Harvey!
Harvey! | 0:00:10 | 0:00:12
This Sunday the 90th
Academy Awards will take place. | 0:00:12 | 0:00:14
For the first time in many
years, one power figure | 0:00:14 | 0:00:16
will not be welcome. | 0:00:16 | 0:00:20
More than 100 women have now come
forward with stories | 0:00:20 | 0:00:22
of sexual harassment,
assault and rape going back decades. | 0:00:22 | 0:00:30
I just remember feeling so small. | 0:00:30 | 0:00:32
And so inconsequential,
and so powerless. | 0:00:32 | 0:00:39
Had me groped. | 0:00:39 | 0:00:46
Very tired. | 0:00:46 | 0:00:47
I was trying to resist and say no. | 0:00:47 | 0:00:49
You know in that moment that
you may not make it. | 0:00:49 | 0:00:52
It's not about sex. | 0:00:52 | 0:00:53
It's not about sex,
it's always about power. | 0:00:53 | 0:01:00
It's part and parcel of doing
business in Hollywood. | 0:01:00 | 0:01:03
This is a filthy stables and Harvey
is merely the guy who has taken | 0:01:03 | 0:01:07
the biggest dump in it. | 0:01:07 | 0:01:14
This is the inside story of how one
of Hollywood's most powerful men | 0:01:14 | 0:01:17
suppressed allegations of sexual
abuse for decades. | 0:01:17 | 0:01:20
Harvey Weinstein had an incredibly
complex machine designed to maintain | 0:01:20 | 0:01:23
silence around this. | 0:01:23 | 0:01:25
We got very angry and said,
I've investigated you, | 0:01:25 | 0:01:28
and you're not so clean,
so be careful. | 0:01:28 | 0:01:33
It saddens me that everyone woke up
because of Harvey Weinstein. | 0:01:33 | 0:01:38
On the other hand, thank
God we've woken up. | 0:01:38 | 0:01:46
I was just out of acting
school, going on auditions | 0:01:50 | 0:01:53
and pounding the pavement. | 0:01:53 | 0:01:56
The first time I met
him was in his office. | 0:01:59 | 0:02:03
It was at a meeting
set up by my agents. | 0:02:03 | 0:02:09
The first moments of that meeting
were very easy, breezy, casual. | 0:02:09 | 0:02:15
And I felt very much like he was
going to take care of me. | 0:02:15 | 0:02:18
It was 1994. | 0:02:18 | 0:02:21
Actress Katherine Kendall thought
she was about to get her big break. | 0:02:21 | 0:02:25
She'd been invited by Harvey
Weinstein to a movie screening. | 0:02:25 | 0:02:29
He sent his driver to collect her. | 0:02:29 | 0:02:33
Once I got there, I realised it
wasn't a special screening | 0:02:33 | 0:02:36
with cast and crew. | 0:02:36 | 0:02:38
It was just a movie. | 0:02:38 | 0:02:46
I knew I'd been had.
I mean, I knew I'd been tricked. | 0:02:46 | 0:02:50
I wanted to leave. | 0:02:50 | 0:02:52
He said, I'll take you home. | 0:02:52 | 0:02:58
We ended up stopping at his house. | 0:02:58 | 0:03:04
And then I ended up going up,
probably against my better judgment. | 0:03:04 | 0:03:09
Once I was in there,
we had an hour-long conversation | 0:03:09 | 0:03:13
about movies and film and books. | 0:03:13 | 0:03:16
It was almost like
he had my playlist. | 0:03:16 | 0:03:19
And he knew exactly
what book to talk about. | 0:03:19 | 0:03:22
And he knew that book,
the way I knew that book. | 0:03:22 | 0:03:25
And he knew who to quote
and what passage to quote. | 0:03:25 | 0:03:29
And he knew the author,
and he had the rights | 0:03:29 | 0:03:32
to that book, actually. | 0:03:32 | 0:03:32
He was going to make
a movie of that book. | 0:03:32 | 0:03:36
I kind of got up to
leave, or get my stuff. | 0:03:36 | 0:03:42
And he went into the other room
and he came back with a robe on. | 0:03:42 | 0:03:49
And the robe was just an open robe. | 0:03:49 | 0:03:53
I didn't even look
to see, you know... | 0:03:53 | 0:03:55
I was just so stunned. | 0:03:55 | 0:04:00
There was no, like,
suave moves or anything. | 0:04:00 | 0:04:08
There was just a really
weird, awkward, "Will | 0:04:09 | 0:04:12
you give me a massage?" | 0:04:12 | 0:04:13
I had to say, just no. | 0:04:13 | 0:04:15
He said, well, a lot
of other people do it. | 0:04:15 | 0:04:18
I mean, so-and-so does it
all the time, and she's one | 0:04:18 | 0:04:20
of my really good friends. | 0:04:20 | 0:04:22
I said no, I'm not comfortable. | 0:04:22 | 0:04:23
At one point he said... | 0:04:23 | 0:04:26
If you won't let me kiss
you or touch you or something, God, | 0:04:26 | 0:04:29
I don't know, will you at least lift
up your shirt and show me your tits? | 0:04:29 | 0:04:36
He left the room and he came back. | 0:04:36 | 0:04:38
And this time when he came back,
he was just fully naked. | 0:04:38 | 0:04:41
I thought, he's coming after me. | 0:04:41 | 0:04:44
You know in that moment that
you may not make it. | 0:04:44 | 0:04:51
I said, you know, I can't believe
you're doing this to me. | 0:04:51 | 0:04:58
You are undermining me in a way
that is so painful, you know? | 0:04:58 | 0:05:02
And he... | 0:05:02 | 0:05:06
I mean... | 0:05:06 | 0:05:10
I don't know if he heard
me, but he may have. | 0:05:10 | 0:05:15
I was able to finally get a way out. | 0:05:15 | 0:05:21
I knew that if I went up
against Harvey Weinstein, | 0:05:21 | 0:05:25
just instinctually,
I would be squashed. | 0:05:25 | 0:05:27
So, I was scared. | 0:05:27 | 0:05:31
So, I didn't say anything. | 0:05:31 | 0:05:36
To the people that might have
been able to help me. | 0:05:36 | 0:05:43
It began in Buffalo. | 0:06:00 | 0:06:02
It all began in Buffalo. | 0:06:02 | 0:06:07
It was a brash young fellow
from Flushing, Queens, | 0:06:07 | 0:06:11
who arrived here as an 18-year-old
freshman at the | 0:06:11 | 0:06:13
University of Buffalo. | 0:06:13 | 0:06:16
I believe he only put in a year
before he was just kind | 0:06:16 | 0:06:19
of mesmerised by all
of the opportunities | 0:06:19 | 0:06:23
that awaited him here. | 0:06:23 | 0:06:30
In Buffalo, Harvey Weinstein built
up a successful career | 0:06:30 | 0:06:31
in the music business. | 0:06:31 | 0:06:35
Then, in 1980, he
made his first film. | 0:06:35 | 0:06:40
24-year-old Paula Wachowiak
applied to be an intern. | 0:06:40 | 0:06:44
And he said, how would you like to
work on a movie I'm making? | 0:06:44 | 0:06:48
So, I was excited. | 0:06:48 | 0:06:50
I thought, yeah. | 0:06:50 | 0:06:56
It was a gory film about a guy that
comes back for revenge | 0:06:56 | 0:07:00
and murders people. | 0:07:00 | 0:07:03
During filming, Paula says
she was asked to take some cheques | 0:07:05 | 0:07:10
to Harvey Weinstein's hotel room
for him to sign. | 0:07:10 | 0:07:12
I opened the door. | 0:07:12 | 0:07:16
He was standing there, and he had
a hand towel around his waist. | 0:07:16 | 0:07:23
So, all these things started flying
through my head, how calm | 0:07:23 | 0:07:25
he was without his clothes on. | 0:07:25 | 0:07:28
Which to me seemed unusual. | 0:07:28 | 0:07:32
I handed him the folder,
and he dropped the hand towel. | 0:07:32 | 0:07:37
And all the while he's asking me
questions about cheques. | 0:07:37 | 0:07:39
And he sat down on the bed. | 0:07:39 | 0:07:43
And he plopped
the folder on his lap. | 0:07:43 | 0:07:47
And then he started saying,
what about this one? | 0:07:47 | 0:07:49
And he's pointing. | 0:07:49 | 0:07:50
And I'm not going to look down. | 0:07:50 | 0:07:52
So I say, which one is that, Harvey? | 0:07:52 | 0:07:55
Then he said, I have
a crick in my shoulder. | 0:07:55 | 0:07:59
He said, could you give
me a massage, could | 0:07:59 | 0:08:02
you rub it out for me? | 0:08:02 | 0:08:05
And at that point I looked
at him and I said, Harvey, | 0:08:05 | 0:08:08
I don't think that's
in my job description. | 0:08:08 | 0:08:11
At the end of the shoot,
he said to me, just in this tone... | 0:08:21 | 0:08:25
IN A SMUG AND FLIRTATIOUS TONE: So,
was it the high point | 0:08:25 | 0:08:28
of your internship to see me naked? | 0:08:28 | 0:08:30
And I looked at him and I was like,
Harvey, no, you disgust me. | 0:08:31 | 0:08:35
And he laughed. | 0:08:35 | 0:08:42
Harvey Weinstein soon left
Buffalo for New York City. | 0:08:48 | 0:08:55
Here, with his brother Bob,
he grew the company that | 0:08:56 | 0:08:59
would make them famous -
Miramax. | 0:08:59 | 0:09:01
They saw themselves as artists. | 0:09:01 | 0:09:03
Outsiders to the Hollywood system. | 0:09:03 | 0:09:06
At Miramax we are not under that
corporate pressure to say, Jesus, | 0:09:06 | 0:09:09
we've got to go up each year. | 0:09:09 | 0:09:12
We can do what we think is good,
and if our profits are lower next | 0:09:12 | 0:09:16
year than they were the year
before, so what. | 0:09:16 | 0:09:18
So what, as long
as we did good work. | 0:09:18 | 0:09:22
I first met Harvey when he started
to come over to the UK. | 0:09:22 | 0:09:27
What made Harvey so successful
is there is nobody around | 0:09:27 | 0:09:29
who works harder than him. | 0:09:29 | 0:09:32
Seemed to be able to speed read,
could consume books, | 0:09:32 | 0:09:34
articles, films, scripts,
at a phenomenal rate. | 0:09:34 | 0:09:39
Seems to have a photographic memory. | 0:09:39 | 0:09:44
And he used that to power this kind
of insatiable lust for success. | 0:09:44 | 0:09:50
Miramax's niche became making
the kind of movies that mainstream | 0:09:50 | 0:09:54
Hollywood studios had ignored. | 0:09:54 | 0:10:00
With a script or a book,
I try to do what would appeal to me. | 0:10:00 | 0:10:03
And I'm not here to do
the mainstream movies. | 0:10:03 | 0:10:06
I want to take the audience
on an incredible journey. | 0:10:06 | 0:10:11
He became, basically,
the quality judge for a lot | 0:10:11 | 0:10:15
of independent cinema
for many, many years. | 0:10:15 | 0:10:17
At least two decades. | 0:10:17 | 0:10:20
And it was because he had
an instinct for intense emotions. | 0:10:20 | 0:10:24
And he could understand the basic
nature of drama in ways that many | 0:10:24 | 0:10:27
business people wouldn't. | 0:10:27 | 0:10:29
Come on, we got 'em. | 0:10:29 | 0:10:32
Miramax was working with some
of Hollywood's top talent. | 0:10:32 | 0:10:40
In 1992, Sean Young starred
in their new film, Love Crimes. | 0:10:43 | 0:10:45
Who are you? | 0:10:45 | 0:10:46
District attorney, asshole. | 0:10:46 | 0:10:49
It was about a man who poses
as a photographer so he | 0:10:49 | 0:10:53
could prey on women. | 0:10:53 | 0:10:55
I play a character who discovers
this sexual predator | 0:10:55 | 0:10:59
and then tracks them down. | 0:10:59 | 0:11:01
The wire went out, I wanted
to get him on a felony | 0:11:01 | 0:11:04
and I needed him on tape. | 0:11:04 | 0:11:06
I was sitting in Harvey's
office after the picture. | 0:11:06 | 0:11:10
And this is the only time
this has ever happened | 0:11:10 | 0:11:12
to me, he pulled his... | 0:11:12 | 0:11:16
Thing out, and my response
was, you know, Harvey. | 0:11:16 | 0:11:21
I really wouldn't be
pulling that thing out, | 0:11:21 | 0:11:24
because it's really not pretty. | 0:11:24 | 0:11:26
And I got up and I left. | 0:11:26 | 0:11:30
Actresses are expected to be
obedient, talented, and, | 0:11:30 | 0:11:34
depending on the person, available. | 0:11:34 | 0:11:41
But I upset a few important men. | 0:11:41 | 0:11:44
And the trajectory of my
career went wooo... | 0:11:44 | 0:11:52
The reason I didn't get another
movie with Harvey Weinstein was that | 0:11:55 | 0:11:58
I made him feel foolish. | 0:11:58 | 0:12:05
In 1993, Harvey Weinstein cut
a deal that gave Miramax | 0:12:13 | 0:12:17
massive financial clout. | 0:12:17 | 0:12:21
They were now being bankrolled
by the Disney company. | 0:12:21 | 0:12:27
Miramax was one of the hottest
production companies in the world. | 0:12:27 | 0:12:29
And Harvey Weinstein
was its leading man. | 0:12:30 | 0:12:36
Working at Miramax was
like being in a cult. | 0:12:36 | 0:12:38
The cult of Harvey. | 0:12:38 | 0:12:42
I took the job in 1995 as president
of production for Miramax. | 0:12:42 | 0:12:49
It was a long process
of seduction from Harvey. | 0:12:49 | 0:12:52
I knew I was making
a deal with the devil. | 0:12:52 | 0:12:55
I knew he was a bully. | 0:12:55 | 0:12:58
I knew he was a dangerous character. | 0:12:58 | 0:13:06
But I knew also that he
was at the epicentre | 0:13:07 | 0:13:09
of where I wanted to be. | 0:13:09 | 0:13:11
Once the deal was done,
everything changed. | 0:13:11 | 0:13:18
In one of my first production
meetings at Miramax, | 0:13:18 | 0:13:20
Harvey was getting angrier
and angrier, as he often did. | 0:13:20 | 0:13:23
He turned to me, his president
of production and said, | 0:13:23 | 0:13:29
"Well, what do you think,
Mr President of production?!" | 0:13:29 | 0:13:31
So, immediately shrinking me
to kind of micro size. | 0:13:31 | 0:13:34
And then he proceeded
to say something else. | 0:13:34 | 0:13:36
I said, Harvey, that's not true. | 0:13:36 | 0:13:44
And that was a cue for a tirade
of abuse, basically. | 0:13:45 | 0:13:48
Which, you know... | 0:13:48 | 0:13:49
I still remember with horror. | 0:13:49 | 0:13:53
People that I knew within
the company were afraid. | 0:13:53 | 0:14:01
They all knew that they had
the potential to work | 0:14:01 | 0:14:06
on great movies, OK? | 0:14:06 | 0:14:07
And the question was
always, is that worth it? | 0:14:07 | 0:14:10
Oh, my love. | 0:14:10 | 0:14:11
I thought you were dead. | 0:14:11 | 0:14:13
A part in a Miramax film
could mean artistic | 0:14:13 | 0:14:16
credibility, fame and awards. | 0:14:16 | 0:14:21
In 1998, 26-year-old Gwyneth Paltrow
appeared in Shakespeare In Love. | 0:14:21 | 0:14:29
The movie propelled her
to international stardom | 0:14:31 | 0:14:35
and won both Paltrow
and Harvey Weinstein an Oscar. | 0:14:35 | 0:14:39
This is a movie about life and art. | 0:14:39 | 0:14:42
And art and life combining
is called Magic. | 0:14:42 | 0:14:45
However, an ugly story had begun
to circulate around Hollywood. | 0:14:45 | 0:14:49
We had heard that Gwyneth Paltrow
had been assaulted. | 0:14:49 | 0:14:53
We heard it from a director
who was very upset about it. | 0:14:53 | 0:14:59
And we thought, well, yeah,
we've got to try and do this. | 0:14:59 | 0:15:02
Kim Masters was a journalist
working in Hollywood | 0:15:02 | 0:15:03
with contacts inside Miramax. | 0:15:03 | 0:15:06
Intermittently we would call
someone we knew who worked | 0:15:10 | 0:15:13
there, someone who left. | 0:15:13 | 0:15:15
But it was just, there was no path
forward at that point at all. | 0:15:15 | 0:15:18
If you called their publicist
and said I want to talk | 0:15:18 | 0:15:21
to Gwyneth Paltrow because I heard
she was attacked by Harvey | 0:15:21 | 0:15:24
Weinstein, you can imagine how that
phone call would go. | 0:15:24 | 0:15:26
It would be short. | 0:15:26 | 0:15:28
Last year, Gwyneth Paltrow went
on the record about the rumours. | 0:15:28 | 0:15:36
She didn't accuse Harvey Weinstein
of assault but told reporters that | 0:15:36 | 0:15:39
when she was 22 years old he had
sexually harassed her. | 0:15:39 | 0:15:42
He'd suggested a massage
in his hotel bedroom, | 0:15:42 | 0:15:44
which she'd refused. | 0:15:44 | 0:15:51
I remember one executive saying
that there are people | 0:15:51 | 0:15:53
who are famous, and there are people
who are not famous. | 0:15:53 | 0:15:57
And I was, like, OK the famous
people are not going to want to go | 0:15:57 | 0:16:00
there, but what about those
who are not famous. | 0:16:00 | 0:16:03
So, the question was who were they,
and we never got a name. | 0:16:03 | 0:16:07
I mean, we never got a single name. | 0:16:07 | 0:16:11
Harvey Weinstein had
a small army of assistants, | 0:16:11 | 0:16:13
usually young women. | 0:16:13 | 0:16:15
Bright and ambitious,
but with little experience | 0:16:15 | 0:16:18
in the world of work. | 0:16:18 | 0:16:22
For four years, Zelda Perkins was
employed in Miramax's London office. | 0:16:22 | 0:16:28
He had a repertoire that included
constant requests of massage, | 0:16:28 | 0:16:31
constantly appearing
in the room undressed. | 0:16:31 | 0:16:36
His first meeting would usually be
8:30 in the morning, | 0:16:36 | 0:16:38
and generally when you turned up
he would still be in bed. | 0:16:38 | 0:16:42
So, he would have a habit of trying
to grab you from the bed | 0:16:42 | 0:16:45
and say come on, you know,
come and have a cuddle, | 0:16:45 | 0:16:48
come and lie down. | 0:16:48 | 0:16:52
The first time that I travelled
alone abroad with him, | 0:16:52 | 0:16:56
he insisted that I went
into the bathroom while he had a | 0:16:56 | 0:16:59
sauna because he needed to do work. | 0:16:59 | 0:17:05
And he was reeling off names
of all the actresses that he had had | 0:17:05 | 0:17:10
some sort of sexual relations with,
or had given him | 0:17:10 | 0:17:12
massages, or whatever. | 0:17:12 | 0:17:15
And I remember looking
round at him and saying, | 0:17:15 | 0:17:17
how do you look at
yourself in the mirror? | 0:17:17 | 0:17:20
How do you do that? | 0:17:20 | 0:17:25
I can remember him looking back
at me utterly nonplussed, | 0:17:25 | 0:17:28
and saying I have no problem at all. | 0:17:28 | 0:17:36
The Venice Film Festival
in 1998 was when things | 0:17:42 | 0:17:46
really came to a head. | 0:17:46 | 0:17:49
I had a new colleague with me
who was there to assist with Harvey. | 0:17:49 | 0:17:57
She came to me in a very
distressed state, and told me | 0:17:57 | 0:18:05
that he had assaulted her,
that he had attempted to rape her. | 0:18:06 | 0:18:11
I was completely sideswiped by this,
because I honestly never | 0:18:11 | 0:18:14
believed that Harvey
would physically overpower anybody. | 0:18:14 | 0:18:22
I went straight to Harvey
and confronted him, and he swore | 0:18:24 | 0:18:27
on the life of his wife and children
that absolutely | 0:18:27 | 0:18:29
nothing had happened. | 0:18:29 | 0:18:33
I was very aware of his tactics,
and swearing on the life of his wife | 0:18:33 | 0:18:36
and children was a very familiar
get out of jail card. | 0:18:36 | 0:18:42
Back in the UK, Zelda
and her colleague quit Miramax | 0:18:42 | 0:18:45
and took legal advice. | 0:18:45 | 0:18:53
There didn't seem to be
any recourse in terms | 0:18:53 | 0:18:55
of bringing Harvey to justice. | 0:18:55 | 0:19:02
We had no physical proof, we hadn't
gone to the police in Venice. | 0:19:02 | 0:19:06
Really the only option that we were
given was to request damages. | 0:19:06 | 0:19:14
During the negotiations,
Zelda and her colleague agreed | 0:19:14 | 0:19:19
a payment of £125,000 each. | 0:19:19 | 0:19:21
They were asked to sign
a nondisclosure agreement, | 0:19:21 | 0:19:24
common in many media organisations. | 0:19:24 | 0:19:27
But her agreement went
further than most. | 0:19:27 | 0:19:31
This wasn't a normal
confidentiality agreement. | 0:19:31 | 0:19:39
This wasn't us saying
that we weren't going to give | 0:19:40 | 0:19:42
away corporate secrets. | 0:19:42 | 0:19:43
This was a deeply personally
binding agreement. | 0:19:43 | 0:19:49
Harvey Weinstein has admitted that
over the last 30 years he's | 0:19:49 | 0:19:51
settled up to nine claims
of harassment against him. | 0:19:51 | 0:19:55
When he settled with Zelda Perkins,
it was his brother and Miramax | 0:19:55 | 0:19:59
co-founder Bob Weinstein
who provided the money. | 0:19:59 | 0:20:05
He has said that he believed
it was to conceal affairs. | 0:20:05 | 0:20:10
The use of NDAs on behalf
of Weinstein was an enabling factor. | 0:20:10 | 0:20:16
It allowed him to silence
complaining victims and just see it | 0:20:16 | 0:20:18
as a cost of doing business. | 0:20:18 | 0:20:25
And learning that he could
successfully use NDAs to buy | 0:20:25 | 0:20:28
silence, he also knew that he had
nothing to fear from continuing | 0:20:28 | 0:20:32
with the behaviour that led
to the problem in the first place. | 0:20:32 | 0:20:36
And again, and again, and again. | 0:20:36 | 0:20:40
Zelda had been silenced, but she was
determined to fight back. | 0:20:40 | 0:20:46
She wanted better protection
for women in the company | 0:20:46 | 0:20:49
and a clause in the agreement that
could see him fired | 0:20:49 | 0:20:52
if he paid off anyone else. | 0:20:52 | 0:20:53
And that wasn't all. | 0:20:53 | 0:20:56
We insisted that he had to go
to therapy, and I had to be present | 0:20:56 | 0:21:00
in the first therapy session to make
sure that he talked | 0:21:00 | 0:21:07
about the issues, and that there had
to be a big new HR policy that | 0:21:07 | 0:21:10
informed all employees
of their rights. | 0:21:10 | 0:21:14
Zelda successfully pushed
through most of her demands, | 0:21:14 | 0:21:16
but when it came to the therapy
sessions there was a stalemate. | 0:21:16 | 0:21:21
They kept holding us
off and holding us off, | 0:21:21 | 0:21:24
and to be honest I was exhausted
and pretty broken from | 0:21:24 | 0:21:27
the whole experience. | 0:21:27 | 0:21:33
And I gave up, I gave up
pushing, and I actually... | 0:21:33 | 0:21:37
I went abroad for a while. | 0:21:37 | 0:21:40
And so I have no idea
whether he complied | 0:21:40 | 0:21:43
with the therapy or not. | 0:21:43 | 0:21:51
So you take your cheque,
and you try to deal | 0:21:58 | 0:22:00
with it as best you can. | 0:22:00 | 0:22:03
He got away with it for years just
on the strength of that. | 0:22:03 | 0:22:09
Only a small circle of people knew
about the allegations being levelled | 0:22:09 | 0:22:12
against Harvey Weinstein. | 0:22:12 | 0:22:16
However, some of those who worked
for him were beginning | 0:22:16 | 0:22:19
to connect the dots. | 0:22:19 | 0:22:24
I think we were all complicit
because you were in there, | 0:22:24 | 0:22:27
you are in the company,
it was part of doing | 0:22:27 | 0:22:29
business at Miramax. | 0:22:29 | 0:22:34
My memory is that I was fully aware
that Harvey was a serial womaniser, | 0:22:34 | 0:22:38
that there would be times when you'd
be kicked out of the suite | 0:22:38 | 0:22:42
of the Savoy or the Peninsula Hotel
in LA, and he would entertain. | 0:22:42 | 0:22:50
But I think it didn't take too much
brain power to put it together that | 0:22:50 | 0:22:54
a man who was so abusive
and bullying in every aspect | 0:22:54 | 0:22:57
of his life would bring that abuse
into the sexual arena. | 0:22:57 | 0:23:02
I think, looking back, that I did
know and I chose to suppress it. | 0:23:02 | 0:23:08
I chose to hide from that fact. | 0:23:08 | 0:23:12
Could I have done
anything at the time? | 0:23:12 | 0:23:16
Well, I know that I prevented my
assistant being called | 0:23:16 | 0:23:19
to the Savoy Hotel late at night. | 0:23:19 | 0:23:20
I said no, you can't go. | 0:23:20 | 0:23:26
So, obviously I was aware of that. | 0:23:26 | 0:23:28
I didn't have the guts
to do anything about it, | 0:23:28 | 0:23:32
I think the deal I'd made
with the devil was to my advantage. | 0:23:32 | 0:23:38
Harvey Weinstein was now
Hollywood's most powerful | 0:23:38 | 0:23:40
independent film producer,
and a regular at film festivals. | 0:23:40 | 0:23:48
At Cannes, his films had won
the top prize three times. | 0:23:48 | 0:23:55
A number of women also say
they were harassed or assaulted | 0:23:55 | 0:23:58
by Harvey Weinstein here. | 0:23:58 | 0:24:01
In 1998, I was 24,
modelling around the world. | 0:24:01 | 0:24:09
I thought I was tough. | 0:24:09 | 0:24:13
Zoe Brock joined the head
of her modelling agency | 0:24:13 | 0:24:15
on a private trip to Cannes. | 0:24:15 | 0:24:17
She hoped it would help her career. | 0:24:17 | 0:24:24
I flew to the south of France,
and we were taken into | 0:24:24 | 0:24:26
the Majestic Hotel to have dinner. | 0:24:26 | 0:24:28
That was where I was
sat next to Harvey. | 0:24:28 | 0:24:34
As the evening was drawing
to a close, Zoe's friends got | 0:24:34 | 0:24:36
into a taxi and she says
Harvey Weinstein offered her a lift. | 0:24:36 | 0:24:42
Then Harvey told us that
he'd spoken to everybody | 0:24:42 | 0:24:45
and that they were going to join us
at the Du Cap, where he was staying, | 0:24:45 | 0:24:49
which is 30 minutes out
of Cannes and quite remote. | 0:24:49 | 0:24:54
My friends were never coming. | 0:24:54 | 0:24:56
That was a blatant lie. | 0:24:56 | 0:25:00
When they arrived at the hotel,
Harvey Weinstein's | 0:25:00 | 0:25:02
entourage also melted away. | 0:25:02 | 0:25:07
Zoe believes that he engineered
the evening so that she would | 0:25:07 | 0:25:10
end up alone with him. | 0:25:10 | 0:25:12
I was in this crazy old hotel
in the middle of nowhere, | 0:25:12 | 0:25:17
and I remember sobering up, fast. | 0:25:17 | 0:25:23
And then Harvey walked back
in and he was naked. | 0:25:23 | 0:25:30
And that's a sight. | 0:25:30 | 0:25:35
And I think Harvey knows
what a sight that is, | 0:25:35 | 0:25:38
and that's part of it. | 0:25:38 | 0:25:39
You know? | 0:25:39 | 0:25:43
It's stunning, it's stunning
and discombobulating, | 0:25:43 | 0:25:46
because this person has been acting
like a mentor, making you feel | 0:25:46 | 0:25:49
like you're fabulous. | 0:25:49 | 0:25:51
And all of a sudden there's a dick
in your face, literally. | 0:25:51 | 0:25:56
So he's negotiating,
he's negotiating massage. | 0:25:56 | 0:25:59
I want a massage, come
on give me a massage. | 0:25:59 | 0:26:02
You know, let me give you a massage. | 0:26:02 | 0:26:04
And he's rapid-fire and he takes
control of the situation. | 0:26:04 | 0:26:10
I very cautiously and unwillingly
let him manoeuvre me | 0:26:10 | 0:26:15
into his bedroom, and he started
to massage my shoulders. | 0:26:15 | 0:26:23
Within seconds I knew
that there was no way this | 0:26:25 | 0:26:28
was happening, and I got up,
and I bolted into the bathroom. | 0:26:28 | 0:26:32
And he chased me. | 0:26:32 | 0:26:35
I remember locking the door
and him being on the other | 0:26:35 | 0:26:37
side of it and banging. | 0:26:37 | 0:26:42
That's when I strangely
channelled this weird anger, | 0:26:42 | 0:26:44
and I was fucking furious. | 0:26:44 | 0:26:49
I screamed at him, put your fucking
clothes on you naughty fucking boy! | 0:26:49 | 0:26:56
And I meant it. | 0:26:56 | 0:26:59
And it worked. | 0:26:59 | 0:27:03
I came out of the bathroom
and he was apologising, | 0:27:03 | 0:27:05
and he started to cry. | 0:27:05 | 0:27:13
He said something that
I have never forgotten, | 0:27:15 | 0:27:18
and I never will for the rest
of my days, in between his tears, | 0:27:18 | 0:27:21
"you don't like me because I'm fat." | 0:27:21 | 0:27:27
Harvey Weinstein has not denied
Zoe Brock's allegations, but says | 0:27:27 | 0:27:30
she is publicising her lawsuit
for damages against him. | 0:27:30 | 0:27:34
The number of women allegedly
harassed by Harvey Weinstein | 0:27:34 | 0:27:39
was growing, but it was still only
industry insiders who had | 0:27:39 | 0:27:42
heard the stories. | 0:27:42 | 0:27:45
And if journalists got too close,
Harvey Weinstein had friends | 0:27:45 | 0:27:50
who could help him out. | 0:27:50 | 0:27:55
Harvey liked to have a good
relationship with the media. | 0:27:55 | 0:27:58
I guess because I'm a Brooklyn guy
and he's a Queens guy, | 0:27:58 | 0:28:01
and most gossip columnists tend
to be gay or women or Brits, | 0:28:01 | 0:28:04
and I was none of those
things, he took to me. | 0:28:04 | 0:28:09
We'd spend some time
on the phone shooting the breeze | 0:28:09 | 0:28:12
about what went on last night,
where were the parties, | 0:28:12 | 0:28:14
what did you do. | 0:28:14 | 0:28:15
You know, just a couple
of guys talking. | 0:28:15 | 0:28:19
Benza says he'd heard nothing
about sexual misconduct, | 0:28:19 | 0:28:23
but he did pick up a tip
about his friend having an affair. | 0:28:23 | 0:28:27
I called him and he said it's not
true, it's not true, it's not true. | 0:28:27 | 0:28:31
And then he called back and said OK,
there's something to it. | 0:28:31 | 0:28:34
Let's try to work this out. | 0:28:34 | 0:28:35
And he said look, I can't
afford this bad publicity, | 0:28:35 | 0:28:38
I can't afford it. | 0:28:38 | 0:28:41
Benza says they cut a deal. | 0:28:41 | 0:28:43
He was paid to supply celebrity
gossip to Harvey Weinstein | 0:28:43 | 0:28:47
so he could trade it with reporters
who dug up dirt on him. | 0:28:47 | 0:28:52
The gossip industry is run
on the barter system. | 0:28:52 | 0:28:58
If I've got a story
about you and you don't | 0:28:58 | 0:29:00
want to print it you say hold it,
I'll get you something better. | 0:29:00 | 0:29:03
And I'll say, you've got an hour. | 0:29:03 | 0:29:05
And you'll come back in 15 minutes
with a better story, | 0:29:05 | 0:29:08
and I'll print the other story
and save you. | 0:29:08 | 0:29:10
That's done every day. | 0:29:10 | 0:29:11
So what Harvey and I were
doing, it's always done. | 0:29:11 | 0:29:14
Harvey Weinstein denies
there was any such deal. | 0:29:14 | 0:29:22
TINA BROWN: The real Harvey
was a very dark, very paranoid man. | 0:29:23 | 0:29:31
He was just obsessed with knowing
where the remote glimmer of a piece | 0:29:34 | 0:29:37
of bad press came from. | 0:29:37 | 0:29:38
And I mean really trivial. | 0:29:38 | 0:29:39
In 1999, Harvey Weinstein
had acquired a new way | 0:29:39 | 0:29:42
to control his public image. | 0:29:42 | 0:29:44
He set up his own magazine
and a publishing house. | 0:29:44 | 0:29:49
It was my idea to create a magazine
that was a search engine | 0:29:49 | 0:29:52
culturally for movies,
documentaries that could be a place | 0:29:52 | 0:29:54
as a centre of thought. | 0:29:54 | 0:29:56
That's about the best thing that
I ever came up with, | 0:29:56 | 0:29:59
the rest of it is Tina Brown's. | 0:29:59 | 0:30:03
When I went to work for him,
I found that the creativity | 0:30:03 | 0:30:08
was really completely a sidebar. | 0:30:08 | 0:30:15
The fact is that he really just
wanted to control me and it. | 0:30:15 | 0:30:18
For him to have a magazine like Talk
was a way for him surround himself | 0:30:18 | 0:30:22
in press protection. | 0:30:22 | 0:30:23
Tina Brown believed
that he was commissioning articles | 0:30:23 | 0:30:25
from journalists who had stories
about him he didn't want published. | 0:30:25 | 0:30:28
I would be continually getting calls
from journalists who would say, | 0:30:28 | 0:30:32
"I saw Harvey last night
and he commissioned a piece | 0:30:32 | 0:30:36
for me about whatever." | 0:30:36 | 0:30:38
And I would think, I don't want
you writing for this magazine. | 0:30:38 | 0:30:42
I mean, it was usually some gossip
columnist or some kind | 0:30:42 | 0:30:44
of somewhat nefarious writer
of tabloid journalism. | 0:30:44 | 0:30:49
Over in the publishing division,
Tina Brown discovered that | 0:30:49 | 0:30:52
Harvey Weinstein was giving out book
deals to people who | 0:30:52 | 0:30:55
had never written before. | 0:30:55 | 0:30:57
One of them was a stewardess
on a Miramax plane. | 0:30:57 | 0:31:00
So it was, what was that for? | 0:31:00 | 0:31:04
Was it because she'd seen things
he wanted to make sure didn't come | 0:31:04 | 0:31:07
to the light of day? | 0:31:07 | 0:31:09
Or was she somebody
that he found attractive? | 0:31:09 | 0:31:11
I had no idea, but there was this
book advance with no due date. | 0:31:11 | 0:31:15
That was the clue. | 0:31:15 | 0:31:17
Despite Harvey Weinstein's control
of parts of the press, | 0:31:18 | 0:31:22
journalist Kim Masters
was still pursuing her story. | 0:31:22 | 0:31:29
I met him at the Peninsula Hotel
for the first time face-to-face. | 0:31:29 | 0:31:33
I had written something he didn't
like, so he comes in very | 0:31:33 | 0:31:36
aggressive, yelling and screaming. | 0:31:36 | 0:31:41
"Why do you write
this shit about me?! | 0:31:41 | 0:31:43
What have you heard about me?" | 0:31:43 | 0:31:44
And I sort of had this now
or never think, and I said, | 0:31:44 | 0:31:47
"I've heard you raped women." | 0:31:47 | 0:31:49
He did not seem shocked or outraged. | 0:31:49 | 0:31:52
You would expect a normal person
to say, what, how dare you. | 0:31:52 | 0:31:55
There was none of that at all. | 0:31:55 | 0:31:57
Harvey Weinstein confirms this
exchange took place. | 0:31:57 | 0:32:02
He says he denied it and wasn't
shocked because he was already aware | 0:32:02 | 0:32:05
of a rape allegation,
which he says was false. | 0:32:05 | 0:32:10
He kind of believed, as he did
with reason for years to come, | 0:32:10 | 0:32:13
that he was going to be untouchable. | 0:32:13 | 0:32:16
In 2002, four years after leaving
Miramax, Harvey Weinstein's former | 0:32:17 | 0:32:22
assistant Zelda Perkins got a call
out of the blue. | 0:32:22 | 0:32:27
I picked up the phone and this
gentleman asked me directly | 0:32:27 | 0:32:32
about whether I had an agreement
with Harvey Weinstein. | 0:32:32 | 0:32:35
She was frightened. | 0:32:35 | 0:32:37
And when I got her on the phone,
she was really terrified. | 0:32:37 | 0:32:40
How did you find me? | 0:32:40 | 0:32:44
I think I might have even said,
yes, when he said, do | 0:32:44 | 0:32:47
you have an agreement with Harvey,
and then panicked and said, | 0:32:47 | 0:32:50
no, no I haven't. | 0:32:50 | 0:32:51
Yes I have! | 0:32:51 | 0:32:54
No I haven't! | 0:32:54 | 0:32:55
I can't talk to you. | 0:32:55 | 0:32:58
I just knew that one thing
I absolutely, on fear of death, | 0:32:58 | 0:33:00
I wasn't allowed to talk
to a journalist. | 0:33:00 | 0:33:04
Zelda Perkins did not say any
more to Ken Auletta. | 0:33:04 | 0:33:08
But like Kim Masters before him,
he confronted Harvey Weinstein. | 0:33:08 | 0:33:12
I said, Harvey, tell me
about Zelda Perkins. | 0:33:12 | 0:33:17
He rose and he clenched his fists
and he raised his shoulders | 0:33:17 | 0:33:25
and he said, "This is a f..." | 0:33:28 | 0:33:35
You can imagine "..an outrage,"
and he started screaming at me. | 0:33:35 | 0:33:37
So I thought, he's going
to throw a punch at me. | 0:33:37 | 0:33:40
So I stood up. | 0:33:40 | 0:33:41
And at that point,
Harvey started to cry. | 0:33:41 | 0:33:43
It was extraordinary. | 0:33:43 | 0:33:44
And what he said was, Ken,
you're going to ruin my marriage. | 0:33:44 | 0:33:47
These were consensual relationships
and if you publish this you're | 0:33:47 | 0:33:50
going to destroy my family. | 0:33:50 | 0:33:56
I wish I could have
nailed the guy in 2002. | 0:33:57 | 0:33:59
The problem I had was that
I couldn't prove it. | 0:33:59 | 0:34:03
Clearly, people knew
or suspected that Harvey | 0:34:03 | 0:34:06
was a predator, a sexual predator. | 0:34:06 | 0:34:08
And they kept their mouths shut. | 0:34:08 | 0:34:13
Three years later, Bob
and Harvey Weinstein left Miramax | 0:34:13 | 0:34:16
and started the Weinstein Company. | 0:34:16 | 0:34:20
There followed an award winning run
of commercial and critical hits. | 0:34:20 | 0:34:25
Thank you, Harvey Weinstein. | 0:34:25 | 0:34:27
And of course, Harvey. | 0:34:27 | 0:34:30
Harvey, thank you for killing
whoever you had to kill | 0:34:30 | 0:34:32
to get me up here today. | 0:34:32 | 0:34:34
LAUGHTER. | 0:34:34 | 0:34:39
I just want to thank my agent,
Kevin Huvane, | 0:34:39 | 0:34:41
and God -
Harvey Weinstein. | 0:34:41 | 0:34:42
LAUGHTER. | 0:34:42 | 0:34:44
APPLAUSE. | 0:34:44 | 0:34:52
Feted by Hollywood's A-list, he was | 0:34:54 | 0:34:57
still able to persuade young
actresses to meet him in hotel | 0:34:57 | 0:34:59
rooms. Often here in Beverly Hills. | 0:34:59 | 0:35:01
The Peninsula Hotel served
as not just an office | 0:35:01 | 0:35:03
for Harvey Weinstein
when he was in LA, outside | 0:35:03 | 0:35:07
of the official office
for his company, but also was kind | 0:35:07 | 0:35:09
of ground zero for his
predatory behaviour. | 0:35:09 | 0:35:15
In 2011, he invited
actress Jessica Barth | 0:35:15 | 0:35:17
for a business meeting here. | 0:35:17 | 0:35:21
He said that there was a role
in Sarah Jessica Parker's new film. | 0:35:21 | 0:35:26
And then it very quickly shifted
to asking me to give him | 0:35:26 | 0:35:29
a naked massage in the bed. | 0:35:29 | 0:35:32
And I was like, I'm married. | 0:35:32 | 0:35:40
I said, you are too, right? | 0:35:40 | 0:35:42
And he said, yes, but we
have an arrangement. | 0:35:42 | 0:35:48
I said, you know what, Harvey, | 0:35:48 | 0:35:50
I'm about done with this
conversation right now. | 0:35:50 | 0:35:53
So I left, I shut the door,
and I burst into tears. | 0:35:53 | 0:35:59
I told my mother, and she
was devastated for me. | 0:35:59 | 0:36:03
And then I told Seth MacFarlane. | 0:36:03 | 0:36:05
He was a close friend of mine. | 0:36:05 | 0:36:06
Good morning. | 0:36:06 | 0:36:08
I'm Seth MacFarlane,
the host of the Oscars. | 0:36:08 | 0:36:11
The 2012 nominees for best
performance by an actress | 0:36:11 | 0:36:14
in a supporting role are... | 0:36:14 | 0:36:21
When I first saw Seth say the joke
at the Academy Awards I was shocked. | 0:36:21 | 0:36:25
Congratulations, you five ladies no
longer have to pretend to be | 0:36:25 | 0:36:27
attracted to Harvey Weinstein. | 0:36:27 | 0:36:31
LAUGHTER | 0:36:31 | 0:36:37
I was like, good, I'm
glad he just did that. | 0:36:37 | 0:36:40
I don't think people knew the extent
of what this man was capable of. | 0:36:40 | 0:36:43
He definitely had a reputation
in Hollywood, but I guess | 0:36:43 | 0:36:45
they still wanted to make movies
and collect their awards | 0:36:45 | 0:36:48
and go on their merry way. | 0:36:48 | 0:36:49
Harvey Weinstein has not denied
Jessica Barth's account. | 0:36:49 | 0:36:57
Stories about Harvey Weinstein's
predatory behaviour were now | 0:36:57 | 0:37:01
well known in Hollywood. | 0:37:01 | 0:37:04
He commanded a movie empire
and was also growing a TV division, | 0:37:04 | 0:37:08
working with broadcasters around
the world, including the BBC. | 0:37:08 | 0:37:12
His longest running
show is Project Runway. | 0:37:12 | 0:37:13
Welcome to the runway. | 0:37:13 | 0:37:15
As you know, in fashion,
one day you're in, | 0:37:15 | 0:37:17
and the next day, you're out. | 0:37:17 | 0:37:23
Aspiring models and designers fought
it out to launch their careers. | 0:37:23 | 0:37:25
I mean, as a man, I can
tell you that I like | 0:37:25 | 0:37:28
girls to look like that. | 0:37:28 | 0:37:32
It's my belief that Harvey has
structured his professional life | 0:37:32 | 0:37:35
in order to have access to women. | 0:37:35 | 0:37:40
He's used the movie industry
to have access to women. | 0:37:40 | 0:37:43
And he's done exactly the same thing
with the modelling industry. | 0:37:43 | 0:37:48
In 2014, Kadian Noble was building
a career as a model. | 0:37:48 | 0:37:56
She first met Harvey Weinstein
at a Bafta party in London. | 0:37:59 | 0:38:02
There's Oprah Winfrey,
there's Naomi Campbell. | 0:38:02 | 0:38:05
The champagne is flowing. | 0:38:05 | 0:38:07
There is everyone just
gliding across the room. | 0:38:07 | 0:38:15
I was stood by the bar when Harvey
looked at me and he called me over, | 0:38:16 | 0:38:20
is he talking to me! | 0:38:20 | 0:38:24
He said to me, it's going to be
good for you, I have | 0:38:24 | 0:38:27
something in mind for you. | 0:38:27 | 0:38:29
I was just thinking,
oh my god, oh my god, | 0:38:29 | 0:38:31
this is really happening. | 0:38:31 | 0:38:34
The next time I bumped
into Harvey Weinstein was May 2014 | 0:38:36 | 0:38:40
at the Cannes Film Festival. | 0:38:40 | 0:38:45
I was in the lobby
at the Majestic Hotel. | 0:38:45 | 0:38:48
And he approached me
and again, I am, oh my God. | 0:38:48 | 0:38:51
He said he hadn't had time
to look at my showreel | 0:38:51 | 0:38:56
but if I was willing to go up
with him to have a look at it. | 0:38:56 | 0:38:59
Of course I have it
with me, why not. | 0:38:59 | 0:39:07
We walked it up to
his room, his suite. | 0:39:07 | 0:39:09
He asked me to have
a seat on the sofa. | 0:39:09 | 0:39:11
He then looked at me
and said, I want to know | 0:39:11 | 0:39:14
that you really like me. | 0:39:14 | 0:39:15
And I said to him, what do you mean? | 0:39:15 | 0:39:18
I was really confused because I'm
thinking, what do you mean? | 0:39:18 | 0:39:20
Genuinely, genuinely confused. | 0:39:20 | 0:39:25
Then he gripped my arm
in a forceful way. | 0:39:25 | 0:39:29
Really holding onto my arm. | 0:39:29 | 0:39:34
He led me into the bathroom. | 0:39:34 | 0:39:40
Kadian says that Harvey Weinstein
then sexually assaulted her. | 0:39:40 | 0:39:44
He pulled my dress down
and I wasn't wearing a bra. | 0:39:44 | 0:39:49
He was rubbing my breast. | 0:39:49 | 0:39:52
He had me gripped. | 0:39:52 | 0:39:54
Very tight. | 0:39:54 | 0:39:56
And I was trying
to resist and say no. | 0:39:56 | 0:40:00
I was saying, why. | 0:40:00 | 0:40:02
He was telling me to relax, relax. | 0:40:02 | 0:40:08
He was using his leg
to stroke my vagina from behind. | 0:40:08 | 0:40:11
Pressing his leg from behind me. | 0:40:11 | 0:40:18
He turned me around whilst
he unbuckled his trousers | 0:40:18 | 0:40:25
and exposed his penis and said
to me, "Don't worry, I'm not | 0:40:25 | 0:40:30
going to ask you to suck it." | 0:40:30 | 0:40:33
And he started to
masturbate himself. | 0:40:33 | 0:40:35
And he forced my hand and used my
hand to help him with the process, | 0:40:35 | 0:40:43
until he ejaculated all over
the bathroom floor. | 0:40:43 | 0:40:50
He just stepped over
as if nothing had happened. | 0:40:57 | 0:41:01
And that was our moment
in the Majestic Hotel, May 2014. | 0:41:01 | 0:41:09
It's not about sex. | 0:41:15 | 0:41:17
It's not about sex,
it's always about power. | 0:41:17 | 0:41:24
There's something particularly
violent about stories about Harvey. | 0:41:25 | 0:41:32
There's like a ritualistic
humiliation quality. | 0:41:32 | 0:41:40
It's rage, and it's anger,
and it's some form of deep-seated | 0:41:40 | 0:41:48
power grab that goes way
beyond the situation in the room. | 0:41:50 | 0:41:56
For decades, Harvey Weinstein had
managed to repress the stories | 0:41:56 | 0:42:01
For decades, Harvey Weinstein had
managed to suppress the stories | 0:42:01 | 0:42:04
about his sexual misconduct. | 0:42:04 | 0:42:05
In 2015, that changed. | 0:42:05 | 0:42:09
Movie mogul Harvey Weinstein's
facing sexual assault | 0:42:09 | 0:42:11
allegations this morning. | 0:42:11 | 0:42:12
Police in New York confirmed
they are investigating | 0:42:12 | 0:42:14
an accusation against Weinstein. | 0:42:14 | 0:42:20
The Daily Nnews broke the story
initially, and it was... | 0:42:20 | 0:42:23
You know, it was a fairly
cut and dried story. | 0:42:23 | 0:42:27
22-year-old Italian model
Ambra Battilana Gutierrez. | 0:42:27 | 0:42:31
Was invited for a business meeting
with Harvey Weinstein. | 0:42:31 | 0:42:37
Ambra shows up at the offices
in Tribeca of Harvey Weinstein. | 0:42:37 | 0:42:44
The story that she told is that
shortly after she came in, | 0:42:44 | 0:42:48
Harvey Weinstein enquired
about whether her breasts | 0:42:48 | 0:42:49
were real or not. | 0:42:49 | 0:42:51
He groped her breasts. | 0:42:51 | 0:42:54
He reached up her skirt
and he tried to kiss her. | 0:42:54 | 0:43:00
Very quickly, it degenerates
from her coming up | 0:43:00 | 0:43:02
there to discuss her career,
to her fighting this | 0:43:02 | 0:43:04
guy off in his office. | 0:43:04 | 0:43:06
Ambra went straight to the police. | 0:43:06 | 0:43:08
Detectives put a plan in place. | 0:43:08 | 0:43:11
Ambra would meet Harvey Weinstein
at a New York hotel | 0:43:11 | 0:43:14
the following evening. | 0:43:14 | 0:43:18
This time she would secretly
record the conversation. | 0:43:18 | 0:43:20
After I left the hotel,
I was with the police. | 0:44:22 | 0:44:28
They were super happy and saying,
wow, now this person | 0:44:28 | 0:44:30
is completely finished. | 0:44:30 | 0:44:32
You saved a lot of women. | 0:44:32 | 0:44:38
The NYPD arranges to speak
with Harvey Weinstein. | 0:44:38 | 0:44:41
He is denying that
anything happened. | 0:44:41 | 0:44:44
And they thought this
was a prosecutable case, | 0:44:44 | 0:44:48
which leads us then to the Manhattan
district attorney's office. | 0:44:48 | 0:44:52
Before it got to the district
attorney, Harvey Weinstein hired | 0:44:52 | 0:44:57
a corporate intelligence firm called
K2. | 0:44:57 | 0:45:00 | |
A former K2 employee agreed to speak
on condition of anonymity. | 0:45:00 | 0:45:07
Harvey Weinstein came to K2
initially with a matter | 0:45:07 | 0:45:10
that they probably wouldn't take
on if it was somebody else. | 0:45:10 | 0:45:15
Nobody likes to develop information
on somebody who is accusing a client | 0:45:15 | 0:45:18
of sexual misconduct. | 0:45:18 | 0:45:19
But Harvey Weinstein
being Harvey Weinstein, | 0:45:19 | 0:45:20
exceptions were made. | 0:45:20 | 0:45:22
K2 says it won't comment
on client matters. | 0:45:22 | 0:45:27
Harvey Weinstein says
he is entitled to defend himself | 0:45:27 | 0:45:30
against allegations he knows
to be false. | 0:45:30 | 0:45:34
K2's brief was to find information
that might undermine Ambra. | 0:45:34 | 0:45:40
What they found was useful
to Harvey Weinstein. | 0:45:40 | 0:45:45
Stuff started leaking
out of the Weinstein | 0:45:45 | 0:45:47
camp about her past. | 0:45:47 | 0:45:50
The New York Post then went
after the Italian model | 0:45:50 | 0:45:53
with a story, secret life
of Harvey's shy accuser. | 0:45:53 | 0:45:55
The paper says that she once filed
a sexual assault suit | 0:45:55 | 0:45:57
against a 70-year-old,
quote, sugar daddy. | 0:45:57 | 0:46:02
It lasted for, like, a week. | 0:46:02 | 0:46:04
Everything was about me
being a blackmailer, | 0:46:04 | 0:46:08
me being a prostitute. | 0:46:08 | 0:46:13
The press reports were based
on evidence she had given | 0:46:13 | 0:46:16
in an Italian court case. | 0:46:16 | 0:46:19
She said she had been
sexually exploited as | 0:46:19 | 0:46:21
a teenager by an older man. | 0:46:21 | 0:46:25
The district attorney
asked her about the reports. | 0:46:25 | 0:46:30
They were asking me questions
like are these news real, like, | 0:46:30 | 0:46:33
you're a prostitute. | 0:46:33 | 0:46:35
I was asking them, did
you hear the recording? | 0:46:35 | 0:46:39
They were like, yes,
I heard it, but you have | 0:46:39 | 0:46:42
to explain this situation. | 0:46:42 | 0:46:43
In Italy it's very confusing. | 0:46:43 | 0:46:45
The district attorney needed to be
sure she would be a credible | 0:46:45 | 0:46:48
witness, but she had given
conflicting accounts | 0:46:48 | 0:46:50
of what had happened in Italy. | 0:46:50 | 0:46:54
They were questioning me
like I was a predator or something. | 0:46:54 | 0:46:58
Like, guys, I mean, I'm the victim. | 0:46:58 | 0:47:04
Journalists were briefed that Ambra
would be a problematic witness | 0:47:04 | 0:47:07
and that the tape didn't
prove criminal intent. | 0:47:07 | 0:47:09
There would be no charges. | 0:47:09 | 0:47:12
Harvey Weinstein was off the hook. | 0:47:12 | 0:47:17
You know, when I look back at that
time, nobody seemed to take a really | 0:47:17 | 0:47:21
hard look at Harvey Weinstein,
but everybody just focused | 0:47:21 | 0:47:23
on Ambra and nobody focused
on the guy that she accused. | 0:47:23 | 0:47:27
With no prospect of a prosecution,
Ambra's lawyers thrashed | 0:47:27 | 0:47:31
out a settlement. | 0:47:31 | 0:47:33
Harvey Weinstein would
pay her $1 million. | 0:47:33 | 0:47:37
It came with a
nondisclosure agreement. | 0:47:37 | 0:47:41
There is a list of different
things I can't do, | 0:47:41 | 0:47:44
and first of all is silence. | 0:47:44 | 0:47:52
Even today, Ambra feels she has
to remain silent on what happened | 0:47:52 | 0:47:55
in Harvey Weinstein's office
and the hotel the following day. | 0:47:55 | 0:48:00
Step back, step back, step back. | 0:48:00 | 0:48:02
Harvey Weinstein's
reputation was intact. | 0:48:02 | 0:48:06
Thank you, Harvey. | 0:48:06 | 0:48:09
And he still had his
powerful friends. | 0:48:09 | 0:48:11
Harvey Weinstein was protected
by the liberal political system. | 0:48:11 | 0:48:16
He rallied a lot of money in that
community and was known | 0:48:16 | 0:48:19
for supporting good causes. | 0:48:19 | 0:48:24
Over the years he had helped raise
millions for Aids research. | 0:48:24 | 0:48:27
I'd like to open the
bidding at $50,000. | 0:48:27 | 0:48:34
But in 2015, at the charity
where he was a patron, | 0:48:34 | 0:48:36
there was a problem. | 0:48:36 | 0:48:41
A dispute over the proceeds
of a fundraising auction. | 0:48:41 | 0:48:44
The charity hired a lawyer
to look into precisely | 0:48:44 | 0:48:46
what happened to the money. | 0:48:46 | 0:48:48
During the course of our
investigation we had | 0:48:48 | 0:48:51
to interview people. | 0:48:51 | 0:48:53
We would say to them,
why did it go here, | 0:48:53 | 0:48:55
why did it go there? | 0:48:55 | 0:48:57
The response we would get would be,
well, before we get into that, | 0:48:57 | 0:49:01
do you know that Harvey Weinstein
rapes women? | 0:49:01 | 0:49:05
Do you know that Harvey Weinstein
is a sexual predator? | 0:49:05 | 0:49:09
Now, we had no proof of that,
but this is what we were hearing. | 0:49:09 | 0:49:11
It was very disturbing. | 0:49:11 | 0:49:14
Word about this got back
to Harvey Weinstein. | 0:49:14 | 0:49:17
He asked Ajamie to meet. | 0:49:17 | 0:49:24
He said to me, Tom, you're spreading
rumours about me raping women. | 0:49:24 | 0:49:29
And my response was Harvey,
I'm not saying that, | 0:49:29 | 0:49:31
the community is saying
that about you. | 0:49:31 | 0:49:34
And at some point he got
very angry and said, | 0:49:34 | 0:49:38
you'd better be careful,
Tom, because I've investigated | 0:49:38 | 0:49:41
you and you're not so
clean, so be careful. | 0:49:41 | 0:49:48
When the meeting ended,
he ran up to me and got very close | 0:49:48 | 0:49:51
to my face and said please,
please don't tell anyone. | 0:49:51 | 0:49:54
Man-to-man, don't tell anyone
what you've learned about me. | 0:49:54 | 0:49:57
And I said Harvey, I can't do that. | 0:49:57 | 0:50:03
He walked out, he got
into the elevator, and I saw a very | 0:50:03 | 0:50:08
sad and desperate man who was now
sticking his fingers in various | 0:50:08 | 0:50:12
parts of the dyke and trying
to prevent the water from leaking | 0:50:12 | 0:50:16
out and the entire dam from falling
and crashing down on him. | 0:50:16 | 0:50:24
By now, the rumours had reached
the ears of magazine | 0:50:25 | 0:50:27
and newspaper editors. | 0:50:27 | 0:50:31
They set their reporters to turn
what had been Hollywood gossip | 0:50:31 | 0:50:33
into publishable fact. | 0:50:33 | 0:50:40
Harvey Weinstein was deploying
extreme countermeasures. | 0:50:40 | 0:50:46
I encountered more fear really
than I'd encountered | 0:50:46 | 0:50:48
with any other story. | 0:50:48 | 0:50:51
I needed women who were willing
to go on the record, | 0:50:51 | 0:50:53
and I just couldn't get them
to do that. | 0:50:53 | 0:50:55
One woman, calling herself Anna,
seemed unusually willing to talk. | 0:50:55 | 0:51:00
I was approached by a woman
who claimed to be a victim | 0:51:00 | 0:51:04
of Harvey Weinstein's,
but it was very unusual | 0:51:04 | 0:51:06
because I didn't know her last name. | 0:51:06 | 0:51:10
We met at a cafe, and the main
dynamic of our conversation | 0:51:10 | 0:51:13
was her pumping me for information
and revealing almost | 0:51:13 | 0:51:16
nothing about herself. | 0:51:16 | 0:51:20
Two weeks later she says she's
going to be back in New York. | 0:51:20 | 0:51:25
I met with her, and she leaned
forward the entire time. | 0:51:25 | 0:51:28
I was immediately
suspicious that she was | 0:51:28 | 0:51:31
surreptitiously recording me. | 0:51:31 | 0:51:34
Months later we find out
that she works for the Israeli | 0:51:34 | 0:51:37
intelligence firm Black Cube,
and her name is | 0:51:37 | 0:51:39
Stella Penn Pechanac. | 0:51:39 | 0:51:46
One of the firms behind those
undercover agents was Black Cube, | 0:51:46 | 0:51:50
an Israeli firm that
on their website touts the fact | 0:51:50 | 0:51:54
that there are former Mossad agents
in their chain of command. | 0:51:54 | 0:51:57
They really pride themselves
on being the most elite | 0:51:57 | 0:51:59
at this kind of work. | 0:51:59 | 0:52:03
False identities, front companies,
really the most elaborate kind | 0:52:03 | 0:52:05
of human intelligence work
in the world. | 0:52:05 | 0:52:11
Harvey Weinstein had hired
Black Cube to stop negative stories | 0:52:11 | 0:52:14
about him being published. | 0:52:14 | 0:52:19
They contacted former employees,
journalists and an actress who had | 0:52:19 | 0:52:21
accused Harvey Weinstein. | 0:52:21 | 0:52:24
Rose McGowan said he'd raped her. | 0:52:24 | 0:52:28
A woman named Diana Filip reached
out to Rose McGowan, | 0:52:28 | 0:52:31
and over the ensuing months
infiltrated herself | 0:52:31 | 0:52:35
into Rose McGowan's life,
became her friend, they had ice | 0:52:35 | 0:52:38
cream together, and it was
all completely fake. | 0:52:38 | 0:52:42
This woman, Diana Filip,
secretly recorded tens | 0:52:42 | 0:52:43
of hours of audio of her,
and routed back to Weinstein. | 0:52:43 | 0:52:51
Diana Filip was in fact
Stella Penn Pechanac, | 0:52:51 | 0:52:53
the same Black Cube agent who had
tried to find out what | 0:52:53 | 0:52:56
Ben Wallace was up to. | 0:52:56 | 0:53:00
Harvey Weinstein denies
raping Rose McGowan, | 0:53:00 | 0:53:05
and says hiring Black Cube wasn't
an attempt to cover up abuse | 0:53:05 | 0:53:09
but to investigate facts to show
that no abuse occurred. | 0:53:09 | 0:53:17
Harvey Weinstein had now deployed
all the weapons at his disposal, | 0:53:30 | 0:53:32
but journalists were still
coming for him. | 0:53:32 | 0:53:36
This was Harvey
Weinstein's last stand. | 0:53:36 | 0:53:40
In those frantic final days, a war
room of sorts started to assemble. | 0:53:40 | 0:53:45
Anyone who could be
useful in forestalling | 0:53:45 | 0:53:47
publication was brought in. | 0:53:47 | 0:53:52
He used everything at his disposal. | 0:53:52 | 0:53:56
Every contact, money, relationship,
favour that had been owed. | 0:53:56 | 0:53:59
He called in every chit. | 0:53:59 | 0:54:01
He was fighting like hell. | 0:54:01 | 0:54:08
Things were really amped up,
and it seemed like it was coming | 0:54:08 | 0:54:11
apart at the seams. | 0:54:11 | 0:54:12
And then it did. | 0:54:12 | 0:54:18
NEWSREADER: The New York Times is
reporting bombshell allegations... | 0:54:18 | 0:54:20
A scorching expose detailing decades
of rape, sexual assault... | 0:54:20 | 0:54:23
Nearly 60 women now accuse
of misconduct ranging | 0:54:23 | 0:54:25
from sexual harassment to rape. | 0:54:25 | 0:54:28
I never thought there
was ever going to be a day | 0:54:28 | 0:54:32
where I would have ever had a voice. | 0:54:32 | 0:54:35
I felt this man had such high walls
built up around him, | 0:54:35 | 0:54:38
I thought he was untouchable. | 0:54:38 | 0:54:44
Realising that he was a serious
predator, and he had been | 0:54:44 | 0:54:47
seriously abusing people,
abusing them with total | 0:54:47 | 0:54:52
impunity for all this time. | 0:54:52 | 0:54:56
And to have any part
of your life linked | 0:54:56 | 0:54:58
with that is deeply upsetting. | 0:54:58 | 0:55:04
The New York Times published
allegations of sexual misconduct | 0:55:04 | 0:55:07
against Harvey Weinstein. | 0:55:07 | 0:55:12
More serious allegations would
follow in the New Yorker magazine. | 0:55:12 | 0:55:14
In a statement he said listen,
I'm going to take a leave of absence | 0:55:17 | 0:55:21
and go and work on myself. | 0:55:21 | 0:55:25
But simultaneously he was
also threatening to sue | 0:55:25 | 0:55:26
the New York Times for our story. | 0:55:26 | 0:55:34
In the full glare of the media
spotlight, he was fired | 0:55:44 | 0:55:47
from his own company. | 0:55:47 | 0:55:52
Then, the Attorney General
of New York launched legal action. | 0:55:52 | 0:55:57
Had there been a cover up
inside the Weinstein Company? | 0:55:57 | 0:56:01
There were lots of complaints,
not one formal investigation | 0:56:01 | 0:56:04
by human resources,
by the corporation | 0:56:04 | 0:56:06
into Harvey's conduct. | 0:56:06 | 0:56:08
It's sort of unfathomable. | 0:56:08 | 0:56:11
It is very difficult for anyone
who looks at the documents that | 0:56:11 | 0:56:15
we've seen to believe
that there wasn't at least some | 0:56:15 | 0:56:20
knowledge that he was engaged
in sexual misconduct. | 0:56:20 | 0:56:23
We've never seen anything
as despicable as this. | 0:56:23 | 0:56:31
Harvey Weinstein's PR people
say he's in therapy. | 0:56:40 | 0:56:46
He's said he still hopes
to make a comeback. | 0:56:46 | 0:56:49
I've got to get help, guys. | 0:56:49 | 0:56:50
You know what? | 0:56:50 | 0:56:51
We all make mistakes. | 0:56:51 | 0:56:52
Second chance, I hope. | 0:56:52 | 0:56:55
OK? | 0:56:55 | 0:56:57 | |
He doesn't sound sad and dejected. | 0:56:57 | 0:56:59
He sounds a little bit... | 0:56:59 | 0:57:02
..A little bit humiliated, but I
think he's gearing up for the fight. | 0:57:02 | 0:57:05
I would not bet against him,
I really wouldn't. | 0:57:05 | 0:57:09
I think Hollywood is a toxic place. | 0:57:09 | 0:57:12
This is a filthy stables,
and Harvey is merely the guy who's | 0:57:12 | 0:57:15
taken the biggest dump in it. | 0:57:15 | 0:57:19
I think Harvey's career is over. | 0:57:19 | 0:57:20
But, you know, who knows? | 0:57:20 | 0:57:23
Anything can happen. | 0:57:23 | 0:57:26
HE CHUCKLES. | 0:57:26 | 0:57:29
Police in LA, New York and London
are now investigating allegations | 0:57:29 | 0:57:35
made by 16 women of sexual assault,
including rape, stretching | 0:57:35 | 0:57:37
back to the 1980s. | 0:57:37 | 0:57:41
Harvey Weinstein has
denied all claims of | 0:57:41 | 0:57:43
nonconsensual sexual conduct. | 0:57:43 | 0:57:50
The concentric spreading circles
from the stone dropped into the pond | 0:57:50 | 0:57:54
are spreading into British politics,
into American politics. | 0:57:54 | 0:57:57
It's such an old story. | 0:57:57 | 0:57:59
Women have been putting up
with this stuff for years. | 0:57:59 | 0:58:04
Since I started speaking out
about this, I actually have been | 0:58:04 | 0:58:10
so moved by how many people
have come forward. | 0:58:10 | 0:58:13
Like, something's changing,
and I think we all feel it, | 0:58:13 | 0:58:16
and the time is now. | 0:58:16 | 0:58:18
But it wasn't then. | 0:58:18 | 0:58:24
It saddens me that everybody woke up
because of Harvey Weinstein. | 0:58:24 | 0:58:29
On the other hand, thank
God we've woken up. | 0:58:29 | 0:58:37 |
