that fake ones are being sold out of the backs of vans, for example,

or you may have retailers opening up in the period leading up to bonfire

Rachel's been to Carmarthenshire where a new house had an unwelcome

Ashley were eager to look around. A lot of the estates that we know

expensive house on the estate. The house is actually

for this massive plot? Well, long-term we would have had

with the owner of Haywood Homes. We actually had

a meeting here with Mr Haywood and explained our intentions for the

future, why it was ideal for us and So he thought it would be

a good idea? He said, fantastic,

it would look stunning. But they had no idea that lurking

beneath their lovely new home. It was a problem which only surfaced

months after buying their house, when Haywood Homes sent Phil

and Victoria a copy of their plans. It stated that there was pipes

:16:39.:16:42.

in the garden. Not just pipes,

:16:43.:16:49.

they were massive surface-water One of their neighbours took

:16:50.:16:53.

photos during the build, which These are the two pipes that

are actually in our garden. They are that big that you

could walk through them. There's another photograph

and they're massive, Phil and Victoria were furious

It was the end of their dream to extend their home.

Haywood Homes say the Ashley's only mentioned

an extension after they bought the house but the couple dispute this.

If we knew then that the pipes were there, we wouldn't

:18:14.:18:21.

When they complained, the developers said it was

:18:22.:18:25.

the couple's solicitor's fault for not conducting proper searches.

:18:26.:18:27.

I just hope they have the decency to try and resolve this.

:18:28.:18:35.

Because that's all we've wanted, we haven't wanted anything else.

:18:36.:18:40.

Feeling they were getting nowhere, the Ashleys took their case to

:18:41.:18:47.

The ombudsman ruled in the couple's favour.

:18:48.:18:53.

They agreed that, because Haywood Homes hadn't told them about the

:18:54.:18:56.

But the ruling wasn't legally binding and Haywood Homes have

:18:57.:19:01.

It's now been six years since the Ashleys bought

:19:02.:19:07.

their house and they're still not living in it because it's not big

:19:08.:19:10.

And they fear the giant pipes could make it almost impossible to sell.

:19:11.:19:19.

It's so upsetting because this should have been our family home.

:19:20.:19:23.

Well, Haywood Homes have told us the Ashleys' situation is 'regrettable'.

:19:24.:19:30.

They admit their information handbook was written three years

:19:31.:19:34.

before the couple bought their house and it hadn't been

:19:35.:19:38.

updated to show the drains, but say it also clearly states that

:19:39.:19:41.

They also say the couple didn't tell Mr Haywood about the plans for the

:19:42.:19:49.

Haywood Homes say plans showing the drains were on display

:19:50.:19:55.

at the site office, and the onus was on the couple and their solicitors

:19:56.:19:59.

The Ashleys insist they did do this though, and the legal

:20:00.:20:06.

As for compensation, Haywood Homes aren't offering any,

:20:07.:20:12.

they say they will help the Ashleys explore the option of building

:20:13.:20:15.

an extension on a different part of the house, but the couple say

:20:16.:20:18.

Now, back to our investigation into a dealer selling cars

:20:19.:20:29.

Dale Carr, yes that is his name, is a dealer who advertises cars online

:20:30.:20:37.

He doesn't have a forecourt or anything boring like that, instead

:20:38.:20:45.

he parks up his cars beside this lake in Cardiff, and invites people

:20:46.:20:51.

Catherine Morgan fell for his sales pitch, but he failed

:20:52.:20:57.

to tell her that her Nissan Micra had been badly damaged in a crash.

:20:58.:21:03.

I'm just angry more than anything, that he was potentially putting

:21:04.:21:06.

Mr Carr seems to specialise in selling write offs which,

:21:07.:21:10.

as a trader, he must disclose to his customers.

:21:11.:21:15.

Time to find out exactly what Dale Carr tells people about his cars.

:21:16.:21:20.

Our researchers call him up posing as customers.

:21:21.:21:25.

They ask him about the history of several cars we know are write

:21:26.:21:29.

So, our researchers arrange to meet him face to face

:21:30.:21:35.

In his adverts, Dale had claimed to be a private seller,

:21:36.:21:43.

but he soon admits he's a builder who sells cars as a sideline.

:21:44.:21:47.

And he parks them here because a garage would cost too much.

:21:48.:21:53.

One of the cars Dale is selling, this Ford Fiesta, is a category B

:21:54.:22:09.

write off and is showing up on checks as having been scrapped.

:22:10.:22:13.

But what would Dale tell our researchers about it?

:22:14.:22:30.

A few days before passing its MOT, the car had failed because of

:22:31.:22:36.

damage to its structure which had seriously affected its strength.

We then asked Dale where we'd stand if anything went wrong with

:22:41.:22:47.

I won't give no warranty on it but nothing's going to happen like that.

So, any problems with our accident damaged car, and we're on our own.

A clear breach of the law for a dealer,

He's a trader and there are obligations that flow

:23:08.:23:13.

from that, he's claiming he will not accept goods once they are sold,

:23:14.:23:18.

he is in clear breach of his obligations as imposed

:23:19.:23:21.

Dale then shows us a blue Fiesta, which we know is a less serious

:23:22.:23:32.

But when we ask about its accident history, he tells

:23:33.:23:36.

Not checking a vehicle's history before selling it is another

:23:37.:24:04.

He has a duty under the Consumer Protection from Unfair Trading

:24:05.:24:10.

Regulations to exercise professional diligence, each car that is being

:24:11.:24:14.

sold for use you would expect it to be safe and so some basic checks

:24:15.:24:18.

Our researcher then asks Dale whether he'll be getting any more

Some of the laws Dale seems to be ignoring

They are matters that can go to the Crown Court

and are imprisonable up to a maximum sentence of two years..and

also can be subject to an unlimited fine or both.

We asked Dale Carr to explain his actions, but he didn't admit to

:25:11.:25:13.

He claimed there was a 'mix up' with the Category B Fiesta,

:25:14.:25:19.

but there was 'no harm done' as he's now taken it off the market.

:25:20.:25:22.

He also said his cars have new MOTs and are roadworthy.

:25:23.:25:28.

But Dale didn't explain why, even though he's a dealer,

:25:29.:25:31.

he fails to tell his customers they're buying write offs which they

:25:32.:25:35.

So we've been parked up outside Dale Carr's home all morning,

:25:36.:25:50.

we were hoping to catch him before he went out to work.

:25:51.:25:55.

There's been no sign of him up until now, so the decision is we're

:25:56.:25:58.

No sign of life because the curtains are closed.

Okay, so we understand that that is his home address, but the lady who

answered the door, could be partner, is telling us he's not available to

So no real answers there, but his cars are still for sale, though.

He may not be prepared to tell you the true accident history

This one was written off as a Category C in June.
