that's costing the country more
than a billion pounds a year, | 0:01:45 | 0:01:48 | |
and putting British firms
out of business. | 0:01:48 | 0:01:53 | |
We've set up a British company,

I'm going to use both
eBay and Amazon to sell | 0:02:02 | 0:02:04 | |

What we're looking at here
is evasion of VAT by overseas | 0:02:09 | 0:02:12 | |
sellers who sell to UK consumers
online and the rate of evasion | 0:02:12 | 0:02:15 | |
by those retailers is quite high. | 0:02:15 | 0:02:20 | |
It's between £1 billion
and £1.5 billion a year | 0:02:20 | 0:02:25 | |
in lost VAT to the exchequer. | 0:02:25 | 0:02:27 | |
But it also undercuts legitimate
traders who are complying | 0:02:27 | 0:02:29 | |
with their tax obligations | 0:02:29 | 0:02:30 | |
but who find it difficult

so that's two reasons why

This is a scam that starts

But thousands of traders

ship them back to the United Kingdom

But I'm not going to pay

Criminals have been getting away
with this fraud for years. | 0:03:29 | 0:03:34 | |
Well, look, we know that
we've had online marketplaces | 0:03:34 | 0:03:36 | |
and we need to make sure
that our tax authorities | 0:03:37 | 0:03:39 | |
are able not just to deal with this
but are ahead of the curve | 0:03:39 | 0:03:43 | |
for whatever the next
scam down the line is, | 0:03:43 | 0:03:45 | |
and that's a real concern. | 0:03:45 | 0:03:48 | |
Criminals are dodging
two types of VAT. | 0:03:48 | 0:03:50 | |
They're evading VAT at the border
when it's imported. | 0:03:50 | 0:03:52 | |
That's up to 20% of

when they sell the goods

There is two key moments

From the moment you stop complying

Then, you know, it's impossible

But if you are sticking goods

Chinese, it appears that you can

to continue even when people know

you know whatever the excuse,

Amazon and eBay say VAT
fraud is bad for business | 0:11:58 | 0:12:01 | |
and they take it very seriously. | 0:12:01 | 0:12:06 | |
They say they want fair
play for all sellers, | 0:12:06 | 0:12:09 | |
so they work closely with HMRC,
sharing information about foreign | 0:12:10 | 0:12:14 | |
sellers and blocking them
when fraud is suspected. | 0:12:14 | 0:12:18 | |
But Amazon and eBay profit
from these illegal traders | 0:12:18 | 0:12:22 | |
because they charge them fees
to use their services. | 0:12:22 | 0:12:26 | |
They've known about what's been
happening for years. | 0:12:26 | 0:12:32 | |
eBay were told in 2009, 2011,
and a number of times since. | 0:12:32 | 0:12:40 | |
Amazon have been aware
since at least 2015, | 0:12:40 | 0:12:43 | |
and we still see blatant offences,
businesses that aren't | 0:12:43 | 0:12:45 | |
declaring their VAT numbers. | 0:12:45 | 0:12:48 | |
And these are things that global,
multi-billion pound companies | 0:12:49 | 0:12:51 | |
should be able to identify
and get a handle on. | 0:12:51 | 0:12:55 | |

So, here you find examples

where the business has no business
details whatsoever, including | 0:13:37 | 0:13:40 | |
a lack of VAT number. | 0:13:40 | 0:13:44 | |
We've raised this and you'll
see here, still today, | 0:13:44 | 0:13:46 | |
there's no VAT number on there. | 0:13:46 | 0:13:51 | |
So, they're just openly
breaking the legislation? | 0:13:52 | 0:13:53 | |
Blatantly breaking the legislation. | 0:13:53 | 0:13:57 | |
This company has now
finally got a VAT number. | 0:13:57 | 0:14:05 | |
The law says VAT numbers should be
accessible but there's a dispute | 0:14:05 | 0:14:09 | |
about what that means for online
marketplaces like eBay and Amazon. | 0:14:09 | 0:14:16 | |
HMRC says it's not a legal
requirement for sellers | 0:14:16 | 0:14:20 | |
to display a VAT number. | 0:14:20 | 0:14:25 | |
But the taxman says both Amazon
and eBay have agreed to make | 0:14:25 | 0:14:28 | |
sure that those numbers
are displayed anyway. | 0:14:28 | 0:14:33 | |
I understand that Amazon and eBay
do now have it as part | 0:14:33 | 0:14:36 | |
of their processes,
to ask for a VAT number. | 0:14:36 | 0:14:38 | |
And they check the validity
of that number. | 0:14:38 | 0:14:41 | |
And, uh, require that number to be
shown on their website. | 0:14:41 | 0:14:48 | |
I think they're doing that for new
sellers coming onto their sites | 0:14:49 | 0:14:52 | |
and they're working through the
sellers that are already there. | 0:14:52 | 0:14:54 | |
I think for HMRC's point of view,
that - that is a welcome step. | 0:14:55 | 0:14:58 | |
If they didn't have a VAT number
displayed, what would your instinct | 0:14:58 | 0:15:02 | |
be, whether they had one or not? | 0:15:02 | 0:15:03 | |
That makes them very high risk
from our point of view and we do | 0:15:03 | 0:15:07 | |
risk assess all of those cases

for example, we've had 400 cases
where we've had the market, | 0:15:10 | 0:15:13 | |
the sellers thrown off
the marketplace already. | 0:15:13 | 0:15:20 | |
So, will Amazon check
if we have a VAT number? | 0:15:20 | 0:15:23 | |
When we registered Bilton's Bargains | 0:15:23 | 0:15:24 | |
we were asked for a VAT number
but the box said "optional". | 0:15:24 | 0:15:28 | |
We were still allowed to register

Amazon says it's committed
to "helping HMRC identify the small | 0:15:45 | 0:15:51 | |
number of bad actors
who are not VAT compliant". | 0:15:51 | 0:15:54 | |
And that sellers agree to pay
taxes when they sign | 0:15:54 | 0:15:57 | |
the terms and conditions. | 0:15:57 | 0:15:58 | |
Amazon says Bilton's Bargains

because it's a British company

But we know Amazon don't always make
foreign companies provide | 0:16:04 | 0:16:06 | |

You only have to go on Amazon
or eBay to see how widespread | 0:16:18 | 0:16:21 | |
the problem is. | 0:16:21 | 0:16:23 | |
There are thousands of foreign
traders selling goods | 0:16:23 | 0:16:25 | |
from within the UK. | 0:16:25 | 0:16:27 | |
And many do not have VAT numbers. | 0:16:27 | 0:16:32 | |
I also did some mystery shopping
in preparation for our hearing | 0:16:32 | 0:16:35 | |
on this, and it was just
ridiculously easy to buy goods | 0:16:35 | 0:16:40 | |
and ask for a VAT certificate,
and only to find that they didn't | 0:16:40 | 0:16:44 | |
want to give you one,
they didn't have one, | 0:16:44 | 0:16:46 | |
they were trying to fob you off. | 0:16:46 | 0:16:48 | |
In the end, I was offered a 20%
discount on one item to try | 0:16:48 | 0:16:52 | |
and buy me off. | 0:16:52 | 0:16:53 | |
eBay and Amazon say the level of VAT
fraud is lower than HMRC's estimate | 0:16:53 | 0:16:57 | |
of more than a billion
pounds a year. | 0:16:57 | 0:17:00 | |
They also say they try to prevent
fraud by offering information | 0:17:00 | 0:17:03 | |
and training to sellers
about the VAT rules. | 0:17:03 | 0:17:08 | |
But we were able to dig
deeper into Amazon's data. | 0:17:08 | 0:17:11 | |
We checked their top
Chinese sellers in Europe. | 0:17:12 | 0:17:16 | |
60% of them didn't display
a valid VAT number. | 0:17:16 | 0:17:22 | |
If 60% of Chinese sellers,
the top Chinese sellers on Amazon, | 0:17:23 | 0:17:25 | |
are not listing a VAT number,

It means the system's

I think it's indicative of the high
level of noncompliance that we know | 0:18:00 | 0:18:04 | |
exists in this sector,
which is why we've taken | 0:18:04 | 0:18:06 | |
the additional powers that we have
and why we're seeking further powers | 0:18:06 | 0:18:09 | |

We think prosecution is a tool

Even just to make it a bit more

And Amazon stored our

Now, you might find one of Amazon's

The company says it's not a major

Even though Amazon stores,

I bought things on Amazon that

delivered by Amazon,

involve fraudulent transactions. | 0:20:51 | 0:20:52 | |
So I really can't see how they can

And it should be made
a cost of their business | 0:20:55 | 0:20:58 | |

The European Union wants to make

So, one of the issues

is that there's nobody who's

So we have to make those warehouses,

retailers - the online websites -

for collecting the VAT and passing

That at the moment is not the case,

could happen as early

But I did break the law,

Well, they say that 98 % of sales

have a valid VAT number. | 0:22:37 | 0:22:39 | |
And in September, this
is what they told Parliament. | 0:22:39 | 0:22:41 | |
For foreign sellers,
who are the primary focus of this | 0:22:41 | 0:22:44 | |
issue, we require that they display
a valid VAT number, which we check | 0:22:44 | 0:22:47 | |
through the VIES system. | 0:22:47 | 0:22:52 | |
And we make sure that
sellers display that, | 0:22:52 | 0:22:54 | |
and we've also asked them to put
that on their listing. | 0:22:54 | 0:23:01 | |
We wanted to check if that was true. | 0:23:01 | 0:23:03 | |
So, a week later, we
committed another crime. | 0:23:03 | 0:23:07 | |
This time we imported 270 mobile
phone cases for sale on eBay. | 0:23:07 | 0:23:12 | |
To really test the system,
we moved Bilton's Bargains | 0:23:12 | 0:23:15 | |

On eBay, we registered

Once again, our goods

Now eBay have told Parliament

But we listed our mobile phones

We sold one phone cover

eBay then limited our account for 30

they say this restriction
helps reduce all fraud. | 0:23:58 | 0:24:03 | |
eBay said "the block

And it meant that our account
"was unable to sell... | 0:24:05 | 0:24:08 | |

But you told me that

for a VAT number before they deal

and uses its "own detection methods

Amazon say they now have VAT numbers
that cover 95% of sales from foreign | 0:25:43 | 0:25:47 | |
sellers who use an Amazon warehouse. | 0:25:47 | 0:25:51 | |
