I'm afraid it was quite the opposite for others. | 0:02:14 | 0:02:17 | |
Unfamiliar planning laws, unscrupulous developers, | 0:02:17 | 0:02:20 | |
or even corrupt local officials, could turn those dreams into dust. | 0:02:20 | 0:02:24 | |
And what's more, because the people we're about to hear from | 0:02:24 | 0:02:27 | |
poured everything they had into their properties abroad, | 0:02:27 | 0:02:30 | |
they have been left tens of thousands of pounds out of pocket. | 0:02:30 | 0:02:34 | |
And, in one case, with absolutely nothing to show for it. | 0:02:34 | 0:02:38 | |
Beautiful scenery, great beaches and lively resorts, | 0:02:41 | 0:02:45 | |
so it's easy to see why Bulgaria became such a prime spot | 0:02:45 | 0:02:49 | |
for anyone investing in property abroad. | 0:02:49 | 0:02:52 | |
And the rock-bottom property prices around 2005 | 0:02:52 | 0:02:54 | |
were what drew in people like Phil Newport. | 0:02:54 | 0:02:58 | |
It's been advertised as the next big thing in property investment. | 0:03:00 | 0:03:05 | |
It seemed like a good choice to me. | 0:03:05 | 0:03:08 | |
Phil fell in love with an off-plan luxury development | 0:03:08 | 0:03:11 | |
called the Golden Pearl. | 0:03:11 | 0:03:13 | |
Located on the Black Sea coastline | 0:03:13 | 0:03:16 | |
near the picturesque Strandzha National Park. | 0:03:16 | 0:03:19 | |
The type of property I was looking at | 0:03:19 | 0:03:21 | |
was, like, a one-bedroom apartment on the coast, which it was. | 0:03:21 | 0:03:25 | |
All the brochures looked superb. | 0:03:25 | 0:03:28 | |
It looked like a quality development. | 0:03:28 | 0:03:31 | |
Big kick. Wow! | 0:03:31 | 0:03:33 | |
Phil extended his mortgage at home in the UK | 0:03:33 | 0:03:36 | |
to cover the £43,000 cost of the apartment | 0:03:36 | 0:03:39 | |
and went looking for a Bulgarian solicitor | 0:03:39 | 0:03:41 | |
to help with the purchase. | 0:03:41 | 0:03:44 | |
But the London-based sales agent he was buying through | 0:03:44 | 0:03:46 | |
persuaded him that he didn't really need legal help. | 0:03:46 | 0:03:49 | |
I was told by the agent that it really wasn't worth doing. | 0:03:51 | 0:03:55 | |
He'd already sold numerous properties on that development | 0:03:55 | 0:03:59 | |
who had used solicitors, who said the contracts were superb, | 0:03:59 | 0:04:04 | |
so I decided not to do it at that time. | 0:04:04 | 0:04:07 | |
Over the next few months, | 0:04:10 | 0:04:11 | |
Phil made two payments totalling more than £20,000, | 0:04:11 | 0:04:14 | |
almost half of the cost of his new apartment. | 0:04:14 | 0:04:17 | |
But in the summer of 2005, | 0:04:17 | 0:04:20 | |
he discovered that building work had slowed down considerably. | 0:04:20 | 0:04:23 | |
I was a bit shocked at that stage | 0:04:25 | 0:04:27 | |
to see that it wasn't anywhere near as advanced as I expected. | 0:04:27 | 0:04:31 | |
Phil was told there was a dispute | 0:04:31 | 0:04:33 | |
over the legality of building on this particular site | 0:04:33 | 0:04:37 | |
and construction had stopped whilst it was resolved. | 0:04:37 | 0:04:40 | |
And the agent was always saying, "Oh, this is typical Bulgaria, | 0:04:40 | 0:04:45 | |
"building works are always behind schedule." And stuff like that. | 0:04:45 | 0:04:48 | |
As the planning dispute raged, | 0:04:50 | 0:04:52 | |
work stopped, started, and then stopped again. | 0:04:52 | 0:04:55 | |
Until finally in 2007, | 0:04:55 | 0:04:58 | |
Phil discovered that the building permit had been withdrawn completely. | 0:04:58 | 0:05:03 | |
I found the whole thing really quite frustrating. | 0:05:03 | 0:05:07 | |
I had a lot of sleepless nights. | 0:05:07 | 0:05:08 | |
You know, it's a lot of money that's been invested. | 0:05:08 | 0:05:11 | |
And it was quite a struggle at the time. | 0:05:11 | 0:05:14 | |
In the years that followed, Phil and dozens of other investors | 0:05:14 | 0:05:18 | |
tried in vain to get their money back. | 0:05:18 | 0:05:20 | |
But when the company he'd bought from was dissolved, | 0:05:20 | 0:05:23 | |
he just knew that there was little chance of that happening for him. | 0:05:23 | 0:05:27 | |
Then in April 2012, the bulldozers moved in | 0:05:27 | 0:05:30 | |
and demolished the Golden Pearl apartments. | 0:05:30 | 0:05:34 | |
It was absolutely gutting. | 0:05:34 | 0:05:36 | |
We thought, "That's it, we've lost our money." | 0:05:36 | 0:05:38 | |
I'd remortgaged the house, | 0:05:38 | 0:05:40 | |
I was going to be paying this money back on my mortgage | 0:05:40 | 0:05:44 | |
for a number of years to come. | 0:05:44 | 0:05:46 | |
And, you know, I was really sickened by the whole thing. | 0:05:46 | 0:05:50 | |
Sadly, Phil's story isn't unique, | 0:05:50 | 0:05:52 | |
thousands of people who bought homes in the sun | 0:05:52 | 0:05:55 | |
in the property boom of the early 2000s | 0:05:55 | 0:05:57 | |
came to regret it after discovering the hard way | 0:05:57 | 0:06:00 | |
that oversees planning laws can be very, very different to those at home. | 0:06:00 | 0:06:04 | |
And that was particularly true in the country that more Brits chose for their sunshine escape than any other, | 0:06:04 | 0:06:10 | |
in other words, Spain. | 0:06:10 | 0:06:11 | |
There the planning laws are often confusing | 0:06:11 | 0:06:13 | |
and at that time were very regularly ignored by profit-hungry developers. | 0:06:13 | 0:06:18 | |
In the region of Andalusia alone, it's estimated that 300,000 homes | 0:06:20 | 0:06:25 | |
were built without planning permission and local authorities | 0:06:25 | 0:06:28 | |
sought to clamp down on it | 0:06:28 | 0:06:30 | |
by demolishing any buildings constructed illegally. | 0:06:30 | 0:06:34 | |
But even when all the planning laws had been followed to the letter, | 0:06:34 | 0:06:37 | |
there have still been cases where Spanish authorities | 0:06:37 | 0:06:40 | |
have demanded that properties be pulled down. | 0:06:40 | 0:06:43 | |
In 2002, Len and Helen Prior | 0:06:45 | 0:06:47 | |
bought some land in the Andalusian town of Vera, | 0:06:47 | 0:06:50 | |
where they built their dream retirement villa. | 0:06:50 | 0:06:53 | |
They called it Tranquilidad, | 0:06:53 | 0:06:54 | |
which is really Spanish for "tranquillity". | 0:06:54 | 0:06:57 | |
It was three-bedroomed, two-bathroomed. | 0:06:57 | 0:07:00 | |
You know, it was just everything we wanted. | 0:07:00 | 0:07:03 | |
The family came out twice a year, | 0:07:03 | 0:07:05 | |
friends came out to visit, it was just fantastic. | 0:07:05 | 0:07:08 | |
When we caught up with Len, | 0:07:08 | 0:07:10 | |
he was on a rare visit to the UK to see his daughter, Susie, | 0:07:10 | 0:07:14 | |
who was a regular visitor to the villa with her family. | 0:07:14 | 0:07:17 | |
-Hi! -Hiya! | 0:07:17 | 0:07:19 | |
The villa was gorgeous. | 0:07:19 | 0:07:21 | |
The kids literally were in the pool from the minute they got up in morning till they came in... | 0:07:21 | 0:07:26 | |
eventually came in at night-time. | 0:07:26 | 0:07:28 | |
Erm, it was...it was just an ideal holiday, really. | 0:07:28 | 0:07:32 | |
Len and Helen's retirement in the sun was pretty much perfect | 0:07:33 | 0:07:36 | |
until two years after the house was finished. | 0:07:36 | 0:07:39 | |
The couple then received a letter from the town hall | 0:07:39 | 0:07:42 | |
with some devastating news. | 0:07:42 | 0:07:44 | |
They were told that the planning permissions | 0:07:44 | 0:07:46 | |
they'd secured before their house was built | 0:07:46 | 0:07:48 | |
had been revoked by the regional government of Andalusia, | 0:07:48 | 0:07:51 | |
and, as a result, the house had to be demolished. | 0:07:51 | 0:07:56 | |
It was like somebody hitting you over the head with a hammer. | 0:07:56 | 0:07:59 | |
You know, everything you'd sort of worked for all your life | 0:07:59 | 0:08:03 | |
within ten seconds is going to be taken away. | 0:08:03 | 0:08:06 | |
Convinced that the house was legal | 0:08:09 | 0:08:11 | |
and that all the necessary rules had been followed to the letter, | 0:08:11 | 0:08:14 | |
the couple applied to have the demolition stopped. | 0:08:14 | 0:08:17 | |
But while their legal case was still rumbling on, | 0:08:17 | 0:08:20 | |
Len and Helen woke up one morning and noticed that something was wrong. | 0:08:20 | 0:08:24 | |
I went downstairs, turned the tap on, there was no water. | 0:08:25 | 0:08:28 | |
Put the electric on, no electric. | 0:08:28 | 0:08:30 | |
And I looked out the window | 0:08:30 | 0:08:32 | |
and there was police and lorries and JCBs everywhere. | 0:08:32 | 0:08:37 | |
And then we thought, "This is it, | 0:08:37 | 0:08:39 | |
"they're definitely going to knock it down." | 0:08:39 | 0:08:42 | |
The Priors were given just a matter of hours | 0:08:42 | 0:08:44 | |
to get all their belongings out of the house | 0:08:44 | 0:08:46 | |
before it would be demolished. | 0:08:46 | 0:08:49 | |
But in the midst of the chaos, things suddenly got even more serious, | 0:08:49 | 0:08:53 | |
and what happened next was all captured on camera. | 0:08:53 | 0:08:56 | |
I just collapsed. | 0:09:00 | 0:09:02 | |
I'd never had that happen to me in me life. | 0:09:04 | 0:09:07 | |
The ambulance came, took me away to the hospital, | 0:09:07 | 0:09:10 | |
and they told me under no circumstances | 0:09:10 | 0:09:13 | |
am I allowed to go back to the house. | 0:09:13 | 0:09:15 | |
Cos they said, "It'd probably be fatal if you did." | 0:09:15 | 0:09:18 | |
Back at the house, the bulldozers | 0:09:18 | 0:09:20 | |
began tearing the Prior's dream retirement villa to pieces. | 0:09:20 | 0:09:24 | |
All that was left was the garage and the swimming pool. | 0:09:24 | 0:09:28 | |
Nothing seems real, you're sort of walking around in a daze | 0:09:28 | 0:09:31 | |
for sort of 20 minutes before it actually hits you. | 0:09:31 | 0:09:35 | |
Seven years later, Len and Helen | 0:09:35 | 0:09:38 | |
still can't quite believe what happened, | 0:09:38 | 0:09:40 | |
and they've no clearer idea why their house was destroyed. | 0:09:40 | 0:09:44 | |
There was about five different reasons that they gave. | 0:09:44 | 0:09:47 | |
We've never actually found out | 0:09:47 | 0:09:49 | |
the real reason why it was knocked down. | 0:09:49 | 0:09:53 | |
And with their dream villa demolished, | 0:09:53 | 0:09:55 | |
their only option has been to convert its garage into living quarters. | 0:09:55 | 0:09:59 | |
We're using farm water to wash up, to wash in, to shower in. | 0:09:59 | 0:10:06 | |
Our electric comes from a friend of ours and we've got a generator. | 0:10:06 | 0:10:09 | |
It's not...ideal, not for two old age pensioners anyway. | 0:10:09 | 0:10:13 | |
And it's from their garage | 0:10:14 | 0:10:16 | |
that they're fighting to get compensation from Vera Council | 0:10:16 | 0:10:19 | |
for the hundreds of thousands of euros that they've lost. | 0:10:19 | 0:10:22 | |
In recent years, they've been edging slowly closer | 0:10:23 | 0:10:26 | |
to what they hope will be a victory. | 0:10:26 | 0:10:28 | |
Len says that in 2013, the lawyer told them | 0:10:28 | 0:10:31 | |
that their villa was built completely legally | 0:10:31 | 0:10:34 | |
and that the planning permission should never, ever have been revoked. | 0:10:34 | 0:10:38 | |
But that's obviously come far too late. | 0:10:38 | 0:10:40 | |
Shocking as Len and Helen's case is, | 0:10:41 | 0:10:43 | |
there are others in exactly the same position. | 0:10:43 | 0:10:46 | |
Indeed, so many that the Spanish authorities | 0:10:46 | 0:10:48 | |
have now passed new legislation to tackle the problem. | 0:10:48 | 0:10:52 | |
From October 2015, | 0:10:52 | 0:10:53 | |
people like Helen and Len whose homes are to be forcibly demolished | 0:10:53 | 0:10:58 | |
because planning permission was not in place or was revoked, but who bought their property in good faith, | 0:10:58 | 0:11:03 | |
should be entitled to compensation. | 0:11:03 | 0:11:06 | |
And that's something that international property lawyer Stefano Locatello | 0:11:06 | 0:11:10 | |
thinks is long overdue for anyone who finds themselves in the same boat. | 0:11:10 | 0:11:15 | |
The new legislation says that if you build your property | 0:11:15 | 0:11:18 | |
with the correct planning permissions and licences | 0:11:18 | 0:11:22 | |
and subsequently that planning permission or those licences are revoked, | 0:11:22 | 0:11:26 | |
then you are entitled as long as you've done that in good faith | 0:11:26 | 0:11:30 | |
to be paid moral damages. | 0:11:30 | 0:11:32 | |
The extent of moral damages we don't know yet, | 0:11:32 | 0:11:35 | |
it could be the full value of your property or it could be a token payment. | 0:11:35 | 0:11:38 | |
What's more, the new legislation says that if you are entitled to compensation in future, | 0:11:38 | 0:11:44 | |
these damages should be paid in full BEFORE the bulldozers move in. | 0:11:44 | 0:11:49 | |
It's as yet unclear whether the law will apply retrospectively | 0:11:49 | 0:11:53 | |
and therefore help Len and Helen. | 0:11:53 | 0:11:55 | |
But although Stefano thinks that in their case, the couple did everything right when building their home, | 0:11:55 | 0:12:01 | |
he says that not all Brits buying homes abroad have been as diligent. | 0:12:01 | 0:12:05 | |
Unfortunately, people when they go abroad and they're in the mood for buying, | 0:12:07 | 0:12:11 | |
they forget their common sense at the airport. | 0:12:11 | 0:12:13 | |
The concepts of international law, international property law especially, | 0:12:13 | 0:12:17 | |
are completely different to those we have in the United Kingdom or English law. | 0:12:17 | 0:12:20 | |
So you must have a lawyer who is qualified in that jurisdiction to help you. | 0:12:20 | 0:12:25 | |
Meanwhile, Len and Helen are still living in their converted garage | 0:12:25 | 0:12:29 | |
hoping that the way to get back some of what they've lost, | 0:12:29 | 0:12:32 | |
which they estimate, by the way, to be almost 700,000 euros, | 0:12:32 | 0:12:37 | |
won't take as long as their battle through the courts. | 0:12:37 | 0:12:40 | |
If we get compensation and we get the licence back, | 0:12:40 | 0:12:43 | |
do we really want a house built here or do we want to move somewhere else in Spain? | 0:12:43 | 0:12:48 | |
I don't think we would move from Spain. | 0:12:48 | 0:12:50 | |
I mean, you know, it's our home now anyway. | 0:12:50 | 0:12:53 | |
We may not like it, but we've all had to accept over the years | 0:12:58 | 0:13:02 | |
that the price you pay for holidays and flights | 0:13:02 | 0:13:05 | |
can go up and down according to demand. | 0:13:05 | 0:13:07 | |
And, of course, anyone taking their kids away in the school holidays | 0:13:07 | 0:13:10 | |
will know only too well just how much those costs can vary. | 0:13:10 | 0:13:13 | |
But would you expect to pay a different price | 0:13:13 | 0:13:16 | |
for a holiday based on where you live | 0:13:16 | 0:13:19 | |
or indeed from which country you've actually booked it? | 0:13:19 | 0:13:22 | |
You might, not unreasonably, feel rather hacked off to discover | 0:13:22 | 0:13:26 | |
that a family that lives in a different country | 0:13:26 | 0:13:29 | |
is able to book exactly the same holiday for a lot less. | 0:13:29 | 0:13:33 | |
Well, that can and does happen. | 0:13:33 | 0:13:35 | |
Indeed, you may have seen the outraged reports in the press | 0:13:35 | 0:13:38 | |
about how much extra you might sometimes have to pay | 0:13:38 | 0:13:41 | |
to book from the UK for Disneyland Paris. | 0:13:41 | 0:13:45 | |
But don't worry, because we've found a way around that one. | 0:13:45 | 0:13:48 | |

with hotel and theme-park tickets for a family of four at the end of October. | 0:19:49 | 0:19:55 | |

do so to control or prevent a condition they would otherwise be susceptible to, | 0:30:33 | 0:30:38 | |

And the ABI recommended that travellers with medical conditions | 0:30:40 | 0:30:44 | |
shop around to find the right policy | 0:30:44 | 0:30:46 | |

Of course, it's not just taking statins | 0:30:53 | 0:30:55 | |

When Neil Lloyd, his wife Lisa and son Harry | 0:34:41 | 0:34:44 | |
decided to catch some late-summer sun, | 0:34:44 | 0:34:46 | |
they opted for the Italian island of Sicily. | 0:34:46 | 0:34:49 | |
We were just going for a fairly laid-back holiday, | 0:34:50 | 0:34:53 | |
spent a lot of time around the pool, | 0:34:53 | 0:34:55 | |
spent a lot of time just on our local beach. | 0:34:55 | 0:34:57 | |
We spent a lot of time, you know, going out to lunch. | 0:34:57 | 0:35:01 | |
And with total relaxation top of their agenda, | 0:35:01 | 0:35:04 | |
they picked a remote villa several miles from the nearest town, | 0:35:04 | 0:35:07 | |
meaning that hiring a car was a must. | 0:35:07 | 0:35:11 | |
Our villa was some three or four miles outside the town, | 0:35:11 | 0:35:13 | |
so really the only option was to have a hire car. | 0:35:13 | 0:35:16 | |
So Neil turned to a hire car website | 0:35:16 | 0:35:18 | |
that he'd used before called rentalcars.com. | 0:35:18 | 0:35:21 | |
And on there he chose a car from an Italian rental firm called Locauto Rent. | 0:35:21 | 0:35:25 | |
To make sure he and his family were covered for every eventuality, | 0:35:25 | 0:35:28 | |
Neil also took out a full-protection insurance policy at £47 extra. | 0:35:28 | 0:35:33 | |
I've been to Sicily before, | 0:35:33 | 0:35:35 | |
I know the roads are very poor over there, and so I thought I was doing the right thing | 0:35:35 | 0:35:39 | |
in terms of taking out that full-protection insurance. | 0:35:39 | 0:35:43 | |
With the car rental taken care of, the family set off | 0:35:43 | 0:35:46 | |
for a holiday which lived up to all of their expectations. | 0:35:46 | 0:35:49 | |
It was very convenient having the car, it was very convenient having all three of us able to drive it. | 0:35:50 | 0:35:55 | |
So if Harry wanted to shoot off somewhere on his own, he was covered and he could take the car, | 0:35:55 | 0:35:59 | |
or if one of us just wanted to pop to the shops that could be done. | 0:35:59 | 0:36:03 | |
So that's why we put all three of us on the insurance. | 0:36:03 | 0:36:06 | |
But at the end of the week, as Harry was driving them back to the airport, | 0:36:06 | 0:36:09 | |
in a split second everything changed. | 0:36:09 | 0:36:12 | |
We'd had a great holiday, | 0:36:12 | 0:36:14 | |
we're driving back and wanted to stop and get some water. | 0:36:14 | 0:36:17 | |
And we see a place we can buy some water | 0:36:17 | 0:36:19 | |
and it means crossing the carriageway through these cones and everything. | 0:36:19 | 0:36:23 | |
And so we make that left turn and I'm sat in the passenger seat | 0:36:23 | 0:36:27 | |
and I certainly didn't see the oncoming car, | 0:36:27 | 0:36:30 | |
and clearly Harry didn't see the oncoming car. | 0:36:30 | 0:36:33 | |
Unfortunately, Neil, Lisa and Harry | 0:36:33 | 0:36:36 | |
were all injured in the collision that followed. | 0:36:36 | 0:36:38 | |
Neil suffered a head injury and was airlifted to hospital, | 0:36:38 | 0:36:41 | |
while Harry and Lisa were taken by ambulance. | 0:36:41 | 0:36:44 | |
Next thing I really remember is then just being in A&E | 0:36:44 | 0:36:48 | |
in a very small hospital in the middle of rural Sicily. | 0:36:48 | 0:36:52 | |
Harry couldn't even remember we were on holiday, | 0:36:52 | 0:36:54 | |
he kept asking the same questions over and over and over, | 0:36:54 | 0:36:57 | |
and got very distressed when he saw me and my wife, | 0:36:57 | 0:37:00 | |
and particularly me because my shirt was covered in blood. | 0:37:00 | 0:37:02 | |
While the family were coming to terms with their injuries, | 0:37:02 | 0:37:05 | |
the Italian police were keen to interview Harry, | 0:37:05 | 0:37:08 | |
who was driving at the time, about what had happened. | 0:37:08 | 0:37:11 | |
They collected all our luggage and... | 0:37:11 | 0:37:14 | |
they attempted to interview Harry, | 0:37:14 | 0:37:16 | |
but Harry couldn't remember anything at all. | 0:37:16 | 0:37:19 | |
Harry's memory loss was put down to a suspected concussion | 0:37:19 | 0:37:22 | |
and it meant that he couldn't recall anything about the accident. | 0:37:22 | 0:37:25 | |
So Neil gave a statement which Harry signed. | 0:37:25 | 0:37:28 | |
The following day the family were well enough to leave | 0:37:28 | 0:37:31 | |
and they flew back to the UK. | 0:37:31 | 0:37:33 | |
But just over a week later, | 0:37:34 | 0:37:36 | |
Neil got an e-mail from Locauto Rent, the Italian car rental company. | 0:37:36 | 0:37:41 | |
So I just get this e-mail from Locauto, with an invoice attached with no detail on it, | 0:37:42 | 0:37:48 | |
saying that they want to charge me 13,572 euros. | 0:37:48 | 0:37:53 | |
And my immediate reaction was, "Oh, that's a mistake. It's just a typo." | 0:37:53 | 0:37:58 | |
But I'm afraid there was no mistake. | 0:37:58 | 0:38:00 | |
Neil was being charged for the cost of replacing the car. | 0:38:00 | 0:38:03 | |
It really is your nightmare. | 0:38:03 | 0:38:05 | |
That's why you take out all that insurance, | 0:38:05 | 0:38:08 | |
because you just don't want to get stung like that. | 0:38:08 | 0:38:11 | |
Neil couldn't understand why the full-protection insurance he'd taken out | 0:38:11 | 0:38:15 | |
wasn't going to cover the damages. | 0:38:15 | 0:38:18 | |
But the rental car provider Locauto Rent | 0:38:18 | 0:38:20 | |
and the booking website rentalcars.com | 0:38:20 | 0:38:23 | |
both told him that the statement he'd given police at the hospital | 0:38:23 | 0:38:26 | |
had been signed by his son, Harry, | 0:38:26 | 0:38:29 | |
who they claimed had admitted to driving negligently. | 0:38:29 | 0:38:32 | |
And under the terms and conditions of the policy, | 0:38:32 | 0:38:35 | |
that meant the insurance would not pay out. | 0:38:35 | 0:38:38 | |
When you've done everything you possibly could to ensure that, | 0:38:40 | 0:38:45 | |
you know, you are protected and then you find that you're not, it's really gutting. | 0:38:45 | 0:38:49 | |
And it's not only gutting, but it's a huge amount of money. | 0:38:49 | 0:38:52 | |
Worse still, Neil knew that he certainly hadn't given any indication | 0:38:52 | 0:38:57 | |
to the Italian police that his son was driving negligently. | 0:38:57 | 0:39:01 | |
And given that Harry himself had been suffering memory loss at the time, | 0:39:01 | 0:39:05 | |
Neil was horrified that any report he'd signed in that condition, | 0:39:05 | 0:39:08 | |
and of course written in a language that wasn't his own, | 0:39:08 | 0:39:12 | |
could be used as grounds for not paying out. | 0:39:12 | 0:39:15 | |
The police still asked him to sign a report | 0:39:16 | 0:39:19 | |
and that's what the insurance company is relying upon | 0:39:19 | 0:39:22 | |
as being proof of negligent driving, which I just think is outrageous. | 0:39:22 | 0:39:26 | |
Neil's view is shared by solicitor Gary Rycroft. | 0:39:26 | 0:39:31 | |
I would say that natural justice dictates | 0:39:31 | 0:39:33 | |
that you should not be bound by a form that you've completed in a foreign language | 0:39:33 | 0:39:39 | |
immediately after a car accident at a time when you and your family are in a state of considerable distress. | 0:39:39 | 0:39:45 | |
What's more, Gary understands why Neil was so shocked | 0:39:45 | 0:39:49 | |
to be told that his full-protection cover | 0:39:49 | 0:39:51 | |
wasn't quite as FULL as its name suggests. | 0:39:51 | 0:39:54 | |
The title of the car insurance policy they took out was full-protection policy. | 0:39:54 | 0:39:59 | |
Now, it seems to me that that was a misleading title, | 0:39:59 | 0:40:01 | |
because, in this case, it wasn't a full-protection policy at all. | 0:40:01 | 0:40:04 | |
For more than three weeks, Neil tried to argue his case with rentalcars.com and Locauto Rent, | 0:40:04 | 0:40:11 | |
but the companies refused to budge. | 0:40:11 | 0:40:13 | |
In the meantime, Neil got in touch with us | 0:40:13 | 0:40:16 | |
and after that, things suddenly changed. | 0:40:16 | 0:40:20 | |
'You have one new message.' | 0:40:20 | 0:40:22 | |
In fact, one of the companies rang Neil why we were with him | 0:40:22 | 0:40:26 | |
and since we've filmed with the family, Locauto Rent and rentalcars.com | 0:40:26 | 0:40:30 | |
have refunded the charge for the written-off car. | 0:40:30 | 0:40:34 | |
The Italian hire car firm stressed | 0:40:34 | 0:40:37 | |
that while it had agreed to the refund, it was not contractually obliged to do so. | 0:40:37 | 0:40:42 | |
And it maintained that the police report did prove that the accident was Harry's responsibility | 0:40:42 | 0:40:47 | |
and that he had violated Italian driving laws. | 0:40:47 | 0:40:50 | |
It then went on to claim that it was Neil and Harry's choice | 0:40:50 | 0:40:53 | |
whether or not to sign the report. | 0:40:53 | 0:40:56 | |
Meanwhile, rentalcars.com, the company which arranged the rental and provided that full-protection cover, | 0:40:56 | 0:41:03 | |
confirmed that the policy does have exclusions for circumstances | 0:41:03 | 0:41:07 | |
such as negligent driving and may be invalidated if a customer violates local driving laws while abroad. | 0:41:07 | 0:41:14 | |
But it did recognise that extra protection... | 0:41:14 | 0:41:17 | |
They went on to say that Neil's questioning of the police report | 0:41:21 | 0:41:24 | |
had led the company to investigate further, | 0:41:24 | 0:41:27 | |
ultimately leading to the charge for the written-off car being waived. | 0:41:27 | 0:41:31 | |
Rentalcars.com added that while in such situations | 0:41:31 | 0:41:34 | |
it's understandable that well-intentioned customers may want to help the police, | 0:41:34 | 0:41:39 | |
it's vitally important they know what exactly their signing, | 0:41:39 | 0:41:43 | |
pointing out it has a 24-hour helpline that can offer advice in such situations. | 0:41:43 | 0:41:48 | |
But the number of e-mails and letters we get about hiring a car | 0:41:51 | 0:41:55 | |
suggests that the whole process can be fraught with difficulties. | 0:41:55 | 0:41:58 | |
When you hire a car abroad, the law is different, | 0:41:58 | 0:42:02 | |
so when you go and collect the car, you should ask, | 0:42:02 | 0:42:05 | |
"Are there any particular rules that I need to know about | 0:42:05 | 0:42:08 | |
with regard to driving a vehicle in this country or this particular region?" | 0:42:08 | 0:42:13 | |
You should not be put on the spot | 0:42:13 | 0:42:15 | |
and asked to sign something you do not understand. | 0:42:15 | 0:42:18 | |
And although they're very relieved at no longer having to pay out 13,500 euros, | 0:42:18 | 0:42:23 | |
Neil and Harry still don't see how a policy described as full protection may not always provide that. | 0:42:23 | 0:42:30 | |
I'll certainly be wary about renting cars abroad in the future. | 0:42:30 | 0:42:34 | |
And if I'm ever in a position where I need to, | 0:42:34 | 0:42:36 | |
then I don't think I'll be taking out full-protection insurance. | 0:42:36 | 0:42:39 | |
