The Chief Constable of Cleveland Police issued a public | :00:12. | :00:15.
It came after his force admitted unlawfully using anti-terror powers | :00:16. | :00:26.
to secretly monitor people's private phone records. | :00:27. | :00:28.
Mr Spittal apologised to the people whose phones were monitored. | :00:29. | :00:37.
He said every surveillance request involving phone data from the last | :00:38. | :00:39.
And he also promised to get rid of the force's Professional | :00:40. | :00:43.
Standards Department after a series of scandals. | :00:44. | :00:45.
The force had already admitted acting unlawfully | :00:46. | :00:50.
by using legislation reserved for serious crime to monitor | :00:51. | :00:52.
the phone records of journalists and solicitors in 2012 to see | :00:53. | :00:54.
We should not have used those powers, we should not have used | :00:55. | :01:06.
those powers to get details from journalists, so it's | :01:07. | :01:08.
Last month, at a tribunal in London, two former Cleveland Police officers | :01:09. | :01:12.
claimed their private phone records had also been secretly monitored | :01:13. | :01:14.
after they challenged misconduct at the force. | :01:15. | :01:17.
The Professional Standards Department set their stall out | :01:18. | :01:19.
and went out to get me, which was an utter disgrace. | :01:20. | :01:22.
I honestly think they were trying to stitch me up. | :01:23. | :01:25.
I think they were using any means, unlawful or otherwise, | :01:26. | :01:29.
and mainly otherwise, to stitch me up. | :01:30. | :01:33.
Over a four-month period in 2012, the Investigatory Powers Tribunal | :01:34. | :01:36.
in London heard Cleveland Police monitored over a million | :01:37. | :01:40.
minutes of telephone data from just six people. | :01:41. | :01:43.
Some of your police officers broke the law, surely they should now face | :01:44. | :01:46.
There is a subtle difference between unlawful and breaking the law. | :01:47. | :01:53.
What the IPT have said is that the use of the power was unlawful. | :01:54. | :01:57.
That does not necessarily lead to a criminal offence being committed. | :01:58. | :02:00.
If criminal offences have been committed then we will deal | :02:01. | :02:03.
Cleveland's Crime Commissioner said the force would learn | :02:04. | :02:07.
from its mistakes, but even he accepts we have been here before. | :02:08. | :02:14.
We've had police officers sacked, sent to prison, racism rows, | :02:15. | :02:16.
corruption scandals, now police officers secretly | :02:17. | :02:18.
You're the Crime Commissioner, you never seem to be doing | :02:19. | :02:22.
I've got a robust scrutiny process in place, which looks at all aspects | :02:23. | :02:27.
Well, they do, but we've got to bear in mind that we're policing an area | :02:28. | :02:33.
We're dealing with up to 1,000 calls a day from the public. | :02:34. | :02:38.
These are a very small minority of incidents, | :02:39. | :02:40.
very serious incidents, but they are a very small minority | :02:41. | :02:42.
of incidents that affect a very small number of people. | :02:43. | :02:45.
But this latest scandal has led some to call | :02:46. | :02:47.
Cleveland Police should not be abolished. | :02:48. | :02:54.
Cleveland Police, every day, delivers outstanding | :02:55. | :02:56.
But it's constantly mired by these scandals and problems. | :02:57. | :03:01.
Every day, people who work for Cleveland Police save people's | :03:02. | :03:05.
I'm confident that I am the right leader for this organisation to make | :03:06. | :03:12.
sure we move through this phase so that the service we deliver | :03:13. | :03:15.
Four teenage boys have been arrested after a 15-year-old girl | :03:16. | :03:25.
The attack is said to have happened around 7.30 on Tuesday evening | :03:26. | :03:32.
near the Cloffocks car park in Workington. | :03:33. | :03:33.
One 13-year-old was released without charge today but a second | :03:34. | :03:36.
and detectives are continuing to appeal for witnesses. | :03:37. | :03:48.
A grieving family have welcomed changes to X-ray procedures | :03:49. | :03:50.
at James Cook Hospital in Middlesbrough, after their | :03:51. | :03:52.
severely disabled son died after an unnoticed leg fracture. | :03:53. | :03:55.
Callum Robinson died at the Teesside Hospital | :03:56. | :03:57.
after a fall from his bed at home days earlier, | :03:58. | :03:59.
while being looked after by a care worker. | :04:00. | :04:01.
Callum Robinson had lived his 14 years with serious physical | :04:02. | :04:08.
In August of 2014, while being seen by a Voyage Healthcare worker, | :04:09. | :04:15.
he slipped from his bed, resulting in two leg injuries, | :04:16. | :04:20.
including the fracture which eventually needed operating | :04:21. | :04:22.
Teesside Coroner's Court heard today the fracture wasn't | :04:23. | :04:26.
detected in an initial x-ray at James Cook Hospital | :04:27. | :04:28.
because it was felt Callum needn't have his incontinence pad removed, | :04:29. | :04:33.
resulting in a sub-optimal x-ray image. | :04:34. | :04:36.
But Callum's family are still confused about how the initial fall | :04:37. | :04:39.
happened while being looked after by care worker Amy Carter. | :04:40. | :04:41.
The other element was basically at James Cook, where we actually | :04:42. | :04:47.
had him checked over by a doctor, he was x-rayed, the x-ray was poor | :04:48. | :04:51.
Unfortunately that delay between, as Dr Bob Platter said, | :04:52. | :05:01.
He wasn't in a good position to battle the fractures. | :05:02. | :05:05.
In court today, Paul said his initial request | :05:06. | :05:07.
for a repeat x-ray was at first refused, but he's welcomed changes | :05:08. | :05:11.
made in the radiology department since then. | :05:12. | :05:18.
We are pleased that changes have been put in place, | :05:19. | :05:22.
especially two new procedures which makes it really clear | :05:23. | :05:24.
I think there was just too much discretion by the radiographer. | :05:25. | :05:31.
In a statement, South Tees Hospitals NHS Trust said it would | :05:32. | :05:34.
like to offer sympathy to Mr and Mrs Robinson and their family. | :05:35. | :05:37.
The trust has been open and honest and is sorry it did not identify | :05:38. | :05:40.
the fracture initially and has now strengthened its procedures. | :05:41. | :05:42.
Voyage Specialist Healthcare said Callum slipped from his bed | :05:43. | :05:45.
while under their care and they added the incident | :05:46. | :05:47.
was thoroughly investigated by the police and the Health | :05:48. | :05:49.
and Safety Executive and no further action was taken. | :05:50. | :05:51.
Amy Carter's training was up-to-date and included specialist training | :05:52. | :05:53.
In concluding the inquest, the coroner, Karen Welsh, | :05:54. | :06:03.
said Mr and Mrs Robinson always accepted they'd lose | :06:04. | :06:05.
Callum at some point, but not in such a tragic | :06:06. | :06:07.
A Newcastle company's been fined over ?7,000 | :06:08. | :06:16.
for the unauthorised sale of nitrous oxide after an undercover | :06:17. | :06:19.
investigation by the BBC's Inside Out programme and BBC | :06:20. | :06:21.
Although nitrous oxide is used legally in the catering industry, | :06:22. | :06:29.
it can be fatal when inhaled as a drug. | :06:30. | :06:31.
Here's our News Correspondent Mark Denten. | :06:32. | :06:34.
Nitrous oxide, or laughing gas, is a legal product used | :06:35. | :06:36.
in the catering industry, but it can also be used as | :06:37. | :06:39.
Two former Northumbria University students, David Jenkins and Jonathan | :06:40. | :06:55.
Lawrence, ran Toon Whip, which sold nitrous oxide director students. | :06:56. | :07:06.
Today both men appeared in court charged, along with their company | :07:07. | :07:10.
with the un-authorised sale of nitrous oxide. | :07:11. | :07:11.
Former Northumbria University students David Jenkins | :07:12. | :07:13.
and Jonathan Lawrence appeared in court today charged | :07:14. | :07:15.
with the unauthorised sale of nitrous oxide, | :07:16. | :07:16.
It can be used as a catering product, | :07:17. | :07:21.
but the court heard it is also a popular recreational drug. | :07:22. | :07:24.
The court heard David Jenkins and Jonathan Lawrence's company, | :07:25. | :07:26.
Out Of The Kitchen Ltd, made a total profit in 2015-16 of ?40,000. | :07:27. | :07:29.
Toon Whip, part of that company, made a ?10,000 profit alone. | :07:30. | :07:32.
The court heard the case came to light after an undercover | :07:33. | :07:35.
investigation by the BBC's Inside Out programme, | :07:36. | :07:37.
in which undercover reporter Philippa Goymer purchased two boxes | :07:38. | :07:38.
She was given instructions by staff, who were not Jenkins on Lawrence. | :07:39. | :07:42.
Two people working as distributors for the company also showed our | :07:43. | :07:53.
reporter how to use a balloon to inhale the gas. | :07:54. | :07:55.
Magistrates here imposed a fine totalling ?7,620 | :07:56. | :07:57.
on Out Of The Kitchen Ltd, which must be paid within 14 days. | :07:58. | :08:00.
Newcastle Council trading standards brought the case and says it's a | :08:01. | :08:03.
I'm absolutely delighted, it sends out a | :08:04. | :08:05.
firm and clear message to those people who are selling nitrous oxide | :08:06. | :08:08.
and potentially putting people's lives that risks. | :08:09. | :08:17.
All credit to the BBC, the sting exposed the company | :08:18. | :08:19.
and highlighted what they are doing and the sale of much as oxide for | :08:20. | :08:25.
We know young people participate in this, but we | :08:26. | :08:28.
are aware there are deaths associated with taking it. | :08:29. | :08:30.
We have a responsibility as the local | :08:31. | :08:32.
authority to look after people's health and well-being. | :08:33. | :08:34.
The BBC played a key role in this activity. | :08:35. | :08:36.
Meanwhile, the case against David Jenkins | :08:37. | :08:39.
and Jonathan Lawrence was adjourned until later this month. | :08:40. | :08:48.
A new ?3 million holiday park in North Yorkshire has | :08:49. | :08:51.
Hambleton District Council has approved the proposal for 54 chalets | :08:52. | :08:56.
at Angrove Country Park near Great Ayton. | :08:57. | :08:58.
Building work's expected to start in the next few weeks | :08:59. | :09:01.
and it's hoped the park - which is expected to | :09:02. | :09:03.
create around 50 jobs - will open in the summer. | :09:04. | :09:06.
Newcastle Airport has been announced as the most punctual small | :09:07. | :09:10.
airport in the world, with over 90% of flights both | :09:11. | :09:12.
The most punctual route was to Dublin, with an on-time | :09:13. | :09:16.
The airport, which flies to more than 80 direct destinations, | :09:17. | :09:21.
was one of only three UK airports to achieve an on-time performance | :09:22. | :09:24.
OK that's it from me this evening. Clear skies for take-off then, Paul. | :09:25. | :09:37.
Very good. Clear skies making it a cold start | :09:38. | :09:41.
tonight, Carol. A touch of frost for many of us for a time but overnight | :09:42. | :09:44.
the clouds will increase from the west. The breeze will increase as | :09:45. | :09:47.
well and that will combine to lift the temperatures. So we will see | :09:48. | :09:54.
temperatures, for a time, around 0 in Newcastle, minus-1 in Penrith but | :09:55. | :09:57.
they'll rise again later in the night. Tomorrow is a much cloudier | :09:58. | :10:01.
day than we had today. The cloud will produce rain at times. Heavy | :10:02. | :10:05.
bursts for a time in the west. A fairly damp day in general. Much | :10:06. | :10:09.
milder than it has been. Temperatures will peak around about | :10:10. | :10:13.
9 Celsius tomorrow afternoon, which is 48 Fahrenheit but that South to | :10:14. | :10:17.
South-westerly wind will be quite brisk at times. Tomorrow's cloud and | :10:18. | :10:22.
rain comes courtesy of this weather front that keeps on moving away to | :10:23. | :10:25.
the east, to leave a drier picture again under this Etheridge of high | :10:26. | :10:28.
pressure, as we head into the weekend. | :10:29. | :10:32.
So, Saturday will see still fairly cloudy skies on the whole, thick | :10:33. | :10:35.
enough for some patchy rain perhaps in the west. Many places dry. | :10:36. | :10:41.
Temperatures up to about 8 or 9 Celsius, with a fairly light | :10:42. | :10:44.
westerly breeze. Sunday sees the cloud that bit more broken, so the | :10:45. | :10:48.
better chance of seeing blue skies and sunshine in the east. Again | :10:49. | :10:52.
temperatures in the too bad. 8 or 9 Celsius at best and probably staying | :10:53. | :10:56.
frost-free through the weekend. I will leave you with a summary: | :10:57. | :11:00.
creeping up by a notch or two, 10, maybe nine Celsius. Here is Louise | :11:01. | :11:04.
with the national picture. Won't it cold and frosty this | :11:05. | :11:16.
morning? The coldest night of the winter so far in | :11:17. | :11:17. |
