Whilst he was pushing a caravan during the course of his employment, | 0:02:50 | 0:02:53 | |
he'd slipped on some liquid on the floor. | 0:02:53 | 0:02:56 | |
According to the claimant, this simple slip | 0:02:56 | 0:02:58 | |
had done a lot of damage. | 0:02:58 | 0:03:00 | |
So, he injured his back, his lower leg and was suggesting | 0:03:02 | 0:03:05 | |
that he had some type of chronic pain syndrome injury. | 0:03:05 | 0:03:09 | |
The claimant's condition had a huge impact on his day-to-day life. | 0:03:09 | 0:03:13 | |
He couldn't function properly, he couldn't go to work, he couldn't | 0:03:15 | 0:03:18 | |
carry out the activities that he could normally do, so, as a result | 0:03:18 | 0:03:22 | |
of the accident, he was alleging that he was quite severely disabled. | 0:03:22 | 0:03:25 | |
With ongoing symptoms as severe as this, | 0:03:25 | 0:03:28 | |

But before a penny of the half a million pounds was paid, | 0:03:40 | 0:03:44 | |
Scott needed to put some concerns about the claim to rest. | 0:03:44 | 0:03:48 | |
We had suspicions about this claim, because this chap | 0:03:48 | 0:03:52 | |
was suggesting that he was severely injured. | 0:03:52 | 0:03:54 | |
And the medical records didn't really tally up in terms of his | 0:03:54 | 0:03:57 | |
future prognosis and what was wrong, | 0:03:57 | 0:03:59 | |
so we decided to put him under surveillance and find out | 0:03:59 | 0:04:03 | |
exactly what he was able to and not able to do. | 0:04:03 | 0:04:06 | |
The medical report suggested that the claimant stopped work due | 0:04:06 | 0:04:10 | |
to a stress-related illness rather than his physical condition. | 0:04:10 | 0:04:14 | |
So the surveillance would establish whether or not this was the case. | 0:04:14 | 0:04:19 | |
There's an element of satisfaction, but surprise when you get | 0:04:19 | 0:04:23 | |
surveillance footage through that's as revealing as this. | 0:04:23 | 0:04:26 | |
So, in this particular case, you can see that he's | 0:04:30 | 0:04:33 | |
loading a cement mixer, | 0:04:33 | 0:04:35 | |
it would appear as if he's doing some sort of building work. | 0:04:35 | 0:04:38 | |
But it's certainly manual labour, | 0:04:41 | 0:04:43 | |
and for someone who's got a significant back injury, | 0:04:43 | 0:04:46 | |
that completely contradicts what we're seeing in the medical reports. | 0:04:46 | 0:04:49 | |
With the foundations of this case crumbling, | 0:04:49 | 0:04:52 | |
his next act would leave the claim all washed up. | 0:04:52 | 0:04:55 | |
We can see the claimant working as, | 0:04:55 | 0:04:57 | |
it would appear to be a car valeter. | 0:04:57 | 0:04:59 | |
And you can see him spending hours working on a car, | 0:05:01 | 0:05:04 | |
bending down, bending over and he's not in any pain at all. | 0:05:04 | 0:05:08 | |
This is somebody who doesn't appear to be injured | 0:05:08 | 0:05:10 | |
or suffering in any way. | 0:05:10 | 0:05:12 | |
For somebody who's trying to claim half a million pounds, | 0:05:14 | 0:05:17 | |
this surveillance evidence blows his claim out of the water, | 0:05:17 | 0:05:20 | |
-so it just goes to show how crucial it can be. -Too right. | 0:05:20 | 0:05:24 | |
But Scott wanted to be absolutely sure they hadn't just caught | 0:05:24 | 0:05:27 | |
the claimant on a good day. | 0:05:27 | 0:05:29 | |
Because we carried out three separate periods of surveillance | 0:05:29 | 0:05:33 | |
over a number of dates, then it's clear, unequivocally, | 0:05:33 | 0:05:36 | |
that this person isn't injured anywhere near | 0:05:36 | 0:05:39 | |
the extent that he claims he was on that day. | 0:05:39 | 0:05:42 | |
It was the conclusive proof Scott needed. | 0:05:42 | 0:05:45 | |
The claimant was as fit as an insurance fiddler. | 0:05:45 | 0:05:49 | |
The surveillance evidence was absolutely dynamite, | 0:05:49 | 0:05:51 | |
because it provides us with a true account of this person's disability, | 0:05:51 | 0:05:57 | |
which, in this case, proved that | 0:05:57 | 0:05:58 | |
there was nothing really wrong with him. | 0:05:58 | 0:06:02 | |

We assessed the true value to be roundabout £5,000, | 0:06:15 | 0:06:18 | |
but by that time, we'd incurred so much costs and solicitors fees, | 0:06:18 | 0:06:23 | |

which would ultimately completely dwarf any settlement figure. | 0:06:24 | 0:06:28 | |
The combined costs at this point were close to £100,000. | 0:06:28 | 0:06:32 | |

the surveillance footage was passed on to the claimant's solicitors. | 0:06:33 | 0:06:37 | |
I can only imagine the shock that they were under | 0:06:37 | 0:06:40 | |
when they saw the footage, because clearly it displays somebody | 0:06:40 | 0:06:43 | |
who's submitting a fraudulent claim. | 0:06:43 | 0:06:45 | |
Unsurprisingly, the video evidence wasn't contested, but there was | 0:06:45 | 0:06:50 | |
no way the claimant was walking away from this scot-free. | 0:06:50 | 0:06:53 | |
He was caught. The penalties for being caught were severe, | 0:06:53 | 0:06:57 | |
because he had to pay our legal costs, his legal costs... | 0:06:57 | 0:07:01 | |
We estimated our cost to be in the region of £36,000. | 0:07:01 | 0:07:07 | |
Well, that's not it, because he's got his own solicitor's costs | 0:07:07 | 0:07:10 | |
to pay as well, which we believe are in the region of £40,000. | 0:07:10 | 0:07:14 | |
If the claimant had been honest, | 0:07:14 | 0:07:16 | |
he would've received fair compensation, | 0:07:16 | 0:07:19 | |
instead of facing a bill of around £80,000, | 0:07:19 | 0:07:22 | |

He could've settled this claim for £5,000 long ago | 0:07:26 | 0:07:29 | |
and it would've been done and dusted, | 0:07:29 | 0:07:31 | |
but instead, he decided to lie, | 0:07:31 | 0:07:32 | |
exaggerate the effects of this injury and ultimately try | 0:07:32 | 0:07:35 | |
and achieve a life-changing sum of money. | 0:07:35 | 0:07:38 | |
When it comes to this type of claim, Scott's position is crystal clear. | 0:07:38 | 0:07:43 | |
This is an example of gross exaggeration, | 0:07:43 | 0:07:45 | |
a £5,000 claim that he was suggesting was worth half a million, | 0:07:45 | 0:07:49 | |

In support of the claim, the customer provided us with an e-mail, | 0:10:40 | 0:10:44 | |
purportedly from the taxi company confirming that they were | 0:10:44 | 0:10:48 | |
stuck in traffic and they couldn't get to the airport on time. | 0:10:48 | 0:10:52 | |
It seemed like a straightforward claim to process. | 0:10:52 | 0:10:55 | |
But the proof provided was sending a few different messages. | 0:10:55 | 0:10:59 | |
We were immediately concerned with the e-mail that we received | 0:10:59 | 0:11:02 | |
from the customer to support the claim, | 0:11:02 | 0:11:04 | |
as it was riddled with irregularities | 0:11:04 | 0:11:07 | |
and grammatical errors. | 0:11:07 | 0:11:09 | |
The claimant was contacted by a member of Simon's team | 0:11:12 | 0:11:15 | |

They didn't even provide a taxi for the customer to get to the airport. | 0:13:28 | 0:13:32 | |
Despite the claimant's robust denial, | 0:13:32 | 0:13:35 | |
the evidence clearly suggested that, after the taxi firm had | 0:13:35 | 0:13:38 | |
refused to fabricate an e-mail to validate her bogus story, | 0:13:38 | 0:13:42 | |
she'd just gone ahead and done it herself anyway. | 0:13:42 | 0:13:45 | |
And it was this forged e-mail that was forwarded on to Simon's team. | 0:13:45 | 0:13:49 | |
While somebody had edited the e-mail before it was received by Cega, | 0:14:28 | 0:14:32 | |
reviewing the evidence suggested the claimant | 0:14:32 | 0:14:35 | |
was attempting an elaborate scam. | 0:14:35 | 0:14:37 | |
The e-mails confirmed that the customer had tried to get the | 0:14:39 | 0:14:42 | |
taxi company to falsely give her some information in writing | 0:14:42 | 0:14:45 | |
to support her claim. | 0:14:45 | 0:14:47 | |
Despite the claimant firmly denying this information, | 0:14:47 | 0:14:50 | |
Simon was certain about one key fact. | 0:14:50 | 0:14:54 | |
We have no idea what the true reason was why the customer missed | 0:14:56 | 0:15:00 | |
her international flight home, but what we do know is that | 0:15:00 | 0:15:03 | |
it definitely didn't have anything to do with | 0:15:03 | 0:15:06 | |
a taxi getting caught up in heavy traffic. | 0:15:06 | 0:15:08 | |

a taxi booked with them to travel to the airport. | 0:15:28 | 0:15:30 | |
The claim was declined in full. | 0:15:30 | 0:15:33 | |
And this was relayed to the claimant. | 0:15:33 | 0:15:35 | |
The situation is that her claim had been deemed to be false. | 0:15:59 | 0:16:02 | |
She wouldn't be receiving a penny | 0:16:03 | 0:16:05 | |
and was lucky to avoid further action. | 0:16:05 | 0:16:07 | |
This customer actually went one step further | 0:16:09 | 0:16:12 | |
than just exaggerating her claim. | 0:16:12 | 0:16:14 | |
She's actually falsified a document to support the claim. | 0:16:14 | 0:16:17 | |

Insurers Allianz deal with these claims on a daily basis. | 0:17:05 | 0:17:09 | |
And their fraud manager, Mihir Pandya, | 0:17:09 | 0:17:12 | |
is an expert at weeding out the spurious ones from the genuine. | 0:17:12 | 0:17:16 | |
He was asked to look into a case from a commercial customer | 0:17:16 | 0:17:20 | |
worth several thousand pounds. | 0:17:20 | 0:17:22 | |
We were contacted by our policyholder, | 0:17:23 | 0:17:27 | |
who owned a local convenience store, | 0:17:27 | 0:17:30 | |
telling us that a customer a month prior had fallen | 0:17:30 | 0:17:33 | |
into a trench that was outside his store and injured himself. | 0:17:33 | 0:17:38 | |
Oh, dear. Not what you'd expect when you're picking up a pint of milk. | 0:17:38 | 0:17:43 | |
Once Allianz had spoken to the shop owner | 0:17:43 | 0:17:45 | |
it seemed like an open-and-shut case. | 0:17:45 | 0:17:48 | |
The owner of the local convenience store confirmed | 0:17:50 | 0:17:53 | |
that there were indeed works going on outside. | 0:17:53 | 0:17:55 | |
There was a trench. | 0:17:55 | 0:17:57 | |
It had been dug out for some work to be done to a water mains connection. | 0:17:57 | 0:18:02 | |
But what he told us was that there were barriers placed there daily, | 0:18:02 | 0:18:06 | |

The alleged injuries sustained were a broken left big toe, | 0:18:18 | 0:18:23 | |
bruising and swelling to the feet and also unspecified injuries | 0:18:23 | 0:18:28 | |
to the individual's knee. | 0:18:28 | 0:18:30 | |
It looked like Allianz would be paying out. | 0:18:31 | 0:18:34 | |
Well, that was until the claimant's medical records were received. | 0:18:35 | 0:18:39 | |
Now, within the medical notes, there was indication | 0:18:42 | 0:18:45 | |
that the individual had history of falling over | 0:18:45 | 0:18:50 | |
and there were pre-existing injuries being alluded to within the report. | 0:18:50 | 0:18:57 | |
There was no mention of the alleged incident | 0:18:57 | 0:18:59 | |
or that he had fallen into a trench. | 0:18:59 | 0:19:01 | |
Odd that, considering the alleged injuries | 0:19:01 | 0:19:04 | |
were the direct result of the accident. | 0:19:04 | 0:19:06 | |
And further examination would leave the claimant | 0:19:08 | 0:19:10 | |
without a leg to stand on. | 0:19:10 | 0:19:12 | |
It was also apparent that the individual had not sustained | 0:19:13 | 0:19:17 | |
injuries by falling into a trench. | 0:19:17 | 0:19:20 | |
There was indeed confirmation within that report that, three days | 0:19:20 | 0:19:23 | |
prior to the alleged incident date, he'd dropped something heavy on his | 0:19:23 | 0:19:27 | |
foot, which was probably the reason why he sustained a broken toe. | 0:19:27 | 0:19:31 | |
Allianz had all the proof they needed to make a decision. | 0:19:32 | 0:19:35 | |
On the back of the information that we had in our possession, we felt | 0:19:35 | 0:19:40 | |
confident we had enough information to decline the claim, which we did. | 0:19:40 | 0:19:44 | |
But that wouldn't be the last Allianz | 0:19:46 | 0:19:49 | |
would hear from the claimant. | 0:19:49 | 0:19:50 | |
We thought that was the end of the matter, but six months later, | 0:19:51 | 0:19:56 | |
we received communication from the claimant's solicitors telling us | 0:19:56 | 0:20:01 | |

It was only a matter of months | 0:24:42 | 0:24:44 | |

and first attempting to make a claim on medical grounds. | 0:24:47 | 0:24:50 | |
With both the policies that Mark Downs had with Cardif Pinnacle, | 0:24:50 | 0:24:54 | |
he was claiming that he was suffering from ulcerated colitis. | 0:24:54 | 0:24:57 | |
Which is a particularly nasty enlarging of the bowels and colon. | 0:24:57 | 0:25:02 | |
And upon looking into Downs' work history, | 0:25:02 | 0:25:04 | |
it appeared he had been less than truthful. | 0:25:04 | 0:25:07 | |
Mark Downs had claimed that he was working for a Dutch haulage company. | 0:25:09 | 0:25:13 | |
He also claimed that he owned a Dutch haulage company. | 0:25:13 | 0:25:17 | |
He always claimed to be a managing director, | 0:25:17 | 0:25:20 | |
even the owner of the company. | 0:25:20 | 0:25:22 | |
We spoke to the actual managing director, who assured us that | 0:25:22 | 0:25:26 | |
Mark Downs was not a manager, although he had worked there, | 0:25:26 | 0:25:29 | |
albeit some years before the claim was ever submitted. | 0:25:29 | 0:25:32 | |
So he was claiming loss of earnings on a job he didn't even have. | 0:25:34 | 0:25:38 | |
Downs had also submitted evidence alleging | 0:25:40 | 0:25:43 | |
he owned numerous haulage companies. | 0:25:43 | 0:25:45 | |
But when detectives checked out the office at addresses provided, | 0:25:46 | 0:25:49 | |
no trace of the businesses could be found. | 0:25:49 | 0:25:52 | |
Mark Downs had previously been a lorry driver, | 0:25:53 | 0:25:57 | |
and that was the business he knew, | 0:25:57 | 0:26:00 | |
which is the reason I believe why he kept claiming to be | 0:26:00 | 0:26:03 | |
the manager or the owner or someone senior in various haulage companies. | 0:26:03 | 0:26:09 | |
In support of his £56,000 claim, Downs had also submitted | 0:26:09 | 0:26:13 | |
medical records reportedly from his examining doctors. | 0:26:13 | 0:26:17 | |
They were able to tell us | 0:26:18 | 0:26:20 | |
that they hadn't ever provided these doctors notes. | 0:26:20 | 0:26:23 | |
The doctors notes were fraudulent. | 0:26:23 | 0:26:25 | |
They hadn't operated from the various places | 0:26:25 | 0:26:27 | |
that he stated GP surgeries were. | 0:26:27 | 0:26:31 | |
And they also were able to tell us that he wasn't suffering from | 0:26:31 | 0:26:34 | |
the illness that he was claiming from either. | 0:26:34 | 0:26:37 | |
Mark Downes's lies had been exposed | 0:26:37 | 0:26:39 | |
along with the fake documents he had been providing to his insurer. | 0:26:39 | 0:26:43 | |
His attempted scam had failed. | 0:26:43 | 0:26:45 | |
There was an awful lot of evidence against Mark Downes. | 0:26:47 | 0:26:50 | |
We were able to show that the claims he had made were | 0:26:50 | 0:26:54 | |
completely fraudulent, that he had pretended to be at doctors. | 0:26:54 | 0:26:59 | |
He had signed fake doctors' notes. | 0:26:59 | 0:27:03 | |
He had pretended to be managers, | 0:27:03 | 0:27:05 | |
owners of haulage companies. | 0:27:05 | 0:27:07 | |

fraudulent doctors' notes | 0:27:27 | 0:27:30 | |
and other documentation relating to the insurance claim. | 0:27:30 | 0:27:34 | |
Despite the overwhelming body of evidence, there would be | 0:27:34 | 0:27:37 | |
no confession. | 0:27:37 | 0:27:38 | |
He was interviewed | 0:27:41 | 0:27:42 | |
where he denied that the claim was fraudulent. | 0:27:42 | 0:27:45 | |
He stated that it was all a genuine claim, that all the doctors' notes | 0:27:45 | 0:27:49 | |
were genuine and maintained his innocence throughout. | 0:27:49 | 0:27:53 | |
With Downes in custody and facing multiple fraud charges, | 0:27:53 | 0:27:56 | |
his case took an unexpected turn. | 0:27:56 | 0:27:59 | |
After Mark Downes's initial arrest | 0:27:59 | 0:28:03 | |

And exactly the same fraud had been going on with Shepherds Friendly. | 0:28:19 | 0:28:23 | |
Things were going from bad to worse for Mark Downes | 0:28:23 | 0:28:26 | |
and the full extent of his attempted fraud had been revealed. | 0:28:26 | 0:28:31 | |
He clearly thought he was never ever going to get caught and | 0:28:31 | 0:28:34 | |
he thought he was going to get £56,000 from Cardif Pinnacle | 0:28:34 | 0:28:39 | |
and a further £40,000 from Shepherds Friendly, which again | 0:28:39 | 0:28:42 | |
he was not entitled to as it was a completely made up set of claims. | 0:28:42 | 0:28:46 | |
With false claims totalling nearly £100,000, | 0:28:46 | 0:28:50 | |
Downes was charged with 12 counts of fraud. | 0:28:50 | 0:28:53 | |
He pled guilty at trial... | 0:28:53 | 0:28:54 | |
..and was sentenced to 14 months in prison. | 0:28:56 | 0:28:59 | |

If Downes hadn't been stopped when he was, | 0:29:18 | 0:29:20 | |
the consequences could have been grave. | 0:29:20 | 0:29:23 | |
Mark Downes has previous convictions for fraud and like offences. | 0:29:23 | 0:29:30 | |

the witness had observed Luke Gaughan and Sam Borbely | 0:31:17 | 0:31:20 | |
staging a deliberate collision using their two cars. | 0:31:20 | 0:31:24 | |
The police turned up to the scene and warned both individuals | 0:31:25 | 0:31:29 | |
that, if they pursued a claim, they would likely to be | 0:31:29 | 0:31:32 | |
blacklisted from insurance and that that would be an offence. | 0:31:32 | 0:31:35 | |

wouldn't be deterred so easily. | 0:32:08 | 0:32:10 | |
And submitted claims for personal injury and damage to both vehicles. | 0:32:10 | 0:32:15 | |
Our customer said the other party had neck and wrist injuries. | 0:32:15 | 0:32:19 | |
This claim would have been worth approximately £7,000. | 0:32:20 | 0:32:24 | |
So at this stage, Borbely, Insure The Box's customer, | 0:32:24 | 0:32:27 | |
has already said that he was at fault for the alleged accident. | 0:32:27 | 0:32:30 | |
While he's not pursuing any insurance claims, he is assisting | 0:32:30 | 0:32:34 | |
the claims of his crash buddy and the third party driver Gaughan, | 0:32:34 | 0:32:38 | |
which the evidence suggests are completely fraudulent. | 0:32:38 | 0:32:41 | |
But any chance the duo had of pulling off their scam | 0:32:41 | 0:32:44 | |
was soon scuppered. | 0:32:44 | 0:32:46 | |
When confronted with the overwhelming evidence, | 0:32:47 | 0:32:49 | |
our policyholder made a full confession. | 0:32:49 | 0:32:53 | |
However, the other driver continued with the claim, | 0:32:53 | 0:32:56 | |
even went to an accident management company and, when Insure The Box | 0:32:56 | 0:33:00 | |

we were really surprised that claims were still presented. | 0:33:24 | 0:33:27 | |
He obviously didn't hear the police advising him | 0:33:51 | 0:33:55 | |

While the claim was repudiated immediately, | 0:34:14 | 0:34:17 | |

and Gaughan seemed slightly confused about who hit whom. | 0:34:19 | 0:34:23 | |
Despite this, Gaughan continued to lie to the call handler. | 0:34:24 | 0:34:27 | |
Try as he might to push his claim, | 0:34:51 | 0:34:53 | |
Gaughan's efforts were met with a sobering response. | 0:34:53 | 0:34:56 | |
We'd already flagged the policy on the back of the information that | 0:34:58 | 0:35:03 | |
the police had given us, so, when a claim was intimated, | 0:35:03 | 0:35:07 | |
it was declined straight away. | 0:35:07 | 0:35:10 | |
Undeterred, Gordon continued to try it on. | 0:35:10 | 0:35:13 | |
Well, insurers are under no obligation to play false claims. | 0:35:32 | 0:35:36 | |
Borbely had already admitted to his own insurer that the accident | 0:35:36 | 0:35:40 | |
was staged and Ifed's investigations prove that | 0:35:40 | 0:35:44 | |
and also that Gaughan and Borbely had been friends for some time. | 0:35:44 | 0:35:48 | |
At least they had each other when the full weight of the law | 0:35:49 | 0:35:52 | |
came crashing down on them. | 0:35:52 | 0:35:54 | |
Both men were charged with fraud. They were both prosecuted | 0:35:55 | 0:36:00 | |
