over local services, are in disarray tonight. | :01:13. | :01:15. | |
Chesterfield was due to join the so-called Sheffield City Region, | :01:16. | :01:18. | |
but Derbyshire County Council said they didn't like that | :01:19. | :01:21. | |
idea and went to court. A judge has decided that | :01:22. | :01:23. | |
consultations on the new region were unlawful. | :01:24. | :01:26. | |
The legal wrangle has cost a six-figure sum and is likely | :01:27. | :01:29. | |
to delay the mayoral elections next May. | :01:30. | :01:33. | |
Almost ?1 billion of funding is at stake, and there could be | :01:34. | :01:36. | |
Tom Ingall has our top story tonight. | :01:37. | :01:45. | |
It's full of decisions. Like, who gets what. Take Chesterfield itself. | :01:46. | :01:52. | |
Geographically it's firmly in North Derbyshire. But political leaders | :01:53. | :01:56. | |
here think an invitation to join the new set so much I feel economic | :01:57. | :02:01. | |
region was too good a gift to refuse. -- Sheffield economic | :02:02. | :02:06. | |
region. It is about investment and economic opportunity. It is not | :02:07. | :02:09. | |
about geography or administrative boundaries. It is getting economic | :02:10. | :02:14. | |
activity devolved from government of the local decision-makers, of which | :02:15. | :02:17. | |
I am one, and ensuring that is used in the best place for Chesterfield | :02:18. | :02:24. | |
residents. Devolution of power was supposed to be a gift from | :02:25. | :02:27. | |
Government to the regions. Then Chancellor George Osborne promised | :02:28. | :02:30. | |
more cash, as long as a male was elected. He was keen to grab and | :02:31. | :02:34. | |
local politicians as a deal for the Sheffield city region was signed. -- | :02:35. | :02:39. | |
too glad hand. It should have been straightforward. There is Sheffield, | :02:40. | :02:43. | |
rather, Barnsley and Doncaster at its heart. Also over, Derbyshire | :02:44. | :02:47. | |
Dales and north-east dog should councils were invited to join in. | :02:48. | :02:52. | |
Bassetlaw and Chesterfield wanted to become a buzz with full voting | :02:53. | :02:54. | |
rights. But garbage or county council sake Chesterfield cannot be | :02:55. | :03:00. | |
claimed just like that. They went to a High Court. The judge agreed that | :03:01. | :03:03. | |
the consultation to establish the new region was an more. Your luck | :03:04. | :03:07. | |
I've had more contact from people in the field over this issue than | :03:08. | :03:12. | |
anything else. People have been very alarmed that they didn't know | :03:13. | :03:16. | |
anything about it. And very concerned that they didn't have any | :03:17. | :03:19. | |
chance to say what they thought about it, either. So far, there's no | :03:20. | :03:23. | |
sign of the Goverment's taking the gift back to the shop. In a | :03:24. | :03:29. | |
statement after today's ruling, the Department for Communities and Local | :03:30. | :03:30. | |
Government said... As 2016 draws to a close, | :03:31. | :03:47. | |
Chesterfield is no closer to answering the question, does it, the | :03:48. | :03:52. | |
calling a phrase look north towards Sheffield? Or does it, like the | :03:53. | :03:57. | |
twisted spire, lean towards Derby and the county council offices in | :03:58. | :04:03. | |
Matlock. We have asked them for an interview, but they gave a short | :04:04. | :04:06. | |
statement. They said they are considering a judgment and or | :04:07. | :04:13. | |
announcing the steps shortly. The timetable for electing a new mayor | :04:14. | :04:14. | |
looks at best ambitious. So what does this ruling mean | :04:15. | :04:17. | |
for further devolution in Yorkshire? Professor Tony Travers is an expert | :04:18. | :04:19. | |
in local government from the LSE. Is this a real mess, Professor? It | :04:20. | :04:30. | |
is a bit of a mess, isn't it? What we've got here in effect is one | :04:31. | :04:34. | |
local authority, that stop the show, going to court to stop another | :04:35. | :04:40. | |
combined -- that's Derbyshire. The stop another come by authority | :04:41. | :04:44. | |
proceeding with a deal they have already struck with the Government. | :04:45. | :04:48. | |
Having local authority is going to court against other local | :04:49. | :04:51. | |
authorities is not great. There are costs involved of course. This will, | :04:52. | :04:57. | |
as you are about to discover, create consequences for the possibility of | :04:58. | :05:02. | |
all of this going forward, having a directly elected mayoral election. | :05:03. | :05:06. | |
You heard something about the arguments that Chesterfield put | :05:07. | :05:10. | |
forward. Have they got a point? I mean, clearly there is an issue | :05:11. | :05:15. | |
here. Because, you know, you've got districts that are, or District | :05:16. | :05:19. | |
Council areas, that are in counties that are outside Yorkshire wanting | :05:20. | :05:25. | |
to join a city region. Now, city regions don't respect traditional | :05:26. | :05:28. | |
boundaries, coordinates trip. The economic area of Sheffield is | :05:29. | :05:32. | |
certainly one that spills over a number of boundaries, including the | :05:33. | :05:35. | |
old South Yorkshire county boundaries. As we have seen in the | :05:36. | :05:44. | |
not of pressure and option as well. The question here is, -- into | :05:45. | :05:46. | |
Nottinghamshire. How does the economic rationality of a city | :05:47. | :05:48. | |
region cope with traditional local authorities and the boundaries. | :05:49. | :05:50. | |
Clearly the county and Derbyshire feels that of just feel breaks away, | :05:51. | :05:54. | |
Chesterfield is a substantial authority within Derbyshire, it begs | :05:55. | :05:57. | |
questions about the future of Derbyshire. On this occasion, they | :05:58. | :06:02. | |
set so much saying it was all about how the cause patient was undertaken | :06:03. | :06:05. | |
in Chesterfield. If I have to put you on the spot, what is your gut | :06:06. | :06:10. | |
feeling about whether or not there will be a mayor in 2017 in the | :06:11. | :06:15. | |
Sheffield city region? I think, given that the combined authority is | :06:16. | :06:18. | |
saying that it's going to review the judgment carefully, and that | :06:19. | :06:23. | |
suggests there would have to be a further consultation if they want to | :06:24. | :06:26. | |
hold together the listing authorities, it is hard, as of now, | :06:27. | :06:29. | |
to see the mayoral election going ahead next May. Professor Travers, | :06:30. | :06:32. | |

and businesses in Yorkshire This week, we've been | :06:36. | :06:37. | |
looking at the legacy Today, we hear from | :06:38. | :06:40. | |
the residents of Calderdale. Millions of pounds are being | :06:41. | :06:43. | |
invested in a new flood prevention scheme, but many residents say | :06:44. | :06:45. | |
they still live in fear Charlotte Leemng is in Todmorden | :06:46. | :06:48. | |
for us this evening. Thank you, good evening. The year | :06:49. | :07:04. | |
may have flown by for many of us, but here in the Calder Valley it | :07:05. | :07:07. | |
really has been a long and painful 12 months, that's because the floods | :07:08. | :07:12. | |
caused around ?150 million worth of damage. What a whopping figure that | :07:13. | :07:17. | |
is. And people here are still recovering. We are here in the | :07:18. | :07:21. | |
Golden Lion pub in Todmorden. It's very Christmassy and joyous tonight. | :07:22. | :07:25. | |
But make no mistake, there are still people trying to get in their homes | :07:26. | :07:29. | |
and businesses trying to reopen. We have spent the day here across the | :07:30. | :07:32. | |
Calder Valley, speaking to some of the people who were affected. | :07:33. | :07:35. | |
The Calder Valley will never forget Boxing Day 2015. | :07:36. | :07:37. | |
By 3pm, the River Calder was at the highest level ever recorded. | :07:38. | :07:41. | |
Water rampaged through the valley, showing no mercy. | :07:42. | :07:43. | |
From Elland to Todmorden, and some residents had no choice | :07:44. | :07:49. | |
but to risk their own safety to help others. | :07:50. | :07:52. | |
At this close, dozens of elderly people had to be rescued | :07:53. | :07:55. | |
from the ground floor flats, which were completely submerged. | :07:56. | :08:00. | |
The 82-year-old only moved back into her flat on the close | :08:01. | :08:09. | |
I used to walk round and just peep in the window and thought, | :08:10. | :08:14. | |
We've done this, we've got over this. | :08:15. | :08:27. | |
I'm not going to be worried, be afraid of the rain. | :08:28. | :08:29. | |
But others are looking for more reassurance. | :08:30. | :08:38. | |
Calderdale Council has ?60 million set aside for flood risk management. | :08:39. | :08:43. | |
But the severity of the floods came with both a financial | :08:44. | :08:48. | |
Flood warden Tim risked his own safety to save the lives | :08:49. | :08:52. | |
And he says people still feel vulnerable. | :08:53. | :08:58. | |
We've got flood stores, but with nothing in them. | :08:59. | :09:02. | |
So if push comes to shove and there is, God forbid, | :09:03. | :09:07. | |

And it's a shame, because we're told there is so much | :09:11. | :09:18. | |
money available to us, yet we never see any of it. | :09:19. | :09:21. | |
At this bridge, the fear of further floods has forced some to move away. | :09:22. | :09:24. | |
John and Catherine's home was destroyed last Christmas. | :09:25. | :09:26. | |
And they want a safer place to bring up baby Edmund. | :09:27. | :09:32. | |
We just decided that it wasn't probably the best place to sort | :09:33. | :09:36. | |
And also you've got the whole flood risk and all that | :09:37. | :09:40. | |
So, you know, the house next door came on the market so we decided | :09:41. | :09:46. | |
But that ever-present threat of damage and harm does hang over | :09:47. | :09:59. | |
Some experts have even said it's a miracle nobody died | :10:00. | :10:04. | |
Now these communities want to know that the flood protection | :10:05. | :10:09. | |
work will save them, should the heavy rains come again. | :10:10. | :10:19. | |
So let's speak to the man who will know, the leader of Calder Dell | :10:20. | :10:27. | |
Council, councillor Tim Swift. A lot of people saying they would be | :10:28. | :10:30. | |
worried if bad weather came again that they would not be protected. I | :10:31. | :10:35. | |
understand why people will feel nervous after the experiences of | :10:36. | :10:39. | |
last Boxing Day. I want to reassure them that we are doing everything we | :10:40. | :10:43. | |
can. We've got extra teams out there, checking the drains, clearing | :10:44. | :10:48. | |
the gullies and so on. Plus we will have extra staff on stand-by over | :10:49. | :10:51. | |
Christmas just in case of the worse. We know that the Environment Agency | :10:52. | :10:55. | |
have put a huge amount of effort into preparing the river defences to | :10:56. | :10:59. | |
make sure that we are prepared as we can beat if there should be further | :11:00. | :11:04. | |
problems over this winter. There were heavy rains in November, we | :11:05. | :11:08. | |
know that storm Barbara is on the way. What plans have you put in | :11:09. | :11:13. | |
place for that? As I say, we've got teams out right now, making sure | :11:14. | :11:17. | |
that the drains are checked and as clear as they can be. We will have | :11:18. | :11:20. | |
extra staff on stand-by throughout the Christmas weekend, so if there | :11:21. | :11:24. | |
are any problems, we are ready to respond quickly. Councillor Swift, | :11:25. | :11:28. | |
thank you. They are having a right good time in here tonight, but my | :11:29. | :11:32. | |
word, it was very different on Boxing Day. It came so quickly, | :11:33. | :11:41. | |
didn't it? It this time of the -- the year when we get ready to make a | :11:42. | :11:44. | |
big party. Then everything just happened to wipe everything off, all | :11:45. | :11:50. | |
the dreams and your hopes. You cannot get on with this year against | :11:51. | :11:54. | |
up yellow but people really turned out to help you, didn't they? Yes, I | :11:55. | :11:57. | |
don't want to go through that again because all of my friends are | :11:58. | :12:01. | |
fabulous. You know, maybe about 100 of them came to help us clean up in | :12:02. | :12:06. | |
three days. And you are open again and having a good time. You looking | :12:07. | :12:11. | |
forward to the future? Yes, I hope so, this year is going to be | :12:12. | :12:15. | |
brilliant. I hope we can skip this and go to 2017 and have a pace, | :12:16. | :12:19. | |
peaceful years. Some people say that community spirit is it cliche or a | :12:20. | :12:25. | |
thing of the past, but community spirit has shone this year. People | :12:26. | :12:29. | |
have come together and really made each other safe. So we are hoping | :12:30. | :12:33. | |
for a peaceful Christmas, aren't we, in the Calder Valley. The white and | :12:34. | :12:38. | |

of pounds of compensation. Hundreds of men are suing | :12:51. | :12:51. | |
the Catholic Church over historical abuse | :12:52. | :12:53. | |
at the St Williams Approved Three other men today | :12:54. | :12:55. | |
lost their case for compensation at the High Court in Leeds, | :12:56. | :12:58. | |

about compensation. It was the proof they needed | :13:14. | :13:18. | |
that they may finally be believed. I still have to live | :13:19. | :13:22. | |
the nightmares of all of this. It's the worst feeling you can have, | :13:23. | :13:27. | |
to be called a liar, Nigel Feeley from Leeds was 13 | :13:28. | :13:30. | |
when he was sent to the St Williams His case for compensation | :13:31. | :13:37. | |
is still to be heard. He was one of the boys | :13:38. | :13:43. | |
that the former principal, He's been jailed three times now | :13:44. | :13:45. | |
for physically and sexually The former chaplain Anthony McCallan | :13:46. | :13:49. | |
was jailed in January The home was run by | :13:50. | :13:54. | |
the Middlesbrough Docese It is these two Catholic | :13:55. | :13:59. | |
organisations that the former pupils 249 men are carrying | :14:00. | :14:04. | |
out this litigation. But it has started with | :14:05. | :14:12. | |
just five test cases. Judgments were handed down | :14:13. | :14:15. | |
here at the High Court in Leeds The judge found only in favour | :14:16. | :14:18. | |
of one of the claimants. Today's judgment does not reflect | :14:19. | :14:25. | |
on the other 245 cases that Those acting on behalf of victims | :14:26. | :14:32. | |
say they will appeal. I absolutely feel sick to the guts | :14:33. | :14:39. | |
with what's happened today. Not just for myself, | :14:40. | :14:41. | |
but for the other 248 victims of St Williams, | :14:42. | :14:44. | |
and probably many more. It's not about compensation, | :14:45. | :14:47. | |
it's about justice and recognisation And hopeful that the last judgment | :14:48. | :14:50. | |
in this case will rule in their favour when it | :14:51. | :15:09. | |
comes in January. Well, David Greenwood | :15:10. | :15:18. | |

and joins us now. David, it must be a bittersweet day | :15:21. | :15:32. | |
for you. You represented the one man who has been awarded compensation, | :15:33. | :15:36. | |
and two man who were not. Can you understand why the judge made that | :15:37. | :15:41. | |
decision? I can understand it. He stuck to, you know, the strict | :15:42. | :15:44. | |
letter of the law and the evidence that was presented to him on the | :15:45. | :15:51. | |
day. It appears he hasn't taken into account a lot of the background | :15:52. | :15:54. | |
evidence that we tried to present to him also. We will keep trying. We'll | :15:55. | :15:58. | |
try again. We'll hopefully get the right decision eventually. I've got | :15:59. | :16:04. | |
249 men who claim that they were sexually abused at Saint Williams. | :16:05. | :16:10. | |
I've witnessed many of these men in my office in tears. I'm convinced | :16:11. | :16:16. | |
that there is a lot of evidence that this sexual abuse was happening, and | :16:17. | :16:20. | |
I will continue to achieve justice for these men. We heard one of the | :16:21. | :16:24. | |
men say that, it's not about compensation, it's about being | :16:25. | :16:28. | |
relieved. So will believe. This must be a real setback for them. | :16:29. | :16:31. | |
Definitely. A lot of them have said to me, this is just about | :16:32. | :16:37. | |
recognition. The fact that this happened, for it to be recognised by | :16:38. | :16:42. | |
somebody in authority, a court would have been great. It appears that | :16:43. | :16:46. | |
this judgment or this decision hasn't recognised the hole that was | :16:47. | :16:52. | |
done to these three men. Why was it held in a civil court? These are | :16:53. | :16:58. | |
very serious charges? Yes, I know that Look North has reported | :16:59. | :17:00. | |
previously that these men were convicted in 2015, and one of them | :17:01. | :17:07. | |
was convicted in 1993. Those were criminal convictions. For the men | :17:08. | :17:15. | |
who have suffered psychological form, and the pain and suffering of | :17:16. | :17:19. | |
the sexual assaults, they are entitled to claim compensation. And | :17:20. | :17:23. | |
they have to do that in a civil court. Just one final point. What | :17:24. | :17:27. | |
does this mean, very quickly, for the Catholic Church? The Catholic | :17:28. | :17:31. | |
Church have been resistant to these types of cases for a long time. I | :17:32. | :17:35. | |
think the fact that this is coming to court now means that they need to | :17:36. | :17:40. | |
get a grip of these cases and change their policy on how they respond. | :17:41. | :17:41. | |

backgrounds because he was such Bradford Council could consider | :19:03. | :19:05. | |
selling the Alhambra Theatre and three other venues as it has | :19:06. | :19:11. | |

here. There is Richard here with, well, it's got to be one of the best | :20:28. | :20:35. | |
selections of ladies underwear, nylons, tights. Dressing gowns. It's | :20:36. | :20:40. | |
got to be one of the best selections in Wakefield. As more units close, | :20:41. | :20:45. | |
fewer people seem to be popping in, and shoppers say they are very | :20:46. | :20:47. | |
disappointed. The old market was fantastic. When it was over there, | :20:48. | :20:53. | |
it was fantastic. People used to come from miles around. For | :20:54. | :20:59. | |
Wakefield market. Years ago. But they don't now, they all go to | :21:00. | :21:04. | |
Barnsley or Huddersfield, wherever. They should have left it down there, | :21:05. | :21:10. | |
built a tree to walk around it, and they'd have been a lot better off. | :21:11. | :21:13. | |
They still have the Sunday markets and everything. Lynne's cafe is | :21:14. | :21:17. | |
still thriving, and is one of the first things shoppers see when they | :21:18. | :21:23. | |
come into the market. She plans to retire at when it closes. If I could | :21:24. | :21:28. | |
wave a magic wand, the layout would be different. It's never been right | :21:29. | :21:31. | |
from day one, everything has been wrong with the market since day one. | :21:32. | :21:36. | |
I've seen the current state of Wakefield market. Compared to what | :21:37. | :21:39. | |
it used to be, it's a crying shame. My heart goes out to the market | :21:40. | :21:43. | |
traders and there, because they have been stuffed in a little corner. | :21:44. | :21:46. | |
It's about a tenth of what it used to be. It's just, the atmosphere has | :21:47. | :21:51. | |
gone. Wakefield Council wouldn't go on camera, but says its new outdoor | :21:52. | :21:56. | |
market is proving successful, and that it will help indoor market | :21:57. | :22:00. | |
traders relocate the vacant shop units in the city if they want to. I | :22:01. | :22:04. | |
don't think closing down independent traders like ours is the right way | :22:05. | :22:08. | |
to go. Personally, I don't want to go into just a shot. I like the | :22:09. | :22:12. | |
environment of a shopping centre or a market area so will just a shop. | :22:13. | :22:18. | |
I'm here until the bitter end. I'm the last person, when the police | :22:19. | :22:23. | |
turn out the lights, that'll be me. That place has a special feel to it. | :22:24. | :22:29. | |
That made me well up a bit! My parents and grandparents have been | :22:30. | :22:33. | |

And then you can pack it using a range of felting needles. | :23:44. | :23:48. | |
And the process of actually using the needles compacts it | :23:49. | :23:53. | |
