Rachel burden's life is in tatters.

night, she organised entertainment

highlight of the week for

syndrome. He popped on stage. He

three of us, so we did. It was a
great night. Nothing untoward. I put | 0:03:48 | 0:03:53 | |
the photograph on Facebook and
thought nothing more of it after | 0:03:53 | 0:03:56 | |
that. By posting the photo,
identifying David and the location, | 0:03:56 | 0:04:01 | |
Rachel had breached the council's
social media guidance and resident | 0:04:01 | 0:04:07 | |
confidentiality. The assistant
director told me, "This is probably | 0:04:07 | 0:04:11 | |
going to be construed as gross
misconduct, and you could end up | 0:04:11 | 0:04:14 | |
getting dismissed from the council.

given an ultimatum. I was given two

being dismissed with effect from

The photo received five likes. No
one shared it. I knew how good she | 0:04:41 | 0:04:50 | |
was at her job. Reverend David had
been visiting the care home for over | 0:04:50 | 0:04:56 | |
a year, offering chaplaincy to
residents. Rachel had such care for | 0:04:56 | 0:05:00 | |
the residents, and was so observant.
It was very friendly and homely. | 0:05:00 | 0:05:04 | |
There was a sense of love. I didn't
mean any harm by what I did. And | 0:05:04 | 0:05:10 | |
they crucified me for giving 21

the rules, and why while residents

his family could have objected. Here

case. They didn't. In fact, they

featured. Claire is David's sister.

there on that fateful Friday

clear and ask you, did you mind?
When we found out, we were aghast. | 0:05:40 | 0:05:49 | |
Friday night was the thing that he

loved being the centre of attention.

and posting them on Facebook and

wanted that to happen. So when the

amazed that that was the cause of

experienced. Rachel took the council
to an employment tribunal, accusing | 0:06:12 | 0:06:16 | |
them of unfair dismissal. With no
money, she couldn't afford legal | 0:06:16 | 0:06:21 | |
representation, but Reverend David
stepped up. I lived under vows to be | 0:06:21 | 0:06:27 | |
a supporter of everything that is
fine and fair and a challenger of | 0:06:27 | 0:06:31 | |
what is mean and destructive. You
cannot stand on the sidelines and | 0:06:31 | 0:06:35 | |
let things happen to people as good
as Rachel. David represented Rachel | 0:06:35 | 0:06:42 | |
in the tribunal. I needed to prove
that what I did, OK, yes, I did | 0:06:42 | 0:06:47 | |
something wrong, but the sanction
was far too harsh. Rachel won her | 0:06:47 | 0:06:53 | |
case. The tribunal found that the
two days she had to make a decision | 0:06:53 | 0:06:58 | |
wasn't fair. But she had lost the
career she loved. Today, she is back | 0:06:58 | 0:07:03 | |
at court to find out how much
compensation she will receive for | 0:07:03 | 0:07:07 | |
her unfair dismissal. I'm extremely
nervous at the moment because it is | 0:07:07 | 0:07:11 | |
a massive big day. After a full day
in court, Rachel has the decision. | 0:07:11 | 0:07:15 | |
An offer of £5,800. It is not what I
wanted. 21 years of going above and | 0:07:15 | 0:07:27 | |
beyond for my clients and my staff
and the families. That's all I'm | 0:07:27 | 0:07:34 | |
worth is £5,800. The average person
uploads for voters to Facebook | 0:07:34 | 0:07:38 | |
everyday. How often do you stop and

with the fact that Rachel had broken

offer to the motor to a lower

which determined the compensation.

about things going forward. What are

broken in BBC Radio four and a
newspaper, I have very kindly got | 0:08:46 | 0:08:51 | |
legal representation, and there is a
barrister looking at now whether I | 0:08:51 | 0:08:54 | |
should appeal the judgment going
forward. And can you ever see | 0:08:54 | 0:08:59 | |
yourself going back into the care
sector I can. Maybe not this year, | 0:08:59 | 0:09:06 | |
but certainly next year, but I won't
go back into full management. It is | 0:09:06 | 0:09:11 | |
my vocation. It is what I was born
to do. And at the end of the day, | 0:09:11 | 0:09:15 | |
you were posting that photo to
celebrate that night and David's | 0:09:15 | 0:09:20 | |
performance. Kevin, it is tough and
really hard to hear this, but there | 0:09:20 | 0:09:24 | |
are lessons here for people when you
read between the lines. The best way | 0:09:24 | 0:09:29 | |
forward as far as uploading
photographs and the amount of | 0:09:29 | 0:09:30 | |
content that you are pairing with

social media account, most companies

and the rule is if you are not sure

policy. It is as simple as that.

books, "Views are my own." That

That's interesting. But it will make

you are putting on there. Social

the onus is on the company to let

guidelines are their policy, so just

HR department every six months to

forward, people who are going for

about salary and holiday pay and

separating work social media and

sometimes they combine. And

presence in social media. But for

or any easier. I think it is

environment has changed a lot over

especially since I took my test. So,

is a good thing. Change is

Some examiners say parts of the new

reaction to that? I don't think the

think what you have to do as a

people is choose your areas

How has our Freddie got on today?
