:44:28 | 0:44:31
Like, my mum has taken me somewhere or my brothers. Just stupid things. | 0:44:31 | 0:44:36
I cannot sleep most of the time. | 0:44:36 | 0:44:39
It just goes through my head. I don't know why. | 0:44:39 | 0:44:41
You are going to have to work through that. | 0:44:41 | 0:44:44
-You are safe and well here. -Yeah. -You are safe and well here. | 0:44:44 | 0:44:51
-OK? Well, we're love you and leave you. -All right. | 0:44:52 | 0:44:54
A few weeks later, the toxicology report arrives. | 0:45:03 | 0:45:07
Its findings will be crucial. | 0:45:07 | 0:45:09
It could reveal what caused Shabana's condition | 0:45:09 | 0:45:12
after she drank the hot, sweet milk. | 0:45:12 | 0:45:15
We've got a statement back from a forensic scientist, | 0:45:17 | 0:45:20
who's analysed the urine. | 0:45:20 | 0:45:23
There's six pages. | 0:45:23 | 0:45:25
It confirms that there are traces of Lorazepam, a powerful sedative. | 0:45:25 | 0:45:31
This evidence is important, | 0:45:31 | 0:45:32
because it supports what we believed from the very onset, | 0:45:32 | 0:45:39
that she was given, administered a substance | 0:45:39 | 0:45:43
to render her, erm, unfit... | 0:45:43 | 0:45:47
..to, basically, subdue her, | 0:45:48 | 0:45:51
for what purpose we still don't know. | 0:45:51 | 0:45:53
But it confirms our suspicions from the onset. | 0:45:53 | 0:45:57
Putting a sleeping tablet, | 0:45:58 | 0:46:00
a prescription medication into somebody's drink, | 0:46:00 | 0:46:03
yeah, it is a desperate act. | 0:46:03 | 0:46:05
The toxicology report states that this drug is a prescription drug. | 0:46:05 | 0:46:09
It's not something you can find, you know, | 0:46:09 | 0:46:11
or put into a drink sort of by accident. | 0:46:11 | 0:46:16
It's something that's been placed there. | 0:46:16 | 0:46:19
We don't know what was going to happen to her. | 0:46:19 | 0:46:22
If the officer hadn't gone then, | 0:46:22 | 0:46:23
if they hadn't have been able to catch hold of the car, | 0:46:23 | 0:46:26
we don't know where the vehicle was heading. | 0:46:26 | 0:46:29
And that is what is worrying | 0:46:29 | 0:46:32
for, certainly, the investigating officers | 0:46:32 | 0:46:34
and why I feel that she had a very, very, very lucky escape. | 0:46:34 | 0:46:38
It's time for Richard to update the Crown Prosecution Service | 0:46:38 | 0:46:42
on latest developments. | 0:46:42 | 0:46:44
The brothers then sort of got involved, and... | 0:46:44 | 0:46:47
The lawyers have to assess the strength of the case. | 0:46:47 | 0:46:50
And the villain of the piece is Shamrez Khan. | 0:46:53 | 0:46:56
The bottom line is, from the family's point of view, | 0:46:56 | 0:46:59
this is a question of honour, | 0:46:59 | 0:47:00
and it's been made clear, you know, | 0:47:00 | 0:47:02
that disrespecting the family is an honour-type situation, isn't it? | 0:47:02 | 0:47:06
-I don't think there's any dispute about that. -No. | 0:47:06 | 0:47:09
It's about the family honour | 0:47:09 | 0:47:10
and her doing things that are not consistent with where they see... | 0:47:10 | 0:47:14
the family going, with whatever. | 0:47:14 | 0:47:16
So we're fairly clear on that. | 0:47:16 | 0:47:18
These are photographs of... | 0:47:18 | 0:47:21
Richard briefs the lawyers | 0:47:21 | 0:47:23
on how Shabana's brother had climbed through her kitchen window | 0:47:23 | 0:47:26
while she was away | 0:47:26 | 0:47:28
and how Shabana's belongings were taken. | 0:47:28 | 0:47:30
At this point, | 0:47:30 | 0:47:33
mum and brother start sort of collecting all... | 0:47:33 | 0:47:37
Her personal belongings? | 0:47:37 | 0:47:40
All her stuff, yeah, everything that's there that's belonging to her, | 0:47:40 | 0:47:43
-and also, crucially, the passport and the marriage certificate. -Oh, dear. | 0:47:43 | 0:47:47
-OK? -Which means control. | 0:47:49 | 0:47:50
A lot of control, yeah. | 0:47:50 | 0:47:52
-But we're not talking about a normal burglary here, are we? -No. | 0:47:52 | 0:47:55
What we're talking about, | 0:47:55 | 0:47:57
this behaviour is just part of the same thing. | 0:47:57 | 0:48:00
Yeah, to control her. | 0:48:00 | 0:48:01
So whether or not we go for burglary at the end of the day, | 0:48:01 | 0:48:04
if we're satisfied about the evidence, | 0:48:04 | 0:48:06
is another matter, isn't it? | 0:48:06 | 0:48:07
It's probably just all part of the same incident, | 0:48:07 | 0:48:12
which is basically... | 0:48:12 | 0:48:14
What we're saying is that it looks like | 0:48:14 | 0:48:16
they're conspiring to kidnap her, aren't they, and imprison her? | 0:48:16 | 0:48:19
That's what, basically, we're saying. | 0:48:19 | 0:48:21
Whichever way you look at this, this case, it seems to be a runner. | 0:48:21 | 0:48:25
It's something where we would be looking to build it. | 0:48:25 | 0:48:29
-It's destined for the Crown Court. OK? -Thank you. -All right. | 0:48:29 | 0:48:33
After further investigations, | 0:48:39 | 0:48:41
the police bring all five members of the family back | 0:48:41 | 0:48:44
for formal charging for kidnap, false imprisonment | 0:48:44 | 0:48:48
and administering the drug Lorazepam. | 0:48:48 | 0:48:50
You're charged with the offences shown below. | 0:48:50 | 0:48:53
Even though Shabana has said she trusts her sister Saima, | 0:48:53 | 0:48:56
she is still charged. | 0:48:56 | 0:48:59
Do we call you Mohammed? Is that OK? | 0:48:59 | 0:49:01
-Or...? -Her father, Mohammed, | 0:49:01 | 0:49:03
is still baffled by what is happening. | 0:49:03 | 0:49:05
-Do you want to make any reply to the charges? -Not guilty. | 0:49:05 | 0:49:08
-Not guilty. -Not guilty. | 0:49:08 | 0:49:09
Her brother Shamrez Khan wants more detail of the charges. | 0:49:19 | 0:49:23
Shamrez, this is a joint charge | 0:49:23 | 0:49:26
with the other family members that appeared today. OK? | 0:49:26 | 0:49:29
Do you want to make any... | 0:49:31 | 0:49:33
..reply to the charges? | 0:49:35 | 0:49:37
It says, "Namely, false imprisonment," | 0:49:42 | 0:49:44
ie you've kept somebody in an area against their will. | 0:49:44 | 0:49:49
And that one's actually kidnap. | 0:49:49 | 0:49:51
That's actually moving someone from one place to another. | 0:49:51 | 0:49:54
-OK? So he's asking you if you've any reply to make. -No comment, no. | 0:49:54 | 0:49:57
OK. Thank you. | 0:49:57 | 0:49:59
OK? You must attend court on that date. | 0:50:00 | 0:50:02
If you don't, there will be a warrant issued for your arrest. All right? | 0:50:02 | 0:50:06
Her mother, Shamim Akhtar, who helped collect | 0:50:06 | 0:50:09
Shabana's belongings, | 0:50:09 | 0:50:11
also faces charges. | 0:50:11 | 0:50:12
And finally, Shabana's brother-in-law, Zahid Mahmood, | 0:50:15 | 0:50:18
is called forward. | 0:50:18 | 0:50:20
He stated that Shabana's brother told him he had given her sedatives. | 0:50:20 | 0:50:23
You're charged with four offences, Zahid, OK? | 0:50:23 | 0:50:27
And released on bail to appear at court. | 0:50:27 | 0:50:29
In a later statement, | 0:50:30 | 0:50:32
he said he couldn't be certain about what he said. | 0:50:32 | 0:50:35
But now it's time for a jury to decide who and what to believe. | 0:50:35 | 0:50:39
I don't think they were expecting | 0:50:41 | 0:50:43
the seriousness of the charges. | 0:50:43 | 0:50:46
Obviously, they were informed | 0:50:46 | 0:50:47
prior to attending the police station this morning via their solicitors | 0:50:47 | 0:50:51
that they were facing charges, | 0:50:51 | 0:50:52
but we didn't tell them the nature of the offences | 0:50:52 | 0:50:55
with which they were going to be charged. | 0:50:55 | 0:50:57
Yeah, I think it took the wind out of their sails, really. | 0:50:58 | 0:51:02
Anyone that's faced any one of them particular charges, | 0:51:04 | 0:51:07
would be automatically going to Crown Court, | 0:51:07 | 0:51:10
they're indictable-only offences. | 0:51:10 | 0:51:13
Erm, quite serious offences, | 0:51:13 | 0:51:15
each of them carries a life sentence - potentially. | 0:51:15 | 0:51:19
Obviously, in this case, it would be up to a judge to decide the relevant sentences, | 0:51:19 | 0:51:25
should they be found guilty. | 0:51:25 | 0:51:27
And...the next port of call is court. | 0:51:27 | 0:51:29
Right, I'll see you out. OK. | 0:51:29 | 0:51:32
When the case comes to its full trial, | 0:51:40 | 0:51:43
the five defendants arrive to face their peers on the jury. | 0:51:43 | 0:51:46
For the police, just getting legal proceedings started is an achievement | 0:51:46 | 0:51:50
in itself because of the pressures such accusations put on families. | 0:51:50 | 0:51:55
Most people who're in her situation or similar situations, | 0:51:59 | 0:52:03
don't want to attend court | 0:52:03 | 0:52:05
and don't want to send their family to prison. | 0:52:05 | 0:52:09
The thought of that and criminalising them | 0:52:09 | 0:52:12
is a very difficult choice to make. | 0:52:12 | 0:52:14
For the number of investigations we do in relation to forced marriages, | 0:52:16 | 0:52:21
very few actually come to court | 0:52:21 | 0:52:26
because before we get to that stage, before we do a prosecution with | 0:52:26 | 0:52:30
the Crown Prosecution Service, many of the victims want to withdraw. | 0:52:30 | 0:52:34
The court allows Shabana to give her evidence from behind a screen, | 0:52:35 | 0:52:39
so she is hidden from her family's view. | 0:52:39 | 0:52:42
Even so the whole thing is a tremendous ordeal. | 0:52:42 | 0:52:45
This young lady has been waiting two years for the trial | 0:52:46 | 0:52:50
and she's spent the last two years coming to terms with the fact | 0:52:50 | 0:52:54
that the people closest to her could harm her and wanted to harm her. | 0:52:54 | 0:53:00
So it's been a difficult time for her, trying to rebuild a life | 0:53:00 | 0:53:03
but also knowing that at some point she'd have to give | 0:53:03 | 0:53:06
evidence against her family. | 0:53:06 | 0:53:09
She did say that she just got used to not hearing her family's voice. | 0:53:09 | 0:53:14
Her sisters, her mum and dad, just general family life, | 0:53:14 | 0:53:19
and now she has to see or hear them again | 0:53:19 | 0:53:22
and hearing the voices in the corridor was very difficult for her, | 0:53:22 | 0:53:26
it brought her other life back to her. | 0:53:26 | 0:53:31
She was really upset about that. | 0:53:31 | 0:53:33
All five family members plead not guilty to the charges of kidnap, | 0:53:35 | 0:53:40
false imprisonment and administering a drug. | 0:53:40 | 0:53:43
But Shabana's brother and brother-in-law change their pleas | 0:53:44 | 0:53:47
to guilty during the proceedings. | 0:53:47 | 0:53:49
After nearly three weeks, her mother is also found guilty | 0:53:53 | 0:53:57
but Shabana's sister and her father are acquitted on all charges. | 0:53:57 | 0:54:02
The police pass on the news of the convictions to Shabana. | 0:54:04 | 0:54:07
When we spoke to her afterwards she said it was perhaps | 0:54:07 | 0:54:11
one of the worst times of her life. | 0:54:11 | 0:54:13
Ultimately what she wants to come out of it is, it shouldn't | 0:54:13 | 0:54:19
have happened to me and I don't want it to happen to anybody else. | 0:54:19 | 0:54:23
After being declared innocent, Shabana's sister gives her reaction through her barrister. | 0:54:23 | 0:54:27
This is also a very tragic day as far as she's concerned | 0:54:29 | 0:54:33
because not only has she been exonerated but members of her | 0:54:33 | 0:54:35
family have now found themselves in custody facing very serious charges | 0:54:35 | 0:54:42
and likely prison sentences. | 0:54:42 | 0:54:44
The family are divided, hopefully in the future there will be | 0:54:44 | 0:54:48
a possibility of some form of reconciliation between the sisters. | 0:54:48 | 0:54:54
Shabana's father, too, reveals his feelings | 0:54:57 | 0:55:00
and how the trial has split the family apart. | 0:55:00 | 0:55:03
"I strongly condemn the acts of my family members for any | 0:55:05 | 0:55:09
"wrongdoing and they should be punished for that. | 0:55:09 | 0:55:12
"And also want to say I am against any sort of force | 0:55:12 | 0:55:16
"used against your daughters to get them married against their will." | 0:55:16 | 0:55:19
-Thank you very much. -What do you think about your daughter? | 0:55:19 | 0:55:22
-I've no comments. -Would you say anything to your daughter? | 0:55:22 | 0:55:25
Do you want to say anything to your daughter? | 0:55:25 | 0:55:28
Well, I still miss her. I can't express my... | 0:55:28 | 0:55:32
..Nor can I forget her but she forget me. I don't know why, how. | 0:55:32 | 0:55:37
I miss her and I love her. | 0:55:37 | 0:55:43
For Shabana, the end of the trial is not an end to the hurt. | 0:55:46 | 0:55:52
But, even before the trauma of the trial itself, she recognised | 0:55:52 | 0:55:56
it could be the beginning of a new life - | 0:55:56 | 0:55:59
a life perhaps without her family. | 0:55:59 | 0:56:02
I can't imagine my life without running away and back in that family, | 0:56:05 | 0:56:11
living the life like I was, because I wasn't going nowhere. | 0:56:11 | 0:56:16
And what's happened now has happened because they've made it happen. | 0:56:16 | 0:56:20
She's sort of torn between the love for her family | 0:56:21 | 0:56:25
and what has happened to her. | 0:56:25 | 0:56:27
And that is part of the healing process she's going through. | 0:56:27 | 0:56:32
I've got no feelings left, if you know what I mean. | 0:56:32 | 0:56:36
Like, what's happened has happened and when I just let go, | 0:56:36 | 0:56:39
forget I ever had a family - | 0:56:39 | 0:56:41
if that's the way it has to be now. | 0:56:41 | 0:56:43
