If you're owed money but aren't getting paid...

0:00:020:00:04

it's time to call the sheriffs.

0:00:040:00:05

My name's Mr Grix. My colleague and I are enforcement agents.

0:00:050:00:08

I'm here to issue a high court writ.

0:00:080:00:09

I've got to do what I'm instructed to by the courts.

0:00:090:00:12

They're enforcement agents of the High Court.

0:00:120:00:15

And if a court's ruled in your favour, they're on your side.

0:00:150:00:20

If the debtor doesn't want to pay...

0:00:200:00:23

You currently owe £9,461.80.

0:00:230:00:25

..the law says the sheriffs can get you what you're owed.

0:00:250:00:28

If you don't come to the door, we have to remove

0:00:280:00:30

the vehicle off the drive.

0:00:300:00:31

You'll have a week to pay in full before it gets sold at auction.

0:00:310:00:34

Whether it's a small company...

0:00:340:00:36

Can I speak to the person in charge, please?

0:00:360:00:37

..or a household name...

0:00:370:00:39

We're here to see somebody from G4S.

0:00:390:00:41

..if they owe you money, the sheriffs get it paid.

0:00:410:00:44

I'm not going anywhere, you get him to come in here.

0:00:440:00:46

We're not going to be waiting around like that, it needs to be done now.

0:00:460:00:49

I just collected 42 grand.

0:00:490:00:51

Coming up...

0:00:540:00:56

things get heated at a car dealer's in east London.

0:00:560:00:58

-Move, move.

-Oi, oi, oi! Pal.

0:00:580:01:01

You think you can come in here and start bullying people.

0:01:010:01:04

I'll get my pals here and we'll see who's going to bully who.

0:01:040:01:06

But can Sheriff Ken Warby get them to pay the five grand they owe?

0:01:060:01:10

The value of the goods is here.

0:01:100:01:12

Did I not warn you earlier that this would happen?

0:01:120:01:14

In Leeds, Michael Redman's house was left exposed to the elements

0:01:140:01:17

after an insulation job was abandoned halfway through.

0:01:170:01:20

It leaked, it was draughty, it was an eyesore.

0:01:200:01:23

You could actually look through the window frames out into the street.

0:01:230:01:27

Sheriff Chris Pearson pays the company a visit.

0:01:270:01:30

-Can they take the heat?

-Is the boss in, mate?

0:01:300:01:32

-He's not, no.

-Can you get him on the phone for me?

0:01:320:01:35

And when Lawrence and Kev visit a classic car restorer's,

0:01:350:01:38

the boss admits he's made a mistake in ignoring the court.

0:01:380:01:41

The reason I didn't pay was purely on principle.

0:01:410:01:44

It's a chilly winter's morning in London and enforcement agent

0:01:490:01:52

Ken Warby is working his patch in the north of the city.

0:01:520:01:56

His first job today is to pay a visit to a car

0:01:560:01:59

dealership in Walthamstow.

0:01:590:02:02

We're going to a place called BD Trade Sales Ltd.

0:02:020:02:06

And it's an individual that has taken them to court for just over

0:02:060:02:09

four grand.

0:02:090:02:10

BD Trade Sales Ltd were taken to court by a Mr Tarsem Kainth.

0:02:100:02:15

He bought a second-hand car which broke down on the way home,

0:02:150:02:18

and was refused a refund.

0:02:180:02:20

The company didn't defend the case,

0:02:200:02:22

so Mr Kainth won a default judgment, but he's never been paid.

0:02:220:02:27

Now, including fees, the debt's just over £5,000.

0:02:270:02:31

Ken knows that collecting money from car dealerships can be tricky.

0:02:310:02:35

Different people owning different vehicles in the yard.

0:02:350:02:39

Paperwork has to be got out. Proof has to be shown.

0:02:390:02:43

There's usually an argument there somewhere.

0:02:430:02:46

What he doesn't know is that today's argument is going to

0:02:460:02:49

involve not one but two car dealerships.

0:02:490:02:52

Blue Diamond garages. That could be the one.

0:02:520:02:56

No, BD Trade Sales is different.

0:02:560:02:58

-Hello.

-Hello.

-BD Trade Sales Ltd?

0:03:050:03:09

I'm here regarding a high court writ of control against

0:03:090:03:13

BD Trade Sales from a Mr Tarsem Kainth.

0:03:130:03:18

Why you got the camera here? Tell the camera to move away.

0:03:180:03:20

The man asks our camera to leave the forecourt before telling

0:03:200:03:24

Ken that the case against the company is in dispute.

0:03:240:03:28

-It's to be set aside, is it?

-No, it's already set aside.

0:03:320:03:35

Is it? Have you got any paperwork I can see?

0:03:350:03:37

-Yeah.

-Thank you.

0:03:370:03:39

The man says the judgment against BD Trade Sales has already been

0:03:390:03:43

overturned by the courts.

0:03:430:03:44

But when he shows Ken the paperwork, it instead seems to

0:03:440:03:48

show their application for a set aside hasn't yet been successful.

0:03:480:03:52

But then he comes up with a different reason not to pay...

0:03:520:03:55

It's not his company.

0:03:550:03:57

This debt is against BD Trade Sales.

0:03:570:04:00

And he is the MD of a company called Blue Diamond.

0:04:000:04:05

Blue Diamond is a different garage, just down the road.

0:04:050:04:09

But there's a reason why its boss is manning the BD Trade Sales office.

0:04:090:04:13

They're brothers and one owes the other one a debt.

0:04:130:04:16

The man says that because his brother owes him money,

0:04:160:04:19

he's given him all the cars on the BD Trade Sales forecourt,

0:04:190:04:23

so now they belong to Blue Diamond Garages Ltd.

0:04:230:04:26

That would mean Ken can't remove them,

0:04:260:04:28

but he's not just going to take his word for it.

0:04:280:04:31

Unless they can provide money transfer proof that each

0:04:310:04:35

vehicle on this site was sold from the defendant company to the

0:04:350:04:40

brother's company, then we can remove the vehicles.

0:04:400:04:43

Inside, the man does manage to produce invoices which appear

0:04:440:04:48

to back up his story.

0:04:480:04:50

But for Ken, it's still not enough.

0:04:500:04:52

Because there are no actual bank transfers

0:04:520:04:55

and no solicitors undertaking for one company to satisfy

0:04:550:05:01

the debt to another company, also that's not around.

0:05:010:05:05

So it all looks a little bit iffy.

0:05:050:05:08

The man in the office has now got hold of his brother

0:05:080:05:10

on the phone, so Ken talks to him to try to clarify the situation.

0:05:100:05:14

You are the MD of BD Trade Sales Ltd, are you?

0:05:160:05:19

My instructions are to remove a vehicle or two from here to

0:05:200:05:25

cover this debt.

0:05:250:05:26

The boss doesn't want to pay.

0:05:260:05:28

He too is claiming the cars on the forecourt belong to

0:05:280:05:31

Blue Diamond, but Ken disagrees.

0:05:310:05:34

Because we don't have anything in concrete from a solicitor,

0:05:340:05:37

for example, saying that this is a bona fide debt

0:05:370:05:41

and it needs to be paid in a certain way, we can remove vehicles.

0:05:410:05:46

Yeah, I understand that.

0:05:460:05:47

But on the basis of you saying you owe him loads of money

0:05:470:05:50

and him saying the same, that isn't good enough.

0:05:500:05:52

We have to have it properly documented.

0:05:520:05:54

Yeah. It's not good enough, mate, it's not good enough.

0:05:540:05:58

Unfortunately you've got a stance there, I've got a stance as well.

0:05:580:06:01

Unfortunately we're at an impasse.

0:06:010:06:03

I'll just make a phone call and get a transporter on its way down here.

0:06:030:06:07

And obviously you do what you've got to do, my friend,

0:06:070:06:09

and I've got to do what I'm instructed to by the courts.

0:06:090:06:12

Yeah, you just said that. Thank you very much.

0:06:130:06:16

Cheers for speaking to me.

0:06:160:06:17

True to his word, Ken makes a call, to book a tow truck to remove cars.

0:06:170:06:21

If I need you in E17, how long?

0:06:210:06:24

That's all right, I might need it, I might not.

0:06:250:06:27

The truck's now on standby and Ken warns the man

0:06:290:06:32

that if he has to call it, then there'll be extra charges.

0:06:320:06:35

It seems to have the desired effect as the man now says he'll

0:06:350:06:38

try to get some money together on his brother's behalf.

0:06:380:06:41

But not all of it.

0:06:410:06:43

He does have the means to pay. I'm sure he does.

0:06:430:06:45

He's saying I can pay part and part at the end of this month.

0:06:450:06:49

But considering the value of the vehicles here

0:06:490:06:51

and we're only after around five grand, I want payment in one go.

0:06:510:06:56

If it was a football match it's like a one-all draw at the moment.

0:06:560:06:59

You know, going in at half-time it's like one-all.

0:06:590:07:01

But I know we're going to come out strong in the second half

0:07:010:07:04

and get full payment, win the game.

0:07:040:07:07

Later in the programme...

0:07:070:07:08

Move that camera from here.

0:07:080:07:09

..it all kicks off at BD Trade Sales...

0:07:090:07:11

Why you coming in here and start bullying the man?

0:07:110:07:14

Why you doing that for?

0:07:140:07:15

And we find out whether Ken can get the money owed.

0:07:150:07:18

-Did I not warn you earlier that this would happen?

-No.

0:07:180:07:20

The police would turn up, the transporter would turn up,

0:07:200:07:22

it would be like a scene out of Beadle's About and here we are.

0:07:220:07:26

If you've been ripped off and the person or company responsible

0:07:270:07:31

refuses to pay you back,

0:07:310:07:33

the first step is to make a claim in the County Court.

0:07:330:07:36

It's simple to do this online

0:07:360:07:38

for a small fee depending on the size of the claim.

0:07:380:07:41

The court will review the evidence,

0:07:410:07:43

and if it finds in your favour, the debtor will be ordered to pay up.

0:07:430:07:48

If they don't, then for a further £66,

0:07:480:07:50

the High Court will grant a writ,

0:07:500:07:53

authorising the sheriffs to act on your behalf.

0:07:530:07:55

If they're successful, you get all your money back.

0:07:550:08:00

Sheriff Chris Pearson is chasing a debt owed by a businessman

0:08:030:08:07

specialising in green home improvements.

0:08:070:08:09

We're in Leeds today.

0:08:100:08:12

We're off to see a Mr James Kahn.

0:08:120:08:14

It's for the sum of £1,587.

0:08:150:08:18

Owed for... Which I believe is insulation.

0:08:190:08:22

Which is either incorrectly fitted, or it wasn't fitted at all.

0:08:220:08:26

Mr Kahn runs a company called the Green Deal Warehouse.

0:08:260:08:30

It sold the insulation to pensioner Michael Redman

0:08:300:08:33

who lives in the Cookridge area of Leeds.

0:08:330:08:35

A place where to stay warm, you need all the help you can get.

0:08:350:08:39

We're one of the highest points in Leeds.

0:08:390:08:42

We get a lot of fog. Get a lot of wind.

0:08:420:08:45

It's horrendous up here when winter comes.

0:08:450:08:47

We can have snow up here,

0:08:470:08:50

when you can go a mile down the road,

0:08:500:08:53

and people are walking around in T-shirts.

0:08:530:08:56

It is so cold in winter.

0:08:560:08:59

And it's not just the elements which the residents have to contend with.

0:08:590:09:02

Much of the post-war housing here

0:09:020:09:04

is poorly insulated and can't easily be improved.

0:09:040:09:08

Houses are solid wall.

0:09:080:09:10

There is no cavity.

0:09:100:09:12

So, you can't put insulation inside.

0:09:120:09:16

Which is where a special type of insulation

0:09:160:09:18

called thermal cladding comes in.

0:09:180:09:20

It involves adding a whole new shell to the outside of the house.

0:09:200:09:25

It's like wrapping your house in a rather large blanket.

0:09:250:09:30

Hoping to keep his house warm, and cut down his bills,

0:09:300:09:33

Michael decided to buy thermal cladding

0:09:330:09:35

from local company The Green Deal Warehouse.

0:09:350:09:38

We had a choice of two firms that we could have gone with.

0:09:380:09:42

And we just decided to go with the first telephone number

0:09:420:09:45

which happened to be Green Deal.

0:09:450:09:47

Now we wished we hadn't.

0:09:470:09:49

The job meant also replacing his doors and windows

0:09:500:09:54

and the work got off to a good start.

0:09:540:09:56

But the progress would prove to be short-lived.

0:09:560:09:58

We paid £1,000 deposit.

0:09:580:10:01

They came out within a week to fit the new windows and doors.

0:10:010:10:06

They said we're coming back to do the insulation the scaffolding

0:10:060:10:10

and everything within the next fortnight.

0:10:100:10:12

And that was the last time we saw Green Deal Warehouse

0:10:140:10:19

for five months.

0:10:190:10:22

And it wasn't for lack of trying.

0:10:220:10:23

Michael called time and again

0:10:230:10:25

to try and arrange for the main work to begin.

0:10:250:10:28

They kept telling us that the scaffolding

0:10:280:10:31

was going to be coming next week.

0:10:310:10:33

Never came.

0:10:330:10:35

Ring up again. "Coming in another week's time."

0:10:350:10:38

Never came.

0:10:380:10:40

And it went on and on.

0:10:400:10:42

In the meantime, the windows and doors had been left half-finished.

0:10:420:10:45

So, far from keeping the heat in, the house was colder than ever.

0:10:450:10:51

You could actually look through the window frames. Not the glass.

0:10:510:10:55

Out into the street. Cos there were rather large holes.

0:10:550:11:00

And a lot of expanding foam.

0:11:000:11:03

It leaked if it rained.

0:11:030:11:05

It were draughty. It were an eyesore.

0:11:050:11:07

After months of phone calls and missed appointments,

0:11:090:11:12

Michael finally had enough and made one last call

0:11:120:11:15

to the boss of Green Deal Warehouse, James Kahn.

0:11:150:11:19

I said, "I'm cancelling it."

0:11:190:11:21

And straightaway Mr Kahn says, "You'll not get your deposit back."

0:11:210:11:26

I says, I'm not going to argue with you.

0:11:270:11:30

I'll see you in court, and put the phone down on him.

0:11:300:11:33

I think Mr Kahn thought I was joking.

0:11:330:11:36

But after spending £1,000 and five months exposed to the elements,

0:11:360:11:40

this was no laughing matter.

0:11:400:11:42

Michael got another company to complete the work

0:11:420:11:46

and took the Green Deal Warehouse to the County Court.

0:11:460:11:49

Although Mr Kahn did offer a defence,

0:11:490:11:51

he missed the hearing, and judgment was found against him.

0:11:510:11:54

He was ordered to pay Michael back his deposit, plus costs.

0:11:540:11:58

Not that it seemed to make any difference.

0:11:580:12:01

He just wouldn't pay.

0:12:010:12:03

We never saw a penny.

0:12:030:12:05

He just...totally ignored it.

0:12:050:12:09

Sheriff Chris Pearson is on his way to the Green Deal Warehouse

0:12:120:12:16

to try to get Michael his money back.

0:12:160:12:18

And as a fellow Northerner,

0:12:180:12:20

he has every sympathy with Michael's insulation nightmare.

0:12:200:12:25

You can get the snow up to two to three feet deep.

0:12:250:12:28

Can get a bit cold as well, to say the least.

0:12:280:12:30

So, if you're looking to get your property, your home, insulated,

0:12:300:12:33

it's got to be done correctly, I would say.

0:12:330:12:35

As Chris arrives, the business is open

0:12:370:12:40

and production seems to be in full swing.

0:12:400:12:42

But is Mr Kahn here?

0:12:420:12:44

Hello, mate.

0:12:450:12:47

Hello?

0:12:470:12:48

Is the boss in, mate, please?

0:12:490:12:51

Just up here, yeah? Cheers.

0:12:510:12:53

-Is Mr Kahn in, please?

-He's not mate, no.

0:12:530:12:56

Can you get him on the phone for me? I'm from the High Court.

0:12:560:12:58

-He's away, mate.

-Can you get him on the phone for us, mate?

0:12:580:13:02

Upstairs in the office, Chris explains the purpose of his visit.

0:13:020:13:06

There's been a writ issued, love, to seize company assets.

0:13:060:13:09

It's not for a great deal of money,

0:13:090:13:11

I'm sure we'll resolve it straight away.

0:13:110:13:14

The staff offer to contact the boss,

0:13:140:13:16

but they don't want our camera in the office.

0:13:160:13:18

-Could you all just go downstairs five minutes?

-Absolutely.

0:13:180:13:21

-I can wait down here, no problem.

-Yeah. Yeah, cheers for that.

0:13:210:13:24

But once downstairs, our cameraman's asked to leave altogether.

0:13:260:13:30

Chris remains inside to negotiate

0:13:360:13:39

and soon emerges to fill us in on what's going on.

0:13:390:13:42

The actual debtor is not there. Apparently, he's away on holiday,

0:13:420:13:45

but they are trying to get in touch with him at the minute.

0:13:450:13:47

So, hopefully, within a couple of minutes,

0:13:470:13:49

we'll get in touch with him, get this paid.

0:13:490:13:51

Until they can get hold of him,

0:13:510:13:53

there's no guarantee he'll agree to pay up.

0:13:530:13:55

But if he doesn't,

0:13:550:13:57

Chris is confident he's got plenty to fall back on.

0:13:570:14:00

Forklifts, windows, cars. There's all-sorts in there.

0:14:000:14:04

Hopefully they'll pay,

0:14:040:14:05

but if they don't there seems to be more than enough to cover the debt.

0:14:050:14:08

Back inside, the staff manage to make contact with Mr Kahn abroad

0:14:080:14:13

and break the news that a High Court sheriff is on the doorstep.

0:14:130:14:16

Mr Kahn says that the case is still in dispute,

0:14:160:14:19

but Chris explains that he's got a High Court writ

0:14:190:14:22

and so the debt to Mr Redman needs to be paid now.

0:14:220:14:25

Soon enough, Chris is heading back to his car.

0:14:280:14:31

So, what's the news?

0:14:310:14:32

Mr Kahn was away on holiday, but we managed to contact him by phone.

0:14:320:14:36

And he's agreed to pay the full amount.

0:14:360:14:39

It's a textbook job for the sheriffs.

0:14:390:14:41

That was one of the better ones.

0:14:410:14:42

Yeah. If they could all go like that, it'd be fantastic.

0:14:420:14:45

Unfortunately, they don't.

0:14:450:14:47

Michael Redman will now get his lost deposit back.

0:14:470:14:50

We've received a cheque for a total of £1,246.73

0:14:500:14:56

and I think they've done a superb job for us.

0:14:560:15:00

The Green Deal Warehouse told us,

0:15:000:15:02

"The work on Mr Redman's house was subject to a voucher scheme and was

0:15:020:15:05

"delayed due to a government backlog in processing the applications.

0:15:050:15:10

"Mr Redman was offered a number of start dates which he refused

0:15:100:15:13

"because they weren't convenient."

0:15:130:15:15

The company says it was unable to attend the court hearing due

0:15:150:15:19

to work commitments.

0:15:190:15:21

And the reason they didn't pay the debt is that they never

0:15:210:15:23

received the letter from the court.

0:15:230:15:25

Sheriff Ken Warby is at a car dealer's in Walthamstow,

0:15:280:15:32

where he's chasing a debt of £5,000.

0:15:320:15:35

BD Trades Sales Ltd sold a car to Tarsem Kainth

0:15:350:15:39

and when it broke down, didn't give him a refund.

0:15:390:15:42

Ken is dealing with the director's brother,

0:15:420:15:45

who says he's trying to raise the money.

0:15:450:15:47

But after a lot of waiting around, Ken has run out of patience.

0:15:470:15:51

I've just been kept waiting.

0:15:510:15:53

And fed a load of rubbish at the moment.

0:15:530:15:55

Saying, "Give me five minutes, give me five minutes,

0:15:550:15:57

"I need to make a few phone calls." Nothing's happened.

0:15:570:16:00

Going to phone the office now,

0:16:000:16:01

organise a transporter to come down, remove one or two of these vehicles.

0:16:010:16:05

As Ken gets ready to make the call,

0:16:050:16:07

the director's brother makes a last-ditch attempt

0:16:070:16:10

to put on the brakes.

0:16:100:16:11

Sorry, mate.

0:16:140:16:15

Mate.

0:16:190:16:20

But Ken's heard enough of this argument already.

0:16:200:16:23

Hello, Wayne.

0:16:230:16:24

It's Ken Warby.

0:16:240:16:26

Look, I need a transporter down in Walthamstow.

0:16:260:16:28

If you could get down here as soon as possible.

0:16:280:16:30

About 40 minutes? Nice one, mate, appreciate it. Cheers. Bye.

0:16:300:16:34

All the stalling has cost the debtor dearly.

0:16:340:16:37

The fees sheriffs charge are set by the government

0:16:370:16:40

and now that the transporter is on its way, the final bill has shot up.

0:16:400:16:45

£5,075...

0:16:450:16:48

to a, erm... To a whopping £6,700.

0:16:480:16:53

And counting.

0:16:550:16:57

But no sooner than the call is made,

0:16:570:16:59

the boss' brother says a friend is on his way with the cash.

0:16:590:17:02

It is the larger amount now, unfortunately.

0:17:020:17:04

I called the transporter, mate. It's on its way.

0:17:040:17:07

Just left the yard.

0:17:070:17:08

But you just....

0:17:080:17:10

Mate, it's not.

0:17:100:17:11

It's been like an hour and a half

0:17:110:17:12

since that first five minutes, do you remember?

0:17:120:17:15

Yeah.

0:17:150:17:16

I did warn ya. I had a coffee, we chatted.

0:17:160:17:20

Still nothing happened. The five minutes became an hour and a half.

0:17:200:17:24

Enough's enough.

0:17:240:17:25

Yeah, that's not enough now. It needs to be the full amount.

0:17:310:17:34

It makes no difference.

0:17:360:17:37

As soon as I tell the office,

0:17:370:17:39

"They're not paying" and that I need a transporter, these fees go on.

0:17:390:17:42

No.

0:17:450:17:46

The man said a friend was coming and sure enough one soon turns up.

0:17:460:17:50

Only it doesn't look like this guy's in the mood to hand over any cash.

0:17:500:17:54

-Move your camera from here.

-I'm on the street.

0:17:540:17:57

-Move your camera from here. Move. Move.

-Oi, oi, oi, oi, oi.

0:17:570:17:59

-Move.

-Oi, pal. Seriously...

0:17:590:18:00

You think you can come in here and start bullying people?

0:18:000:18:03

I'll get my people here right now.

0:18:030:18:05

-Why you

-BLEEP

-come here try bully the man? Huh?

0:18:050:18:07

-I'm not trying to bully...

-Why you come here to bully the man?

0:18:070:18:10

Mate, I'm not trying to bully anybody.

0:18:100:18:12

-I'll get my

-BLEEP

-pals here. Move that camera from here.

0:18:120:18:15

I'm on the public street. I'm on the public street.

0:18:150:18:18

Move away from my premises.

0:18:180:18:20

Ken has seen enough.

0:18:200:18:22

Police, please.

0:18:220:18:23

Someone has been physically threatening.

0:18:240:18:27

He's just suddenly come in to the car yard.

0:18:270:18:29

I would like someone here to prevent the breach of the peace.

0:18:290:18:31

I think they knew I was on the phone to the police

0:18:310:18:33

and they've sort of like disappeared,

0:18:330:18:35

so I'm in the car yard on my own at the moment.

0:18:350:18:37

But not for long, as the men soon return.

0:18:370:18:39

Move that camera away from me. Move that camera away from me.

0:18:390:18:42

Yeah, that's it, good boy. Yes, sir.

0:18:420:18:45

Why you coming in here and start bullying the man?

0:18:450:18:48

Why you doing that for?

0:18:480:18:49

I'll get my pals here and we'll see who's going to bully who.

0:18:490:18:52

If that's the way you wanna do it.

0:18:520:18:53

Has this gentleman just told you I was bullying him?

0:18:530:18:55

Well, that's the approach you've come along.

0:18:550:18:57

"Oh, we're going to do that, we're going to remove cars."

0:18:570:18:59

Come on, mate.

0:18:590:19:01

-Can I just ask who you are?

-Khan, Mr Khan.

-Mr Khan.

-Mr Khan.

0:19:010:19:03

-And what involvement...?

-Listen, forget that involvement.

0:19:030:19:07

Tell him to switch that camera off.

0:19:070:19:09

-Otherwise he's going to be in a lot of trouble.

-Listen.

0:19:090:19:11

Tell him to switch that camera off.

0:19:110:19:13

If you want I can go talk to him personally.

0:19:130:19:15

Mate, switch that off, or I'll take that off you.

0:19:150:19:17

-Mate, you won't be doing that.

-No, no. Don't tell me that.

0:19:170:19:19

Why are you recording?

0:19:190:19:20

Just as the situation is spiralling out of control,

0:19:200:19:23

the police arrive, and Mr Khan makes himself scarce.

0:19:230:19:26

Meanwhile, the director's father has also arrived.

0:19:280:19:31

And he's brought cash.

0:19:310:19:33

Yep.

0:19:350:19:36

OK. I understand what you're saying.

0:19:420:19:44

The father is willing to pay his son's original bill,

0:19:440:19:47

but not the extra fees which were added

0:19:470:19:49

when the transporter was called.

0:19:490:19:51

But as far as Ken's concerned,

0:19:510:19:53

this is a situation entirely of their own making.

0:19:530:19:56

Did I not warn you earlier that this would happen?

0:19:560:19:58

The police would turn up, the transporter would turn up,

0:19:580:20:00

it'd be like a scene out of Beadle's About and here we are.

0:20:000:20:03

Are you able to settle the full amount with the gentleman?

0:20:030:20:06

No.

0:20:060:20:07

The father isn't budging.

0:20:070:20:09

OK. He is not willing to accept that. That's what he's saying.

0:20:120:20:16

But it will be here soon

0:20:200:20:22

and you've got sufficient goods in the yard to cover the debt.

0:20:220:20:24

But the son still thinks these cars can't be taken.

0:20:240:20:27

And now with the police in attendance,

0:20:270:20:29

he's hoping he can convince them of his side of the story.

0:20:290:20:32

-You've got a High Court writ for BD Trade Sales.

-Yes.

0:20:320:20:35

These cars, they belong to me, they belong to Blue Diamond Garages.

0:20:350:20:38

That's what I was trying to explain to you and you weren't listening.

0:20:380:20:41

-I hear what you're saying.

-Yeah.

-And so does this gentleman.

-Yeah.

0:20:410:20:44

But what happened is he's been issued

0:20:440:20:47

with a court writ for these premises.

0:20:470:20:49

-For BD Trade Sales.

-OK. I hear what you're saying.

0:20:490:20:52

But these cars are here, on these premises.

0:20:520:20:57

You got a big sign up there.

0:20:570:20:59

If you've got 6,600 and whatever it is,

0:20:590:21:02

then I would suggest you pay it.

0:21:020:21:04

Then you can go to court.

0:21:040:21:06

If it is proved in your favour, you will get reimbursed.

0:21:060:21:10

If you choose not to pay back today, these guys can take the cars.

0:21:100:21:16

With the policewoman delivering the final verdict,

0:21:160:21:19

father and son realise the game is up.

0:21:190:21:22

-What we at?

-6,708... Just shy of seven grand.

0:21:220:21:26

Is what we said earlier on we needed to avoid.

0:21:260:21:30

The father reluctantly agrees to pay

0:21:300:21:33

and hands over the full total in cash.

0:21:330:21:36

At the same time, the transporter arrives and is sent on its way.

0:21:360:21:39

They think it's all over... It is now.

0:21:420:21:45

Well, I did tell you earlier on it was like one-all at half-time.

0:21:450:21:49

But, erm... 2-1 to the sheriffs.

0:21:490:21:52

Much to the father's disapproval.

0:21:520:21:54

This is very unfair system here.

0:21:540:21:56

Because the case is still in the court.

0:21:560:21:59

But nevertheless, to finish this matter off,

0:21:590:22:02

I didn't want any aggravation with no-one.

0:22:020:22:04

I paid the sheriffs, now we will claim it back.

0:22:040:22:07

The case never went back to court.

0:22:080:22:10

And Tarsem Kainth has got back the money he was rightfully owed.

0:22:100:22:14

In the south-east, Enforcement Agents Lawrence Grix and Kev McNally

0:22:250:22:29

are in Kent. And their prospects of getting paid today

0:22:290:22:32

are looking pretty good.

0:22:320:22:34

The company they're going to is definitely still trading,

0:22:340:22:37

and it specialises in classic-car restoration.

0:22:370:22:40

We're in Ashford. We're going to Xtreme Jaguar Restorations Ltd.

0:22:400:22:45

They owe £3,161.

0:22:450:22:48

They soup up and restore old Jaguars.

0:22:480:22:52

Xtreme Jaguar was taken to court by a supplier.

0:22:520:22:56

Mr Gannon, who is the director of Xtreme Jaguar Ltd,

0:22:560:23:00

he was actually in court to defend the hearing with his solicitor.

0:23:000:23:02

He's not going to be able to say he's not aware of this.

0:23:020:23:05

Mr Gannon didn't pay what he was ordered to by the court.

0:23:050:23:09

And now the sheriffs are heading his way.

0:23:090:23:11

One of them in particular can't wait.

0:23:110:23:13

I do like my Jags. Always have done. I got one about a year ago.

0:23:130:23:16

Mine is like a metallic British racing green.

0:23:160:23:20

I've always loved the shape of the Jag.

0:23:200:23:22

There's just something about them.

0:23:220:23:24

Never seen him as excited about a job.

0:23:240:23:27

It's probably about as good as it gets for him.

0:23:270:23:29

As for getting paid, the Jaguars themselves are likely

0:23:290:23:33

to be out of the equation...

0:23:330:23:34

What we're going to find here I would imagine

0:23:340:23:36

is most of the actual cars belong to customers.

0:23:360:23:39

Parts, tools is the main thing we'll be looking for.

0:23:390:23:42

But will they need to take anything, or will the garage pay up?

0:23:420:23:45

Time to find out.

0:23:480:23:49

-Hi, there.

-Hi, there.

-How are you doing?

-Fine.

0:23:500:23:53

We're enforcement agents. We've got a High Court writ

0:23:530:23:56

against Xtreme Jaguar Restorations Ltd.

0:23:560:23:58

We're ordered here today to take control of goods

0:23:580:24:00

to the value of £3,161.14.

0:24:000:24:03

-£3,100 and...?

-£61.14.

0:24:040:24:09

Right, well, first of all, what's the camera for?

0:24:090:24:12

At this point our cameraman's asked to leave.

0:24:140:24:17

Inside, Lawrence tells Mr Gannon that the outstanding debt

0:24:220:24:26

needs to be paid today.

0:24:260:24:28

Shortly afterwards our camera's let back in,

0:24:280:24:31

only to find Lawrence and the owner talking shop.

0:24:310:24:36

Ah.

0:24:360:24:37

-So, I've just built all...

-Oh, it's lovely.

0:24:370:24:41

That is just gorgeous. I've got an X300.

0:24:410:24:44

It's the last of the 3.2s cos I wanted a straight 6.

0:24:440:24:47

I didn't want a V8.

0:24:470:24:48

It's lucky it's the sheriffs' last job of the day

0:24:480:24:51

because they could be here a while.

0:24:510:24:53

So, he's just showing Lawrence around the workshop at the moment.

0:24:530:24:57

He knew Lawrence was pretty keen to look round here,

0:24:570:24:59

so he's giving him a guided tour.

0:24:590:25:01

And Lawrence is geeking him out with information over there,

0:25:010:25:04

showing off that he knows a little bit about it.

0:25:040:25:06

So, let him have his moment. He's loving it over there.

0:25:060:25:10

Back to the writ in question.

0:25:100:25:12

Lawrence wants to know if any of these cars belong to the garage.

0:25:120:25:15

I'm guessing these are customers' cars, aren't they?

0:25:150:25:18

They're all customers' cars.

0:25:180:25:19

They are, which mean they can't be removed by the sheriffs,

0:25:190:25:22

or used as leverage to get payment.

0:25:220:25:24

But it doesn't look like that will be necessary, anyway.

0:25:240:25:27

You can pay online with a card,

0:25:270:25:28

-we've got a secure online payment system.

-Yeah.

0:25:280:25:30

Or you can go online and do a bank transfer.

0:25:300:25:33

Mr Gannon is willing to pay £1,100 today.

0:25:330:25:37

And says he'll clear the rest of the debt tomorrow.

0:25:370:25:41

-There you go.

-OK.

0:25:410:25:42

Mr Gannon tells us his side of the story.

0:25:420:25:45

He says the dispute arose from a respray job on an E-Type Jaguar.

0:25:450:25:50

The paint shop involved sent me a sample of the paint, which is this.

0:25:500:25:55

And based on that being the correct colour,

0:25:550:25:58

I sent the car to the paint shop to be resprayed.

0:25:580:26:00

Mr Gannon claims that when the car came back, the colour wasn't right.

0:26:000:26:05

So, he refused to pay the full cost of the job,

0:26:050:26:07

and instead made an offer for part payment.

0:26:070:26:10

He wouldn't accept it. We went to court.

0:26:100:26:12

Sadly, the magistrate involved couldn't see the concept

0:26:120:26:16

of how much it was going to cost to respray a complete E-Type.

0:26:160:26:20

She did however find in my favour and knocked some off the bill,

0:26:200:26:24

but nowhere near enough.

0:26:240:26:26

She only knocked £1,000 off and anybody who's in this industry

0:26:260:26:30

will tell you you're looking at a minimum of £6,000

0:26:300:26:32

to respray an E-Type.

0:26:320:26:34

The reason I didn't pay it was purely on principle.

0:26:340:26:37

But the court made its decision

0:26:370:26:39

and Mr Gannon has tried to ignore it.

0:26:390:26:41

As a result he's now facing a higher bill, with extra charges and fees.

0:26:410:26:46

As he seems willing to pay,

0:26:460:26:48

Lawrence and Kev are happy to leave with £1,100 for the time being.

0:26:480:26:53

But they do list a couple of vehicles

0:26:530:26:55

belonging to the company, just in case.

What they've got outside, they've got a recovery vehicle.

0:26:580:27:00

A sort of 7.5-tonne van and they've also got a transit van, as well.

0:27:000:27:04

So, between the two vans there, there's more than enough

0:27:040:27:07

to cover the little that's left owing.

0:27:070:27:10

-Cheers.

-All right, thanks very much.

0:27:100:27:12

It's job done for the sheriffs.

0:27:120:27:14

And the moral of the story is that a court's decision is final.

0:27:140:27:18

The judge said, this is how much you've got to pay.

0:27:180:27:20

So, that's what we have to do, we have to enforce the writ.

0:27:200:27:23

So, we've taken what we could get today, which is £1,100.

0:27:230:27:26

We've got a controlled goods agreement signed for the full balance

0:27:260:27:29

by close of business tomorrow.

0:27:290:27:31

The guys have come today. They're just doing a job.

0:27:310:27:34

So yes, I'm quite happy to pay it.

0:27:340:27:37

It's unfortunate, but I'll just have to chalk it up to experience.

0:27:370:27:41

And for Lawrence,

0:27:410:27:42

it's been a bit of case of mixing business with pleasure.

0:27:420:27:45

If I had to pick one from in here, that would be it, I think.

0:27:450:27:47

Oh, it would have to be.

0:27:470:27:48

I'd love to own some of the cars that are in there.

0:27:480:27:50

But hey ho, I've got my cheap old run-around, and that will do me

0:27:500:27:53

and I picked up a bit of advice while I was in there, as well.

0:27:530:27:56

So, happy days.

0:27:560:27:57

Xtreme Jaguar Restorations Limited paid the remaining balance,

0:27:590:28:03

and the paint shop got the money they were owed.
